Resource allocation is a central part of the decision-making process in any health care system. Resources have always been finite, thus the ethical issues raised are not new. The debate is now more open, and there is greater public awareness of the issues. It is increasingly recognised that it is the technology which determines resources. The ethical issues involved are often conflicting and relate to issues of individual rights and community benefits. One central feature of resource allocation is the basing (...) of decisions on the outcomes of health care and on their subsequent economic evaluation. The knowledge base is therefore of great importance as is the audit of results of clinical treatment. Public involvement is seen as an integral part of this process. For all parts of the process, better methodologies are required. (shrink)

The hypothesis that values change and evolve is examined by this paper. The discussion is based on a series of examples where, over a period of a few decades, new ethical issues have arisen and values have changed. From this analysis it is suggested that there are a series of core values around which most people would agree. These are unlikely to change over long time periods. There are then a series of secondary or derived values around which there is (...) much more controversy and within which differences of view occur. Such changes need to be documented if we are to understand the process involved in the evolution of differences in ethical views. (shrink)

Some practical problems in the teaching of ethics to medical students are described. The definition of the objectives of the course remains the central aspect, and is more important than the specific content. The use of student projects, buzz groups, case histories and discussion points is described. There is a need for student assessment or examination at the end of the course. The teachers require a broad background in philosophy, clinical medicine and teaching skills. The learning of the teachers may (...) be as important as that of the students. (shrink)

Open peer commentary on the article “Examining the Role of Re-Presentation in Mathematical Problem Solving: An Application of Ernst von Glasersfeld’s Conceptual Analysis” by Victor V. Cifarelli & Volkan Sevim. Upshot: Education researchers often explain student activity in terms of general thinking and learning processes, including those identified by Cifarelli and Sevim. In this commentary, I refocus Cifarelli and Sevim’s discussion in order to hypothesize the organization of mental actions that comprise and support those learning processes.

This is a sequel to Forman's well-received collection, The Problems of Pure Consciousness (OUP 1990). The essays in this previous volume argued that some mystical experiences do not seem to be formed or shaped by the language system--a thesis that stands in sharp contrast to the constructivist school, which holds that all mysticism is the product of a cultural and linguistic process. In The Innate Capacity, the same scholars put forward a hypothesis about the formative causes of these "pure consciousness" (...) experiences. All the contributors agree that mysticism is the result of an innate human capacity, rather than a learned, socially conditioned constructive process. They look at mystical experience as it is manifested in a variety of religious and cultural settings, including Hindu Yoga, Buddhism, Sufism, and medieval Christianity. Taken together, the essays constitute an important contribution to the ongoing debate about the nature of mystical experience and its relation to the social and cultural context in which it appears. On October 31, 1994, it was announced that a confidential settlement had been reached in Doe v. Kohn, Nast & Graf, P.C., et al., 862F. Supp. 1310 ). The settlement in ths widely publicized AIDS discrimination case came three weeks after the trial began in the District Court for the Eastern District of Pennsylvania, Nov. 2, 1994, at 10).Plaintiff Doe, an associate employed at Kohn, Nast & Graf, a prominent law firm in Philadelphia, filed an AIDS discrimination case under the (...) Americans with Disabilities Act against his employer claiming that the firm fired him in March 1993 because he was HIV-positive. The purpose of this paper is threefold. First, I visit the Fogelin–Geach-dispute, criticizeMiller''s interpretation of the Geachian notationN(x:N(fx)) and conclude that Fogelin''s argumentagainst the expressive completeness of the Tractariansystem of logic is unacceptable and that the adoptionof the Geachian notation N(x:fx) would not violate TLP5.32. Second, I prove that a system of quantificationtheory with finite domains and with N as the solefundamental operation is expressively complete. Lastly, I argue that the Tractarian system is apredicate-eliminated many-sorted theory (withoutidentity) with finite domains (...) and with N as the solefundamental operation, and thus is expressivelycomplete. Early commentaries on the Tractatus, such as Russell's introduction and Ramsey's review in Mind already noted and commented on Wittgenstein's peculiar views concerning nonsense and elucidation. Ramsey also complains that 'sentences apparently asserting such properties of objects are held by Mr Wittgenstein to be nonsense, but to stand in some obscure relation to something inexpressible'. However, there would not be 'the orthodox reading' of the Tractatus exemplified by these remarks, were it not for the emergence of the 'resolute reading', the (...) 'New Wittgensteinian', the 'therapeutic reading', or the 'post‐modernist interpretation', which challenge it. Resolute readings can be divided into 'strong' and 'weak' readings or, more or less equivalently, 'Jacobin' and 'Girondin' readings. The resolute reading proposes a new way of reading the Tractatus, and tries to give prominence to its distinctness and correctness by attacking the orthodox reading. It should then be seen as an unorthodox reading. (shrink)

Upshot: The commentaries concentrate mostly on ontological issues but overlook the main epistemological argument in my target article. This argument refers to the conditions that make cognition possible, and to the limits of cognition. These are important for two reasons: they have ontological consequences and they limit the theory’s contingency.

