I have learned a lot from thinking through their replies. As it happens, they focus on pretty disparate aspects of the book: necessitation, relative fundamentality, and what builds the building facts, respectively. I will thus engage with their remarks separately.

This is a timely re-appraisal of feminist political thinkers and their male contemporaries, providing a re-evaluation of feminist humanism.

Ecological feminism is a feminism which attempts to unite the demands of the women's movement with those of the ecological movement. Ecofeminists often appeal to “ecology” in support of their claims, particularly claims about the importance of feminism to environmentalism. What is missing from the literature is any sustained attempt to show respects in which ecological feminism and the science of ecology are engaged in complementary, mutually supportive projects. This paper defends Hegel’s positive contribution in the Subjective Logic and argues that it can be understood as presenting a compelling account of the space of reasons as a form of second nature. Taking Hegel’s praise of Kant’s conception of internal purposiveness and its connection to what he calls the Idea as a point of departure, I argue that Hegel’s theory of the Idea that concludes theLogicmust be understood in direct reference to Kant’s argument in the thirdCritiquethat purposiveness defines the (...) space of judgement’s power. I take up two arguments that help to understand Hegel’s appropriation and transformation of Kant’s purposiveness thesis: first, Hegel’s contention that internal purposiveness must have primacy over external purposiveness when considered in relation to judgement; and second, Hegel’s presentation of a logical concept of life as the immediate form of the Idea. There is a disconnect between the central place that Hobbes now occupies in the presumed history of democratic republicanism, and the fortunes of his political philosophy during the period leading up to the American and French revolutions. Given the central place that Hobbes’s political ideas are now accorded in the history of liberal democracy, this is a surprising fact. One of the few eighteenth-century works to engage with Hobbes was Catharine Macaulay’s critical, Loose Remarks on certain positions to be found (...) in Mr Hobbes’s “Philosophical rudiments of government and society, first published in 1767. This chapter locates Macaulay’s polemic in the context of critiques and editions of Hobbes’s political philosophy, published earlier in the century, in particular the English edition of his works and the translation of Richard Cumberland’s De legibus naturae disquisition philosophica, which both appeared in 1750. It compares Macaulay’s critique with Cumberland’s and suggests that there are features of Macaulay’s treatment of Hobbes’s ideas which help explain how it has been possible for them to have come to occupy the central place they now enjoy in the history of democratic thought, as it is now taught, despite the fact that his philosophy was almost universally rejected by democratic republicans during the eighteenth century and thus had little to do with the actual genesis of Western democratic institutions. In lieu of an abstract, here is a brief excerpt of the content:Practical Wisdom and Moral Imagination in Sense and SensibilityKaren StohrThere is no single virtue more important to Aristotle's ethical theory than the intellectual virtue of phronesis, or practical wisdom. Yet for all its importance, it is not easy to make sense of this virtue, either in Aristotle's own writings or in virtue ethics more generally. Insofar as Aristotle defines it, he does so opaquely, saying it is "a state (...) grasping the truth, involving reason, concerned with action about things that are good or bad for a human being." 1Practical wisdom is a form of knowledge aimed fundamentally at acting well. It requires both a general understanding of what is worthwhile in human life and the ability to act in ways that reflect that understanding. 2 My goal in this paper is to explore the latter aspect of practical wisdom in its application to ordinary social behavior. The circumstances that will interest me here are often thought to be the domain of manners or decorum, rather than morals proper. Although no one who takes Hume seriously can deny the moral significance of manners, the relationship between one's inner state of character and how that character is expressed in seemingly mundane behavior has received insufficient attention from moral philosophers. 3 In such a task, there can be few better places to begin than with Jane Austen, whose novels reveal the intricacies of ordinary moral behavior with extraordinary acumen.I shall use Austen's Sense and Sensibility to examine the skill associated with knowing how to behave rightly in the sense we associate with propriety or decorum. This skill is essential to pleasant social life, and hence, on the Aristotelian view, to human flourishing. Yet it is often lacking, even among those who have sound moral principles and good hearts. Well-meaning people frequently say or do what is inappropriate. [End Page 378] Consider, for instance, how common it is for kindly disposed people to say to bereaved friends things like, "it's all for the best" or "be thankful for your other healthy children" or "you're young, you'll marry again." The intricacies of offering sympathy are hard to get right, and otherwise good people can unwittingly leave behind disasters in their wakes.The skill of acting well in complex social situations has interesting links to the capacity for moral imagination. Engaging in imaginative identification with others is essential to empathy. 4 Without suggesting that empathy is at the root of all fluid social interactions, I shall argue that certain characteristic failures to act well in that sphere are imaginative failures. In other words, insofar as the exercise of practical wisdom is present in the realm of manners, it requires moral imagination.Failures of moral imagination, however, can take different forms and have different social effects. I shall use two of Austen's characters in Sense and Sensibility—Marianne Dashwood and Mrs. Jennings—to illustrate different ways in which inadequate imaginative capacity can impede the exercise of practical wisdom. The contrast I shall draw is with Elinor Dashwood, to whom I ascribe practical wisdom in full. 5 This contrast is especially interesting because it is not always very sharp: all three characters have fundamentally good moral principles and warm hearts. Yet unlike Elinor, Mrs. Jennings and Marianne routinely fail to act well, and in characteristic ways. Despite the differences in their characters, they have in common an inability to use moral imagination appropriately. The moral errors of Marianne and Mrs. Jennings occur in relatively insignificant circumstances, but the errors themselves point to something deeper about how the virtue of practical wisdom functions in ordinary moral practice.In exploring the link between moral imagination and moral practice, it will help to remember Aristotle's emphasis on the reciprocity between practical wisdom and the moral virtues. Using qualitative data based on interviews with 22 married infertile couples living in western New York State, we describe the ways in which husbands and wives interact in the process of constructing their infertility. The wives experienced infertility as a cataclysmic role failure. Husbands tended to see infertility as a disconcerting event but not as a tragedy. Couples tended to see infertility as a problem for wives. Frustration and lack of communication were typical consequences of the confrontation of husbands' and (...) wives' perspectives on infertility. Interactions with medical professionals tended to reinforce these consequences. These interactions between wives, husbands, and medical professionals may lead to taking wrong directions in treatment and to ignoring treatment options. Some of the problems we describe could be lessened by adopting a model of couple-centered treatment in a setting that incorporated routine counseling. (shrink)

