This article examines two texts, each representative of a system of morality taught in nineteenth-century Ottoman morality textbooks: Risâle-i ahlâk by Sâdik Rifat and al-Risāla al-shāhiyya fī cilm al-akhlaq by cAḍud al-Dīn al-Ījī . So as to inform conclusions about the variety of moral traditions that inspired the authors of late Ottoman public school textbooks on morality, I analyse the organizing metaphors, moral rationalizations, types of moral agency, and techniques of inculcating morality utilized in these representative texts. Normally, texts such (...) as Sâdık Rifat's are taken as representing an Ottoman tradition of secular morality, whereas texts from the akhlâq tradition such as Ījī's are said to represent the religious tradition of Islamic ethical philosophy. I argue, however, that textbook writers in the late Tanzimat and early Hamidian Ottoman Empire drew on both of these ethical traditions uncritically, and that the heterogeneity of nineteenth-century Ottoman public school morality texts makes it inappropriate to characterize them as ‘religious’ or ‘secular’. I suggest, instead, that these types of morality text may be more fruitfully analysed with an eye to the types of subjectivity they seek to generate rather than their ‘religious’ or ‘secular’ content. Scholars have studied multiple femininities across different spaces by attributing variation to cultural/spatial contexts. They have studied multiple femininities in the same space by attributing variation to class/race positions. However, we do not yet know how women from the same cultural, class, and race locations may enact multiple femininities in the same context. Drawing on observations and interviews in a women-only bazaar in Pakistan, I show that multiple femininities can exist within the same space and be enacted by the same (...) individual. Working-class women workers in Meena Bazaar switched between performances of “pariah femininity” and “hegemonic femininity,” patching together contradictory femininities to secure different types of capital at the organizational and personal levels. Pariah femininities enabled access to economic capital but typically decreased women’s symbolic capital, whereas hegemonic femininities generated symbolic capital but could block or enable access to economic capital. The concept of a patchwork performance of femininity explains how and why working-class women simultaneously embody idealized and stigmatized forms of femininity. Furthermore, it captures how managerial regimes and personal struggles for class distinction interact to produce contradictory gender performances. By examining gender performances in the context of social stratification, I explain the structural underpinnings of working-class women’s gendered struggles for respectability and work. (shrink)

The purpose of this paper is to reflect on how the Corona pandemic might influence human understanding of our position of being in the world. In the first part of the paper, we present how a pandemic can be under- stood in relation to our society and our educational system. Then, we will present problems and questions highlighted by the pandemic and the kind of transformations needed to address these problems. The core ele- ments that require transformation are the understanding (...) of the essence of man or the human condition, the understanding of what caring for nature and even a pandemic means, and how to measure human action and values. One of our purposes here is to expose something of the elementary logical structure of abductive reasoning, and to do so in a way that helps orient theorists to the various tasks that a logic of abduction should concern itself with. We are mindful of criticisms that have been levelled against the very idea of a logic of abduction; so we think it prudent to proceed with a certain diffidence. That our own account of abduction is itself abductive is methodological (...) expression of this diffidence. A second objective is to test our conception of abduction's logical structure against some of the more promising going accounts of abductive reasoning. We offer our various suggestions in a benignly advisory way. The primary targets of our advice is ourselves, meant as guides to work we have yet to complete or, in some instances, start. It is possible that our colleagues in the abduction research communities will find our counsel to be of some interest. But we repeat that our first concern is to try to get ourselves straight about what a logic of abduction should encompass. (shrink)

In 2005 the author introduced networks which allow attacks on attacks of any level. So if a → b reads a attacks 6, then this attack can itself be attacked by another node c. This attack itself can attack another node d. This situation can be iterated to any level with attacks and nodes attacking other attacks and other nodes. In this paper we provide semantics to such networks. We offer three different approaches to obtaining semantics. 1. The translation approach (...) This uses the methodology of ' Logic by translation'. We translate faithfully the new networks into ordinary Dung networks with more nodes and extract the semantics from the translation. 2. The labelling approach This method regards the arrows as additional entities to be attacked and to mount attacks and applies a variation of the usual machinery of Camindada like labelling to the network. The new concept we need to employ here is that of 'joint attacks'. 3. The logic programming approach We translate the higher level network into a logic program and obtain semantics for it through known semantics for logic programs. We then compare our methods with those of S. Modgil and P. M. Dung et al. (shrink)

