On the 24th June 2015, Feminist Legal Studies and the London School of Economics Law Department hosted an afternoon event with Professor Wendy Brown, Class of 1936 First Professor of Political Science, University of California. Professor Brown kindly agreed to discuss her scholarship on feminist theory, and its relationship to both the law and neoliberalism. The event included an interview by Dr Katie Cruz and a Q&A session, which are presented here in an edited version of the (...) transcript. Sumi Madhock, Professor of Gender Studies, LSE chaired the interview and discussion and introduced Professor Brown’s work. Katie Cruz asked Wendy Brown to reflect upon topics that span her scholarship and activism, including the state of critical, feminist, and Left approaches to rights, neoliberalism, despair and utopianism, and the future of feminist theory and practice in the context of neoliberalism and current debates about intersectionality. Participants in the discussion asked questions on a wide range of issues, including the limits of feminist engagement with law as a tool for social change, the dominance of neoliberalism, imperialist feminism, Islamophobia, secularism, and our attachment to the figure of homo politicus. This article analyzes the demarcations made within psychology as a feature of the “memory wars”—the current controversy around “recovered” or “false” memory. As it is played out inside professional psychology, the dispute features clinical practitioners acting largely as proponents of recovered memory and experimentalists as proponents of false memory. Tracing a genealogy of this dispute back to a pair of original sites, we show how the traditions’engagement in three modes of scientific demonstration varies systematically in terms of the modes of (...) social relation inherent in their epistemic practices and the kinds of “reliable witness” these practices produce. We conclude that whereas the experimentalist tradition is able to transporttheir produced witnesses from oneto anothersite of demonstration with relative ease, the clinical tradition has much greater difficulty in doing so and thus has to engage in a variety of compensatory demonstrative strategies. This volume explores assumptions and frameworks concerning violence, nonviolence, war, conflict, and reconciliation, and considers what would be needed in order for people to see nonviolence as a viable approach to contemporary problems.

While the mainstreaming of the far right is attracting growing scholarly interest based on its contemporary relevance, the role that far-right self-representation strategies play in this process has seen limited engagement. In this article, we argue that far-right actors employ a post-fascist logic to bring their ideas closer to the mainstream. This logic rests on a dual message, whereby they attempt to outwardly distance themselves from fascism while at the same time recontextualising fascist ideas. To explore these dynamics, we use (...) a mixed-methods approach to discourse analysis to examine far-right social media posts during the 2022 Italian general election. Taking all Facebook, Instagram and Twitter posts during the official campaigning period from the party and leader accounts of Lega per Salvini Premier and Fratelli d’Italia, we explored articulations of the post-fascist dyad within this context. Our findings underscore how both far-right parties ridiculed accusations of fascism and depicted themselves as ‘centre-right’, yet they commonly used fascist dog-whistles and violent anti-immigration discourse to construct a broader conspiracy narrative and portray themselves as Italy's saviour. While Italy proves a paradigmatic case, this research has wider implications for the need to explore the relationship between self-representation and mainstreaming. (shrink)

It was also the first Venezuelan film to feature a kiss between two men, as well as an openly transgender character. At the heart of the film is a scene which cross-cuts between transsexual Delirio performing the 1980s Venezuelan pop hit ‘No soy una señora’ and a vicious homophobic attack. This scene exemplifies the film’s preoccupation with the performance of gender, (...) its denunciation of machista violence, and its call for acceptance of difference. (shrink)

The search for the statistical mechanical underpinning of thermodynamic irreversibility has so far focussed on the spontaneous approach to equilibrium. But this is the search for the underpinning of what Brown and Uffink have dubbed the ‘minus first law’ of thermodynamics. In contrast, the second law tells us that certain interventions on equilibrium states render the initial state ‘irrecoverable’. In this article, I discuss the unusual nature of processes in thermodynamics, and the type of irreversibility that the second law (...) embodies. I then search for the microscopic underpinning or statistical mechanical ‘reductive basis’ of the second law of thermodynamics by taking a functionalist strategy. First, I outline the functional role of the thermodynamic entropy: for a thermally isolated system, the thermodynamic entropy is constant in quasi-static processes, but increasing in non-quasi-static processes. I then search for the statistical mechanical quantity that plays this role—rather than the role of the traditional ‘holy grail’ as described by Callender. I argue that in statistical mechanics, the Gibbs entropy plays this role. (shrink)