The Court of Justice of the European Union and the way in which it works can be seen as a microcosm of how a multilingual, multicultural supranationalisation process and legal order can be constructed—the Court is a microcosm of the EU as a whole and in particular of EU law. The multilingual jurisprudence produced by the CJEU is necessarily shaped by the dynamics within that institution and by the ‘cultural compromises’ at play in the production process. The resultant texts, which (...) make up that jurisprudence, are hybrid in nature and inherently approximate. On the one hand, that approximation can lead to discrepancies between language versions of the Court’s case law and thus jeopardise the uniform application of EU law. On the other hand, that approximation and hybridity define EU law as a distinct, supranational legal order. This paper analyses the operation of the CJEU and considers whether a linguistic cultural compromise exists within that institution which exercises a formative influence on the character of its ‘output’—i.e. its jurisprudence—and what that may mean for our understanding of the development of EU law. This paper explores two phases of the early modern genre wars. The first was fought by Marie de Gournay, in her “Preface” to Montaigne's Essays, on behalf of her adoptive father and in defense of his naked and masculine prose. The second was fought half a century later by Nicholas Boileau in opposition to Gournay's feminizing successor, Madeleine de Scudéry. In this debate Gournay's position is egalitarian, whereas Scudéry's approximates to a feminism of difference. It is claimed that both female (...) protagonists in this early debate occlude the female body. The far more sexually explicit prose of Mary Delarivier Manley is then used to raise the question: is it genre, or is it, rather, the very nature of erotic sexuality, that makes it so difficult for women to masterfully expose themselves as authoritative subjects? In this paper I argue that the capacity to behave appropriately in social settings is properly understood as a virtue. Genuinely good manners contribute to, and are expressive of, morally important ends, the ends to which someone with full Aristotelian virtue is committed. They thus form an essential component of virtuous conduct.

