William Roche and Elliott Sober argue that explanatoriness is evidentially irrelevant. This conclusion is surprising since it conflicts with a plausible assumption—the fact that a hypothesis best explains a given set of data is evidence that the hypothesis is true. We argue that Roche and Sober's screening-off argument fails to account for a key aspect of evidential strength: the weight of a body of evidence. The weight of a body of evidence affects the resiliency of probabilities in the (...) light of new evidence. Thus, Roche and Sober are mistaken. Explanatoriness is evidentially relevant. (shrink)

This article proposes to elucidate Wilfrid Waluchow’s notion of constitutional morality by explaining how it relates to the classical common law idea of artificial reason. It examines how Waluchow’s effort to reconcile insights from the thought of H.L.A. Hart and Ronald Dworkin through the idea of constitutional morality is both reminiscent of the artificial reason of the common law and distinct from it. It shows that constitutional morality evokes the subtle union of custom and reason found in artificial reason, but (...) also that it proposes, under the influence of Hart’s notion of rule of recognition, a narrower understanding of law’s foundation in established practices, and that it gives, consistent with Dworkin’s vision of law as integrity, a greater theoretical scope to law’s rationality. Husserl seems to have devoted roughly equal amounts of energy and pages to the description of perception, judgement, and imagination. By “description,” he meant the analysis of the traits and components of mental states or acts and their objects. As his views changed over the years about the nature of intentionality and philosophy, the descriptive psychology of the Logical Investigations (1900/01) gave way to descriptive programmes in which the objects of perception and of judgement were conceived of in terms of (...) a new, analytic framework; in particular Husserl lost interest in describing the things and processes in the real world that are the objects of perception and judgement and so too in describing their relations to these acts. His new analytic framework, particularly as it applies to perception, has been thoroughly expounded and discussed in the literature. My aim here is to expound Husserl's first descriptions of perception within the framework of the Investigations and to incorporate as far as possible his later descriptive results to the extent that these are separable from his later turn to idealism. In contemporary philosophy of science many theories of explanation are rooted in positivist or post-positivists accounts of explanation. This paper attempts to ground a phenomenological account of scientific explanation by using the works of Werner Heisenberg and Patrick Heelan. To explain something for Heisenberg is to describe what can be intersubjectively observed and conceptualized in an adequate language. However, this needs to be qualified, as not any adequate account will do. While Heisenberg thinks that Kant is right to think that (...) a priori concepts are the conditions which make science, and thus explanation, possible, he also believes pure a priori concepts have a limited range of applicability. Neils Bohr shared this belief with Heisenberg, but thinks human thought can go no further. However, Heisenberg never gave up on the idea that we could create new concepts that act as a priori grounds for quantum entities. To go beyond Heisenberg, I believe that we should look to Husserl’s account of Evidenz and the material a priori to help us think about a phenomenological account of explanation. (shrink)

Phenomenology was in large part the discovery of Edmund Husserl, whose Logical Investigations of 1900/01 are normally regarded as the work that launched the phenomenological movement. Yet Husserl's phenomenology, in particular in the form in which it is set out in this his most important contribution to philosophy, is itself part of an Austrian philosophical tradi tion inspired by Brentano and continued, in very different ways, by Meinong, Stumpf, Twardowski, Ehrenfels, Husserl - and Marty. Like Brentano and all his heirs (...) Marty's philosophical interests were in the philosophy of mind, where this is taken to include or at least ground the philosophy of language, and analytic metaphysics. It is Marty's discussions of topics in these two areas that provide the contributions to this volume with their subject-matter. The papers by Roderick Chisholm, S. -Y. It is widely thought in philosophy and elsewhere that parsimony is a theoretical virtue in that if T1 is more parsimonious than T2, then T1 is preferable to T2, other things being equal. This thesis admits of many distinct precisifications. I focus on a relatively weak precisification on which preferability is a matter of probability, and argue that it is false. This is problematic for various alternative precisifications, and even for Inference to the Best Explanation as standardly understood.