Flooding is one of the most damaging natural hazards globally. During the past three years, floods have claimed hundreds of lives and millions of dollars of damage in Iran. In this study, we detected flood locations and mapped areas susceptible to floods using time series satellite data analysis as well as a new model of bagging ensemble-based alternating decision trees, namely, bag-ADTree. We used Sentinel-1 data for flood detection and time series analysis. We employed twelve conditioning parameters of elevation, normalized (...) difference’s vegetation index, slope, topographic wetness index, aspect, curvature, stream power index, lithology, drainage density, proximities to river, soil type, and rainfall for mapping areas susceptible to floods. ADTree and bag-ADTree models were used for flood susceptibility mapping. We used software of Sentinel application platform, Waikato Environment for Knowledge Analysis, ArcGIS, and Statistical Package for the Social Sciences for preprocessing, processing, and postprocessing of the data. We extracted 199 locations as flooded areas, which were tested using a global positioning system to ensure that flooded areas were detected correctly. Root mean square error, accuracy, and the area under the ROC curve were used to validate the models. Findings showed that root mean square error was 0.31 and 0.3 for ADTree and bag-ADTree techniques, respectively. More findings illustrated that accuracy was obtained as 86.61 for bag-ADTree model, while it was 85.44 for ADTree method. Based on AUC, success and prediction rates were 0.736 and 0.786 for bag-ADTree algorithm, in order, while these proportions were 0.714 and 0.784 for ADTree. This study can be a good source of information for crisis management in the study area. (shrink)

From the point of view of non-classical logics, Heyting's implication is the smallest implication for which the deduction theorem holds. This book studies properties of logical systems having some of the classical connectives and implication in the neighbourhood of Heyt ing's implication. I have not included anything on entailment, al though it belongs to this neighbourhood, mainly because of the appearance of the Anderson-Belnap book on entailment. In the later chapters of this book, I have included material that might be (...) of interest to the intuitionist mathematician. Originally, I intended to include more material in that spirit but I decided against it. There is no coherent body of material to include that builds naturally on the present book. There are some serious results on topological models, second order Beth and Kripke models, theories of types, etc., but it would require further research to be able to present a general theory, possibly using sheaves. That would have postponed pUblication for too long. I would like to dedicate this book to my colleagues, Professors G. Kreisel, M.O. Rabin and D. Scott. I have benefited greatly from Professor Kreisel's criticism and suggestions. Professor Rabin's fun damental results on decidability and undecidability provided the powerful tools used in obtaining the majority of the results reported in this book. Professor Scott's approach to non-classical logics and especially his analysis of the Scott consequence relation makes it possible to present Heyting's logic as a beautiful, integral part of non-classical logics. This essay evaluates the moral logic of ‘liberal eugenics’: the ideal of genetic control which leaves decisions about what sort of people to produce in the hands of individual parents, absent government intervention. I argue that liberal eugenics cannot be justified on the basis of the underlying liberal theory which inspires it. I introduce an alternative to Rawls's social primary goods that might be called natural primary goods: hereditable mental and physical capacities and dispositions that are valued across a range (...) of projects and pursuits. I suggest that reproductive genetic biotechnologies like embryo selection, cellular surgery, and genetic engineering, which aim to enhance ‘general purpose’ traits in offspring are less like childrearing practices a liberal government leaves to the discretion of parents than like practices the state makes compulsory. I argue that if the liberal commitment to autonomy is important enough for the state to mandate childrearing practices such as health care and basic education, that very same interest is important enough for the state to mandate safe, effective, and functionally integrated genetic practices that act on analogous all‐purpose traits such as resistance to disease and general cognitive functioning. I conclude that the liberal case for compulsory eugenics is a reductio against liberal theory. (shrink)

