The narration of tashahhud being a conversation between Allah, the Prophet and the angels is quite common among people. This article examines the authenticity of this narration and questions whether it has an informative value. In this context, the research undertaken in Hadith, Siyar, Tafsīr and Fiqh sources resulted that the narration was not stated in the hadith books -with sanad (the chain of narrators) or without sanad. The first and only summary version of the script was included in the (...) commentary of Thaʿlebī (d. 427/1035), which has very problematic sanads. The first narration without sanad but having a full text (matn) was narrated by Qurṭubī (d. 671/1273). It appears that various commentators of hadith, fuqahāʾ (expert in Islamic jurisprudence), mufassirs (commentators on the Qur’ān) and historians followed Thaʿlabî and Qurṭubī by narrating from them. In fact, these group of scholars did not specify a sanad for the narration but they usually used tamrīd forms (a form which shows that the hadith is weak or deficient), which suggests that they also did not convinced that the narrarion was makbūl (accepted). On the other hand, the fact that this narration did not accompany authentic (ṣaḥīḥ) hadiths on the emergence of tashahhud narrated by hadith scholars, such as Bukhārī, Muslim, Abū Dāwūd, Nasāʾī and Ibn Mājah, which also indicates another problem with this narration. Summary: The narration on the emergence of the prophetic prayer that is called tashahhud in the fiqh literature as it includes the word shahadah (testimony) and known as “al-tahiyyat” and “tahiyyat” is constantly transmitted among people. According to this narration, the Prophet (pbuh) praised Allāh by saying “al-taḥiyyātu lillāhi wa-al-salawātu wa-al-ṭayyibāt” on the night of Miʿrāj when he met Allāh. Our Lord responded to him by saying “al-salāmu ʿalayka ayyuhan-Nabiyyu wa-raḥmatullāhi wa-barakātuhu”. The honorable Prophet also included his ummah in this prayer by saying “al-salāmu ʿalayna wa-ʿalā ʿibād Allāh al-ṣāliḥīn” and the Gabriel (and/or angel community) who witnessed this greeting said “ashhadu an lā illāha illallāh wa-ashhadu anna Muḥammadan ʿabduhu wa-rasūluhu.”This article examines the authenticty of the narration and whether it has an informative value. In this tafsīr, Thaʿlabī combines two different chains of narrators in one text. The sanads of these two narrations combined by Thaʿlabī as follows:1. Sanad: Zuhrī → Ibn Salimah b. ʿAbd al-Raḥmān → Jābir b. ʿAbdullāh → Prophet (pbuh).2. Sanad: Suddī → Muḥammad b. al-Sāib → Bāzān → Ibn ʿAbbās → Prophet (pbuh).The identity of Ibn Salimah mentioned in the first sanad is disputed. The rijāl (literally; men, refers to knowledge of men/narrators) scholars, such as Ibn Abī Ḥātim stated that he is a man whose memory is corrupted in his old age. In the second sanad there are three dhaʽīf (weak) narrators, namely Suddī, Muḥammad b. al-Sāib and Bāzān. Ibn Abī Ḥātim stated that some parts of Kalbī’s (Muḥammad b. al-Sāib) narration with ṭarīkh (synonym of sanad) of Bāzān from Ibn ʿAbbās was fabricated. Moreover, Thaʿlabī who narrated these two sanads in his tafsīr was accused of being conveying fabricated narrations in his books.As far as we can ascertain, Qurṭubī narrated the first narration of this story without sanad and without referring to a source. However, he narrated the full version of the text. Similarly this narration was also transmitted by Suhaylī and ʿAlī al-Qārī without sanad and a reference but they transmitted it by seperating into two slightly different texts. According to Suhaylī’s text in al-Ravḍ al-Unuf, angels stated “al-salāmu ʿalayka ayyuhan-Nabiyyu wa-raḥmatallāhi wa-barakātuhu” not Allāh. According to ʿAlī al-Qārī’s text in Sharḥ al-Shifa, when Allāh Said “al-salāmu ʿalayka ayyuhan-Nabiyyu wa-raḥmatallāhi wa-barakātuhu”, the Prophet (pbuh) responded by saying: “Allāhumma anta al-Salām wa-minka al-Salām wa-ilayka yarjiuʿ al-Salām, al-Salām alaynā wa-alā ibād Allāh al-sālihīn.” It is clear that there are disputes about the contents of some sentences as well as their subjects in the text of Tashahhud’s narration.The full text and summary versions of this narrarion can be found in tafsīr books, such as Rāzī's Mafātiḥ al-ghayb, Samarqandī's Baḥr al-ʿulūm and Bursavī's Rūḥ al-bayān; in fiqh books, such as Bābartī's al-ʿInâyah, Ḥaddād's