This chapter presents what people think about God and how one should act in this world. It discusses how people should pray, and that, if possible, one could pray through poetry. It also discusses why poetry is considered as sacrament, on how its writings reflect one's belief. It focuses on “Lachrimae”, a poem that exemplifies sacramental manner.

In his second appearance to Aeneas in Aeneid 4 Mercury drives the hero to flee Carthage with a false allegation that Dido is planning an attack, capping his warning with an infamous sententia about the mutability of female emotion. Building on a previous suggestion that Mercury's first speech to Aeneas is modelled on Athena's admonishment of Telemachus at the opening of Odyssey 15, this article proposes that Mercury's second speech as well is modelled on Athena's warning, in which the goddess (...) uses misdirection about Penelope's intentions and a misogynistic gnōmē about the changeability of women's affections to spur Telemachus’ departure from Sparta. After setting out how Virgil divides his imitation of Athena's speech verbally and thematically between Mercury's two speeches, the discussion turns to why both Athena and Mercury adopt these deceptive tactics. The speeches are shown to be culminations of the poets’ similar approaches to creating doubt and foreboding around the queens’ famed capacities for using δόλος. Common features in the ensuing hasty departures of Telemachus and Aeneas further confirm Virgil's use of Odyssey 15 in devising Aeneas’ escape from Carthage. (shrink)

Among contemporary liberal political theorists in the West, there appears to be a standoff between two camps. One camp promotes tighter social bonds through collective responsibility and patriotic fellow-feeling while the other insists on the need for relaxed social bonds through respect for individual freedom. This essay shows how two Vietnamese thinkers—Ho Chi Minh (1872–1969) and Nguyen Manh Tuong (1909–1997)—can help move this intractable debate about collective responsibility and individual freedom beyond statements of principle to a more pragmatic discussion of (...) what should be done to maintain a healthy polity. They present an alternative to the static standoff, arguing that dynamic oscillation between two activities can forge national fraternal solidarity while also respecting individual freedom when the needs arise: ‘criticism and self-criticism' which tightens social bonds, and ‘liberal self-exploration' which relaxes social bonds. This paper is the second phase of a project that was begun more than three years ago. The first phase culminated in the publication of a paper working toward a critical appropriation of Aristotle’s Nicomachean Ethics.1 Therein Aristotle famously argues that human wellbeing (eudaimonia) is constituted by “activity of the soul in accordance with moral and intellectual virtue.”2 This earlier paper brought into focus all the main lines of Aristotle’s theoretical web in the N. Ethics: including the nature of the (...) soul, intellectual virtue, moral virtue, etc. That paper went on to give a developed critique of Aristotle’s theoretical web, and against that background it argued for a very different way of thinking about intellectual virtue, and it prepared the ground for different ways of thinking about moral virtue. This current paper explores the various conceptual understandings of “the mean” in Aristotelian and in Confucian thought. It begins with an explanatory sketch of “the mean” as understood in Aristotle’s Nicomachean Ethics, and then in a second section goes on to explore “the mean” as presented in classical Confucianism. The third section of this paper offers some reflections oriented toward a tentative formulation of a modified conception of “the mean” as it might be construed from a humanistic Marxist perspective. This essay explores the adventures of the word “without” in Jacques Derrida's work from the mid-1970s until his death. It is argued that Derrida comes to Yale primarily with a new reading of Kantian formalism in mind and that this in part explains both the ready acceptance and the resistance he found at Yale. It is further argued that by the time Derrida left Yale in the mid-1980s, the word “without” was serving a new end: ethics and religion. And yet (...) Derrida remained Kantian in his main emphases. This is a working paper that presents the first phase of what will eventually be a huge project, namely a critical appropriation of Aristotle’s Nicomachean Ethics. Early on it provides a sketch of the main strands of Aristotle’s theoretical web in his N. Ethics. Following that, the paper offers some critical commentary concerning some of Aristotle’s main positions: especially his views on moral virtue, the soul, intellectual virtue, and human well-being. The paper then turns to the development of some significantly (...) different ways of construing both intellectual virtue as well as moral virtue. With respect to intellectual virtue, I present my own perspective in interconnection with a process-oriented way of understanding reality, as opposed to Aristotle’s substance-oriented way. With respect to moral virtue, I present my interpretation in relation to a thisworldly understanding of the human spirit/soul, as well as a humanistic-Marxist interpretation of human well-being. Toward the paper’s end, I offer some suggestions concerning a modified “doctrine of the mean” that would be a sort of critical synthesis of the views of Aristotle and Confucius. (shrink)

