This book presents the current state of the art regarding the application of logical tools to the problems of theory and practice of lawmaking. It shows how contemporary logic may be useful in the analysis of legislation, legislative drafting and legal reasoning concerning different contexts of lawmaking. Elaborations of the process of lawmaking have variously emphasised its political, social or economic aspects. Yet despite strong interest in logical analyses of law, questions remains about the role of logical tools in lawmaking. (...) This volume attempts to bridge that gap, or at least to narrow it, drawing together some important research problems-and some possible solutions-as seen through the work of leading contemporary academics. The volume encompasses 20 chapters written by authors from 16 countries and it presents diversified views on the understanding of logic (from strict mathematical approaches to the informal, argumentative ones) and differentiated choices concerning the aspects of lawmaking taken into account. The book presents a broad set of perspectives, insights and results into the emerging field of research devoted to the logical analysis of the area of creation of law. How does logic inform lawmaking? Are legal systems consistent and complete? How can legal rules be represented by means of formal calculi and visualization techniques? Does the structure of statutes or of legal systems resemble the structure of deductive systems? Based on a small research project conducted in Kuala Lumpur (KL) in July - August 2017, the paper discusses places and practices of young heterosexual Malaysian Muslims dating in KL. In Malaysia, the law (Khalwat law) does not allow for two unrelated people (where at least one of them is Muslim) of opposite sexes to be within ‘suspicious proximity’ of one another in public. This law significantly influences behaviours and activities in urban spaces in KL. However, apart from the legal (...) framework, the faith of urban users seems to influence significantly the way they perceive space and how they behave in the city. The paper questions the analytical usefulness of the notion of public space (as the Western construct) in an attempt to formulate new intellectual coordinates to discuss urban space in a context of the Islamic, post-colonial, tropical, and global city. The ultimate aim of this paper is to start discussing how religious imagination and narratives could lead to formulating a new typology of urban spaces. (shrink)

Sixteen years ago, Prahalad and Hart introduced the possibility of both profitably serving the poor and alleviating poverty. This first iteration of the Bottom/Base of the Pyramid approach focused on selling to the poor. In 2008, after ethical criticisms leveled at it, the field moved to BoP 2.0, instead emphasizing business co-venturing. Since 2015, we have witnessed some calls for a new iteration, with the focus broadening to a more sustainable development approach to poverty alleviation. In this paper, we seek (...) to answer the question: How has the BoP approach evolved over the past 16 years, and has it delivered on its early promise? We conducted a systematic review of 276 papers published in journals in this period, utilizing a rigorous correspondence analysis method to map key trends, and then further examined the 22 empirical studies conducted on the BoP approach. Our results suggest that the field has evolved, passing through a number of trends and coming full circle—with our analysis pointing to more recent BoP literature emphasizing similar themes to those espoused in the initial BoP iteration, rather than reflecting the principles espoused in either BoP 2.0 or BoP 3.0. Our analysis also points to a lack of clear evidence that the BoP concept has delivered on its promise either to businesses or to BoP participants. (shrink)