Formal nonmonotonic systems try to model the phenomenon that common sense reasoners are able to “jump” in their reasoning from assumptions Δ to conclusions C without their being any deductive chain from Δ to C. Such jumps are done by various mechanisms which are strongly dependent on context and knowledge of how the actual world functions. Our aim is to motivate these jump rules as inference rules designed to optimise survival in an environment with scant resources of effort and time. (...) We begin with a general discussion and quickly move to Section 3 where we introduce five resource principles. We show that these principles lead to some well known nonmonotonic systems such as Nute’s defeasible logic. If we arrange in chronological order the various statements Darwin made about God, creation, design, plan, law, and so forth, that I have discussed, there emerges a picture of a consistent development in Darwin's religious views from the orthodoxy of his youth to the agnosticism of his later years. Numerous sources attest that at the beginning of the Beagle voyage Darwin was more or less orthodox in religion and science alike.78 After he became a transmutationist early in 1837, he concluded (...) that the doctrine of secondary causes must be extented even to the history of life and that after the first forms of life were created, there was no further need for divine intervention, except where man was concerned. Man's body, he thought, was produced by the process of transmutation, but he believed for a time that man's soul was “superadded.” By mid-1838 he had become convinced that nothing, after the creation of life, was due to miracles. God works only through laws, which are capable of producing “every effect of evey kind which surrounds us.” The existence of man, the idea of God in man's mind, and the harmony of the whole system were in his eyes prearranged goals of deterministic laws imposed by God. Such a conception excludes the miracles on which Christianity depends; but it is not possible to say whether Darwin's loss of Christian faith, which occurred at about this same time, preceded and made possible his “materialism” or was rather caused or hastened by it.79 In the weeks after his reading of Malthus, Darwin's belief in a plan of creation gave way to the belief that God created matter and life and designed their laws, leaving the details, however, to the workings of chance. This remained his view until the 1860s.There is no exact parallel between this development of Darwin's religious views and the development of his ideas on evolution, but there is a general correspondence. When he believed in a plan of creation, Darwin's theory of transmutation did not depend on struggle or the selection of chance variations. Adaptation was, for him, an automatic response to environmental chance. From late 1838 to 1859 he believed in designed laws and chance, and this belief, too, has its parallel in his theory. The element of chance in natural selection meant that there could be no detailed plan,in which even man's idea of God would be a necessary outcome of nature's laws (man himself is not a necessary outcome of the working of natural selection).80 But Darwin still believed nature was programmed to achieve certain general ends. We might say that he believed in a general, though not a special, teleology. Natural selection was for him a law to maximize utility, creating useful organs, retaining vestiges for future use. For many years it was a law designed to produce organisms perfectly adapted to their environments. Only later did Darwin come to doubt even this sort of design in nature.81 One way of describing the development of Darwin's evolutionary thought is to say that it shows a gradual abandoning of his “theistic” assumptions, so that by the late 1860s his theory was informed to a slighter extent by notions of purpose and design than it was in 1838 or 1844 or 1859. Second-order quantifier elimination in the context of classical logic emerged as a powerful technique in many applications, including the correspondence theory, relational databases, deductive and knowledge databases, knowledge representation, commonsense reasoning and approximate reasoning. In the current paper we first generalize the result of Nonnengart and Szałas [17] by allowing second-order variables to appear within higher-order contexts. Then we focus on a semantical analysis of conditionals, using the introduced technique and Gabbay’s semantics provided in [10] and substantially using a third-order (...) accessibility relation. Agenda Relevance is the first volume in the authors' omnibus investigation of the logic of practical reasoning, under the collective title, A Practical Logic of Cognitive Systems. In this highly original approach, practical reasoning is identified as reasoning performed with comparatively few cognitive assets, including resources such as information, time and computational capacity. Unlike what is proposed in optimization models of human cognition, a practical reasoner lacks perfect information, boundless time and unconstrained access to computational complexity. The practical reasoner is (...) therefore obliged to be a cognitive economizer and to achieve his cognitive ends with considerable efficiency. Accordingly, the practical reasoner avails himself of various scarce-resource compensation strategies. He also possesses neurocognitive traits that abet him in his