Recent critics (Andrew Light, Bryan Norton, Anthony Weston, and Bruce Morito, among others) have argued that we should give up talk of intrinsic value in general and that of nature in particular. While earlier theorists might have overestimated the importance of intrinsic value, these recent critics underestimate its importance. Claims about a thing’s intrinsic value are claims about the distinctive way in which we have reason to care about that thing. If we understand intrinsic value in this manner, we can (...) capture the core claims that environmentalists want to make about nature while avoiding the worries raised by contemporary critics. Since the distinction between intrinsic and extrinsic value plays a critical role in our understanding of the different ways that we do and should care about things, moral psychology, ethical theory in general, and environmental ethics in particular shouldn’t give up on the concept of intrinsic value. This book explores the nature, value, and role of hope in human life under conditions of oppression. Oppression is often a threat and damage to hope, yet many members of oppressed groups, including prominent activists pursuing a more just world, find hope valuable and even essential to their personal and political lives. This book offers a unique evaluative framework for hope that captures the intrinsic value of hope for many of us, the rationality and morality of hope, and ultimately how (...) we can hope well in the non-ideal world we share. It develops an account of the relationship between hope and anger about oppression and argues that anger tends to be accompanied by hopes for repair. When people’s hopes for repair are not realized, as is often the case for those who are oppressed, anger can evolve into bitterness: a form of unresolved anger involving a loss of hope that injustice will be sufficiently acknowledged and addressed. But even when all hope might seem lost or out of reach, faith can enable resilience in the face of oppression. Spiritual faith, faith in humanity, and moral faith are part of what motivates people to join in solidarity against injustice, through which hope can be recovered collectively. Joining with others who share one’s experiences or commitments for a better world, and uniting with them in collective action, can restore and strengthen hope for the future when hope might otherwise be lost. The 2004 Canadian Assisted Human Reproduction Act bans commercial contract pregnancy and egg provision, but Canadians undertake cross-border reproductive travel to access these services. Feminist bioethicists have argued that the ethical justification for enforcing the ban domestically, namely exploitation, grounds its extraterritorial enforcement. I raise an additional problem when Global Southern or low-income countries are destinations for travel: neocolonialism. Further, I argue that a ban on commercialized reproduction is problematic. Although well-suited to address neocolonial forces of exploitation and commodification, a (...) ban reinforces neocolonialism by paying insufficient attention to the agency of gestational laborers and egg providers. This article is about the special, subjective concepts we apply to experience, called “phenomenal concepts”. They are of special interest in a number of ways. First, they refer to phenomenal experiences, and the qualitative character of those experiences whose metaphysical status is hotly debated. Conscious experience strike many philosophers as philosophically problematic and difficult to accommodate within a physicalistic metaphysics. Second, PCs are widely thought to be special and unique among concepts. The sense that there is something special about PCs (...) is very closely tied up with features of the epistemic access they afford to qualia. When we deploy phenomenal concepts introspectively to some phenomenally conscious experience as it occurs, we are said to be acquainted with our own conscious experiences. Accounts of PCs either have to explain the acquaintance relation, or acquaintance with our phenomenal experiences has to be denied. PCs have received much attention in recent philosophy of mind mainly because they figure in arguments for dualism and in physicalist responses to these arguments. The main topic of this paper is to explore different accounts of phenomenal concepts and their role in recent debates over the metaphysical status of phenomenal consciousness. (shrink)

