In this field questions arise which are certainly difficult; but as I listened last time to members of the group, I felt that the main difficulty perhaps lay in determining precisely what questions we are trying to answer. I have the conviction that if we could only say clearly what the questions are, the answers to them might not appear so elusive. So I have begun with a simple list of questions about discretion which in one form or another were, (...) as it seemed to me, expressed by the group last time. I may indeed have omitted something and inserted something useless: if so, no doubt I shall be informed of this later. The central questions then seem to me to be the following: 1. What is discretion, or what is the exercise of discretion? 2. Under what conditions and why do we in fact accept or tolerate discretion in a legal system? 3. Must we accept discretion or tolerate discretion, and if so, why? 4. What values does the use of discretion menace, and what values does it maintain or promote? 5. What can be done to maximize the beneficial operation of the use of discretion and to minimize any harm that it does? (shrink)

The purpose of this study was to investigate the ways novice social studies teachers perceived difficult discourses in their classrooms. Specifically, we sought to understand what social studies teachers think is difficult about navigating political discourses, and how they describe the nature of those discourses in order to draw conclusions about why some teachers choose to avoid or engage in political or social issues discussions with students. We used a collective case study and a grounded theory analysis of video recorded (...) class sessions and video guided debriefings with teachers to explore this phenomena. We found that the degree to which teachers thought the discourse to be difficult to navigate was shaped by: emotional safety of students, teacher's own ideologies, and the distances of students’ identities from the discourse. We consider the problem of measurement using the Lindblad equation, which allows the introduction of time in the interaction between the measured system and the measurement apparatus. We use analytic results, valid for weak system-environment coupling, obtained for a two-level system in contact with a measurer (Markovian interaction) and a thermal bath (non-Markovian interaction), where the measured observable may or may not commute with the system-environment interaction. Analysing the behavior of the coherence, which tends to a value asymptotically close to (...) zero, we obtain an expression for the time of measurement which depends only on the system-measurer coupling, and which does not depend on whether the observable commutes with the system-bath interaction. The behavior of the coherences in the case of strong system-environment coupling, found numerically, indicates that an increase in this coupling decreases the measurement time, thus allowing our expression to be considered the upper limit for the duration of the process. BackgroundExtremely violent events such as terrorist attacks and mass shootings form a severe risk for the health and wellbeing of affected individuals. In this study based on a public health monitor, we focus on the health impact of the Utrecht tram shooting, which took place in the morning of March 18th 2019. A lone gunman opened fire on passengers within a moving tram. Four people died, and six people were injured in this attack. The attack resulted in nationwide commotion and (...) drew much media attention. Aim of this study was to increase insight into the health effects for the survivors, and whether they received the needed care and support.MethodsSemi-structured interviews with accompanying questionnaires were conducted at six and 18 months post-attack. Overall, 21 survivors participated in the first series of interviews, 15 in the second series. Qualitative data were analyzed using reflexive thematic analysis, quantitative data was only described because of the low sample size.ResultsAt both six and 18 months after the attack many survivors had been able to resume daily life, and most rated their overall health as good or excellent. At the same time, a substantial portion suffered from health problems such as posttraumatic stress symptoms and other complaints, and needed professional care. Furthermore, those in need did not always find their own way to appropriate care through the existing health system: half of the survivors still needed support in finding the right care 18 months later.ConclusionAlthough the design and implementation of this public health monitor were accompanied by multiple challenges, it was possible to track a portion of the survivors and gain insight in the considerable health burden of the attack. Also, it is clear in this study that the health impact of terrorism affects survivors in the long run and requires attention from health authorities and professionals, as survivors were not able to find the right care by themselves. The term fuzzy logic is used in this paper to describe an imprecise logical system, FL, in which the truth-values are fuzzy subsets of the unit interval with linguistic labels such as true, false, not true, very true, quite true, not very true and not very false, etc. The truth-value set, , of FL is assumed to be generated by a context-free grammar, with a semantic rule providing a means of computing the meaning of each linguistic truth-value in as a (...) fuzzy subset of [0, 1].Since is not closed under the operations of negation, conjunction, disjunction and implication, the result of an operation on truth-values in requires, in general, a linguistic approximation by a truth-value in . Quentin Smith has argued that the new tenseless theory of time is faced with insurmountable problems and should be abandoned in favour of the tensed theory of time. Smith;s main argument attacks the fundamental premise of the tenseless theory: that tenseless truth conditions for tokens of tensed sentences adequately capture the meaning of tensed sentences. His position is that tenseless truth conditions cannot explain the logical relations between tensed sentences, thus the tensed theory must be accepted. Against Smith, this paper (...) adopts an alternative approach to the explanation of the entailment relations between sentences which contain indexicals. The approach drops the reliance upon tokens and instead relies on the evaluation of sentence types with respect to a context rather than upon actual or possible utterances of tokens of the types. This (new) version of the tenseless theory of time can adequately explain the relevant entailment relations between tensed sentences. (shrink)

I explore some of the ways that assumptions about the nature of substance shape metaphysical debates about the structure of Reality. Assumptions about the priority of substance play a role in an argument for monism, are embedded in certain pluralist metaphysical treatments of laws of nature, and are central to discussions of substantivalism and relationalism. I will then argue that we should reject such assumptions and collapse the categorical distinction between substance and property.