reasoning tasks. Prominent among these is the practical agent's striking (though not perfect) adeptness at evading irrelevant information and staying on task. On the approach taken here, irrelevancies are impediments to the attainment of cognitive ends. Thus, in its most basic sense, relevant information is cognitively helpful information. Information can then be said to be relevant for a practical reasoner to the extent that it advances or closes some cognitive agenda of his. The book explores this idea with a conceptual detail and nuance not seen the standard semantic, probabilistic and pragmatic approaches to relevance; but wherever possible, the authors seek to integrate alternative conceptions rather than reject them outright. A further attraction of the agenda-relevance approach is the extent to which its principal conceptual findings lend themselves to technically sophisticated re-expression in formal models that marshal the resources of time and action logics and label led deductive systems. Agenda Relevance is necessary reading for researchers in logic, belief dynamics, computer science, AI, psychology and neuroscience, linguistics, argumentation theory, and legal reasoning and forensic science, and will repay study by graduate students and senior undergraduates in these same fields. In this article, we propose a belief revision approach for families of (non-classical) logics whose semantics are first-order axiomatisable. Given any such (non-classical) logic , the approach enables the definition of belief revision operators for , in terms of a belief revision operation satisfying the postulates for revision theory proposed by Alchourrrdenfors and Makinson (AGM revision, Alchourrukasiewicz's many-valued logic. In addition, we present a general methodology to translate algebraic logics into classical logic. For the examples provided, we analyse in what (...) circumstances the properties of the AGM revision are preserved and discuss the advantages of the approach from both theoretical and practical viewpoints. The Wiener index WI is one of the connectivity parameters used to know the biochemical and physicochemical properties of compounds depending upon their molecular structures. Intuitionistic fuzzy graphs IFG s are a convenient tool to represent the objects and relations between them with two types of information using truth membership degree and falsity membership degree. This research work presents the concept of WI under the structure IFG s, I F trees, and I F cycles. Some bounds on WI are investigated. (...) In the current paper we consider theories with vocabulary containing a number of binary and unary relation symbols. Binary relation symbols represent labeled edges of a graph and unary relations represent unique annotations of the graph's nodes. Such theories, which we call annotation theories^ can be used in many applications, including the formalization of argumentation, approximate reasoning, semantics of logic programs, graph coloring, etc. We address a number of problems related to annotation theories over finite models, including satisfiability, querying problem, (...) specification of preferred models and model checking problem. We show that most of considered problems are NPTime- or co-NPTime-complete. In order to reduce the complexity for particular theories, we use second-order quantifier elimination. To our best knowledge none of existing methods works in the case of annotation theories. We then provide a new second-order quantifier elimination method for stratified theories, which is successful in the considered cases. The new result subsumes many other results, including those of [2, 28, 21]. (shrink)

To avoid exorbitant and extensive laboratory experiments, QSPR analysis, based on topological descriptors, is a very constructive statistical approach for analyzing the numerous physical and chemical properties of compounds. Therefore, we presented some new entropy measures which are based on the sum of the neighborhood degree of the vertices. Firstly, we made the partition of the edges of benzene derivatives which are based on the degree sum of neighboring vertices and then computed the neighborhood version of entropies. Secondly, we made (...) use of the software SPSS for developing a correlation between newly introduced entropies and the physicochemical properties of benzene derivatives. Our obtained results demonstrated that the critical temperature C T, critical pressure C P, and critical volume C V can be predicted through fifth geometric arithmetic entropy, second S K entropy, and fifth N D entropy, respectively. Other remaining physical characteristics include Gibb’s energy qℰ, log P, molar refractivity ℳℛ, and Henry’s law ℋℒ that can be predicted by using sixth N D entropy. (shrink)