This paper is about a category of social conventions that, I will argue, have significant moral implications. The category consists in our conventions about what we notice and choose not to notice about persons, features of persons, and their circumstances. We normally do not think much about what we notice about others, and what they notice about us, but I will argue that we should. Noticing people is a way of engaging with them in social contexts. We can engage in (...) social noticing more or less respectfully, more or less benevolently. Moreover, our standard conventions about noticing often have disparate effects on different groups of people. To be noticed appropriately is to have one's moral and social standing affirmed; conversely, to be denied notice or to be noticed inappropriately is very often to be denigrated or objectified. My aim in this paper is to unpack these moral dimensions of conventions of noticing and discuss their implications for how people engage with each other in certain kinds of social exchanges involving persons with disabilities. In Part I, I explain what I mean by the conventions of noticing and how they operate in social interactions. I show that although we do not always attend to them, these conventions are thoroughly embedded in our everyday social life. In Part II, I argue that these conventions have important moral dimensions and as such, should be governed by moral principles and values. I employ a Kantian framework of duties of love and respect in order to show how moral concerns should shape the way we use conventions of noticing and respond to their use by others. In Part III, I draw out the implications of this picture for social interactions among strangers when one or more of the parties involved has an immediately visible disability. (shrink)

Today many homes are accessible from afar, with mobile phones functioning as remote controls for technologies within the home. In this article we propose the ‘leaky home’ as a conceptual figure to understand how automated homes that leak through connected devices and sensors that collect, transmit, receive and share data are experienced and sensed by bodies within these distributed spaces. The leak brings together postmodern metaphors of fluidity and the 21st century discourse of information leaks, while maintaining infrastructural connotations of (...) substances that shift domain in very tangible ways. By looking at a series of examples from media accounts and research conducted in Denmark, the UK, the USA and Australia, ranging from everyday family practices to digital coercive control, we explore how the care-control complex of the home is impacted by its leaky nature. I examine recent arguments to the effect that there are significant logical, conceptual, historical, or psychosexual connections between the subordination of women and the subordination of nature and argue that they are all problematic. Although there are important connections between women’s emancipation and the achievement of important environmental goals, they are practical connections rather than conceptual ones.

Catharine Macaulay’s The History of England challenges Hume’s interpretation of the history of the Stuarts, as developed in his The History of Great Britain, and is grounded in meta-ethical, religious, and political principles that are also fundamentally opposed to those developed by Hume, as she makes clear in her Treatise on the Immutabilty of Moral Truth. Here it is argued that the contrast between them poses a problem for a number of recent accounts of the enlightenment period, and that Macaulay’s (...) work demonstrates that one path to radical politics went via an optimistic strand of intellectualist theism. Macaulay’s ‘republican’ history, which was read on both sides of the Atlantic as justifying the overthrow of arbitrary governments, was grounded in conceptions of liberty, virtue, and sincere theistic belief, similar to those of the Cambridge Platonists. By contrast, Hume’s moral and religious scepticism led naturally to the political conservatism evident in his history. This paper offers an outline of their alternative accounts of the significance of the two English revolutions, and the opposing metaphysical and meta-ethical positions that underpin those accounts. It concludes with a discussion of the contrast between their concepts of liberty and their consequent very different evaluations of the value of liberty. (shrink)

