While the field of aesthetics has long been dominated by European philosophy, recent inquiries have expanded the arena to accommodate different cultures as well as different definitions. In this volume, scholars and teachers in the fields of African and African American studies advance the debate over the nature of African aesthetics, approaching the subject from a broad range of disciplines. This chapter discusses how phenomenologies of pregnancy challenge traditional philosophical accounts of a subject that is seen as autonomous, rational, genderless, unified, and independent from other subjects. Pregnancy defies simple incorporation into such universal accounts since the pregnant woman and her unborn child are incapable of being subsumed into traditional theories of the subject. Phenomenological descriptions of the experience of pregnancy lead one to question if philosophy needs to reject the subject altogether as central, or rather to revise traditional descriptions (...) of the subject. The chapter examines both options and argues for the later. The exploration of pregnancy in feminist theory upholds the value of working from the subject’s lived experience, but indicates that it is possible without viewing the subject as a disembodied universal agent. Finally, it discusses how phenomenologies of pregnancy are attuned to discussing difference thereby aiding philosophies that take into account the political, historical, and cultural conditioning that shape experience and theory. ABSTRACTThis article attempts a properly critical and political analysis of the “police power” immanent to the form and logic of academic rankings, and which is reproduced in the extant academic literature generated around them. In contrast to the democratising claims made of rankings, this police power short-circuits the moment of democratic politics and establishes the basis for the oligarchic power of the State and its status quo. Central in this founding political moment is the notion of the Arkhè, a necessarily (...) asymmetric “distribution of the sensible” that establishes the basis of the political order, in this case an oligarchic political order. Drawing on Foucault and Rancière, the article argues for a necessary “dissensus” with both the ranking practice and its attendant academic literature, as the first step towards a politics of ranking that is properly critical, and therefore genuinely political. An evidence-based approach to crime and justice policy can go a long way toward ensuring that the best available research is considered in decisions that bear on the public good. However, the term "evidence-based" is characterized by a great deal of rhetoric. Indeed, there remains a marked disjuncture between calls for "evidence-based" policy and an understanding of what it means for policy to be "evidence-based." The calls for evidence-based policy nonetheless provide a powerful foundation for propelling a movement toward bringing (...) about rational, cost-effective, and humane policies for the betterment of society. This handbook showcases the state of research on evidence-based crime and justice policy and the challenges that impede its creation and use. The volume has three core objectives: to promote new and productive ways to think about evidence-based policy; to demonstrate how research can contribute to and guide evidence-based policy in juvenile justice, criminal justice, and alternatives to system responses; and to identify strategies that can increase reliance on evidence-based policy. To meet these objectives, each chapter is guided by several central questions: What do we know about evidence-based policy and practice in crime and justice? How can we improve knowledge of evidence-based policy and practice? How can we promote more use of evidence-based policy and practice? Taken as a whole, the volume emphasizes the critical need for policies that are grounded in high-quality research, that address critical research gaps, and that fully acknowledge the limitations of what extant research can do to inform policy decisions. The Four Branches of the Mabinogi is a work, or perhaps a cycle of four related works, composed in Middle Welsh prose probably near the end of the eleventh century and perhaps in southwest Wales. It is the most important surviving prose fiction produced in Britain before the romances of Malory four centuries later and is all the more valuable in that we do not have from medieval Britain, as we do from Ireland, a rich legacy of vernacular prose (...) fiction. It draws freely from a broad background of traditional narratives, many known to us primarily as oral folktales, and yet is certainly the work of an author, composed in writing: few of the telltale signs of oral composition appear in its controlled and economical style. However, the old eagle continued to call out to him, “Eagle down there, hello.” Finally the eagle in the chicken yard thought, can that eagle in the tree be yelling to me? So he looked up at the tree and saw that the old eagle was beckoning to him to fly up to the tree's branch. The young eagle said, “I cannot fly. I am a chicken.” Insisting that he try to fly the old eagle said, “No, you are not a chicken you are an eagle and I know your parents, in fact, I am your mother and your father is waiting for me to bring you.”