Explainable AI (XAI) provides methods to understand non-interpretable machine learning models. However, we have little knowledge about what legal experts expect from these explanations, including their legal compliance with, and value against European Union legislation. To close this gap, we present the Explanation Dialogues, an expert focus study to uncover the expectations, reasoning, and understanding of legal experts and practitioners towards XAI, with a specific focus on the European General Data Protection Regulation. The study consists of an online questionnaire and (...) follow-up interviews, and is centered around a use-case in the credit domain. We extract both a set of hierarchical and interconnected codes using grounded theory, and present the standpoints of the participating experts towards XAI. We find that the presented explanations are hard to understand and lack information, and discuss issues that can arise from the different interests of the data controller and subject. Finally, we present a set of recommendations for developers of XAI methods, and indications of legal areas of discussion. Among others, recommendations address the presentation, choice, and content of an explanation, technical risks as well as the end-user, while we provide legal pointers to the contestability of explanations, transparency thresholds, intellectual property rights as well as the relationship between involved parties. Organ trafficking is officially banned in several countries and by the main Nephrology Societies. However, this practice is widespread and is allowed or tolerated in many countries, hence, in the absence of a universal law, the caregiver may be asked for advice, placing him/her in a difficult balance between legal aspects, moral principles and ethical judgments.In spite of the Istanbul declaration, which is a widely shared position statement against organ trafficking, the controversy on mercenary organ donation is still open and (...) some experts argue against taking a negative stance. In the absence of clear evidence showing the clinical disadvantages of mercenary transplantation compared to chronic dialysis, self-determination of the patient may conflict with other ethical principles, first of all non-maleficence. The present paper was drawn up with the participation of the students, as part of the ethics course at our medical school. It discusses the situation in which the physician acts as a counselor for the patient in the way of a sort of “reverse” informed consent, in which the patient asks advice regarding a complex personal decision, and includes a peculiar application of the four principles to the donor and recipient parties. Background: Undergraduate nursing students have been documented to experience ethical distress during their clinical training and felt poorly supported in discussing the ethical issues they encountered. Research aims: This study was aimed at exploring nursing students’ perceived opportunity to discuss ethical issues that emerged during their clinical learning experience and associated factors. Research design: An Italian national cross-sectional study design was performed in 2015–2016. Participants were invited to answer a questionnaire composed of four sections regarding: (1) socio-demographic data, (2) previous (...) clinical learning experiences, (3) current clinical learning experience quality and outcomes, and (4) the opportunity to discuss ethical issues with nurses in the last clinical learning experience (from 0 – ‘never’ to 3 – ‘very much’). Participants and research context: Participants were 9607 undergraduate nursing students who were attending 95 different three-year Italian baccalaureate nursing programmes, located at 27 universities in 15 Italian regions. Ethical considerations: This study was conducted in accordance with the Human Subject Research Ethics Committee guidelines after the research protocol was approved by an ethics committee. Findings: Overall, 4707 (49%) perceived to have discussed ethical issues ‘much’ or ‘very much’; among the remaining, 3683 (38.3%) and 1217 (12.7%) students reported the perception of having discussed, respectively, ‘enough’ or ‘never’ ethical issues emerged in the clinical practice. At the multivariate logistic regression analysis explaining 38.1% of the overall variance, the factors promoting ethical discussion were mainly set at the clinical learning environment levels (i.e. increased learning opportunities, self-directed learning, safety and nursing care quality, quality of the tutorial strategies, competences learned and supervision by a clinical nurse). In contrast, being male was associated with a perception of less opportunity to discuss ethical issues. Conclusion: Nursing faculties should assess the clinical environment prerequisites of the settings as a context of student experience before deciding on their accreditation. Moreover, the nursing faculty and nurse managers should also enhance competence with regard to discussing ethical issues with students among clinical nurses by identifying factors that hinder this learning opportunity in daily practice. Este artículo plantea un diálogo sobre la ficción y su relevancia narrativa dentro del relato histórico contemporáneo colombiano, a la luz de sus relaciones transversales. Tras el Acuerdo de Contribución a la Verdad Histórica y la Reparación y de la consolidación del trabajo llevado a cabo por el Centro Nacional de Memoria Histórica iniciado hace casi una década con su primer informe, es pertinente volver sobre algunas ideas relacionadas con la manera en la que se narra la historia en Colombia. En este sentido, se constata el valor histórico de la ficción, así como la vitalidad de sus diversos actores sociales y culturales, en sus intersecciones y recorridos por la memoria colectiva, en su materialidad y en su reinvención histórica. Los textos de ficción, por tanto, ofrecen caminos de reinvención de los relatos históricos, que no los sustituyen, pero sí empoderan a sus participantes/enunciantes, sus lectores/receptores y sus versiones/ relatos dentro de los procesos de memorias nacionales y humanas de la Colombia de hoy. Lo significativo de esta propuesta radica en que estos relatos son inclusivos, plurales y carecen del juicio moral hecho por una voz narradora autoritaria y única. (shrink)

