In this paper, I explore Kant’s discussion of juridical and ethical laws in the introduction to the Metaphysics of Morals as a whole. Following Marcus Willaschek and early Allen Wood, I pose a dilemma for Kant that I call “the paradox of juridical imperatives”, a dilemma that Willaschek and Wood hold Kant can only avoid by giving up his claim that juridical laws are categorical imperatives. I show how a set of interpretative issues concerning juridical incentives, the content (...) of juridical laws, and the idea of an “indirect” ethical obligations, hang together, and must solved simultaneously in order to address the paradox. I argue, contra Willaschek and Wood, that we can dissolve the paradox, solving the network of issues satisfactorily and affirming the status of juridical laws as categorical imperatives, once we recognize that one can go wrong with respect to a principle while fulfilling the letter of its requirements. The picture that emerges is one on which we can straightforwardly affirm Recht as a moral concept for Kant, while simultaneously representing its distinctive character in his system of morality. Johnathan Cohen's book provides a lucid and penetrating treatment of the fundamental issues of contemporary analytical philosophy. This field now spans a greater variety of topics and divergence of opinion than fifty years ago, and Cohen's book addresses the presuppositions implicit to it and the patterns of reasoning on which it relies.

The structure and style of philosophy has evolved in response to philosophy's confrontation with its own limits. Are these limits real or are they just phantoms haunting the philosophical project? How do philosophy and philosophers attempt to overcome these limits, or at least come to terms with them? In "Philosophy at the Limit" David Wood pursues this theme in modern philosophers from Hegel to Derrida including Nietzsche, Wittgenstein, Heidegger and Gadamer. He focuses on questions of philosophical style, problems with (...) dialogue and in direct communication, the structural closure of philosophical texts, and performative strategy in philosophy. USHER In 1843, two years before Henry Thoreau built his cabin at Walden Pond, the Fitchburg Railroad laid down tracks through the woods near the Pond for its line connecting Boston to Fitchburg. The original Fitchburg Line, at 54 miles long, was, until 2010, the longest run in the present -day MBTA Commuter Rail system. And it is one of (...) the oldest railways in New England. By 1900, fortunes swelled and the Fitchburg’s Hoosac Tunnel Line took passengers and goods westward toward Chicago. The Lake Champlain Route connected Boston to points north like Burlington, Vermont. The Railroad was literally a fixture in Thoreau’s landscape. Its tracks pass remarkably close to Walden Pond (Figure 2), and the Fitchburg Line—both its reality and the specter of it—is practically a character in his writing: “I usually go to the village along its causeway, and am, as it were, related to society by this link,” Thoreau writes in “Sounds,” a chapter of Walden that contains what must be one of the most picturesque odes (or laments) to rail travel and commerce in all of American literature: The engine’s whistle, Thoreau complains, pierces the still silence of his idyllic retreat like a screaming hawk circling a farmer’s field, its billows of steam an ominous harbinger of “this travelling demi-god, this cloud-compeller.”1 Thoreau’s frequent, customary walks into Concord along the railroad tracks took him through a heavily excavated stretch of the line known as the Deep Cut, to which he returned again and again each year in early spring, even after leaving the cabin, to observe and to record his observations. The leaf-shaped sand flows and trickling surface erosion caused by melting frost in the banks of the Deep Cut are elaborately described in Thoreau’s chapter in Walden entitled “Spring,” what Laurence Buell calls the “high point of Thoreau’s epic.”2 And yet, in spite of the universal acclaim of this passage as a literary tour de force, it has not received the full attention it deserves. What warrants fresh consideration first and foremost is “Spring”’s deep-rootedness in classical sources. Many classical influences, allusions, and a good deal of etymological word play have gone so far unnoticed. The chapter is also important because it describes, by intimation, what contemporary scientists now call emergence. Emergent phenomena are properties or behaviors that arise in systems as a result of complex, dynamic interactions amongst constituent parts, including changes to a system brought about by human interventions3—not only, e.g., climate change and wildfires, but also traffic patterns and terrorist networks; kidney function in the body; the rings of Saturn. As he tries to capture the essence of the 114 classics and complexity in WALDEN’s “spring” Deep Cut and interpret its significance, Thoreau adumbrates this concept, but also grapples ingeniously with broader issues of perennial concern—the relationship of Nature to Culture, for example, of Wilderness to Civilization, of Science to the Humanities—making “Spring” not only a probing work of eco-criticism and environmental philosophy, but of scientific reflection and poetic experiment as well. In short, Thoreau’s “Spring” is that rare work of classical reception that transmits both literary and scientific insight. Perhaps at this point, in lieu of accolades, it is best to let Thoreau start speaking for himself. What I offer in the following pages is a commentary on the Deep Cut passage from “Spring.” Classical references and aspects of systems theory will be explained and contextualized as they emerge, as it were, from Thoreau’s text. The whole chapter corresponds to pages 289–308 in Cramer’s edition of Walden—26 paragraphs all told, of which only the relevant ones are printed and annotated here. Cet article se propose d’analyser comment s’écrit, en marge et à rebours de l’histoire de l’art des historiens, une histoire qui leur conteste le monopole de la discipline et qui revendique un point de vue spécifique. Ancrées dans (...) une pratique artistique, ces histoires de l’art des artistes prennent, en effet, le contre-pied d’une histoire de l’art dominante qu’elles critiquent et déconstruisent. Les enjeux de cette prise en charge de l’histoire de l’art par les artistes sont multiples : esthétiques bien sûr mais aussi épistémologiques et politiques. The clinical ethics literature is striking for the absence of an important genre of scholarship that is common to the literature of clinical medicine: systematic reviews. As a consequence, the field of clinical ethics lacks the internal, corrective effect of review articles that are designed to reduce potential bias. This article inaugurates a new section of the annual "Clinical Ethics" issue of the Journal of Medicine and Philosophy on systematic reviews. Using recently articulated standards for argument-based normative ethics, we provide (...) a systematic review of the literature on concealed medication for the management of psychiatric disorders. Four steps are completed: identify a focused question; conduct a literature search using key terms relevant to the focused question; assess the adequacy of the argument-based methods of the papers identified; and identify conclusions drawn in each paper and whether they apply to the focused question. We identified seven papers and provide an assessment of them. While none of the papers fully meet the standards of argument-based ethics, they did provide rationales for the use of concealed medications, with the important requirement such a practice be accountable in explicit organizational policy to prevent abuse of patients with mental illness or dementia. While philosophers debate the precise articulation of philosophical theory to achieve a desirable change in environmental attitudes, they may be neglecting the fountainhead of social change. Insofar as ordinary people are concemed, it is religion which is the greatest factor in determining morality. In order to achieve an enlightened environmental ethics, we need what can only be termed a “religious experience.” While not denying the efficacy of other religious persuasions, I explore the contribution of an informed modem Pantheism to environmental (...) ethics. The conceptual division of the holy and theworld is rectified by pantheism. As a form of “nature mysticism,” pantheism promotes a theological basis for achieving oneness with God through knowledge, devotion, and works, all of which establish an enlightened theory for environmental ethics. A modem pantheism bears investigation by those advocating new ethical approaches toward the environment. (shrink)

