The Gita at first appears to be a series of explanations of various kinds of yoga strung together in no apparent order, and several of its claims and arguments seem to contradict one another. I argue that the apparent contradictions disappear if we see the arguments as related to one another dialectically rather than analytically. From an analytic perspective contradictions are either merely verbal and can be disambiguated by a conceptual distinction, or else they render the statement meaningless. Interpretation of theAgamemnonin general and of its first choral sequence in particular has tended to proceed on two assumptions: first, that Aeschylus could have given an answer to the question, ‘Was Agamemnon free to choose whether or not to sacrifice his daughter?’; and secondly, that he composed the play in such a way that if we try hard enough we can discover his answer. I submit in this paper an interpretation which replaces both these assumptions with an alternative trio of (...) hypotheses for which, I think, a case can be made: first, that Aeschylus was well aware that in real life we cannot know the extent to which an agent was able to choose whether or not to commit a particular act; secondly, that inAg.104–257 he has portrayed realistically the manner in which people respond to the commission of an extraordinary and disagreeable act by a respected agent; and thirdly, that the aspect of Agamemnon's predicament which made the most powerful impression on Aeschylus and his audience is an aspect to which modern interpreters of the play have seldom alluded even by implication. I would not be so rash as to assert that Aeschylus never concerned himself with the question of responsibility, nor that his concepts of justice and retribution are of small interest, but I am not satisfied that ‘with all the powers of his mind’, as Professor Lesky puts it, ‘he wrestled with the problem arising from the conflict between human existence and divine rule’, nor do I take the view that a dramatist passionately involved in metaphysics and theology is a wiser and greater man than one who devotes the powers of his mind to concrete problems of poetic and theatrical technique. The scale of values adopted by interpreters of early Greek tragedy has certainly been affected, and has perhaps been somewhat distorted, by the dominant position of philosophy in European culture and education. I argue that a certain initially appealing Fregean conception of our shared semantic competence in our shared language cannot be made good. In particular, I show that we must reject two fundamental Fregean principles‐what I call Frege's Adequacy Condition and what I call Frege's Cognitive Constraint on Reference Determination. Frege's adequacy condition says that in an adequate semantic theory, sentence meanings must have the same fineness of grain as attitude contents. The Cognitive Constraint on Reference Determination says that in an (...) adequate semantic theory mechanisms of reference determination will fix routes of epistemic access to referents and will mediate one‐sided recognition judgments about referents. I argue against Frege's adequacy condition that if meanings are sliced as finely as it requires there will be too many meanings to go around. I argue against the cognitive constraint on reference determination that even in an adequate theory of reference, mechanisms of reference determination must be sharply distinguished from routes of epistemic access. If so, we have little reason to expect an adequate theory of reference determination to directly illuminate Frege's cognitive puzzles or be sufficient to explain the basis of our one‐sided recognition judgments. Purpose– The purpose of this paper is to present a novel mnemonic, ACTIVE, inspired by Mason's 1985 PAPA mnemonic, which will help researchers and IT professionals develop an understanding of the major issues in information ethics.Design/methodology/approach– Theoretical foundations are developed for each element of the mnemonic by reference to philosophical definitions of the terms used and to virtue ethics, particularly MacIntyrean virtue ethics. The paper starts with a critique of the elements of the PAPA mnemonic and then proceeds to develop (...) an understanding of each of the elements of ACTIVE ethics, via a discussion of the underpinning virtue ethics.Findings– This paper identifies six issues, described by the mnemonic, ACTIVE. ACTIVE stands for: autonomy, the ability of the individual to manage their own information and make choice; community, the ethical effect of an information systems on the community which it supports; transparency, the extent to which the derivation of content and process in an information system is made clear; identity, the social and ethical effect of an information system on the definition and maintenance of the distinctive characteristics of a person; value, the value or moral worth placed on information associated with an individual and hence on the relationship with the individual; and empathy, the ability of the information systems professional to emotionally connect with the user and the extent to which the information system distances or connects.Originality/value– The paper applies virtue ethics to developing a tool to help information professionals reflect on their ethical practice in developing and supporting information systems. In this brief essay, I attempt to reply to Wilfrid Waluchow’s critique of my positivist theory of legal obligation, which appear in his contribution to this volume, Lessons from Hart. Waluchow argues, with insight and elegance, that my theory fails to distinguish between the internal and external point of view, and gives an account of legal obligation from the external point of view. I attempt to rebut this interesting criticism by arguing that the distinction between the internal and external point (...) of view was made inside Hart’s analysis of the concepts central to law, and that I am attempting to give an account from the same point of view that Hart takes when he analyzes legal concepts —that of the methodology of traditional conceptual analysis.Resumen:En este breve ensayo, intento responder a la crítica de Wilfrid Waluchow sobre mi teoría positivista de la obligación jurídica, crítica que aparece en su colaboración de este número, Lessons from Hart. Waluchow sostiene, con perspicacia y elegancia, que mi teoría fracasa al no distinguir entre el punto de vista interno y externo, y que ofrece una explicación de la obligación jurídica desde el punto de vista externo. Intento refutar esta interesante crítica al argumentar que la distinción entre el punto de vista interno y externo fue hecho dentro del análisis de Hart de los conceptos centrales del derecho y que yo intento proporcionar una explicación desde el mismo punto de vista que toma Hart cuando analiza conceptos jurídicos, el de la metodología tradicional del análisis conceptual. The Eurozone crisis has triggered profound political and economic changes across the debtor member states. This article shows how the crisis and the imposition of austerity policies by the Troika have forced Spain to pursue internal devaluation as a means of economic adjustment through the reduction of real wages, increased pressure for liberalizing labor market institutions, and given Spain’s conservative government the opportunity and cover to pursue radical neoliberal labor law reforms. Spain’s 2012 labor law reforms went well beyond external (...) demands. The crisis and the Troika’s policy demands generated mass unemployment, devastated Spain’s Socialist Party, and created the enabling conditions for economic reforms. But domestic partisan considerations led the conservative People’s Party to commandeer the crisis to weaken unions as the electoral and organizational base of the center-left opposition. The PP channeled reform into an attack on labor that decisively shifted power to employers. As organized labor relations were reduced to concession bargaining, real wages have plummeted for the vast majority of Spaniards, even as mass unemployment and economic stagnation persist. Analysis suggests the emergence of a winner-take-all economy that will have lasting consequences for the Eurozone and the European Union. (shrink)

The notion that Hegel repudiated epistemology has had dire consequences for our understanding of Hegel. By disregarding epistemology, Hegel’s expositors often disregarded the general issues central to epistemology of how one can establish or justify a philosophical view. If Hegel did address epistemological issues and tried to justify (not simply to expound) ‘absolute knowledge’, then that disregard would produce skewed interpretations of Hegel. Recent attention to Hegel’s epistemology (e.g., by Klaus Hartmann, Joseph Flay, Robert Pippin, Michael Forster, Terry Pinkard, and (...) Justus Hartnack) is salutary. However, I argue that most of these efforts founder by making key assumptions about epistemology that Hegel clearly rejects. Moreover, many of these efforts exhibit hermeneutic defects that Hegel scholars should consider carefully; most of these interpretations are long on interpretive promise but short on philosophical delivery.