In this paper I explore the connection between Catharine Macaulay’s views on freedom of the will and her promotion of the cause of political liberty and show that the position she develops has its origins in Locke’s philosophy. I argue for the existence of a distinctive ‘Lockean’ conception of political liberty, which is grounded in an account of moral agency, and which does not fit very well into contemporary characterizations of negative, republican, or positive liberty. I demonstrate that this concept (...) of political liberty was widely disseminated during the eighteenth century and can be found in the writing of many of Macaulay’s female contemporaries, both in Great Britain and on the Continent. Recognizing this ‘Lockean’ conception of political liberty is important for understanding the connection between the idea of enlightenment and radical movements promoting political reform. Furthermore, acknowledging its widespread influence throws doubt on Jonathan Israel’s recent attempt to overthrow standard histories—according to which Locke’s rational religion is foundational for radical politics during the period—as well as Israel’s attempt to replace such standard histories with an account that locates the impetus for political reform in metaphysical monism and religious skepticism. We critique the metaphysical ecology developed by J. Baird Callicott in “The Metaphysical Implications of Ecology” in light of what we take to be the most viable attempt to provide an inclusive theoretical framework for the wide variety of extant ecosystem analyses—namely, hierarchy theory. We argue that Callicott’s metaphysical ecology is not consonant with hierarchy theory and is, therefore, an unsatisfactory foundation for the development of an environmental ethic.

It is generally thought that Searle 's cluster theory of the sense of a proper name was soundly refuted by Kripke in Naming and Necessity. This paper challenges this widespread belief and argues that the observations made by Kripke do not show that Searle 's version of descriptivism is false. Indeed, charitably interpreted, Searle 's theory retains considerable plausibility.

Organizational demands for loyalty often profit from a certain vagueness. This profit is probably a product of both nature and design.

This article begins with clarification of the notion of progress. The author believes that it is possible to consider progress objectively, if by progress we understand a positive change in the effectiveness of something. He mentions two types of progress: progress of improvement and progress of augmentation. He then distinguishes evaluative from reflective philosophy. Evaluative philosophy gives answers to the second and third of Kant's famous three questions; reflective philosophy answers the first, dealing with the limits of human knowledge. Progress (...) in evaluative philosophy takes the form of augmentation. But in reflective philosophy it could take the form of improvement. The author believes, however, that it is not an easy task to improve contemporary social philosophy. Three main obstacles are: the “anthropological turn” in philosophy, the challenge of postmodernism, and the turning of social philosophy into a kind of useful knowledge. (shrink)