Analytic theology can flourish in the secular academy, and flourish as authentically Christian theology. Analytic Theology and the Academic Study of Religion explains analytic theology to other theologians and scholars of religion, while simultaneously explaining those other fields to analytic theologians. William Wood defends analytic theology from some common criticisms, but also argues that analytic theologians have much to learn from other forms of inquiry. Analytic theology is a legitimate form of theology, and a legitimate form of academic inquiry, (...) and it can be a valuable conversation partner within the wider religious studies academy. Analytic Theology and the Academic Study of Religion articulates an attractive vision of analytic theology, fosters a more fruitful inter-disciplinary conversation, and enables scholars across the religious studies academy to understand one another better. Hilary Putnam's Twin Earth thought experiment has come to have an enormous impact on contemporary philosophical thought. But while most of the discussion has taken place within the context of the philosophy of mind and language, Terence Horgan and Mark Timmons (H8cT) have defended the intriguing suggestion that a variation on the original thought experiment has important consequences for ethics.' Two profound atrocities in the history of Western culture form the subject of this moving philosophical exploration: American Slavery and the Holocaust. An African American and a Jew, Laurence Mordekhai Thomas denounces efforts to place the suffering of one group above the other. Rather, he pronounces these two defining historical experiences as profoundly evil in radically different ways and points to their logically incompatible aims. The author begins with a discussion of the nature of evil, exploring the fragility of (...) human beings and the phenomena of compartmentalizing, unquestioning obedience to authority, and moral drift. Citing compelling examples from history and contemporary life, he characterizes evil acts in terms of moral agency, magnitude, and intent. With moving testimony, Thomas depicts the moral pain of African Americans and Jews during their ordeals and describes how their past as victims has affected their future. Without invidious comparison, he distinguishes between extermination and domination, death and natal alienation, physical and mental cruelty, and between being viewed as irredeemable evil and as a moral simpleton. Thomas also considers the role of blacks and Jews in the Christian narrative. _In Vessels of Evil_, Thomas also considers the ways Jews and blacks have gone on to survive. He analyzes the relative flourishing of Jews and the languishing of blacks in this country and examines the implications of their dissimilar tragedies on any future relationship between these two minorities. I argue for the use of the adjunction operator (adding a single new element to an existing set) as a basis for building a finitary set theory. It allows a simplified axiomatization for the first-order theory of hereditarily finite sets based on an induction schema and a rigorous characterization of the primitive recursive set functions. The latter leads to a primitive recursive presentation of arithmetical operations on finite sets.