The sports world has historically rejected the practice of tanking. I argue that this attitude is unwarranted. To do so, I introduce a concept called strategic suboptimal play (SSP), which is the practice of incurring the risk of a short-term competitive disadvantage to increase the chances of gaining a longer-term competitive advantage. Tanking is just an instance of SSP employed in higher-order games, i.e. games that are at least partially played by other games, like tournaments or seasons. Since SSP is (...) integral to every sport, there are currently no easy grounds for rejecting it outright. As such, the same is true of tanking. I will explore some possible reasons why tanking is wrongly thought objectionable, as well as some objections to and implications of my argument for competitive sports more broadly. (shrink)

A leaf falls to the ground, wafting lazily on the afternoon breeze. Clouds move across the sky, and birds sing. Are these events governed by universal laws of nature, laws that apply everywhere without exception, subsuming events such as the falling of the leaf, the movement of the clouds and the singing of the birds? Are such laws part of a small set of fundamental laws, or descended from such a set, which govern everything there is in the world?

As you face a life-defining change, you might ask yourself: Who will I become? This can be understood as a question about the nature and character of your future life, asked from your first person, or subjective, perspective. The nature and character of your conscious, first person, lived experience is a defining constituent of what it is like to be you. Framed this way, knowing the nature of your future lived experience is a way of knowing your future self. In (...) this paper, I explore this way of understanding one’s self and its implications for understanding life-defining changes in high-stakes contexts. My exploration of this way of understanding one’s self highlights the role of experience in grasping perceptual truths, and the importance of imagination, empathy, and testimony in self-understanding and prediction. A theory of the causal relate as aspects or property instances is developed. A supposed problem for transitivity is assessed and then resolved with aspects as the causal relata.

Background and objective: Code status discussions may fail to address patients’ treatment-related goals and their knowledge of cardiopulmonary resuscitation (CPR). This study aimed to investigate patients’ resuscitation preferences, knowledge of CPR and goals of care. Design, setting, patients and measurements: 135 adults were interviewed within 48 h of admission to a general medical service in an academic medical centre, querying code status preferences, knowledge about CPR and its outcome probabilities and goals of care. Medical records were reviewed for clinical information (...) and code status documentation. Results: 41 (30.4%) patients had discussed CPR with their doctor, 116 (85.9%) patients preferred full code status and 11 (8.1%) patients expressed code status preferences different from the code status documented in their medical record. When queried about seven possible goals of care, patients affirmed an average of 4.9 goals; their single most important goals were broadly distributed, ranging from being cured (n = 36; 26.7%) to being comfortable (n = 8; 5.9%). Patients’ mean estimate of survival to discharge after CPR was 60.4%. Most patients believed it was helpful to discuss goals of care (n = 95; 70.4%) and the chances of surviving inhospital CPR (n = 112; 83.0%). Some patients expressed a desire to change their code status after receiving information about survival following inhospital CPR (n = 11; 8.1%) or after discussing goals of care (n = 2; 1.5%). Conclusions: Doctors need to address patients’ knowledge about CPR and take steps to avoid discrepancies between treatment orders and patients’ preferences. Addressing CPR outcome probabilities and goals of care during code status discussions may improve patients’ knowledge and influence their preferences. (shrink)

Analytical reflections on tasks and functions of philosophy in the modern world, as well as, efforts deriving novel vision of practically all areas of the philosophical thought may become sound only after consideration of the innovations with which modern natural science has crossed the 20—21 centuries boundary. Discoveries in astrophysics at the end of the 20th century offer new and unprecedented perceptions of our world. In this world only 4% of the total Universe energy is attributed to the known forms (...) of the matter, 20% constitutes “dark matter” and 76% is in “dark energy”. The first decade of the 21st century will go on record inhistory of the civilization as the one associated with breakthrough experiments shedding light on the nature of the mysterious types of the matter, and construction of the unified theory of field. It is safe to regard modern science to be on the verge of profound transformations. These changes are bound to alter our outside world comprehension, redefining human being’s place in it. That advances a set of new serious requirements to philosophy as a science that must present ability to adapt to provide adequate and meaningful methodological interpretations to anticipated discoveries. This article addresses the characteristic features of modern conceptual knowledge of the world, with an attempt of offering their philosophical and methodological comprehension. (shrink)