al-Javharah al-nayyirah, ʿAynī’s al-Bināyah, Molla Khusraw’s Durar al-ḥukkām, Jamal’s Futūḥāt al-Wahhāb and Bujayramī’s al-Tajrīd; and in various hadith commentaries and in some siyar books. The authors of these books did not mention sanads of their narrations and they usually used tamrīd forms. This suggests that they also did not consider this narration as authentic. On the other hand, the fact that all narrations transmitted in these books are not compatible with those authentic (ṣaḥīḥ) hadiths about the emergence of tashahhud, which were reported by muhaddiths, such as Bukhārī, Muslim, Abū Dāwūd, Nasāī and Ibn Mājah. This also indicates another problem with this narration. The authentic hadiths on the issue as follows: 1. Bukhārī→Musaddad→Yaḥyā→Aʿmash→Shaqīq→Ibn Masʿūd: He said:When we prayed with the Messenger of Allāh (pbuh), we used to say: “Peace (al-Salām) be upon Allāh, peace be upon Jibrīl, peace be upon Mikāʿīl.” The Messenger of Allāh (pbuh) said: “Do not say: Peace (al-Salām) be upon Allāh, for Allāh is al-Salām.” Rather say: “al-taḥiyyātu lillāhi wa-al-salawātu wa-al-ṭayyibāt, al-salāmu ʿalayka ayyuhan-Nabiyyu wa-raḥmatallāhi wa-barakātuhu. Al-salāmu ʿalayna wa-ʿalā ʿibād Allāh al-ṣāliḥīn, ashhadu an lā ilāha illallāh wa-ashhadu anna Muḥammadan ʿabduhu wa-rasūluhu (Allāh compliments, prayers and pure words are due to Allāh. Peace be upon you, O Prophet, and the mercy of Allāh and his blessings. Peace be upon us and upon the righteous slaves of Allāh. I bear witness that none has the right to be worshipped except Allāh and I bear witness that Muḥammad is His slave and Messenger.”2. Bukhārī→Abū Nuaym→Sayf→Mucāhid→Abū Maʿmar ʿAbdullāh b. Saḥbarah→Ibn Masʿūd: He said:Allāh’s Messenger (pbuh) taught me Tashahhud as he taught me a sūrah (chapter) from the Qur’ān, while my hand was between his hands. (Tashahhud was): “All the best compliments and the prayers and the good things are for Allāh. Peace and Allāh’s Mercy and Blessings be on you, O Prophet! Peace be on us and on the pious slaves of Allāh, I testify that none has the right to be worshipped but Allāh, and I also testify that Muhammad is Allāh’s slave and His Apostle.” (We used to recite this in the prayer) during the lifetime of the Prophet (pbuh), but when he had died, we used to say: “Peace be on the Prophet.”As a result, it is unlikely that the Prophet (pbuh) did not touch upon the relationship between the Miʿrāj and the Tashahhud while teaching it. It is also unlikely that his companions who narrated this occasion did not mention about this important detail although they had such knowledge. Indeed, hadith scholars did not include the narrations that associated tashahhud with the Miʿrāj but they reported two other aforementioned narrations on the emergence of the Tashahhud in their books, which raises doubts over the authenticity of the relevant narration in question. Dante, primo comparatista, è in grado di reinventare, armonizzandoli, elementi strutturali e tematici provenienti sia dalle visiones latine che dalla tradizione islamica del Isra’ wa’ l Mi‘râj.The purpose of this essay is to make a confrontation between the main important visiones of the Occidental Literature – also the Visio Pauli and the Dante’s Commedia – anche the various redactions of the Islamic Isra’ wa-l mi’râj. The confrontation is in order to establish if the remarked affinities are just due to polygenesis or rather caused by concrete intertestuality.Between the visiones, the mirajic tradition and the Commedia we are in front of a three voices dialogue: it’s like a symphony, in which the themes enriches themselves and, at least, the arrive to Dante for being harmonized. Il contributo sostiene che una versione lunga e composita del Viaggio notturno del profeta e della sua ascensione, attribuita a Ibn ‘Abbas attraverso una figura più tarda conosciuta come al-Bakri, è diventata molto popolare e largamente diffusa nel tredicesimo secolo. Qui si propone una traduzione del viaggio celeste di Muhammad a partire da un importante manoscritto inedito di Istanbul copiato nella penisola araba verso la fine del tredicesimo secolo. Questa traduzione si propone come strumento per gli studiosi interessati alla tradizione (...) islamica delle ascensioni celesti e per chi si occupa delle possibile influenze musulmane sull’opera di Dante. Nonostante non si dimostri che