Background: Exploring the concept of ethical competence in the context of healthcare is essential as it pertains to better quality of care. The concept still lacks a comprehensive definition covering the aspects of ethical expertise, ethical knowledge and action of a health professional. Objective: This article aims to report an analysis of the concept of ethical competence. Method: A modified strategy suggested by Walker and Avant was used to analyse the concept. Results: As a result, the concept of ethical competence (...) can be defined in terms of character strength, ethical awareness, moral judgement skills and willingness to do good. Virtuous professional, experience of a professional, human communication, ethical knowledge and supporting surroundings in the organisation can be seen as prerequisites for ethical competence. Ethical competence results in the best possible solutions for the patient, reduced moral distress at work and development and democratisation of society. Conclusion: The results of the analysis establish a basis for an instrument to evaluate health professionals’ ethical competence. It will guide educators, as well as managers in healthcare, to support the development of ethical conduct in healthcare. (shrink)

The Bayesian maxim for rational learning could be described as conservative change from one probabilistic belief or credence function to another in response to newinformation. Roughly: ‘Hold fixed any credences that are not directly affected by the learning experience.’ This is precisely articulated for the case when we learn that some proposition that we had previously entertained is indeed true (the rule of conditionalisation). But can this conservative-change maxim be extended to revising one’s credences in response to entertaining propositions or (...) concepts of which one was previously unaware? The economists Karni and Vierø (2013, 2015) make a proposal in this spirit. Philosophers have adopted effectively the same rule: revision in response to growing awareness should not affect the relative probabilities of propositions in one’s ‘old’ epistemic state. The rule is compelling, but only under the assumptions that its advocates introduce. It is not a general requirement of rationality, or so we argue. We provide informal counterexamples. And we show that, when awareness grows, the boundary between one’s ‘old’ and ‘new’ epistemic commitments is blurred. Accordingly, there is no general notion of conservative change in this setting. This article defends an account of collective hope that arises through solidarity in the pursuit of justice. I begin by reviewing recent literature on the nature of hope. I then explore the relationship between hope and solidarity to demonstrate the ways in which solidarity can give rise to hope. I suggest that the hope born of solidarity is collective when it is shared by at least some others, when it is caused or strengthened by activity in a collective action setting, (...) and when the reciprocal hopeful expressions of individual group members result in an emotional atmosphere of hope that extends across the group. In the context of social movements, collective hope emerges alongside the collective intentions and actions of the solidarity group; namely, in the pursuit of a form of social justice that inspires the movement. I then suggest that the object of collective hope born of solidarity is the guiding ideal of justice and reflect on what it might mean to hope well for justice. (shrink)