. What is honor? Has its meaning changed since ancient times? Is it an outmoded notion? Does it still have the power to direct our behavior? In this provocative book Alexander Welsh considers the history and meaning of honor and dismisses the idea that we live in a post-honor culture. He notes that we have words other than _honor_, such as _respect_, _self-respect_, and personal _identity_, that show we do indeed care deeply about honor. Honor, he argues, is a continuing (...) process of respect that motivates or constrains members of a peer group. Honor’s dictates function as moral imperatives. Surprisingly, little systematic study of the history of honor in Western culture has been attempted. Offering a welcome remedy, Welsh provides a genealogy of approaches to the subject, mining some of the most influential texts of the Western tradition. He rereads with fascinating results the works of Aristotle, Cicero, Shakespeare, Mandeville, Montesquieu, Rousseau, Kant, Adam Smith, and others. With a sharp focus on the intersection of honor and ethics in both literature and philosophy, Welsh invites new and constructive debate on a topic of vital interest. (shrink)

This paper reports on collaborative research undertaken with the African Australian Christian Impact Centre (CIC) in Perth, Western Australia. It is part of a larger university philosophy outreach program in which the researchers seek to create opportunities for those on the educational and social margins, and young people, to engage in ‘doing philosophy’, and to learn from them about their experiences. We were interested to evaluate whether the collaborative philosophical inquiry methods we use in our university teaching could be beneficial (...) outside of a formal educational setting, for members of the culturally diverse, faith-based community of CIC. In this multi-method evaluative study, we examined the extent to which participation in a series of Community of Inquiry (CoI) sessions improved or did not improve participants’ self-assessment of: (1) their competence and confidence in communicating with others in different contexts; (2) their competence and confidence as a ‘thinker’; and (3) their social competence and confidence. Our findings on ‘communication’ are discussed in this paper. The facilitated philosophical discussions led to insights about ‘speaking out’ and ‘listening’, particularly with respect to participants’ experiences of cultural and generational differences. We suggest that participation in CoI in a faith-based community setting has the potential to significantly increase confidence in communication skills, and lead to greater intergenerational, intercultural, and intercommunity sensitivity. Maurice Merleau-Ponty is one of the few major phenomenologists to engage extensively with empirical research in the sciences, and the only one to examine child psychology with rigor and in such depth. His writings have recently become increasingly influential, as the findings of psychology and cognitive science inform and are informed by phenomenological inquiry. Merleau-Ponty’s Sorbonne lectures of 1949 to 1952 are a broad investigation into child psychology, psychoanalysis, pedagogy, phenomenology, sociology, and anthropology. They argue that the subject of child (...) psychology is critical for any philosophical attempt to understand individual and intersubjective existence. Whilst the Neoliberal alludes to an array of very real material practices and axioms of contemporary capitalism, the concept of Neoliberalism itself has arguably become moribund. Worse, perhaps it has become an asphyxiating and enervating monolith, a ‘ptolemization’ from which our critical thinking cannot escape. The key strategy of the article is to explore the Neoliberalism concept as a ‘mode of telling’, and how the constitutive moments of that concept have been discursively constructed into a hegemonic discursive formation. Whilst the (...) resultant paradigm of Neoliberalism has ironically been constituted out of the identity-thinking and the synthetic historicizing of its very critics, the article searches for alternative avenues of reconstitutive deconstruction, so as to offer both critical optimism and a more effective means of struggle against the material practices of contemporary capitalism. To this end, I shall indicate how overdetermination in conceptualization provides the opportunity to break down identity-thinking and how articulation can translate the material elements of contemporary capitalism into fresh moments of a counter-hegemonic