In his fifth eclogue Candidus the Neo-latin poet Baptista Mantuanus, known in the Renaissance as the “second Virgil”, deals with the poverty of writers and the stinginess of patrons. The dialogue between the sincere-minded poet Candidus, who is frustrated by his hopeless situation, and the rich Silvanus, who gives only empty promises of help, turns out, however, to be futile. As can be demonstrated by the quotations taken mainly from the Roman satirists, Mantuanus makes use of the classical texts as (...) far as they serve his purpose and explicitly displays a subtle view of his various sources. Quoting from classical literature he often compares Candidus, his alter ego, with the victims of Horace, Juvenal and Persius, and frequently transforms the positive aspect of the original into its contrary. This technique emphasizes the needy poet’s self-ironical attitude confirmed by his exaggerated complaints describing his calamity. That is why Candidus appears to be a self-pitying and self-centered character, while, on the other hand, Silvanus represents the specimen of a miser giving nothing but flimsy promises, with the result that the dialogue remains stagnant and ultimately ineffective. We disagree with Juslin & Vll's (J&V's) thesis that music-evoked emotions are indistinguishable from other emotions in both their nature and underlying mechanisms and that music just induces some emotions more frequently than others. Empirical evidence suggests that frequency differences reflect the specific nature of music-evoked emotions: aesthetic and reactive rather than utilitarian and proactive. Additional mechanisms and determinants are suggested as predictors of emotions triggered by music.

This book explores the constitutional, legally binding dimension to legisprudence in the light of the German Federal Constitutional Court's approach to rational lawmaking. Over the last decades this court has been remarkably active in applying legisprudential criteria and standards when reviewing parliamentary laws. It has thus supplied observers with a unique material to analyse the lawmakers' duty to legislate rationally, and to assess the virtues and drawbacks of this strand of judicial control in a constitutional democracy. By bringing together legislation (...) experts and public law scholars to elaborate on 'legisprudence under review', this contributed volume aspires to shed light on the constitutionalisation of rational lawmaking as a controversial trend gaining ground in both national and international jurisdictions. The book is divided into five parts. Part I frames the two key issues pervading the whole collection: the intricate relationship between judicial review and democracy, on the one hand, and the possibility of improving and rationalizing the task of legislation under the current circumstances of politics, on the other. Part II provides an overview of the judicial review of rational lawmaking, laying special emphasis on the duty of legislative justification imposed on lawmakers by the German Constitutional Court. Part III is devoted to the review of the systemic rationality of legislation, in particular to the requirements of legislative consistence and coherence as developed by this court. Contributions in Part IV revolve around the judicial scrutiny of the socio-empirical elements of rational lawmaking, with the control of legislative facts and impacts and the problem of symbolic laws being the central topics. Finally, Part V draws on the German case law to discuss the links between rational lawmaking, balancing and proportionality, and the interdependence between process review and substantive review of legislation. Prvi in drugi del predavanja na splošno obravnavata možnosti in meje medkulturnega sporazumevanja. Pri tem se z vidika temeljnih navad in »globokih razpoloženj« razložijo razlike med kulturnimi svetovi ljudi. Iz tega se poraja razlikovanje med razsežnostjo vsakdanje prakse, ki jo lahko dandanes srečamo kjer koli v svetu in v kateri se ne pojavljajo nikakršne načelne težave medkulturnega sporazumevanja, in razsežnostjo, v kateri je treba premagovati takšne težave in v kateri zaradi tega grozi tako imenovani »clash« kultur. Tretji del predavanja poizkuša (...) na posameznih primerih konkretizirati te splošne predhodne razlage, tako da najprej osvetli pomen družine in demokracije v razvoju zahodnjaškega sveta vse tja do novoveškega gospostva principa subjektivitete in mu nasproti postavi pomen družine v vzhodni Aziji. V nadaljevanju se paradigmatično konfrontira vlogo subiectuma, torej »subjekta« v indoevropski gramatiki in zahodnjaški ontologiji z brezsubjektno strukturo japonskih stavkov in njihovim habitualnim ozadjem. Pri tem se pokaže, da je treba pri premagovanju načelnih težav medkulturnega sporazumevanja izbrati drugačno pot, kot jo ubira naturalistično vračanje k nečemu, kar je biološko skupnega vsem ljudem, ali načelno-teoretsko izpeljevanje domnevno univerzalnih norm človekovih pravic.My presentation consists of three sections. In the title of the lecture, the term “understanding” occurs – in German “Verstehen” – which is embedded in the expression “coming to an understanding,” in German “Verständigung,” i.e., an understanding which includes the effort we need in order to achieve it. Accordingly, in the first section of my reflections, I would like to explain by means of a phenomenologically oriented philosophy why such an effort is required at all, i.e., why the agreement between people does not come to be by itself. In the second section, I will concentrate upon the problem of intercultural coming to an understanding. I intend to show why there are still today fundamental obstacles standing in the way of such an understanding. In the third and final section of my reflections, I would like to explicate these principle difficulties, using the intercultural coming to an understanding between the Eastern and Western hemispheres as an example. I will then close my paper with the question how these difficulties might be overcome. (shrink)

