In the last several months, several major disciplines have started their initial reckoning with what ChatGPT and other Large Language Models (LLMs) mean for them – law, medicine, business among other professions. With a heavy dose of humility, given how fast the technology is moving and how uncertain its social implications are, this article attempts to give some early tentative thoughts on what ChatGPT might mean for bioethics. I will first argue that many bioethics issues raised by ChatGPT are similar (...) to those raised by current medical AI – built into devices, decision support tools, data analytics, etc. These include issues of data ownership, consent for data use, data representativeness and bias, and privacy. I describe how these familiar issues appear somewhat differently in the ChatGPT context, but much of the existing bioethical thinking on these issues provides a strong starting point. There are, however, a few “new-ish” issues I highlight – by new-ish I mean issues that while perhaps not truly new seem much more important for it than other forms of medical AI. These include issues about informed consent and the right to know we are dealing with an AI, the problem of medical deepfakes, the risk of oligopoly and inequitable access related to foundational models, environmental effects, and on the positive side opportunities for the democratization of knowledge and empowering patients. I also discuss how races towards dominance (between large companies and between the U.S. and geopolitical rivals like China) risk sidelining ethics. (shrink)

Timothy Williamson has fruitfully exploited formal resources to shed considerable light on the nature of knowledge. In the paper under examination, Williamson turns his attention to Gettier cases, showing how they can be motivated formally. At the same time, he disparages the kind of justification he thinks gives rise to these cases. He favors instead his own notion of justification for which Gettier cases cannot arise. Libertarian paternalism's notion of “nudging” refers to steering individual decision making so as to make choosers better off without breaching their free choice. If successful, this may offer an ideal synthesis between the duty to respect patient autonomy and that of beneficence, which at times favors paternalistic influence. A growing body of literature attempts to assess the merits of nudging in health care. However, this literature deals almost exclusively with health policy, while the question of the potential benefit of nudging (...) for the practice of informed consent has escaped systematic analysis. This article focuses on this question. While it concedes that nudging could amount to improper exploitation of cognitive weaknesses, it defends the practice of nudging in a wide range of other conditions. The conclusion is that, when ethically legitimate, nudging offers an important new paradigm for informed consent, with a special potential to overcome the classical dilemma between paternalistic beneficence and respect for autonomy. This paper explores the truism that people think about what they say. It proposes that, to satisfy their own goals, people often plan their speech acts to affect their listeners' beliefs, goals, and emotional states. Such language use can be modelled by viewing speech acts as operators in a planning system, thus allowing both physical and speech acts to be integrated into plans. Methodological issues of how speech acts should be defined in a planbased theory are illustrated by defining operators (...) for requesting and informing. Plans containing those operators are presented and comparisons are drawn with Searle's formulation. The operators are shown to be inadequate since they cannot be composed to form questions (requests to inform) and multiparty requests (requests to request). By refining the operator definitions and by identifying some of the side effects of requesting, compositional adequacy is achieved.The solution leads to a metatheoretical principle for modelling speech acts as planning operators. Students of perception have long known that perceptual constancy is an important aspect of our perceptual interaction with the world. Here is a simple example of the phenomenon concerning color perception: there is some ordinary sense in which an unpainted ceramic coffee cup made from a uniform material looks a uniform color when it is viewed under uneven illumination, even though the light reflected by the shaded regions to our eyes is quite different from the light reflected by the unshaded (...) regions to our eyes (see figure 1). Or consider this example concerning size perception: there is some ordinary sense in which two telephone poles look the same size when the first is viewed from 100 meters and when the second is viewed from 1 meter, even though the visual angle subtended by the two poles on our retinae is very different (see figure 2). Or consider this example concerning shape perception: there is some ordinary sense in which a penny looks round both when viewed head on and when viewed from an acute angle, even though the area projected by the penny onto our retinae under these two conditions is very different (see figure 3). The traditional view in epistemology is that we must distinguish between being rational and being right (that is also, by the way, the traditional view about practical rationality). In his paper in this volume, Williamson proposes an alternative view according to which only beliefs that amount to knowledge are rational (and, thus, no false belief is rational). It is healthy to challenge tradition, in philosophy as much as elsewhere. But, in this instance, we think that tradition has it right. “de-extinction” refers to the process of resurrecting extinct species by genetic methods. This science-fiction-sounding idea is in fact already in early processes of scientific implementation. Although this recent “revival of the dead” raises deep ethical questions, the ethics of de-extinction has barely received philosophical treatment. Rather than seeking a verdict for or against de-extinction, this paper attempts an overview and some novel analyses of the main ethical considerations. Five dimensions of the ethics of de-extinction are explored: (a) the possible contribution (...) of de-extinction to promoting ecological values, (b) the deontological argument that we owe de-extinction to species we rendered extinct, (c) the question of “playing God” through de-extinction, (d) the utilitarian perspective, and (e) the role of aesthetic considerations in the ethics of de-extinction. A general feature arising from the paper’s discussion is that, due to de-extinction’s special character, it repeatedly tests the limits of our ethical notions. (shrink)