The article explores the concept of infodemics during the COVID-19 pandemic, focusing on the propagation of false or inaccurate information proliferating worldwide throughout the SARS-CoV-2 health crisis. We provide an overview of disinformation, misinformation and malinformation and discuss the notion of “fake news”, and highlight the threats these phenomena bear for health policies and national and international security. We discuss the mis-/disinformation as a significant challenge to the public health, intelligence, and policymaking communities and highlight the necessity to design measures (...) enabling the prevention, interdiction, and mitigation of such threats. We then present an overview of selected opportunities for applying technology to study and combat disinformation, outlining several approaches currently being used to understand, describe, and model the phenomena of misinformation and disinformation. We focus specifically on complex networks, machine learning, data- and text-mining methods in misinformation detection, sentiment analysis, and agent-based models of misinformation spreading and the detection of misinformation sources in the network. We conclude with the set of recommendations supporting the World Health Organization’s initiative on infodemiology. We support the implementation of integrated preventive procedures and internationalization of infodemic management. We also endorse the application of the cross-disciplinary methodology of Crime Science discipline, supplemented by Big Data analysis and related information technologies to prevent, disrupt, and detect mis- and disinformation efficiently. Porter and Kramer :78–92, 2006; Harv Bus Rev 89, 62–77, 2011) introduced ‘shared value’ as a ‘new conception of capitalism,’ claiming it is a powerful driver of economic growth and reconciliation between business and society. The idea has generated strong interest in business and academia; however, its theoretical precepts have not been rigorously assessed. In this paper, we provide a systematic and thorough analysis of shared value, focusing on its ontological and epistemological properties. Our review highlights that ‘shared value’ has (...) spread into the language of multiple disciplines, but that its current conceptualization is vague, and it presents important discrepancies in the way it is defined and operationalized, such that it is more of a buzzword than a substantive concept. It also overlaps with many other concepts and lacks empirical grounding. We offer recommendations for defining and measuring the concept, take a step toward disentangling it from related concepts, and identify relevant theories and research methods that would facilitate extending the knowledge frontier on shared value. The aim of the article is the analysis of the principle of fair play which co-creates an axiological basis of contemporary sport as well as its basic moral category. The constituents of fair play are, first of all, responsibility and justice. Both values are central values, connected with each other, and also closely connected with other values inscribed in fair play, e.g. respect, solidarity, care or honesty. The conducted analysis shows that the rules of fair play connected with formal responsibility (...) and justice, i.e. following the rules and caring for the integrity of sport, are constituent for both sport and esports, whereas the rules of fair play connected with acting responsibly, i.e. respect and avoiding victory at all costs, are hard to realise in esports. It results from the fact that contact between the players is digitally mediated. Hence, apart from gestures and verbal communication, display of respect towards a player during a game is impeded, as is still more a spontaneous reaction to his or her being hurt. Also, avoiding winning at all costs is impeded in esports, as activities directed at obtaining victory are built into the content of the game and therefore should be carried out in accordance with the regulations, from the technical and tactical side and according to the possessed skills. However, it is possible to stop the game when the connection with the other player is suddenly interrupted. From a fair-play perspective also the content of some games employed in esports is questionable, as it assumes contesting moral rules, which in turn is at variance with the realisation of integrative, educational and formative functions of esports in society. Several authors have investigated the question of whether canonical logic-based accounts of belief revision, and especially the theory of AGM revision operators, are compatible with the dynamics of Bayesian conditioning. Here we show that Leitgeb's stability rule for acceptance, which has been offered as a possible solution to the Lottery paradox, allows to bridge AGM revision and Bayesian update: using the stability rule, we prove that AGM revision operators emerge from Bayesian conditioning by an application of the principle of maximum (...) entropy. In situations of information loss, or whenever the agent relies on a qualitative description of her information state - such as a plausibility ranking over hypotheses, or a belief set - the dynamics of AGM belief revision are compatible with Bayesian conditioning; indeed, through the maximum entropy principle, conditioning naturally generated AGM revision operators. This mitigates an impossibility theorem of Lin and Kelly for tracking Bayesian conditioning with AGM revision, and suggests an approach to the compatibility problem that highlights the information loss incurred by acceptance rules in passing from probabilistic to qualitative representations of beliefs. The paper explores the relationship between conceptual engineering and the methodology of the Lvov-Warsaw School. While conceptual engineering is commonly seen as rooted in Rudolf Carnap's works and his method of explication, this paper argues that LWS predates and informs contemporary understanding of this methodology. The paper establishes that LWS not only engaged in but also systematically developed a method of conceptual revision aimed at enhancing clarity, precision, and coherence with specific theoretical frameworks. The analysis shows that LWS's approach to (...) concepts combined both descriptive and normative methodologies to improve and adapt philosophical concepts to better address actual phenomena and certain theoretical or practical needs. This method, described by LWS members as 'analysis and construction', parallels contemporary conceptual engineering practices, particularly its so-called 'narrow' understanding focused on revising existing concepts rather than on merely introducing new ones. By tracing the historical trajectory of conceptual engineering back to LWS, this paper provides a deeper understanding of its foundational strategies and suggesting that LWS's methodology could serve as a guide for current and future philosophical projects. The aim of the article is to verify a thesis Fukuyama once advanced: the forthcoming end of history is related to the replacing of human need for appreciation by equality and mutual appreciation last men achieve in liberal democracies. I also analyze the conception of human nature which Fukuyama takes for granted and treats as the base for defining the essence of the last man. Another question I consider concerns the role of Platon’s thymos and can be stated as follows: (...) is it justified to draw such far reaching conclusions from the notion as Fukuyama does in The Las Man? To answer the question I confront Fukuyama’s reflections concerning thymos with Hobbes’ and Rousseau’s understanding of the notion, and the idea of the end of history with the idea of generation proposed by Jose Ortega y Gasset. The Flame of Eternity provides a reexamination and new interpretation of Nietzsche's philosophy and the central role that the concepts of eternity and time, as he understood them, played in it. According to Krzysztof Michalski, Nietzsche's reflections on human life are inextricably linked to time, which in turn cannot be conceived of without eternity. Eternity is a measure of time, but also, Michalski argues, something Nietzsche viewed first and foremost as a physiological concept having to do with the body. (...) The body ages and decays, involving us in a confrontation with our eventual death. It is in relation to this brute fact that we come to understand eternity and the finitude of time. Nietzsche argues that humanity has long regarded the impermanence of our life as an illness in need of curing. It is this "pathology" that Nietzsche called nihilism. Arguing that this insight lies at the core of Nietzsche's philosophy as a whole, Michalski seeks to explain and reinterpret Nietzsche's thought in light of it. Michalski maintains that many of Nietzsche's main ideas--including his views on love, morality (beyond good and evil), the will to power, overcoming, the suprahuman (or the overman, as it is infamously referred to), the Death of God, and the myth of the eternal return--take on new meaning and significance when viewed through the prism of eternity. The aim of this paper is to show that expressivism about attitudes is not a tenable position. Although this claim has been often made in the literature, traditional arguments against attitudinal expressivism assumed a dated form of expressivism. In order to show that ascriptions of attitudes cannot be seen as expressive in either of them, the paper discusses two more recent versions of expressivism: quasi-realism and inferentialist expressivism. Quasi-realism escapes traditional arguments against attitudinal expressivism because it allows expressive statements to (...) be true in a deflationary sense. Nonetheless, it is implausible to adopt quasi-realist expressivism with regard to attitudes because this position cannot avoid substantial psychological commitments, despite Toppinen's recent arguments to the contrary. This conclusion also pertains to quasi-realist hybrid expressivist conceptions. The recently developed conception of inferentialist expressivism arguably creates the most accommodating theory for attitudinal expressivism as it does not make any substantial psychological commitments. Still, the criteria of bifurcation assumed in this framework does not support the claim that attitudes play an expressive role. (shrink)