While holist views such as ecocentrism have considerable intuitive appeal, arguing for the moral considerability of ecological wholes such as ecosystems has turned out to be a very difficult task. In the environmental ethics literature, individualist biocentrists have persuasively argued that individual organisms—but not ecological wholes—are properly regarded as having a good of their own . In this paper, I revisit those arguments and contend that they are fatally flawed. The paper proceeds in five parts. First, I consider some problems (...) brought about by climate change for environmental conservation strategies and argue that these problems give us good pragmatic reasons to want a better account of the welfare of ecological wholes. Second, I describe the theoretical assumptions from normative ethics that form the background of the arguments against holism. Third, I review the arguments given by individualist biocentrists in favour of individualism over holism. Fourth, I review recent work in the philosophy of biology on the units of selection problem, work in medicine on the human biome, and work in evolutionary biology on epigenetics and endogenous viral elements. I show how these developments undermine both the individualist arguments described above as well as the distinction between individuals and wholes as it has been understood by individualists. S was 38 and diagnosed with ovarian cancer. She and her husband were high school sweethearts, and she had a young son and a daughter. She had been told that there was no cure for her cancer, and at the point of meeting her, very little was able to (...) be done to manage her symptoms.As a mother of a young daughter, I was humbled by the question she asked me. Her daughter was 12 and was just beginning to learn about becoming a woman. The anticipatory grief of not having the opportunities to care for one's own children in the crucial moments of their development was devastating to S. Her ability to name what she grieves the most was profoundly sad to me and the other team members who witnessed it.As a palliative care chaplain, I am used to sad and tragic cases, but this one felt different. S and I had [End Page 80] a lot in common. I am also 38, married to my high school sweetheart, and I have a son and a daughter. Of course, it was not just these reasons that I felt a connection to S. It was also the tangible despair I felt when I was with her. As a chaplain, I am trained to meet people where they are and not to hurry them from a place of despair and anguish. I visited with S nine different times and watched the progression of her existential distress. Her distress was not always linear. Some days, it took a backseat and other days, it was front and center, but I was there to be a witness to whatever she was thinking and feeling, and a lot of times, it was inexpressible grief.S did not want to meet with "palliative care" initially. She was terrified of her diagnosis and believed that there were treatments that would give her back the life she desired. She was fierce and determined. S was also religious and believed that there was a miraculous cure for her that would allow her the time she desired to spend with her children and her husband. S was a softball mom and loved to watch her daughter play. While in the hospital, she missed many games, and this weighed on her.Along with being an athlete, S's daughter was very artistic and made S a bouquet of paper flowers. Each flower contained an encouraging phrase. S opened one while I was in her room. She had lost her hair, much of her body weight, and was wearing a hospital gown, but when she opened the flower, her daughter had written, "You are beautiful, Mom." In that moment, two 38-year-old women understood that beauty transcends outward appearances. S was beautiful: her story, her life, and her courage.S loved to walk around the hallway of her unit. I think she felt if she could keep moving, she could stay alive. She was able to take a walk outside a few times while she was inpatient and getting fresh air was very positive to her. These walks not only gave her the ability to widen her environmental space, but they also gave her space to think and consider the difficult situation she was faced with. I accompanied her on one of her walks. It was while we walked next to each other that she was able to finally share with me that she was afraid. She told me that the fear of not getting home, and the fear of death was overwhelming. I find that sometimes people can be vulnerable when they are not feeling interrogated by a medical team staring at them as they lay in a hospital bed. The "normal" activity of taking a walk and being side-by-side humanized the experience and I think S felt that at that moment, she could talk to me human-to-human—like friend-to-friend.When S finally decided to go home on hospice, I collected some legacy project supplies. I focus my discussion on the well-known Ellsberg paradox. I find good normative reasons for incorporating non-precise belief, as represented by sets of probabilities, in an Ellsberg decision model. This amounts to forgoing the completeness axiom of expected utility theory. Provided that probability sets are interpreted as genuinely indeterminate belief, such a model can moreover make the “Ellsberg choices” rationally permissible. Without some further element to the story, however, the model does not explain how an agent may come to have (...) unique preferences for each of the Ellsberg options. Levi holds that the extra element amounts to innocuous secondary “risk” or security considerations that are used to break ties when more than one option is rationally permissible. While I think a lexical choice rule of this kind is very plausible, I argue that it involves a greater break with xpected utility theory than mere violation of the ordering axiom. (shrink)

On most understandings of what an ecosystem is, it is a kind of thing that can be literally, not just metaphorically, healthy or unhealthy. Health is best understood as a kind of well-being; a thing’s health is a matter of retaining those structures and functions that are good for it. While it is true both that what’s good for an ecosystem depends on how we define the system and that how we define the system depends on our interests, these facts (...) do not force us to the conclusion that an ecosystem has no good of its own. Ecosystems and persons can have goods of their own in spite of the fact that the schemes we use to categorize them are matters that we decide upon. (shrink)