Dante avesse avuto accesso diretto a questa fonte nel momento in cui componeva la divina commedia, ci sono prove sufficienti che le versioni di questo racconto fossero diffuse in diverse parti del Mediterraneo, prima e durante la vita di Dante. L’autore fa propria la recente ipotesi interpretativa di Bencheikh che sottolinea il ruolo fondamentale della versione di Bakri del Mi’râj per la composizione dell’ormai noto Libro della Scala, tradotto in latino e lingua francese antico in al-Andalus nella seconda metà del tredicesimo secolo.This article argues that a long and composite version of the narrative of Muhammad's night journey and ascension, one often ascribed to Ibn 'Abbas via a later figure known as al-Bakri, became especially popular and widely distributed in the thirteenth-century CE. It offers a translation of the Tour of Paradise section from a particularly important unpublished Istanbul manuscript preserving this version, copied in the Arabian peninsula near the end of the thirteenth-century. This translation could serve as a resource to scholars who are interested in the history of Islamic ascension narratives, and interested in the question of possible Muslim influences on Dante's Divine Comedy. While the author of this article does not argue that Dante must have been aware of this particular manuscript as he composed his masterwork, he claims that there is enough evidence to suggest that versions of this narrative circulated in different parts of the Mediterranean before and during Dante's lifetime. He supports the earlier conjecture by Bencheikh that the Bakri versions were likely foundational to the composition of the now famous "Book of Muhammad's Ladder" that was translated into Latin and Old French in al-Andalus / Spain in the second half of the thirteenth-century. Business organizations in their work environment, aspire to create a high level of performance and low levels of absenteeism and turnover. Organizational commitment is considered a key factor in achieving this objective, however, it can be conditioned by several factors, among which is the psychological contract. The literature has related the organizational commitment with the fulfillment of the psychological contract framing it as one of the explanatory variables. This work aims to investigate research trends on psychological contract and organizational commitment. (...) For this purpose, bibliometric techniques and the software SciMAT have been used. 220 journal articles indexed in Web of Science (WoS) were analyzed. The findings indicate that the theme chosen for this review is valid. Based on the relationship between the two concepts, as the most recurrent themes, issues such as the sense of justice and the consequences of the violation of the psychological contract, normative commitment, HR management or job insecurity are addressed. However, in the last period analyzed (2015–2018), publications related to more sensitive topics to the present time emerge, such as the employability or the impact of these two concepts in the new generations (millennial and generation-Y) or the retention of talent. On the other hand, shortcomings are detected in the research on the ideologically charged psychological contract, the analysis of the organizational context or cultural and demographic factors in relation to both theoretical constructs. The contribution of this work lies in giving visibility to scientific results, which will serve business organizations as instruments for decision making in their labor management and, for the scientific community, as knowledge of the research spaces to explore. Para demostrar esta premisa, reconstruye los fundamentos empíricos de su psicología moral, a los fines de “polemizar” con interpretaciones ilustradas que yuxtaponen diferentes tipologías de despotismo para fundamentar una congruencia exclusivamente racionalistas de sus efectos. Teniendo presente esta dicotomía, explora la metodología comparada del autor francés, con el objetivo de presentar argumentos (...) en favor de una versión hegemónica de los efectos del despotismo, destinada a reproducirse en el comportamiento individual bajo formas “asentidas” de dominación. Community-supported agriculture (CSA) initiatives are spaces where diverse work relations are performed. From a postcapitalist perspective, these initiatives