In this close examination of the social and political thought of Marcus Tullius Cicero, Neal Wood focuses on Cicero's conceptions of state and government, showing that he is the father of constitutionalism, the archetype of the politically conservative mind, and the first to reflect extensively on politics as an activity.

In _Thinking After Heidegger_, David Wood takes up the challenge posed by Heidegger - that after the end of philosophy we need to learn to _think_. But what if we read Heidegger with the same respectful irreverence that he brought to reading the Greeks, Kant, Hegel, Husserl and the others? For Wood, it is Derrida's engagements with Heidegger that set the standard here – enacting a repetition through transformation and displacement. But Wood is not content to crown (...) the new king. Instead he sets up a many-sided conversation between Heidegger, Hegel, Adorno, Nietzsche, Blanchot, Kierkegaard, Derrida and others. Derrida and deconstruction are first critically addressed and then drawn into the fundamental project of philosophical renewal, or renewal _as_ philosophy. The book begins by rewriting Heidegger's inaugural lecture, 'What is Metaphysics?' and ends with an extended analysis of the performativity of his extraordinary _Beitrage_. _Thinking after Heidegger_ will be a valuable text for scholars and students of contemporary philosophy, literature and cultural studies. This essay discusss (1) the differences and commonalities between romantic love and friendship and (2) the differences and commonalities between parental love of friendship.

Contemporary epidemiological methods testing the associations between green space and psychological well-being treat all vegetation cover as equal. However, there is very good reason to expect that variations in ecological "quality" (number of species, integrity of ecological processes) may influence the link between access to green space and benefits to human health and well-being. We test the relationship between green space quality and restorative benefit in an inner city urban population in Bradford, UK. We selected 12 urban parks for study (...) where we carried out botanical and faunal surveys to quantify biodiversity and assessed the site facilities of the green space (cleanliness, provision of amenities). We also conducted 128 surveys with park users to quantify psychological restoration based on four self-reported measure of general restoration, attention-grabbing distractions, being away from everyday life, and site preference. We present three key results. First, there is a positive association between site facilities and biodiversity. Second, restorative benefit is predicted by biodiversity, which explained 43% of the variance in restorative benefit across the parks, with minimal input from other variables. Third, the benefits accrued through access to green space were unrelated to age, gender, and ethnic background. The results add to a small but growing body of evidence that emphasise the role of nature in contributing to the well-being of urban populations and, hence, the need to consider biodiversity in the design of landscapes that enhance multiple ecosystem services. Religious practices centered on controlled trance states, such as Siberian shamanism or North African zar, are ubiquitous, yet their characteristics vary. In particular, cross-cultural research finds that female-dominated spirit possession cults are common in stratified societies, whereas male-dominated shamanism predominates in structurally flatter cultures. Here, we present an agent-based model that explores factors, including social stratification and psychological dissociation, that may partially account for this pattern. We posit that, in more stratified societies, female agents suffer from higher levels of psychosocial (...) trauma, whereas male agents are more vulnerable in flatter societies. In societies with fewer levels of formal hierarchy, males come into informal social competition more regularly than in stratified contexts. This instability leads to a cultural feedback effect in which dissociative experiences deriving from chronic psychosocial stress become canalized into a male religious trance role. The model reproduces these patterns under plausible parameter configurations. (shrink)

This essay, as the title suggests, is not just a reply to Richard Ashcraft -- although it is certainly that too. Its intention is to say something about the political theory of Locke, about his historical context and about the methodological question of contexts in general. About his political theory, I want to make two or three main points which, I think, have important consequences for our understanding of Locke: that he both appropriates and, on critical issues, deliberately neutralizes the (...) radical �discourses� of his time -- so that, for example, he adopts Leveller premises to arrive at something more like Cromwell's (or even more conservative) conclusions; and that he deprives these radical discourses of their most democratic implications less by excluding people from membership in the political nation than by restricting the rights of membership itself. This means, among other things, that the relevant debate is not the one that has so preoccupied Locke scholars -- namely, the controversy about who is a �freeman� or who belongs to the �people�. The decisive question is rather what political rights the �people� have. (shrink)

Two kinds of sources are available to the historian to reconstruct the first centuries of the history of Mithradates' antidote: biographical information on Mithradates' interests in medicine, and a series of recipes. In this paper I argue that we cannot reconstruct the original recipe of Mithridatium from our existing sources. Instead, I examine how the Romans remodelled the history of the King's death and used the royal name to create a "Roman" drug. This drug enjoyed a huge popularity in the (...) first centuries of the Roman Empire. An Emperor, Marcus Aurelius, consumed it as well as members of the upper class; and many highly literate physicians recommended it notwithstanding the medical sect they were belonging to. With all its expensive ingredients, and its claim to work as a panacea, Mithridatium responded to a real demand in a Roman Empire at its commercial and political apogee. (shrink)