discourse. This essay deals with the ideas of Ifeanyi Menkiti and Kwame Gyekye on the individual-community relationship. I begin with a provocative statement: most African intellectuals struggle with abandoning Westernity and consequently remain at the Eshuean crossroads seeking to please both sides of the abyss. It is my argument that both Menkiti and Gyekye understood that teasing out our philosophical problems might lead us to an intellectual clarity about the concepts of community and individual in African cultures. I am making no (...) attempt to solve this problem of Eshuean crossroads in this essay; I simply want to establish the grounds upon which the combatants of philosophical ideas like Menkiti and Gyekye are fighting. This paper considers phenomenological descriptions of health in Gadamer, Heidegger, Merleau-Ponty, and Svenaeus. In these phenomenologies of health, health is understood as a tacit, background state that permits not only normal functioning but also philosophical reflection. Nietzsche’s model of health as a state of intensity that is intimately connected to illness and suffering is then offered as a rejoinder. Nietzsche’s model includes a more complex view of suffering and pain as integrally tied to health, and its language opens up the (...) possibility of many ‘healths,’ providing important theoretical support to phenomenological accounts of the diversity and complexity of health and illness. This paper investigates the claims made by both Freudian psychoanalysic thought and Husserlian phenomenology about the unconscious. First, it is shown how Husserl incorporates a complex notion of the unconscious in his analysis of passive synthesis. With his notion of an unintentional reservoir of past retentions, Husserl articulates an unconscious zone that must be activated from consciousness in order to come to life. Second, it is explained how Husserl still does not account for the Freudian unconscious. Freud's unconscious could be (...) called, in phenomenological terms, a repressed retentional zone that differs from both near and far retention. Finally, an analysis is offered for the significance of this psychoanalytic argument for phenomenology. Does phenomenology provide a complete account of the psychical life of the subject without the Freudian unconscious? Does phenomenology suggest, as is often done, that Freud's discovery of the unconscious is a fantastical invention? Or, does the Freudian unconscious represent a true stumbling block for phenomenology? (shrink)

Anatomically detailed dolls have been used to elicit testimony from children in sex abuse cases. However, studies have shown they often provide false accounts in young, preschool-age children. Typically this problem is seen as a cognitive one: with age, children can correctly map their bodies onto a doll due to greater intellectual ability to represent themselves. I argue, along with the work of Maurice Merleau-Ponty, that although certainly cognitive developments aid in representing one’s own body, a discussion of embodiment is (...) required in order to understand the use and abuse of anatomical dolls in forensic interviews. This paper will examine these issues and suggest that a better understanding of embodied perception in both adults and children helps show how phenomenology can provide a more nuanced understanding to a troubling ethical and legal problem. There is a large literature on technology adoption and environmental management in agriculture. Included in this literature are debates about the role world view or attitudinal variables play in adoption decisions, and whether smaller farms or larger farms exhibit superior environmental performance or differ in commitment to environmental values. In this paper we attempt to extend the literature in this area by proposing and measuring discrete environmental management approaches among sixty-six farmers in Northern New York. Using key informants interviews, purposeful (...) sampling of farmers and a mail survey we find two environmental management types: (1) the larger-scale conservation farmer; and (2) the alternative/ecological farmer. So much of what we experience in neoliberal capitalism resembles the operation of the camp. How then can we understand the camp as a political technology of labour control recurrent in historical capitalism, and why would we want to? Driven by the perennial imperatives to govern and to accumulate, the camp as a modulation of social control allows us to explore the role of ‘meta-disciplinary’ technique in the ‘real subsumption of labour’. The aims here are to question the sanguine expectations (...) of a liberal pastorate that is inextricable from the needs of capital; to articulate the ‘techniques of domination’ experienced in the idiom of neoliberal capitalism; and to find inspiration for corresponding counter-conducts and ‘techniques of the self’. This article offers a kind of historical