Pathology and laboratory medicine are a key component of a patient’s healthcare. From academic care centres, community hospitals, to clinics across the country, pathology data are a crucial component of patient care. But for much of the modern era, pathology and laboratory medicine have been absent from health policy conversations. Though select members in the field have advocated for an enhanced presence of these specialists in policy conversations, little work has been done to thoroughly evaluate the moral and ethical obligations (...) of the pathologist and the role they play in healthcare justice and access to care. In order to make any substantive improvements in access to care, pathology and laboratory medicine must have a seat at the table. Specifically, pathologists and laboratorians can assist in bringing about change through improving clinician test choice, continuing laboratory improvement programmes, promoting just advanced diagnostic distribution, triage testing and be good stewards of healthcare dollars, and recruiting a more robust laboratory workforce. In order to get to that point, much work has to be done in pathology education and the laboratory personnel training pipeline but there also needs to be adjustments at the system level to better involve this invaluable group of specialists in these policy conversations. This Article considers the moral and legal status of practices that aim to modify traits in human offspring. As advancements in reproductive biotechnology give parents greater power to shape the genetic constitution of their children, an emerging school of legal scholars has ushered in a privatized paradigm of genetic control. Commentators defend a constitutionally protected right to prenatal engineering by appeal to the significance of procreative liberty and the promise of producing future generations who are more likely to have their (...) lives go well. This 'new eugenics,' however, confronts us with ethical challenges that neither liberal arguments about autonomy, fairness, and consent, nor utilitarian arguments about preferences, happiness, and equality, are able to capture. I begin by analyzing the Supreme Court's modern substantive due process jurisprudence, as it bears on recent advancements and controversies in genetic science. After developing a doctrinal framework that could support an asserted right to genetic engineering, I draw on empirical research in behavioral psychology to examine the influence of eugenic norms on egalitarian attitudes and institutions. I predict that if parents become accustomed to choosing the genes of their children, it would be radically more difficult to give an influential account for why the successful should adopt a charitable posture toward those who are less fortunate. I argue that by shifting control over offspring DNA from chance to choice, enhancement will inflate a sense of individual entitlement for social and economic outcomes. I conclude that increasing willingness to prevent the birth of abnormal children distracts attention from institutions that fail to accommodate the limitations of imperfect people. Some may reply that producing people who better fit the roles society chooses to reward need not deter us from providing for people whose abilities fail to meet the demands of modern society. However, this reply misses the way that changes in reproductive practices can bring about changes in the way that we understand our identities and relationships. Eugenic solutions to social problems such as poverty, crime, and unemployment reshape the challenge of genetic disadvantage so that it is no longer one we address through collective measures such as public education, social services, and income redistribution, and instead becomes one for individual parents to prevent through donor screening, embryo discard, or selective abortion. Peter Winch and Ludwig Wittgenstein have opposed the idea that traditional religion and magic are practiced in order to gain practical, instrumental ends. Their argument rests on interpretive charity: other cultures would have to be unbelievably irrational to believe in magic's practical effectiveness. In this paper, I show that Winch's own philosopical doctrine makes room for the possibility of instrumental pluralism, the notion that different societies may possess different criteria of instrumental rationality. In this paper we show that some versions of Dung’s abstract argumentation frames are equivalent to classical propositional logic. In fact, Dung’s attack relation is none other than the generalised Peirce–Quine dagger connective of classical logic which can generate the other connectives ${\neg, \wedge, \vee, \to}$ of classical logic. After establishing the above correspondence we offer variations of the Dung argumentation frames in parallel to variations of classical logic, such as resource logics, predicate logic, etc., etc., and create resource argumentation (...) frames, predicate argumentation frames, etc., etc. We also offer the notion of logic proof as a geometrical walk along the nodes of a Dung network and thus we are able to offer a geometrical abstraction of the notion of inference based argumentation. Thus our paper is also a contribution to the question: “What is a logical system” in as much as it integrates logic with abstract argumentation networks. (shrink)

Courts have resolved a range of controversies by casual appeal to the state's interest in “potential life” that Roe held capable of overriding even fundamental rights. My analysis of this potential-life interest reveals its use to mean not one but four species of concern. I call these prenatal welfare, postnatal welfare, social values, and social effects and demonstrate how they operate under different conditions and with varying levels of strength.