By the Riesz representation theorem for the dual of C [0; 1], if F: C [0; 1] → ℝ is a continuous linear operator, then there is a function g: [0;1] → ℝ of bounded variation such that F = ∫ f dg . The function g can be normalized such that V = ‖F ‖. In this paper we prove a computable version of this theorem. We use the framework of TTE, the representation approach to computable analysis, which allows (...) to define natural computability for a variety of operators. We show that there are a computable operator S mapping g and an upper bound of its variation to F and a computable operator S ′ mapping F and its norm to some appropriate g. (shrink)

Marina Gržinić se v intervjuju s Klausom Theweleitom osredotoča na dve različni smeri razprave. Prva se nanaša na knjigo _Moške fantazije_. Leta 2027 se bliža 50. obletnica te vplivne psihoanalitične študije o psihi moških vojakov, natančneje pripadnikov Freikorps, ki so bile paravojaške skupine v Nemčiji po prvi svetovni vojni. Druga smer govori o nasilju na splošno, zlasti v kontekstu zgodovinskega nasilja, primer tega pa so dogodki v Abu Ghraibu leta 2004. Theweleitova analiza nasilja, predvsem skozi optiko njegove kritične teorije, ponuja (...) okvir za razumevanje teh dogodkov ne le kot osamljenih incidentov, temveč kot manifestacij globljih družbenopolitičnih in psiholoških tokov. Intervju preučuje številne ravni Theweleitovega dela in razmišljanja vse do danes ter se vrača k primerom zgodovinskega nasilja in njegovemu vplivu na sodobno družbo. (shrink)

Die Begriffe Körper und Gesundheit sind (nicht erst) seit dem sogenannten body-, corporeal- oder somatic-turn Gegenstand sehr unterschiedlicher Disziplinen und Perspektiven: Die Komplexität der Zusammenhänge, Verschränkungen, Bedingungen des Gegenstandspaares Körper-Gesundheit bis hin zur Identifikation macht es erforderlich, multidisziplinär und multiperspektivisch vorzugehen. In diesem Band sind unterschiedliche Disziplinen und Perspektiven versammelt, die sich aus ihrer Fachgenese und wissenschaftlichen Position heraus mit Körper, Leib und Gesundheit beschäftigen, um v.a. Forschungsfelder zu erschließen und praxeologische Konsequenzen zu benennen.

The book (in German) on “Solar Energy – challenge for research, development and international co-operation” is the report of a study group of the Akademie der Wissenschaften zu Berlin. It reviews solar thermal, photovoltaic, and bio mimetic solar energy techniques; prospects of de-central techniques in developing countries; transport and storage of solar energy; and chances for cooperation with Arabic countries and countries of the South of the former Soviet Union. The prospect of large scale energy production in arid areas, and (...) the modern potentials of conducting electricity over long distances by high-voltage DC transmission (V, 2.1) are particularly relevant for the concluding section. Political chances as well as risks were considered for reliable long term cooperation with various Arab countries on these issues. The recommendations appear to be still appropriate 25 years after the book was published, particularly the political advice in favour of cooperation between Europe and suitable countries of the Maghreb. The global time scale of implementation (discussed in chapter I, 7.2) is of the same (high) magnitude as that of other major changes in the history of technology, such as the substitution of sailing ships by steamboats which took almost a century. This is a review of the new translation-cum-commentary of Lucretius, De rerum Natura by Klaus Binder, published by dtv, Munich 2017. The review stresses the importance of Lucretius work for the Enlightenment. The translation is o. k. on the whole, however the translator should have avoided rendering the Latin >religio< by >Aberglauben< (superstition). >superstition< was the word chosen by the English translator in the Loeb-Library, W. H. D. Rouse. Rouse was a Headmaster of the Perse School in Cambridge and (...) he may have chosen this rendering in 1924 to avoid getting into trouble with the Church of England. (shrink)