This paper explores the ethical aspects of an investigation into a forester's perception of his landscape. Three different ethical issues are addressed. The first issue concerns the ethics associated with the methodology of ethnology. The second concerns a forester's ethics. An example is provided which indicates how he applies values and aesthetics to the landscape in which he lives and works. Finally, the ethics of wilderness is discussed, concentrating on the different ways in which people perceive wilderness and wilderness issues, (...) depending on their relationship with the forest landscape. The article concludes by questioning whether the ways in which wilderness is culturally constructed can lead to misconceptions about human-forest interaction, and by asking whether emphasis on wilderness as a positive value has been exaggerated. In recent years, public health law has seen some important court decisions. Those are presented below.In Pelman v. McDonaldS Corporation, the court dismissed a complaint filed by three children who claimed that McDonald’s practices in making and selling its products were deceptive. This deception, the children alleged, caused them to consume McDonald’s products with great frequency and become obese, thereby injuring their health. The plaintiffs pled five causes of action against McDonald’s, alleging that McDonald’s: 1) failed to adequately disclose the (...) ingredients and health effects of its products and described their food as nutritious without disclosing detrimental health effects; 2) engaged in marketing techniques geared toward inducing children to consume their products; 3) acted negligently in selling foods high in fat, cholesterol, salt, and sugar when studies show that foods containing these ingredients cause obesity and detrimental health effects; 4) failed to warn consumers of the quantity and qualities of levels of fat, cholesterol, salt, and sugar in its products or of the detrimental health effects of such foods; and 5) acted negligently in marketing foods that were physically and psychologically addictive. Emotions influence human decisions under risk and uncertainty, even when they are unrelated to the decisions, i.e. incidental to them. Empirical findings are mixed regarding the directions and sizes of the effects of discrete emotions such as fear, anger, or happiness. According to the Appraisal-Tendency Framework (ATF), appraisals of certainty and control determine why same-valence emotions can differentially alter preferences for risky and uncertain options. Building upon this framework of emotion-specific appraisals, we conducted a systematic review and meta-analysis of 28 (...) experimental studies on the effects of discrete incidental emotions on decision-making under risk and uncertainty. We evaluated potential moderators at the task and study levels. We find emotion-specific, moderately heterogeneous effects partially in line with the expectations of the ATF. The framing and financial consequences of choices, the type of choices, and the presence of other participants during the task do not moderate the effect. Our meta-analytic results support the differential influence of discrete, incidental emotions on decision-making under risk and uncertainty depending on appraisals other than valence. We discuss limited sample sizes and heterogeneity as reasons for the absence of significant moderators and encourage experimental investigations of individual differences in the susceptibility to incidental affective influences. : De Beauvoir and Irigaray are archetypes of two opposed feminisms: egalitarian feminism and radical feminism of difference. Yet a filiation exists between de Beauvoir's claim, that women is Other, and Irigaray's Speculum of the Other Woman. This paper explores the relationship between de Beauvoir's and Irigaray's notion of otherness. It argues that Irigaray deforms de Beauvoir's categories, and that de Beauvoir provides a more coherent prospect for the development of an authentic feminine subjectivity.

Contributing to the debate between referentialist and predicativist accounts of the semantics of proper names, this paper partly endorses a recent trend to reject unitary accounts of their semantics. It does so by restoring a Fregean version of the variety of use account. It criticizes alternative variety of use accounts for not clearly distinguishing pragmatic, syntactic, and semantic issues and argues that, once these are distinguished, the necessity of accepting that names have a variety of uses, and are sometimes logical (...) singular terms and at others logical predicates shows that Frege’s claim, that we should recognize that names have both reference and sense, is vindicated. Science inevitably involves ethical discussions about how research should be implemented. However such discussions often neglect the potential unethical treatment of a third party: the research assistant. Extensive anecdotal evidence suggests that research assistants can experience unique physical, psychological, and social risks when implementing their typical responsibilities. Moreover, these research assistants, who perhaps engage in research experience to bolster their curricula vitae, may feel coerced to continue to work in unsafe environments out of fear of losing rapport with the research (...) supervisor or letters of recommendation for their future endeavors. In the present article, we address two important issues regarding the ethical treatment of research assistants. First, we present evidence suggesting that research assistants may experience substantive risk when implementing their assigned responsibilities. Second, we propose a document, the "Research Assistant's Bill of Rights," as a possible ethics code for people supervising research assistants. This document is independent from typical institutional review board processes, and it has the potential to maximize benefits to research supervisors and research assistants. (shrink)

Arts and Humanities in Higher Education, Ahead of Print. Preparing students to navigate a life in music involves understanding how they develop awareness of their personal and professional identities, build networks, and reflect on practice in order to sustain and develop work which is meaningful. In a complex, uncertain and rapidly changing world, particularly following the Covid-19 pandemic, we explore the ways in which HEIs might support music students as they prepare for their futures. We argue that employability ecosystems may (...) provide a useful frame for considering the ways in which students’ work transitions can be supported. We consider three vignettes of practice relating to the role of eportfolios and mentoring in scaffolding student reflections on how the intersections of passion, partnership and identity inform personal definitions of success. We suggest that there is a need to disrupt dominant working practices within the music industry and its institutions towards a more ethical, sustainable and culturally enriching employability ecosystem.