Greek, Indian and Arabic Logic marks the initial appearance of the multi-volume Handbook of the History of Logic. Additional volumes will be published when ready, rather than in strict chronological order. Soon to appear are The Rise of Modern Logic: From Leibniz to Frege. Also in preparation are Logic From Russell to Gödel, The Emergence of Classical Logic, Logic and the Modalities in the Twentieth Century, and The Many-Valued and Non-Monotonic Turn in Logic. Further volumes will follow, including Mediaeval and (...) Renaissance Logic and Logic: A History of its Central. In designing the Handbook of the History of Logic, the Editors have taken the view that the history of logic holds more than an antiquarian interest, and that a knowledge of logic's rich and sophisticated development is, in various respects, relevant to the research programmes of the present day. Ancient logic is no exception. The present volume attests to the distant origins of some of modern logic's most important features, such as can be found in the claim by the authors of the chapter on Aristotle's early logic that, from its infancy, the theory of the syllogism is an example of an intuitionistic, non-monotonic, relevantly paraconsistent logic. Similarly, in addition to its comparative earliness, what is striking about the best of the Megarian and Stoic traditions is their sophistication and originality. Logic is an indispensably important pivot of the Western intellectual tradition. But, as the chapters on Indian and Arabic logic make clear, logic's parentage extends more widely than any direct line from the Greek city states. It is hardly surprising, therefore, that for centuries logic has been an unfetteredly international enterprise, whose research programmes reach to every corner of the learned world. Like its companion volumes, Greek, Indian and Arabic Logic is the result of a design that gives to its distinguished authors as much space as would be needed to produce highly authoritative chapters, rich in detail and interpretative reach. The aim of the Editors is to have placed before the relevant intellectual communities a research tool of indispensable value. Together with the other volumes, Greek, Indian and Arabic Logic, will be essential reading for everyone with a curiosity about logic's long development, especially researchers, graduate and senior undergraduate students in logic in all its forms, argumentation theory, AI and computer science, cognitive psychology and neuroscience, linguistics, forensics, philosophy and the history of philosophy, and the history of ideas. Logics are like shadows on a wall; to understand why they dance as they do, and how they can be made to move differently, one needs to look at the mathematical structures from which they can be projected. That is a methodology that has long proven its value for classical and other forms of deductive inference; this book manifests its pertinence to logics of uncertain qualitative reasoning. It draws together and refines work from the literature on preferential and other quite (...) different semantics for such reasoning and then, in its central chapter, integrates the leading ideas from them into a single multi-dimensional semantics. It enters new territory with investigations of interpolation and qualitative independence in non-monotonic contexts as well as connections between non-monotonic logic and neuroscience, specifically with Edelman's theory of organization of the brain. Le débat sur la légitimité de la philosophie en Provence au début du XIVe siècle s’ouvrit par une attaque des fondamentalistes contre la magie astrale et les tentatives des rationalistes d’apprivoiser les puissances des corps célestes et des maladies par l’emploi d’images de planètes ou de signes du zodiaque. L’article décrit et analyse les positions rationalistes sur le degré de réalité et le statut halachique de la magie astrale. On peut en distinguer trois : la magie astrale est a) illusoire (...) et interdite, b) illusoire mais psychologiquement efficace, et interdite, c) réelle et permise. Cette dernière opinion était celle de penseurs comme Levi ben Abraham et l’école de Prat Maïmon. La magie astrale acquit en fin de compte sa légitimité dans le contexte de l’herméneutique biblique. During the 2016 election, Donald Trump won conservative support by promising that he would, if elected, nominate “pro‐life” justices to the U.S. Supreme Court. Whether President Trump makes good on his campaign promise