Context: In the literature concerning the theory of social systems, interest in epistemological and ontological questions has increased in recent years. The controversies regarding a realist vs. constructivist interpretation of Luhmann’s theory, as well as the concept of many realities that correspond to many ontologies, deserve attention. Problem: The paper discusses interrelated ontological and epistemological problems in Luhmann’s systems theory, such as ontology and de-ontologization, realism vs. constructivism, contingency and its limits and one vs. many realities. Method: The paper proposes (...) an interpretation, according to which systems theory is based on an epistemology - radical operative constructivism. Results: Luhmann is not a realist. The last word belongs to radical operative constructivism, and naïve realism with reference to social systems has only a preliminary, methodological significance. However, taking a position in the dispute between realism and constructivism inevitably involves an ontological “vocabulary,” that is, usage of the reality/construction distinction. Furthermore, operative constructivism formulates the necessary conditions of the possibility of cognition, which limit the contingency of the theory and constitute one reality that is a construction of systems theory. Luhmann rejects ontology, but he does not renounce epistemology, and consequently the project of de-ontologization remains incomplete. Implications: The paper offers a new, coherent interpretation of ontological and epistemological questions in Luhmann’s theory, and also throws light on some problems of radical constructivism in general, such as the ontological implications of epistemology or the constructivist self-reference of theories. The ethnic conflict between tribals and non-tribals compounded by the insurgency has disturbed the peace in the state for more than 20 years and also resulted in the internal displacement of thousands of people. In order to restore peace and to prevent future internal displacement it would be necessary to give to the tribals their due share in governance.

This article advances an account of the nonhedonic values of horror fiction (including film). It is motivated by cases in which consuming horror fosters what theorists of education call "transformative learning" in adult students, which is a more shocking and disturbing experience than pleasurable. I first present two cases in which Polanski's Repulsion (1968) and Browning's Freaks (1932) disrupted and modified two students' experience of madness and abnormality respectively. Then I draw on Dewey's "aesthetic experience", Foucault's "experience book" and O'Leary's (...) approach to the value of fiction to give the transformative experience in question a philosophical underpinning. In the second half of the paper, I offer a close reading of Bloch's Psycho (1959), with the aim of demonstrating that it has the potential to transform the everyday experience of madness in readers. Direct-to-consumer advertising (DTCA) of prescription drugs has been a heavily contested issue over the past decade, touching on several issues of responsibility facing the pharmaceutical industry. Much research has been conducted on DTCA, but hardly any studies have discussed this topic from a corporate social responsibility (CSR) perspective. In this article, we use several elements of CSR, emphasising consumer autonomy and safety, to analyse differences in DTCA practices within two different policy contexts, the United States of America and the European (...) Union (EU). Doing so results in an alternative analysis of the struggle between proponents and opponents of DTCA from a CSR perspective, adding an alternative view on this debate. (shrink)

Here, dharma has been understood as a category, as an intellectual exercise, for ‘viewing’ Indian reality.The fundamental question is this: what constitutes the concept of dharma in the context of our changing forms of life? How the Study of Consciousness and Mapping Spiritual Experiences Can Reshape Religious Methodology This special issue of the Journal of Consciousness Studies throws down a methodological challenge to the field of Religious Studies. Over the last half century, the academic study of religion has developed a variety of angles and approaches: structuralist, Eliadian, Marxist, feminist, and so on. Recently, approaches popular in many institutions and departments have centred on linguistic and cultural analysis, notably the postmodern and deconstructivist approaches championed by (...) Derrida and others. With the dawn of the interdisciplinary field of the study of human consciousness, and with this issue of the Journal of Consciousness Studies, we challenge this prevailing approach by presenting readers with articles analysing religion, spirituality, and spiritual experience, not solely as cultural phenomena, but as phenomena that can be related to human physiology, and a kind of pan-human technology of human spiritual development. 本文旨在初步探索「限肉令」作為應對傳染病大流行和由工廠化畜牧業帶來的其他威脅的預防措施的正當性。「限肉令」並非指全面禁肉，而是以法律限制市民的人均肉品消耗量在滿足基本營養需求的範圍內。本文採用的進路是 緩解一些可能阻礙對此提案進行更宏觀、理性的思考的潛在心理拘繫。此進路參考了傅柯「日常經驗」(everyday experience) 的分析，和佛家倫理學回應全球環境倫理問題的策略。我們先以香港社會為主要案例研究，檢視形成「肉是必需的」一想法和嗜肉情結的社會模式。接著我們引入葷食心理學研究，討論嗜肉情結如何成為正面考慮「限肉令」的障 礙。我們也嘗試回應一些反對此提案的理由，包括來自自由主義 (Liberalism)的批評。 -/- This article explores the preliminary justifiability of meat restriction order as a preventive measure to the risks of pandemic and other forms of harm posed by factory farming. A meat restriction order seeks to limit citizens’ meat consumption at the level of meeting individuals’ basic nutrient needs. This article aims to loosen some potential psychological hooks that prevent a more expansive, rational deliberation of the proposal. Inspired by Michel Foucault’s analysis of “everyday experience” and the (...) Buddhist responses to global environmental issues, we investigate the social patterns that account for the formation of people’s meat commitment, using Hong Kong society as a major case study. With reference to scientific studies of meat-eaters’ psychology, we discuss how the meat commitment becomes a barrier for society to positively consider the justifiability of the proposal. We will also address a number of objections to our proposal, including those from liberalism. (shrink)
