This article considers the relationship between moral philosophy and constitutional theory through a detailed examination of the work of Jeremy Waldron—an unavoidable voice in contemporary constitutionalist debate. Through a rigorous, original and holistic deconstruction of his work and its philosophical implications, I argue that Waldron’s engagement with core philosophy within his constitutional scholarship is wholly problematic, containing a number of ambiguities and apparent inconsistencies. These issues, I suggest, may stem from an at times rather casual treatment of the realist/anti-realist issue (...) of core philosophy, perhaps owing something to his view that it is in fact safely irrelevant to his constitutional pursuits. In any case, this view, I argue, is misguided, and the problems which result are real: they not only create issues of theoretical consistency and clarity; they put Waldron’s constitutional theory in danger. Like all good tales, I suggest there are lessons to be learned from this: one must think, and think carefully, about the philosophical background of one’s work, and take care in setting this out in a clear, thorough and coherent way—the stakes are too high not to. With this in mind, this article also lays some groundwork for a path into constitutional theory firmly grounded in my own anti-realist moral scepticism. (shrink)

Background: The factors influencing parents’ willingness to enroll their children in biobanks are poorly understood. This study sought to assess parents’ willingness to enroll their children, and their perceived benefits, concerns, and information needs under different consent and data-sharing scenarios, and to identify factors associated with willingness. Methods: This large, experimental survey of patients at the 11 eMERGE Network sites used a disproportionate stratified sampling scheme to enrich the sample with historically underrepresented groups. Participants were randomized to receive one of (...) three consent and data-sharing scenarios. Results: In total, 90,000 surveys were mailed and 13,000 individuals responded (15.8% response rate). 5737 respondents were parents of minor children. Overall, 55% (95% confidence interval 50–59%) of parents were willing to enroll their youngest minor child in a hypothetical biobank; willingness did not differ between consent and data-sharing scenarios. Lower educational attainment, higher religiosity, lower trust, worries about privacy, and attitudes about benefits, concerns, and information needs were independently associated with less willingness to allow their child to participate. Of parents who were willing to participate themselves, 25% were not willing to allow their child to participate. Being willing to participate but not willing to allow one’s child to participate was independently associated with multiple factors, including race, lower educational attainment, lower annual household income, public health care insurance, and higher religiosity. Conclusions: Fifty-five percent of parents were willing to allow their youngest minor child to participate in a hypothetical biobank. Building trust, protecting privacy, and addressing attitudes may increase enrollment and diversity in pediatric biobanks. (shrink)

Consider the following situation. It is the first day of school, and the new third-grade students file into the classroom to be shown to their seats for the coming year. As they enter, the third-grade teacher notices one small boy who is particularly unkempt. He looks to be in desperate need of bathing, and his clothes are dirty, torn and tight-fitting. During recess, the teacher pulls aside the boy's previous teacher and asks about his wretched condition. The other teacher informs (...) her that he always looks that way, even though the boy's family is quite wealthy. The reason he appears as he does, she continues, is that the family observes an odd practice according to which the children do not receive many important things – food, clothing, bathing, even shelter – unless they specifically request them. Since the boy, like many third-graders, has little interest in bathing and clean clothes, he just never asks for them. (shrink)

This paper proposes a brain-inspired cognitive architecture that incorporates approximations to the concepts of consciousness, imagination, and emotion. To emulate the empirically established cognitive efficacy of conscious as opposed to non-conscious information processing in the mammalian brain, the architecture adopts a model of information flow from global workspace theory. Cognitive functions such as anticipation and planning are realised through internal simulation of interaction with the environment. Action selection, in both actual and internally simulated interaction with the environment, is mediated by (...) affect. An implementation of the architecture is described which is based on weightless neurons and is used to control a simulated robot. (shrink)