On Tuesday evenings at New York University School of Medicine, the anatomy lab is transformed into an art studio. Medical students gather with a spirit of creative enterprise and a unique goal: to turn anatomy into art. They are participants in Art & Anatomy, an innovative drawing course within the Master Scholars Program in Humanistic Medicine —a component of NYUSoM, which offers elective courses across a range of interdisciplinary topics in medical humanities. Art & Anatomy has had approximately four hundred (...) fifty participants since its inception in 2009. The educational intention of the course is to use drawing as an active mode of learning that enhances visual-perceptual ability and three-dimensional spatial understanding of the body's interior; however, the course also opens a creative space for participants to process the emotional complexities of cadaver dissection and the anatomy lab experience. The anatomy lab can be the training ground for clinical detachment, but many U.S. medical schools are beginning to attend more closely to the emotional aspects of dissection. The authors maintain that the inherently expressive nature of drawing makes the Art & Anatomy course a novel and effective approach to this endeavor. This paper aims to provide a brief overview of the ethical challenges facing researchers engaging with web archival materials and demonstrates a framework and method for conducting research with historical web data created by young people.,This paper’s methodology is informed by the conceptual framing of data materials in research on the “right to be forgotten” (Crossen-White, 2015; GDPR, 2018; Tsesis, 2014), data afterlives (Agostinho, 2019; Stevenson and Gehl, 2019; Sutherland, 2017), indigenous data sovereignty and governance (Wemigwans, 2018) and feminist ethics (...) of care (Cifor et al., 2019; Cowan, 2020; Franzke et al., 2020; Luka and Millette, 2018). Richard Rudner famously argues that the communication of scientific advice to policy makers involves ethical value judgments. His argument has, however, been rightly criticized. This article revives Rudner’s conclusion, by strengthening both his lines of argument: we generalize his initial assumption regarding the form in which scientists must communicate their results and complete his ‘backup’ argument by appealing to the difference between private and public decisions. Our conclusion that science advisors must, for deep-seated pragmatic reasons, make value judgments is further (...) bolstered by reflections on how the scientific contribution to policy is far less straightforward than the Rudner-style model suggests. In this paper, we present a particular role for abductive reasoning in law by applying it in the context of an argumentation scheme for practical reasoning. We present a particular scheme, based on an established scheme for practical reasoning, that can be used to reason abductively about how an agent might have acted to reach a particular scenario, and the motivations for doing so. Plausibility here depends on a satisfactory explanation of why this particular agent followed these motivations in the (...) particular situation. The scheme is given a formal grounding in terms of action-based alternating transition systems and we illustrate the approach with a running legal example. We argue that concerns about double-counting—using the same evidence both to calibrate or tune climate models and also to confirm or verify that the models are adequate—deserve more careful scrutiny in climate modelling circles. It is widely held that double-counting is bad and that separate data must be used for calibration and confirmation. We show that this is far from obviously true, and that climate scientists may be confusing their targets. Our analysis turns on a Bayesian/relative-likelihood approach to incremental confirmation. We go on to discuss plausible difficulties with calibrating climate models, and we distinguish more and less ambitious notions of confirmation. There are at least two plausible generalisations of subjective expected utility (SEU) theory: cumulative prospect theory (which relaxes the independence axiom) and Levi’s decision theory (which relaxes at least ordering). These theories call for a re-assessment of the minimal requirements of rational choice. Here, I consider how an analysis of sequential decision making contributes to this assessment. I criticise Hammond’s (Economica 44(176):337–350, 1977; Econ Philos 4:292–297, 1988a; Risk, decision and rationality, 1988b; Theory Decis 25:25–78, 1988c) ‘consequentialist’ argument for the SEU (...) preference axioms, but go on to formulate a related diachronic-Dutch-book-style’ argument that better achieves Hammond’s aims. Some deny the importance of Dutch-book sure losses, however, in which case, Seidenfeld’s (Econ Philos 4:267–290, 1988a) argument that distinguishes between theories that relax independence and those that relax ordering is relevant. I unravel Seidenfeld’s argument in light of the various criticisms of it and show that the crux of the argument is somewhat different and much more persuasive than what others have taken it to be; the critical issue is the modelling of future choices between ‘indifferent’ decision-tree branches in the sequential setting. Finally, I consider how Seidenfeld’s conclusions might nonetheless be resisted. (shrink)

In this paper, we develop a novel response to counterfactual scepticism, the thesis that most ordinary counterfactual claims are false. In the process we aim to shed light on the relationship between debates in the philosophy of science and debates concerning the semantics and pragmatics of counterfactuals. We argue that science is concerned with many domains of inquiry, each with its own characteristic entities and regularities; moreover, statements of scientific law often include an implicit ceteris paribus clause that restricts the (...) scope of the associated regularity to circumstances that are ‘fitting’ to the domain in question. This observation reveals a way of responding to scepticism while, at the same time, doing justice both to the role of counterfactuals in science and to the complexities inherent in ordinary counterfactual discourse and reasoning.