attempt to create alternative-capitalist and non-capitalist work relations next to capitalist ones. While analyses of work relations in CSA abound, it remains uncertain how such diversification is made possible and how it is shaped by the micro-politics of and power relations in these initiatives. This paper addresses this gap by analysing how power shapes transformations to postcapitalist work relations in CSA. It provides (...) substantial empirical evidence of multiple manifestations of power enabling or constraining postcapitalist work relations through a comparative case study of three CSA initiatives in Portugal. Results show that while CSA creates postcapitalist work relations that are non-alienated, non-monetised and full of care, they insufficiently unmake unbalanced power relations established in capitalist work relations. This paper argues that, when establishing postcapitalist work relations, the selected CSA initiatives could benefit from actively deconstructing internal hierarchies, de-centralising decision-making power from farm owners and addressing oppressive power relations that are ossified in their local and cultural context. We present evidence that preschool children oftentimes understand disjunctive sentences as if they were conjunctive. The result holds for matrix disjunctions as well as disjunctions embedded under every. At the same time, there is evidence in the literature that children understand or as inclusive disjunction in downward-entailing contexts. We propose to explain this seemingly conflicting pattern of results by assuming that the child knows the inclusive disjunction semantics of or, and that the conjunctive inference is a scalar implicature. We make (...) two assumptions about implicature computation in the child: that children access only a proper subset of the adult alternatives, and that children possess the adult capacity to strengthen sentences with implicatures. As a consequence, children are expected to sometimes not compute any implicatures at all, but in other cases they are expected to compute an implicature that is different from the adult implicature. We argue that the child’s conjunctive strengthening of disjunctive sentences realizes the latter possibility: the adult infers that the conjunction is false but the child infers that the conjunction is true. This behaviour is predicted when our assumptions about child development are coupled with the assumption that a covert exhaustive operator is responsible for strengthening in both the child and the adult. Specifically, children’s conjunctive strengthening is predicted to follow from the same mechanism used by adults to compute conjunctive free choice implicatures in response to disjunctive permission sentences. We furthermore argue that this parallel between the child and the adult extends to disambiguation preferences. In particular, we present evidence that children prefer to strengthen disjunctions to conjunctions, in matrix and embedded positions ; this result mirrors previous findings that adults prefer to compute free choice, at the root and under every. We propose a disambiguation strategy that explains the preference for conjunctive strengthening – by both the child and the adult – even though there is no general preference for exhaustification. Specifically, we propose that the preference for a conjunctive strengthening follows from a pragmatic preference for a complete answer to the Question Under Discussion. (shrink)

In recent months, pharmaceutical manufacturers have brought legal challenges to a provision of the 2022 Inflation Reduction Act (IRA) empowering the federal government to negotiate the prices Medicare pays for certain prescription medications. One key argument made in these filings is that price negotiation is a “taking” of property and violates the Takings Clause of the US Constitution. Through original case law and health policy analysis, we show that government price negotiation and even price regulation of goods and services, including (...) patented goods, are constitutional under the Takings Clause. Finding that the IRA violates the Takings Clause would radically upend settled constitutional law and jeopardize the US’s most important state and federal health care programs. (shrink)

Views on Indian and Tibetan Buddhist philosophical positions (siddhānta).