Research on psychedelic medicines is experiencing a revival. Some clinicians, scientists, and ethicists believe that psychedelics are so different from other treatments that they warrant special consideration in how they are researched, regulated, commercialized, and administered. Others argue that psychedelic medicines show clinical potential, but they should be treated like other medical interventions. In other words, identical standards should apply. This article analyzes whether psychedelic medicines warrant special consideration from a regulatory and ethical perspective.

This paper examines how unethical behavior in the workplace occurs when management places inordinately strong emphasis on goalattainment without a corresponding emphasis on following legitimate procedures. Robert Merton's theory of sodal structure and anomie provides a foundation to discuss this argument. Key factors affecting ethical climates in work organizations are also addressed. Based on this analysis, the paper proposes strategies for developing and changing aspects of organizational culture to reduce anomie, thereby creating work climates which discourage unethical practices and provide (...) employees with mechanisms to resolve ethical conflicts in a constructive way. This paper argues that contrary to what is often thought, virtue for Kant is not just a matter of strength of will; it has an essential affective dimension. To support this claim, I show that certain affective dispositions, namely moral feelings and desires, are virtuous in the sense that they are constitutive of virtue at the affective level. There is thus an intrinsic connection between an agent’s practice of virtue and the cultivation of her affective dispositions.

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

Cases of inexact observations have been used extensively in the recent literature on higher-order evidence and higher-order knowledge. I argue that the received understanding of inexact observations is mistaken. Although it is convenient to assume that such cases can be modeled statically, they should be analyzed as dynamic cases that involve change of knowledge. Consequently, the underlying logic should be dynamic epistemic logic, not its static counterpart. When reasoning about inexact knowledge, it is easy to confuse the initial situation, the (...) observation process, and the result of the observation; I analyze the three separately. This dynamic approach has far reaching implications: Williamson’s influential argument against the KK principle loses its force, and new insights can be gained regarding synchronic and diachronic introspection principles. In a study published in late April in Nature Communications, the authors were able to sustain 105- to 115-day-old premature lamb fetuses—whose level of development was comparable to that of a twenty-three-week-old human fetus—for four weeks in an artificial womb, enabling the lambs to develop in a way that paralleled age-matched controls. The oldest lamb of the set, more than a year old at the time the paper came out, appeared completely normal. This kind of research brings us one step (...) closer to providing excellent quality of life for premature newborns, but it also portends major legal and ethical questions, especially for abortion rights in America. “Medical Tourism” is the travel of residents of one country to another country for treatment. In this article I focus on travel abroad to purchase organs for transplant, what I will call “Transplant Tourism.” With the exception of Iran, organ sale is illegal across the globe, but many destination countries have thriving black markets, either due to their willful failure to police the practice or more good faith lack of resources to detect it. I focus on the sale of kidneys, (...) the most common subject of transplant tourism, though much of what I say could be applied to other organs as well. Part I briefly reviews some data on sellers, recipients, and brokers. Part II discusses the bioethical issues posed by the trade, and Part III focuses on potential regulation to deal with these issues. (shrink)

In addition to the familiar cardinal and proportional readings of many and few, there is yet another interpretation, the relative proportional reading. This reading, unlike the ordinary absolute proportional reading, is not conservative. Under the relative reading, 'Many ψs are φs' is true just in case the proportion of φs among ψs is greater than the proportion of φs among members of contextually given alternatives to ψ. I provide a definition of proportional readings that reduces the differences between absolute and (...) relative interpretations to the value of a single parameter.I argue that relative readings are not restricted to many and few, but are also exhibited by the adverbs often and seldom, and by generics. According to deliberation compatibilism, rational deliberation is compatible with the belief that one’s actions are causally determined by factors beyond one’s control. This paper offers a counterexample to recent accounts of rational deliberation that entail deliberation compatibilism. The counterexample involves a deliberator who believes that whichever action she performs will be the result of deterministic manipulation. It is further argued that there is no relevant difference between the purported counterexample and ordinary doxastic circumstances in which a determinist deliberates.