The libertarian-individualist cause is at a critical crossroads. To have a successful revolution in the minds of men, we must learn from the Leninists what “revolutionaries” can do to advance their principles: nourish and increase the hard core with an “open center” and support specific political actions through auxiliary organizations, while avoiding “left-wing opportunism” and “right-wing sectarianism.” Historically, it was from the post-war libertarian outposts that FEE was able to build and galvanize such a hard core open center, with members (...) even radicalizing one another. But FEE attempted to be more populist than scholarly, driving away scholars once they had “graduated.” The Volker Fund filled this gap to some extent; but has started to go the way of the Earheart foundation’s efforts—since the scholars selected were not radical enough to maintain an open center, the hard core has been weakening and dissolving. The libertarian cause should de-emphasize drastically popular fronts with the conservative right, it should nourish and construct the hardcore libertarian movement with some form or forms of nucleus or center, and it must emphasize libertarian scholars and intellectuals primarily. Aldershot, England: Ashgate, 2002. Pp. x + 235. Paper, $29.95. Most scholarship argues that Nietzsche grants art a position of vital importance for culture, history, and philosophy. Philip Pothen seeks to challenge this general view of Nietzsche [End Page 227] while at the same time raising new questions (...) about Nietzsche's thoughts on art and how Nietzsche's views on art relate to his philosophical concerns. He does not locate Nietzsche's "deep suspicion and at times hostility" (1) toward art in a specific period of Nietzsche's thought, but instead traces it from the notebooks of the 1870s through Nietzsche's so-called "positivist period" to the very end of his productive life. The result is an honest attempt to recognize Nietzsche's ambivalent and at times hostile attitude toward that which is often times unquestionably admired.Although the Birth of Tragedy is the central text for most scholarship about Nietzsche's thoughts on art, this scholarship does not generally look to contemporaneous unpublished private writings. By conducting a close reading of Nietzsche's first published work in juxtaposition with selections from the Nachlass, Pothen shows that even as early as the 1870s, Nietzsche was developing some of the major themes of his subsequent writings on art. Nietzsche had begun to make decisive breaks with conceptual presuppositions inherited from Schopenhauer and the Kantian philosophical framework as well as from Wagner.Nietzsche's earlier belief in a rebirth of the Dionysian through works of genius such as Wagner's was severely criticized by Nietzsche himself in his 1886 Preface to the Birth of Tragedy. The second chapter of this book looks at Nietzsche's criticism of the concept of "genius" and the recognition of the "death of art" in modern artists such as Wagner. Pothen shows that Nietzsche gives a highly naturalistic account of genius, criticizing traditional notions that elevate the genius to a higher status than the merely talented artist.According to Pothen, the decadence of modern art, the deception of the artist, and the "end of art" suggests a type of "sickness" for Nietzsche. Art "represents a suppression of the instincts of becoming" (56). Pothen claims the future of art and its possible "death" are much more severe for Nietzsche than, for instance, Hegel. The challenging conclusion is that Nietzsche, not Hegel, properly announces the "death of art" in modernity.What, however, of the "monological work of art" that Nietzsche first formulates in the Gay Science? By considering the fourth part of Thus Spoke Zarathustra as a decisive conclusion and not an inferior appendage, Pothen argues that this work "for All and None" illustrates "a radical and perhaps impossible orientation" (9) that the godless artist must take up according to Nietzsche. It is a creative position "in favor of solitude [Einsamkeit], forgetting [vergessen] and inner strength" (74).Chapter four of Pothen's book addresses the concept of the "will to power." Pothen argues that it is a "metaphysical principle" of explanation that nevertheless undermines certain other metaphysical concepts such as a unified "subject" as well as traditional aesthetic concepts such as artistic autonomy. Pothen challenges Heidegger's claim that art is the "highest expression" of the will to power for Nietzsche while utilizing Heidegger's insights into art to highlight and question previous themes in the book such as the reduction of art to physiology (117-32).Chapter five concentrates on Nietzsche's analysis of the psychology of production and his critique of the Kantian themes of "disinterestedness" and the "judgment of taste." The book ends with a look at Nietzsche's final productive year of 1888. In works such as The Case of Wagner, Nietzsche, Pothen suggests, holds decadent works such as Wagner's as representative of all art produced "in the time of the death of God and the revaluation of all values" (169). The objectives of this article are twofold. First, by denying the dualism inherent in attempts to load metaphysical significance on the inner/outer distinction, it defends the view that scientific investigation can approach consciousness in itself, and is not somehow restricted in scope to the outward manifestations of a private and hidden realm. Second, it provisionally endorses the central tenets of global workspace theory, and recommends them as a possible basis for the sort of scientific understanding of consciousness thus legitimised. However, (...) the article goes on to argue that global workspace theory alone does not constitute a fully worked-out objective account of the conscious subject. This requires additional attention to be paid to the issue of embodiment, and to the possibility of indexicality that arises when an instantiation of the global workspace architecture inhabits a spatially localised body. This paper assesses the relationship between corporate social responsibility and downside equity tail risk, a field of research that is underdeveloped at this moment. Using global equities data over the period of January 2003 to December 2011, inclusive, the downside tail risk of each company is estimated using techniques of extreme value theory and CSR is approached using stakeholder theory. Our findings show a significant relationship between certain aspects of CSR and downside tail risk. The nature of the relationship differs (...) across region, stakeholder and time. Furthermore, the relationships we found are sequential, which makes a causal link between CSR and tail risk plausible. (shrink)

Using Gebharter’s representation, we consider aspects of the problem of discovering the structure of unmeasured submechanisms when the variables in those submechanisms have not been measured. Exploiting an early insight of Sober’s, we provide a correct algorithm for identifying latent, endogenous structure—submechanisms—for a restricted class of structures. The algorithm can be merged with other methods for discovering causal relations among unmeasured variables, and feedback relations between measured variables and unobserved causes can sometimes be learned.

Nongovernmental organizations (NGOs) comprise the sector of society that attempts to hold business and other institutions accountable for their social responsibility. Yet NGOs rarely have established governance mechanisms whereby their members and supporters can hold them accountable for their activities. In contrast, other major acton in the society -notably governments, corporations, and unions -maintain long established albeit imperfect instruments of governance and responsibility. This article presents a variety of ways in which NGOs could voluntarily strengthen their internal governance and thus (...) become more accountable to their members and supporters as well as society at large. In the process, these important civil society organizations would enhance their effectiveness in achieving improvements in key areas of public policy. (shrink)