Public benefit corporations are National Health Service, that is, state, entities whose function to provide healthcare in discharge of public duties. If we regardvalue as the output of such organisations, it seems logical to connect the values of the organisation to thevalue produced by such organisations. But, on closer examination there are competing underlying logics in play: (1) those based on promoting organisational efficiency and efficacy; and (2) those based on the idea of building service provision around the clinician–patient relationship. (...) Underlying these logics are differing value sets. These clash. Because of the clashing of underlying moral frameworks the connection between values andvalue becomes hard, if not impossible. This paper argues that (1) the clash in these moral frameworks must be addressed by the organisation rather than between individuals or groups of individuals within the organisation; (2) alloying duties within hybrid professionals submerges but does not resolve these conflicts; (3) one approach could be to impose on the organisation itself an ethical imperative to promote, enhance and protect from deterioration the welfare of the patients; (4) a board ethics committee is a possible organisational structure that could transparently and fairly balance clashes within the competing moral frameworks in a way that could reconcile the competing logics and (5) if such conflicts can be better resolved at the organisational level what the organisation must do to achieve its objectives will become clearer because what needs to be valued would naturally emerge connecting values,value and what is valued. In order to explore the ways knowledge travels across spatial and cultural boundaries, this article focuses on the intriguing case of the Edinburgh-trained Scottish surgeon James Esdaile (1808–59), who, after practising conventional surgery for almost fifteen years in British colonial India, quite unexpectedly turned to mesmeric anaesthesia in the last five years of his service. By following his career and his mesmeric turn, the article describes Esdaile's subsequent public experiments in mesmeric anaesthesia in collaboration with indigenous practices and practitioners of (...) trance induction in the 1840s which led to the creation of a special mesmeric hospital in Calcutta. Although very successful, it eventually ceased to function, apparently victim to new and cheaper chemical anaesthetics. Mobilizing the insights of science studies scholarship into the processes of scientific experimentation, this article seeks to shed new light on the necessary professional, social and political investments for the making and mobility of scientific knowledge across social and cultural boundaries in a colonial setting. Este artigo recupera o papel dos cartógrafos indianos na construção da ciência cartográfica britânica e a maneira como o saber-fazer local (ainda que em contexto colonial) se projectou na metrópole. Mostra-se, assim, como a ciência cartográfica na Índia antecipou em larga medida as realizações então em curso na Grã-Bretanha. À noção passiva de difusão, substituem-se as noções mais activas, de recepções, de representações e de apropriações historicamente situadas. Com este estudo sobre cartografia, o autor põe em evidencia a cooperação entre (...) elites indianas e britânicas. O saber-fazer indiano – protagonizados pelo que chama de cartógrafos subalternos – e em especial a técnica da agrimensura foram plenamente reconhecidos pelas instituições coloniais militares e fiscais, que se esforçaram por o desenvolver. Sem pôr em causa a relação entre saber/poder nos processos coloniais, Kapil Raj define zonas de negociação e mostra mesmo como os saberes produzidos por elites não ocidentais se projectaram no Ocidente e o transformaram. La idea de que las teorías separadas por una revolución científica son inconmensurables fue sugerida, de manera independiente, por Thomas S. Kuhn (1962) y Paul Feyerabend (1962) a inicios de la década de 1960. Desde entonces y hasta nuestros días, la tesis de inconmensurabilidad, así como sus polémicas implicancias, han ocupado un papel protagónico en las discusiones en torno a los estudios acerca de la ciencia.1 Un variado número de problemas derivados de la tesis de inconmensurabilidad, tales como el cambio (...) de significado, la referencia de los términos teóricos, la racionalidad y los aspectos cognitivos del cambio científico, sus implicancias para las concepciones realistas y anti-realistas acerca de las teorías científicas, entre otros, pueden encontrarse analizados en una importante compilación de trabajos de un número de distinguidos investigadores editada por Paul Hoyningen-Huene y Howard Sankey, y publicada por primera vez hace ya más de una década bajo el título Incommensurability and related matters (Hoyningen-Huene & Sankey, 2001). Academic research studies examining the ethical attitudes and behaviors of salespeople have produced several frameworks that explore the ethical decision-making processes to which salespeople adhere when faced with ethical dilemmas. Past literature enriches our understanding; however, a critical review of the relevant literature suggests that an emotional route to salesperson ethical decision-making has yet to be explored. Given the fact that individuals’ emotional capacities play an important role in decision-making when faced with an ethical dilemma, there is a need for (...) empirical research in this area. We address this issue by outlining and testing an emotion-based model to study the ethical attitudes and behaviors of salespeople in a relational selling context. Building on the cognitive-affective model proposed by Gaudine and Thorne (J Bus Ethics 31:175–187, 2001 ), we outline a framework that incorporates higher order prosocial emotions: capacity for concern and capacity for guilt. We include salesperson’s role clarity within the organization as a moderator to examine person–situation interaction. (shrink)