This paper provides a historical reevaluation of the originality and implications of Avempace's critique of Aristotle's causal explanation of the motion of projectiles. It also offers a serious revision of the place which has usually been assigned to Avempace in the history of science. The views regarding projectiles defended in Avempace's Arabic commentary are in sharp opposition to the anti-Aristotelian Avempace that was known in the Medieval West through Averroes. Avempace's commentary reveals only a moderate critic of Aristotle, a critic (...) who did not, in any case, break with the master, and who, therefore, did not even go as far as Philoponus in creating a new and more profound theory of projectile motion. Discussions of psychological measurement are largely disconnected from issues of measurement in the natural sciences. We show that there are interesting parallels and connections between the two, by focusing on a real and detailed example (temperature) from the history of science. More specifically, our novel approach is to study the issue of validity based on the history of measurement in physics, which will lead to three concrete points that are relevant for the validity debate in psychology. First of all, studying (...) the causal mechanisms underlying the measurements can be crucial for evaluating whether the measurements are valid. Secondly, psychologists would benefit from focusing more on the robustness of measurements. Finally, we argue that it is possible to make good science based on (relatively) bad measurements, and that the explanatory success of science can contribute to justifying the validity of measurements. The problems that exist in relating quantum mechanical phenomena to classical concepts like properties, causes, or entities like particles or waves are well-known and still open to question, so that there is not yet an agreement on what kind of metaphysics lies at the foundations of quantum mechanics. However, physicists constantly use the formal resources of quantum mechanics in order to explain quantum phenomena. The structural account of explanation, therefore, tries to account for this kind of mathematical explanation in physics, (...) and hinges on the following claims: i) scientific models are central in scientific explanation; ii) in some cases the relevant information for the explanation/understanding of a phenomenon P consists in the sole structural properties of the (models displayed by the) theory; iii) in these cases, the interpretation of the formalism in terms of a categorial framework is unessential for the explanation of P and a mathematical model can be at the base of an objective and effective scientific explanation. The present paper will carry a reflection about some issues arising from R.I.G. Hughes and Robert Clifton’s works in the attempt to outline some details of structural explanation. (shrink)

Resumo Entre 1988 e 1993, Iúri M. Lótman formulou algumas proposições sobre “a voz da massa anônima”: uma voz coletiva que, em certas situacões ligadas a crises de caráter cultural, é portadora de paixões violentas que podem produzir interferências profundas no curso da história. Em seus últimos trabalhos, o semioticista russo postulou, diante disso, a noção de uma semiótica das emoções como objeto de estudo para entender a dinâmica cultural, em especial de períodos tidos como revolucionários ou de transição, a (...) saber, quando a massa anônima é capaz de manipular os eventos ou quando, revendo o passado, confere aos eventos uma interpretação distorcida. Lótman focalizou, principalmente, a relação entre as grandes fraturas históricas, os mecanismos de autopropagação do medo e a criação cultural de bodes expiatórios. O presente estudo visa abordar a reflexão de Lótman sobre perseguição, com especial atenção à figura da mulher durante o fenômeno de caça às bruxas. ABSTRACT Between 1988 and 1993, Yuri Lotman composed a series of reflections on “the voice of the anonymous mass”: a collective voice that, in particular situations linked to a cultural crisis, is the bearer of striking passions, which can deeply influence history. In his late works, the Russian semiotician postulated, therefore, the idea of a semiotics of emotions as an object of study to understand the dynamics of culture, especially during periods perceived as revolutionary or transitional―namely, when the anonymous mass manipulates the events or, when looking back, gives them a distorted interpretation. Lotman focused in particular on the relationship between great historical fractures, the self-propagating mechanisms of fear, and the cultural creation of scapegoats. This paper is devoted to framing Lotman’s reflection on persecution, paying particular attention to women during the phenomenon of the witch hunt. (shrink)

Examining the health of the population of the industrial world, the authors conclude that it is no healthier than it used to be, rather that diseases have been substituted, not eliminated. They suggest an alternative approach to health care which derives from a philosophy of nature.

In a recent paper given at a Symposium on terrorism, Thomas Hill, Jr., discussed “Making Exceptions Without Abandoning the Principle: Or How a Kantian Might Think about Terrorism.” His argument, however, after acknowledging that “terrorists of course often claim to have morally worthy ends and also means that are morally justified in the context,” and further stating that “some such claims deserve a serious hearing,” goes on to deal with the related question of…what one may justifiably do in response to (...) morally indefensible terrorism.