This collection of current research on logic programming languages presents results from a three-year, ESPRIT-funded effort to explore the integration of the foundational issues of functional, logic, and object-oriented programming. It offers valuable insights into the fast-developing extensions of logic programming with functions, constraints, concurrency, and objects. Chapters are grouped according to the unifying themes of functional programming, constraint, logic programming, and object-oriented programming.

The philosophical roots of Malinowski's functionalism are in the academic circles of Krakow, where three figures seem to have exerted a particularly strong influence: Pawlicki, Straszewski, and Heinrich. The predominant trend in philosophy at that time was empiriocriticism, as developed by Mach and Avenarius. Also important were F. A. Lange's interpretation of Marburg neo-Kantianism. It should be noted that the historical philosophy field was extremely broad and diverse. Functionalism, a philosophically open concept, cannot be subordinated to any one philosophical system, (...) although the "openness" of functionalism is not absolute but complemented by its "closedness" to certain other philosophies. Praxism pervades functionalist theory and even creates its foundation. Malinowski approach is entirely scientific, but functionalism is never just empirical. Malinowski realized that pure experience is as impossible as pure reasoning. (shrink)

The article presents a problem of proper hedging strategy in expected utility model when forward contracts and options strategies are available. We consider a case of hedging when an investor formulates his own expectation on future price of underlying asset. In this paper we propose the way to measure effectiveness of hedging strategy, based on optimal forward hedge ratio. All results are derived assuming a constant absolute risk aversion utility function and a Black-Scholes framework.