archaeology of ‘meta-disciplinary’ technique by resuscitating Solzhenitsyn’s The Gulag Archipelago, a surprisingly rich source of insight into the operations of the camp modulation and the counter-conducts it engenders. The analysis to follow works in the space between Marxian and Foucauldian political thought opened up by the new materialisms, and draws upon the recent works of Lordon, Lazzarato, Negri, inter alia, that are currently enriching critical theory. This concluding chapter assesses the debate over humanitarian intervention in the light of the events of September 11, 2001. On the one hand, it can be argued that 9/11 has reversed the momentum behind the norm of ‘sovereignty as responsibility’. In the course of waging the war on terrorism, the powers of sovereign states have been increased and the willingness of Western states to criticize the treatment of civilians within other sovereign jurisdictions appears to have weakened. On the other, there (...) are three reasons why humanitarian intervention – and the issues associated with it – will continue to preoccupy scholars and statesmen in a post-September 11th world. First, the terrorist attacks of 2001 have reinforced the view that instability within or collapse of a state anywhere in the world can have implications that reach far wider than that particular region. Second, the debate about what constraints should be placed on the use of force – particularly those related to proper authority – are as relevant for the ‘war on terror’ as they are for humanitarian intervention. Finally, as the missions in Afghanistan in 2001 and Iraq in 2003 have shown, humanitarian rationale are all-important in justifying the use of force in international society, even when other motives are at work. Until the 1970s, models of early infancy tended to depict the young child as internally preoccupied and incapable of processing visual-tactile data from the external world. Meltzoff and Moore's groundbreaking studies of neonatal imitation disprove this characterization of early life: They suggest that the infant is cognizant of its external environment and is able to control its own body. Taking up these experiments, theorists argue that neonatal imitation provides an empirical justification for the existence of an innate ability to engage (...) in social communication. Since later imitation is taken as a benchmark for self- and other-awareness, theorists claim that a proto- or primitive self must exist in the infant. This paper takes up the issue of whether or not neonatal imitation does provide us with a ground to argue against developmental accounts that consider self-awareness to be a later acquisition. I argue that the enthusiasm over neonatal imitation is premature. Psychological studies that claim to prove neonatal imitation do not provide sufficient grounds for dismissing alternate philosophical and psychological theories about the self as being a post-birth "event" rather than an intrinsic condition. Therefore, I argue that there is no compelling reason to suppose that we come to the world with a primitive sense of self- or other-awareness. (shrink)

BackgroundAcute myocardial infarction (AMI) research is challenging as it requires enrollment of acutely ill patients. Patients are generally in a suboptimal state for providing informed consent. Patients’ understanding to verbal assents have not been previously examined in AMI research. Patients Acceptance and Comprehension to Written and Verbal Consent (PAC–VC) compared patients’ understanding and attitudes to verbal and written consents in AMI RCTs.MethodsPAC–VC recruited patients from 3 AMI trials using both verbal N = 12 and written N = 6 consents. We (...) compared patients’ understanding using two survey questionnaires. The first questionnaire used open-ended questions with multiple choice answers. The second questionnaire used a 5-point Likert scale to measure patients understanding and attitudes to the consent process. Overall answers average scores were categorized into three groups: Adequate understanding (71–100) %, Partial understanding (41–70)% and Inadequate understanding (0–40)%.ResultsResponses showed patients with verbal assent had adequate understanding to most components of informed consent, close to those of written consent. Most patients did not read written information entirely and believed that it is not important to make a final decision. Patients favoured to have written information be part of the consent but not necessarily presented during the initial consent process. Patients felt less pressured in the verbal assent arm than those of written consent.ConclusionPatients had adequate understanding to most components of verbal assent and comparable to those of written consent. Utilizing verbal assents in the acute care setting should be further assessed in larger trials. (shrink)

