Dans des études diachroniques et synchroniques récentes, on constate une convergence vers l’idée que l’analyse de des fonctionnant comme article (« article-like » des, désormais desal) ne doit pas être fondée sur une relation avec les partitifs. Cette contribution reprend ce débat et montrera que les approches proposées pour contourner une analyse partitive de desal entraînent pourtant un certain nombre de défis. L’identification de ces défis nous mène à élargir notre perspective vers les partitifs nus (c’est-à-dire des structures partitives sans (...) déterminant « upstairs », p. ex. de ces N) en français, italien et néerlandais. Surtout cette dernière langue est particulièrement intéressante, vu que les partitifs nus ne s’y sont pas fossilisés. Sur la base de ces données, nous proposerons une analyse de desal comme faisant partie de la famille des partitifs nus. Cette approche partitive de desa, qui rend compte de faits synchroniques et diachroniques, s’avère théoriquement plus élégante et a une couverture empirique plus large. (shrink)

Edgar de Bruyne publie ses Études d'esthétique médiévale en 1946, un ouvrage d'une grande dimension qui a dmandé baucoup d'effort, tenant compte avec les autres publication qu'il avait publié dans les années avant la guerre. L'article présent situe de Bruyne dans la philosophie louvaniste et les néo-scolastiques. L'auteur constate que de Bruyne, thomiste qu'il était lui-même, a liberé l'idée esthétique médiévale de l'idée esthétique thomiste. Plus tard il écrivit sur l'esthétique dans la pensée grecque et romaine jusqu'à (...) l'humanisme. AInsi il démontrait qu'il n'y avait pas de système ethétique thomiste en soi, mais que ces idées faisaient partie d'une plus large idée d'esthétique, dans laquelle l'intuition intellectuelle joue un rôle important. Grâce à de Bruyne on connaît mieux la civilisation médiévale. (shrink)

It is the English translation of a French work, L'Esth~tique du moyen dge,I which, in turn, is a one-volume abridged version by Edgar De Bruyne of his own original three-volume work, I~tudes d'Esth~tique M~di~vale.2 Thus, one may evaluate this book either as a translation or, presupposing the faithfulness and correctness of the translation itself,as a relatively short work by E. De Bruyne, or else in its relation to or as compared with the original three-volume work. I will confine myself here to the lattertwo considerations.3 First, considering this book in comparison with the three-volume original work, one of the principal writings of De Bruyne and one of the most significant contemporary contributions to the history of medieval aesthetics, we can find both quantitative and qualitative differences between the original work and its abridged version. The quantitative difference is considerable. While the abridged work, at least in its English translation, is less than a quarter of a thousand pages in length, the original work includes altogether 1,224 pages 4 and is thus more than five times longer than thc translated abridged version of it. The qualitative or methodological difference is at least equally great. In the original work, each of the three volumes deals primarily with the various medieval authors of aesthetic works and doctrines in a chronological order.5 In contrast, the contents of the translated abridged version follow a topical arrangement with chronology playing only a subordinate role, if any at all, within Louvain. To this may be added a third difference that is the result of the first two differences. There is virtually neither any direct quotation from any author on any topic, nor a~y direct reference to texts in the works of medieval authors mentioned or discussed. While the quantitative difference in itself is understandable, since only a scholar specializing in this field would read over 1,200 pages on medieval aesthetics, and while the qualitative difference is perfectly justified in terms of an intelligent summary, the absence especially of direct references to discussed texts is, as will be shown below, deeply regxettable. So much for the relative consideration of this translated abridged work. Let us next consider the abridged work in itself in the form of a positive and a negative evaluation. Second, despite the relative brevity of the work, one finds this book extremely valuable both in terms of the quantity and the quality of the data it contains. In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 475 whereas in some texts Aquinas explicitly teaches that the higher senses of vision and hearing are the ones that mainly (praecipue, principaliter) lead to aesthetic experience.t5 Moreover, the statement that only in the thirteenth century was the question of the distinction between the higher and lower senses explicitly raised (p. l13f.), is true only if the author meant to exclude the pre-medieval or patristic as well (...) as the ancient period of philosophy.16 Finally, there is one technical weakness in this book that cannot be left unmentioned. The overwhelming majority of references are not to the original medieval texts treated and/or quoted in the three-volume edition, but to the number of volume and page in that edition. Thus the reader must be both familiar with French and in possession of the original three-volume work, or remain