As the aftershocks of the latest economic meltdown reverberate throughout the world, and people organize to physically occupy the major financial centers of the West, few experts and even fewer governments have dared to consider a world without the powerful markets that brought on the crash. Yet, as François Morin explains in _A World Without Wall Street?_, this is the very step that needs to be taken as quickly as possible to avoid a perpetual future of dehumanizing working conditions, devastated (...) ecosystems, and the submission of public policies to private interests. The purpose of this investigation is to define the central issues of the current and future relations between the Western and Chinese civilizations through the evaluation of the myths and realities of these relations. The methodology is based on an interdisciplinary big-picture view of the world scene, driven by the global economy and civilization with an attempt to compare both civilizations according to key criteria. Among the findings are: Today China has become a “robot” of the West. Due to its (...) old culture and ability to invent important civilizational tools, China is becoming an independent developer of its own economic power, and it is very probable that it will surpass its master sooner or later. Due to its transformation to a global civilization, Western civilization has lost its Christian values and adopted new ones based on business. It is probable that the economic success of China will lead to a clash between civilizations, both grasping for access to the strategic resources. Practical implication: Society should elaborate the path to the development of wise civilization driven by a new political system, ecoism.Social implication: It is probable that if the “1%” won’t self-correct its misbehavior, a social revolution by the “99%” cannot be excluded from the current calendar ofWestern civilization. Originality: This investigation, by providing the interdisciplinary and civilizational approach, expands the scope of the traditional relevant approach. (shrink)

The text traces the development of the notion of catatonia in the work of Gilles Deleuze across three spheres – the individual, social and literary. The need for an analysis is based on the author’s perception that Deleuze thought on catatonia and slowness has been undervalued in many interpretations ; the recognition, in works of sociologists such as Hartmut Rosa, of the adverse effects of social acceleration. In the individual sphere, catatonia is the effect of a radical withdrawal into anti-production (...) or the body without organs. In the social sphere, catatonia is also linked to anti-production, but since in capitalism most anti-production is included in the sphere of production, catatonia represents a special case of resistance to this tendency. Deleuze shows how these two spheres intertwine in his analyses of Herman Melville’s works, especially Billy Budd and Bartleby; the title characters of these two texts are interpreted as embodiments of the catatonic as a political-revolutionary figure. Obiektem badań nie bez przyczyny jest ta kategoria społeczna, gdyż młodzież, tworząc własne systemy wartości i normy moralne, kreuje nowy porządek i przyczynia się do postępu. We wstępipe przedstawiono typologię wartości oraz pojęcia, które w dalszej części pracy zostaną zastosowane w analizie omawianych zjawisk. Podstawą podjętych w artykule rozważań są wyniki badań socjologicznych przeprowadzonych w Morągu. Skupiono się głównie na stosunku młodzieży do wartości codziennych. Postawiono pytanie o wartości uznawane za ważne w życiu, oraz (...) o obawy młóodzieży. Podjęto także próbę określenia relacji między wartościami prospołecznymi i egoistycznymi. W konkluzji wskazano kierunek przemian, jakim od pewnego czasu ulegają systemy wartości I preferencje młodzieży. (shrink)

According to a prevailing view, conceptual engineering introduces a revolutionary philosophical methodology, challenging traditional conceptual analysis. However, in our paper, we argue that closer scrutiny reveals not only the falsity but also the inherent ambiguity of this narrative. We explore four interpretations of the "Anti-Novelty Claim", the claim that conceptual engineering is not a new way of doing philosophy. Discussing the Anti-Novelty Claim from the perspective of a text’s producer, the text’s consumers, and the exegetical potential of the text, we (...) examine each perspective’s metaphilosophical implications and demonstrate that taking each perspective requires different methods. Adopting these different methods, we argue that the different interpretations of the Anti-Novelty Claim range from nearly trivially true to unlikely but untested. Importantly, we emphasize that each interpretation offers unique philosophical insights, yet addressing them requires diverse types of evidence, preventing a singular, straightforward answer to whether conceptual engineering is new. I analyze the notion of political theology, King's argumentation in favour of non-violence strategy in politics and reconstruct a standard model of non-violence action. Finally, I discuss some philosophical and political controversies arising around passive resistance.