The principle of the responsibility to protect (RtoP) conceives of a broad set of measures that can be employed in preventing and responding to atrocity crimes. Nevertheless, the UN Security Council remains an important part of the implementation architecture, given what the International Commission on Intervention and State Sovereignty referred to as its authoritative position in international society as the “linchpin of order and stability.” As part of the roundtable “The Responsibility to Protect in a Changing World Order: Twenty Years (...) since Its Inception,” this review of the Council's role in fulfilling its responsibility to protect advances two somewhat contrasting arguments about the original ICISS report. First, it suggests that the commissioners may have underestimated the Council's potential contribution, by concentrating on the authorization of coercive means to address crises of human protection. Over the past two decades, the Security Council has not only employed various diplomatic, political, and humanitarian measures to address atrocity crimes but also adjusted the purposes and practices of peace operations to advance protection goals and more subtly shaped discourses and expectations about state responsibilities for protection. However, I also argue that the willingness of the ICISS to identify potential alternatives to the Security Council when its members are paralyzed appears in retrospect to have been both bold and forward looking, in light of the Council's failures to act in a timely and decisive manner to protect amid crises and the contemporary realities of geopolitical rivalry. The article concludes by suggesting that future efforts to protect populations from atrocity crimes should focus not only on the herculean task of trying to change the behavior of P5 members of the Council but also on encouraging a new institutional balance between the Security Council and other intergovernmental bodies. This paper examines a neglected fifteenth-century manuscript of the opusculum of Julius Exuperantius. It argues that that manuscript (Bologna, Biblioteca Universitaria, 748) is a sibling of Vatican City, BAV, Vat. lat. 3334, and situates the new manuscript in the stemma established by the last editor. It then proposes a modification to that editor's stemma, arguing that those two fifteenth-century manuscripts in fact descend from Milan, BA, H 37 sup., once owned by Francesco Pizolpasso. Interferon (IFN) induced during a virus infection mediates antiviral effects both by direct inhibition of virus replication and by influencing the proliferation, differentiation, and chemotaxis of cyto‐toxic lymphocytes which control the infection. Cells from tissue taken from virus‐infected mice are conditioned by IFN to resist lysis by natural killer (NK) cells, while they become increasingly susceptible to lysis by cytotoxic Tlymphocytes (CTL). This is due to marked IFN‐induced biochemical changes, including an up‐regulation of major histocompatibility antigens, which are targets for (...) CTL. Cytopathic viruses, which inhibit cellular RNA and protein synthesis, render target cells refractory to IFN‐mediated protection against NK cells, thereby providing a mechanism for NK cells to mediate antiviral effect by preferentially lysing virus‐infected but not uninfected cells. This book interprets Max Stirner's The Ego and Its Own as a critique of modernity and traces the basic elements of his dialectical egoism through the writings of Benjamin Tucker, James L. Walker, and Dora Marsden. Stirner's concept of 'ownness' is the basis of his critique of the dispossession and homogenization of individuals in modernity and is an important contribution to the research literature on libertarianism, dialectics, and post-modernism.

On 17 May 2016 Lucy Welsh interviewed Annelise Riles about her work on the relationship between law and time as part of Welsh’s involvement with the AHRC Regulating Time network. Annelise Riles is the Jack G. Clarke Professor of Law in Far East Legal Studies and Professor of Anthropology at Cornell, and is Director of the Clarke Program in East Asian Law and Culture. Her work examines the transnational dimensions of laws, markets and culture across the fields of (...) comparative law, conflict of laws, the anthropology of law, public international law and international financial regulation. Most recently Professor Riles has been examining the nature and meaning of the settlement made on the so-called Comfort Women, and what impact that has for locating events in the past. The Comfort Women were Korean women who were essentially captured and forced to work as sexual slaves for the Japanese army during World War Two. In 2015, Japanese and South Korean ministers agreed a settlement in what they regarded as an irreversible and final settlement of the issue. Welsh and Riles exchange over their mutual interests in time and routinisation in this interview as they discuss what the story of the Comfort Women has to tell us. (shrink)