hopelessly frustrated every time he wishes to consult the original texts or at least know which texts are being mentioned. Yet, if one knows French, he does not need the English translation; and if he is also fortunate enough to have access to the original three-volume version, he will not need the abridged version of the original work at all. For this reason, should there be a second edition of this translation, the references should be changed from the l~tudes to the original medieval works. Although the negative remarks are more lengthy in this review than the positive evaluation is, it would be a grave mistake to conclude from this that the defects outweigh the value of the book. As a matter of fact, upon finishing the reading of this translation of De Bruyne's work, this reviewer was left with the conviction that, in the final balance, the reader can only greatly benefit from this work, and we all owe gratitude to the translator for having made this highly informative work available in the English language. Risse, and C. Vasoli have pointed out the vitality and significance associated with the development of the logical thought of the period. The general question of methodology has produced an enormous scholarly literature in recent years,I but much remains to be done before we fully understand how various methodologies have evolved and what relation philosophical discussions of method have had to the actual practice of science. It definitely does not, however, establish a solid foundation for later studies. The book is organized into three principal parts, dealing with the development of the analytic method in logic (pp. 21-188), in the natural sciences (pp. 189-284), and in mathematics (vv. 285-328). Suppose libertarians could prove that durable, unqualified private property rights could be created through 'original acquisition' of unowned resources in a state of nature. Such a proof would cast serious doubt on the legitimacy of the modern state. It could also render the approach to property rights that I favour irrelevant. I argue here that none of the familiar Lockean-libertarian arguments for a strong natural right to acquisition succeed, and that any successful argument for grounding a right to acquire would (...) have to use my favoured approach to property rights - the 'vector-sum' approach. Quentin Smith has argued that the new tenseless theory of time is faced with insurmountable problems and should be abandoned in favour of the tensed theory of time. Smith;s main argument attacks the fundamental premise of the tenseless theory: that tenseless truth conditions for tokens of tensed sentences adequately capture the meaning of tensed sentences. His position is that tenseless truth conditions cannot explain the logical relations between tensed sentences, thus the tensed theory must be accepted. Against Smith, this paper (...) adopts an alternative approach to the explanation of the entailment relations between sentences which contain indexicals. The approach drops the reliance upon tokens and instead relies on the evaluation of sentence types with respect to a context rather than upon actual or possible utterances of tokens of the types. This (new) version of the tenseless theory of time can adequately explain the relevant entailment relations between tensed sentences. (shrink)

This diverse but representative selection of Rowe's writings will provide students, professional scholars as well as general readers with stimulating and accessible discussions on such topics as the philosophical theology of Paul Tillich, the problem of evil, divine freedom, arguments for the existence of God, religious experience, life after death, and religious pluralism.

In the first section I briefly consider some stituations in which standard desert-claims would be disputed, with the aim of revealing why and by whom they are asserted or denied. Having attained some understanding of the point of different desert-statements, I propose an accound of their content that entails the thesis that statements of positive desert (deserving something desirable) sharply differ in meaning from statements of negative desert (deserving something undesirable), even when expressed in the same form. In the second (...) section I use this ambiguity thesis to argue against an appealing way of defending Hegel's claim that a wrongdoer has a right to be punished and against Kant's defense of the view that there is a duty to punish those who deserve it. I also show how an understanding of negative desert that recognizes the ambiguity thesis enables us to defend the ordinary view of mercy against Kantian criticisms and to reject the popular misconception that mercy is necessarily at odds with justice. In the third section I use the ambiguity thesis to rebut the common claim (found in Mill and Aristotle, among others) that it is unjust for a person to have or be given mone benefits than she deserves. I conclude by showing how an understanding of positive desert that recognizes the ambiguity thesis leads to a rejection both of certain complaints against traditional systems of private property and also of certain moralistic scruples that might give pause to those who acknowledge the moral duty to assist the needy. (New York: Philosophical Library, 1969. Pp. 