Perszyk has argued that Molinists cannot consistently endorse the consequence argument because of a structurally similar argument for the incompatibility of true Molinist counterfactuals of freedom and the ability to do otherwise. Wierenga has argued that on the proper understanding of CCFs, there is a relevant difference between the consequence argument and the anti-Molinist argument. I argue that, even on Wierenga’s understanding of CCFs, there is in fact no relevant difference between the two arguments. Jonah N. Schupbach and Jan Sprenger and Vincenzo Crupi and Katya Tentori have recently proposed measures of explanatory power and have shown that they are characterized by certain arguably desirable conditions or axioms. I further examine the properties of these two measures, and a third measure considered by I. J. Good and Timothy McGrew . This third measure also has an axiomatic representation. I consider a simple coin-tossing example in which only the Crupi–Tentori measure does not perform well. This paper argues that Rawls’ principles of justice provide a normative foundation for stakeholder theory. The principles articulate (at an abstract level) citizens’ rights; these rights create interests across all aspects of society, including in the space of economic activity; and therefore, stakeholders – as citizens – have legitimate interests in the space of economic activity. This approach to stakeholder theory suggests a political interpretation of Boatright’s Moral Market approach, one that emphasizes the rights/place of citizens. And this approach to (...) stakeholder theory – in terms of citizens – raises a further question, what rights and obligations do economic agents have, beyond those attached to their roles as citizens? Rawls would reject additional rights and obligations of this sort for two reasons, one tied to freedom and one tied to pluralism. Rawls’ work therefore presses us to re-conceptualize the place of ethical claims in the economic context. (shrink)

: "Conservative" bioethics is informed by a rich view of human personhood, a decent respect for the well-considered views of people across the political spectrum, and a philosophy of the state carefully calibrated to ensure that imperfect people can live together in community. The deepest disagreements between conservatives and liberals are rooted in different ways of understanding the moral ideal of equality.

While opinions on the semantic analysis of generics vary widely, most scholars agree that generics have a quasi-universal flavor. However, there are cases where generics receive what appears to be an existentialinterpretation. For example, B's response is true, even though only theplatypus and the echidna lay eggs: (1) A: Birds lay eggs. B: Mammals lay eggs too. In this paper I propose a uniform account of the semantics of generics,which accounts for their quasi-existential readings as well as for their more (...) familiar quasi-universal ones. Generics are focus-sensitiveoperators: their domain is restricted by a set of alternatives, which may be provided by focus. I claim that, unlike otherfocus-sensitive operators, generics may, but do not have to, associate with focus. When alternatives are introduced, either by focus or by other means, generics get their usual quasi-universal readings. But when no alternatives are introduced, quasi-existential readings result.I argue that generics, unlike adverbs of quantification, do not introduce tripartite structures directly, but are initially interpreted as cases ofdirect kind predication. Only when this interpretation fails to make sense, the phonologically null generic quantifier is derived, and tripartite structures result. This two-level interpretation has the effect that while adverbs of quantification require focus to determine which elements go to the restrictor and which to the nuclear scope, and hence must associate with focus, generics do not, and hence may fail to associate with focus, resulting in quasi-existential readings. Freedom of Religion, Inc.: Whose Sovereignty? This article focuses on an expansive conception of religious freedom propagated by a vocal group of American legal scholars – jurisdictional pluralists – often working with well-funded conservative foundations and influencing accommodation decisions throughout the US. I show that the proliferation of ‘accommodation’ claims in the name of church autonomy and religious conscience entailing exemption from civil regulation and anti-discrimination laws required by justice have a deep structure that has little to do with fairness (...) or inclusion or liberal pluralism. Instead they are tantamount to sovereignty claims, involving powers and immunities for the religious, implicitly referring to another, higher law and sovereign than the constitution or the people. The twenty-first century version of older pluralist ‘freedom of religion’ discourses also rejects the comprehensive jurisdiction and scope of public, civil law – this time challenging the ‘monistic sovereignty’ of the democratic constitutional state. I argue that the jurisdictional pluralist approach to religious freedom challenges liberal democratic constitutionalism at its core and should be resisted wherever it arises. (shrink)