This article describes recent jurisprudential accountsof analogical legal reasoning andcompares them in detail to the computational modelof case-based legal argument inCATO. The jurisprudential models provide a theoryof relevance based on low-levellegal principles generated in a process ofcase-comparing reflective adjustment. Thejurisprudential critique focuses on the problemsof assigning weights to competingprinciples and dealing with erroneously decidedprecedents. CATO, a computerizedinstructional environment, employs ArtificialIntelligence techniques to teach lawstudents how to make basic legal argumentswith cases. The computational modelhelps students test legal hypotheses againsta database of (...) legal cases, draws analogiesto problem scenarios from the database, andcomposes arguments by analogy with a setof argument moves. The CATO model accountsfor a number of the important featuresof the jurisprudential accounts, includingimplementing a kind of reflective adjustment.It also avoids some of the problems identifiedin the critique; for instance, it deals withweights in a non-numeric, context-sensitivemanner. The article concludes by describingthe contributions AI research can make tojurisprudential investigations of complexcognitive phenomena of legal reasoning. Forinstance, unlike the jurisprudential models,CATO provides a detailed account of how togenerate multiple interpretations of a citedcase, downplaying or emphasizing the legalsignificance of distinctions in terms of thepurposes of the law as the argument contextdemands. Although theories that examine direct links between behavior and brain remain incomplete, it is known that brain expansion significantly correlates with caloric and oxygen demands. Therefore, one of the principles governing evolutionary cognitive neuroscience is that cognitive abilities that require significant brain function (and/or structural support) must be accompanied by significant fitness benefit to offset the increased metabolic demands. One such capacity is self-awareness (SA), which (1) is found only in the greater apes and (2) remains unclear in terms of (...) both cortical underpinning and possible fitness benefit. In the current experiment, transcranial magnetic stimulation (TMS) was applied to the prefrontal cortex during a spatial perspective-taking task involving self and other viewpoints. It was found that delivery of TMS to the right prefrontal region disrupted self-, but not other-, perspective. These data suggest that self-awareness may have evolved in concert with other right hemisphere cognitive abilities. (shrink)

This essay consists of responses to several papers on my book *Kingdoms of God.*.

We seem to enjoy a special kind of access to our beliefs. We seem able to know about them via a distinctively first-personal method, and such knowledge seems epistemically superior to any knowledge that others might attain of our beliefs. This paper defends a novel account of this access. The account is extrospective in that it explains this access in terms of our ability to think about the (non-mental) world. Moreover, it does not require the contentious claim that judging that (...) p suffices for coming to believe that p. This is a significant strength of the account. (shrink)

Christian Ethics and Commonsense Morality goes against the grain of various postmodern approaches to morality in contemporary religious ethics. In this book, Jung seeks to provide a new framework in which the nature of common Christian moral beliefs and practices can be given a new meaning. He suggests that, once major philosophical assumptions behind postmodern theories of morality are called into question, we may look at Christian morality in quite a different light. On his account, Christian morality is a historical (...) morality insofar as it is rooted in the rich historical traditions of the Christian church. Yet this kind of historical dependence does not entail the evidential dependence of all moral beliefs on historical traditions. It is possible to argue for the epistemic autonomy of moral beliefs, according to which Christian and other moral beliefs can be justified independently of their historical sources. The particularity of Christian morality lies not in its particular historical sources that also function as the grounds of justification, but rather in its explanatory and motivational capacity to further articulate the kind of moral knowledge that is readily available to most human beings and to enable people to act upon their moral knowledge.