162. $5.00) Of the author's Zoroaster's Influence on Greek Thought a striking flaw was the misleading rifle. In this earlier volume not one example of Zoroastrian impact was pointed out to corroborate the claim. Now, in the preface to the new work, the author discloses that the original (...) title had merely been "Zoroaster and the Trend of Greek Thought" and that the publishers changed it into "Zoroaster's Influence" etc. "to give the book a more attractive heading" (p. 9). This fiat of the publishers, however, was then gratefully felt by the author a~ a "challenge.... prodding" him to the "venture" (cf. p. 10) of attempting to substantiate (what was before just his belief) "that the illumination vouchsafed by Zoroaster generated the Enlightenment attributed to the Periclean Age of Athens" (p, 12) and to demonstrate, for instance, an ostensible basic similarity between the pfiilosophy of Anaxagoras and the teachings of Zoroaster. This venturous attempt fills six long chapters supposed to show that "Medism," or Zoroastrianism, was the great spiritual power menacing the autochthonous Athenian values, and that Anaxagoras and his circle and Aeschylus, Euripides, Socrates, and Thucydides essentially were propagandists of Zoroastrianism who undermined the pagan culture of Athens. True, the general presentation of Medism and its role in the spiritual struggle of the Periclean Age is sometimes thrillingly interesting reading. Yet, for us the main question is: Has the author succeeded in his attempt? There are prerequisites of such an undertaking. Thorough and first-hand knowledge of both sides of the topic is indispensable, in the first place. To question the historical authenticity of a modern believer's presentation of Zoroastrianism might seem improper. But it should still be permitted sharply to distinguish between the official traditional version and the results of recent serious research. The other side of the topic is concerned with those who, according to the author's claim, were downright prophets of Zoroastrianlsm. Whether this holds true of Aeschylus and Euripides, whether, for instance, really all the dramatis personae of Euripides' Ion were meant as nothing, but symbolizations of the antagonistic spiritual powers of Medism and Athenianism, this to discuss, and perhaps to doubt, is up to literary analysts. But two of those alleged heralds are philosophers: Anaxagoras and Socrates. (Incidentally, what about Heraclitus and Empedocles?) Well, let us forget about Socrates. The "real" Socrates is such an intangible figure anyway that it would not make much sense to argue with any of the author's allegations about him. In the presentation and "analysis" of the philosophy of Anaxagoras, however, the decisive shortcomings come to the fore. The level of the author's general philosophical training is not quite equal to the task. On one view of ethical development, someone not yet virtuous can reliably progress by engaging in what meaningfully resembles virtuous conduct. However, if the well-intended conduct is psychologically demanding, one's character, precisely because one is not yet virtuous, may worsen rather than improve. This risk of degradation casts doubt on the developmental view. I counter the doubt through one interpretation and one application of the Mengzi. In passage 2A2, invoking the image of a farmer who “helped” the crop grow by (...) pulling the sprouts, MENG Ke cautions, “do not help it grow.” I defend a novel interpretation: do not advance with a naïve negligence about your psycho-physiological constitution. I also show how to advance with realistic care by pointing out an overlooked application of a much-discussed cultivation technique illustrated in Mengzi 1A7: ethical reflection can conciliate one with one’s ongoing or past advanced action, lowering the action’s risk of degradation. Background Informed consent is an integral component of good medical practice. Many researchers have investigated measures to improve the quality of informed consent, but it is not clear which techniques work best and why. To address this problem, we propose developing a core outcome set to evaluate interventions designed to improve the consent process for surgery in adult patients with capacity. Part of this process involves reviewing existing research that has reported what is important to patients and doctors in the (...) informed consent process. Methods This qualitative synthesis comprises four phases: identification of published papers and determining their relevance; appraisal of the quality of the papers; identification and summary of the key findings from each paper while determining the definitiveness of each finding against the primary data; comparison of key themes between papers such that findings are linked across studies. Results Searches of bibliographic databases returned 11,073 titles. Of these, 16 studies met the inclusion criteria. Studies were published between 1996 and 2016 and included a total of 367 patients and 74 health care providers. Thirteen studies collected data using in-depth interviews and constant comparison was the most common means of qualitative analysis. A total of 94 findings were extracted from the primary papers and divided into 17 categories and ultimately 6 synthesised findings related to: patient characteristics, knowledge, communication, the model patient, trust and decision making. Conclusions This qualitative meta-aggregation is the first to examine the issue of informed consent for surgery. It has revealed several outcomes deemed important to capture by patients and clinicians when evaluating the quality of a consent process. Some of these outcomes have not been examined previously in research comparing methods for informed consent. This review is an important step in the development of a COS to evaluate interventions designed to improve the consent process for surgery. The old ritual word macte was only vaguely understood even in Republican times. As is well known, the ancient critics connected the word with magis, magnus, and explained it as magis auctus. A glance at Walde's Wörterbuch reveals that many attempts have been made in modern times to solve the mystery; but the formidable equipment of the modern philologist has yielded little better results than the popular etymology of the ancients, the most favoured view to-day seeing in mactus the PPP (...) of a verb mago with macto as the frequentative which replaces it. The supposed semantic development of this verb, originally meaning ‘to increase’, has been set forth by Warde Fowler in a well-known passage, to which recent authorities have accorded their assent and praise: ‘the vitality of the deity … was really increased by placing on the altar the organs of life of the victim’. But this is a solution which ignores half the problem: macte and mactare are used not only of the deities but also of the victim. One can perhaps understand lovem mactare as ‘to magnify J.’, but not even by the most superficial analogy can we find a transition from here to the meaning typified in mactare vinum. Yet this is one of the most frequent usages of the word. So deep a gulf lies between the two semantic spheres of the verb that some scholars have sought to find in it two different verbs. But this is a counsel of despair which the editor of the Thesaurus dismisses with a non recte. We must agree, then, with Hey that the modern explanation is ‘sicher eine unrichtige’ and with Meillet-Ernout that there exists ‘aucune étymologie claire’. It is, therefore, surprising that so ill-founded a preconception should lead investigators to ignore or even dismiss important evidence which the ancient authorities offer for the solution of this problem. In a recent article in this journal, Heidi Giannini (2017) has argued that the Christian doctrines of love and of hope require Christians to endorse universal, unconditional forgiveness, understood in terms of the renunciation of “negative reactive attitudes.” She also addresses criticisms of this interpretation. It is argued that Giannini has failed to provide a Christian justification for universal, unconditional forgiveness. Part of the problem is that she espouses a definition of forgiveness and an understanding of the nature of forgiveness (...) that, as a result of neglecting the teaching of the New Testament, exhibits a number of incoherencies and theological weaknesses. Her account is also vulnerable to philosophical and moral criticisms of a serious nature. (shrink)

In order to get out of present day discussions between determinism and free will, creationism and evolution, bios and zoē, human existence and biological life – those dead end binaries of our present day thinking into which we have manoeuvred ourselves – we need to revisit the Ancient discussions relating to the care of the soul and human existence. I will draw together these two themes from Jan Patočka’s writings by anchor-ing them in his account of Socrates who was the (...) first to emphasise the idea of human re-sponsibility not only for thinking but also for human acting in the world. I will argue that the significant common feature – the care for our own being, our existence – brings Patočka’s reflections on the care for the soul and care for our human existence together. While, according to Patočka, the notion of the care for the soul was displaced from the philosophical reflection by the modern scientific venture, the idea of human existence is, although problematic from the scientific point of view, still a part of our experience.Para librarnos de discusiones contemporáneas entre determinismo y libre albedrío, creacionismo y evolución, bios y zoē, existencia humana y vida biológica, estos binomios, callejones de salida del pensamiento de hoy en los que nos hemos metido, tenemos que volver a escuchar las discusiones de la Antigüedad sobre el cuidado del alma y la existencia humana. Hanlester Network v. Shalala ) marks the first test of the application of the Medicare-Medicaid anti-kickback statute to physician self-referral joint ventures. The most recent development in this ongoing litigation was the April 6, 1995 decision of the Ninth Circuit Court of Appeals, holding the Hanlester Network vicariously liable for its marketing vice president's knowing and willful violation of the antikickback statute. The vice president had offered to pay physician-investors in order to induce their referrals of program-related business.The Hanlester Network (...) was a California general partnership comprised of corporations, clinical laboratories, and individual investors.