to restrict abortion rights may come down to competing impulses of the chief justice, John Roberts. These dueling dispositions—from the man whom many see as the new “swing justice”—hold the key to a blockbuster new case that legal historians call “the most unpredictable the Supreme Court has been (...) on abortion in decades.” The case, June Medical Services v. Russo, turns on arduous new requirements that Louisiana has imposed on facilities and clinicians that provide abortion. But the case is not just about abortion access. This paper studies methodologically robust options for giving logical contents to nodes in abstract argumentation networks. It defines a variety of notions of attack in terms of the logical contents of the nodes in a network. General properties of logics are refined both in the object level and in the metalevel to suit the needs of the application. The network-based system improves upon some of the attempts in the literature to define attacks in terms of defeasible proofs, the so-called rule-based (...) systems. We also provide a number of examples and consider a rigorous case study, which indicate that our system does not suffer from anomalies. We define consequence relations based on a notion of defeat, consider rationality postulates, and prove that one such consequence relation is consistent. (shrink)

We propose a model of an agent’s probability and utility that is a compromise between Savage (The foundations of statistics, Wiley, 1954) and Jeffrey (The Logic of Decision, McGraw Hill, 1965). In Savage’s model the probability–utility pair is associated with preferences over acts which are assignments of consequences to states. The probability is defined on the state space, and the utility function on consequences. Jeffrey’s model has no consequences, and both probability and utility are defined on the same set of (...) propositions. The probability–utility pair is associated with a desirability relation on propositions. Like Savage we assume a set of consequences and a state space. However, we assume that states are comprehensive, that is, each state describes a consequence, as in Aumann (Econometrica 55:1–18, 1987). Like Jeffrey, we assume that the agent has a preference relation, which we call desirability, over events, which by definition involves uncertainty about consequences. For a given probability and utility of consequences, the desirability relation is presented by conditional expected utility, given an event. We axiomatically characterize desirability relations that are represented by a probability–utility pair. We characterize the family of all the probability–utility pairs that represent a given desirability relation. (shrink)

Delaware’s famous corporate law and its highly respected specialized Court of Chancery attract entrepreneurs from all over the world, who choose the small state as their locus of incorporation and litigation forum, and global investors who choose Delaware law as the law governing their corporate investments and mergers and acquisitions. Other jurisdictions vie with Delaware in regard to these choices. This interjurisdictional competition makes Delaware a significant global norm exporter in the field of corporate law because jurisdictions emulate some of (...) its corporate law. Israel leads the global pack. For two decades, it has been approximating its corporate law to Delaware’s and emulating its principal institutions, including by establishing a specialized Chancery-like court whose judges seek guidance in Delaware’s case law in deciding open corporate law questions. This Article employs qualitative methods—interviews with M&A practitioners from the United States, the United Kingdom, and Israel. We use the interviews to assess whether the project of approximating Delaware corporate law has succeeded in shifting incorporation decision preferences away from Delaware to Israel and watering down the natural reluctance of global investors to accepting an unfamiliar corporate law when engaging in cross-border corporate M&A transactions involving an Israeli party. Our findings indicate that the approximation project has countervailing effects, opinions about its success being polarized and nuanced; that approximation increases the familiarity of domestic practitioners with the foreign law being emulated, making the emulated law easier to implement; and that approximation creates more room for other aspects of interjurisdictional competition to influence private choices.
