This article explores and compares cross-gender interactions of first and third graders in one child care center. Three prevalent forms of interaction are discussed: teasing, disputing, and playing. The author argues that these three forms of interaction are related to the use of space: Teasing often occurs when space is constricted, disputing is often the result of invaded space, and playing requires shared space and varying levels of cooperation. By focusing on the relationship between space and interaction, important power asymmetries (...) appear. This paper is concerned with the processing of informal arguments, that is, arguments involving “probable truth.” A model of informal argument processing is presented that is based upon Hample's (1977) expansion of Toulmin's (1958) model of argument structure. The model postulates that a claim activates an attitude, the two components forming a complex that in turn activates reasons. How should we make choices when we know so little about our futures? L. A. Paul argues that we must view life decisions as choices to make discoveries about the nature of experience. Motivated by constraint satisfaction problems, Feder and Vardi (SIAM Journal of Computing, 28, 57–104, 1998) set out to search for fragments of satisfying the dichotomy property: every problem definable in is either in P or else NP-complete. Feder and Vardi considered in this connection two logics, strict NP (or SNP) and monadic, monotone, strict NP without inequalities (or MMSNP). We give a sufficient condition for the inexpressibility of the k-th extended vectorization of a generalized quantifier $\sf Q$ in ${\rm FO}({\vec Q}_k)$ , the extension of first-order logic by all k-ary quantifiers. The condition is based on a model construction which, given two ${\rm FO}({\vec Q}_1)$ -equivalent models with certain additional structure, yields a pair of ${\rm FO}({\vec Q}_k)$ -equivalent models. This thesis examines procedures for ascribing ambiguity to particular sentences and words of a language. My discussion focuses on theories advanced by Keith Donnellan, Saul Kripke and David Kaplan regarding the alleged referential/attributive ambiguity of definite descriptions, and on arguments offered by Paul Ziff, David Wiggins and Jerrold Katz concerning the ambiguity of the word 'good'. I distinguish two kinds of semantic ambiguity, which I call "strong" and "weak", and develop a theoretical model of the former. Using this model, I (...) devise and evaluate a number of theoretically related practical tests designed to detect the presence of ambiguity in concrete cases. I argue against direct appeals to our intuitions of meaning, to Occam's Razor, to grammatical analyses and to foreign languages in settling disputed ascriptions of ambiguity. I favor procedures which indirectly test our intuitions of meaning by isolating the linguistic effects of mixing and shifting senses. My tests rely on the assumption that the effects which accompany the use of truly ambiguous expressions are distinguishable from the mere pragmatic uncertainty which permeates general language use. Semantically ambiguous terms are viewed as awkward linguistic devices whose use, for example, will occasionally produce humor, as in the case of a pun, or deceptively bad reasoning. The account I develop rests heavily on the traditional theory of meaning , and to the extent that the standards I erect furnish better evidence for an ascription of semantic ambiguity, to that extent they ratify the classical analysis of meaning. Graeme Laurie stepped down from the Chair in Medical Jurisprudence at the University of Edinburgh in 2019. This edited collection pays tribute to his extraordinary contributions to the field. Graeme has often spoken about the importance of 'legacy' in academic work and has forged a remarkable intellectual legacy of his own, notably through his work on genetic privacy, human tissue and information governance, and on the regulatory salience of the concept of liminality. The essays in this volume animate the (...) concept of legacy as lens of analysis for the study and practice of medical jurisprudence. In this light, legacy reveals characteristics of both benefit and burden, as both an encumbrance to and facilitator of the development of law, policy and regulation. Overall, the contributions reconcile the ideas of legacy and responsiveness and show that both dimensions are critical to achieve and sustain the health of medical jurisprudence itself as a dynamic, interdisciplinary and policy-engaged field of thinking. Many preventive intervention studies with adolescents address high-risk behaviors such as drug and alcohol use, and unprotected sex. Randomized controlled trials (RCT) are the gold standard methodology used to test the effectiveness of these behavioral interventions. Interventions outside the rigidly described protocol are prohibited. However, there are ethical challenges to implementing inflexible intervention protocols, especially when the target population is young, experiences many stressful events, and lives in a resource-poor environment. Teens who are at high risk for substance use or (...) sexual risk behaviors tend to be at risk for other problems such as exposure to violence, sexual and physical abuse, depression, and homelessness. How should investigators deal with the psychological and social needs of teenagers in prevention programs in an ethically appropriate way and at the same time preserve the validity of RCT results? We have identified program characteristics, participant characteristics, interaction with parents, and problems with adolescents not in the study as sources of ethical dilemmas in RCT with at-risk adolescents. As a result of our experience, we recommend that every behavioral intervention study develop an ethics protocol, which should include rules for providing help to participants, has contact information for experts to provide guidance, and an emergency procedure for dealing with life threatening situations. In addition, studies should have a resource manual, train research staff in these ethical issues, and work with a data safety and monitoring board or ethics committee. (shrink)

Irish Supreme Court upholds paramountcy of parental right to determine a child's best interests at the expense of the rights of children themselvesCan a court force on parents who are careful and conscientious a view of their child's welfare which is rational, but quite contrary to the parents sincerely held but non-rational beliefs? The Supreme Court of Ireland has recently held that it cannot do so, and that the Irish Constitution requires that the right of the family to determine its (...) own direction must be respected except in the most narrow of circumstances, such as an immediate threat to the life of the child or risk of serious injury. The ruling leaves the assessment of a child's best interests to the wide discretion of parents, but at the same time fails to offer a means to resolve potential conflicts between the rights of the family and the rights of the child.FACTS OF THE CASEIn North Western Health Board v W 1 an action was brought by a local health board against the parents of 14 month old Paul, seeking a declaration that their refusal to submit their son to the heel prick test for phenylketonuria was a failure to vindicate their son's rights and that it would be lawful to proceed without parental consent. Phenylketonuria is a metabolic condition which can lead to severe and untreatable mental impairment if not detected in its early stages, but a simple variation in diet can stave off this outcome. While Paul's parents did not doubt the veracity of this medical opinion, nor indeed the importance of the test, they refused to subject their son to the invasive heel prick, offering instead samples of urine or hair, such that the test could be carried out by non-invasive means. This article re-examines and fundamentally re-assesses the symbiotic relationship between law and ethics in the governance and regulation of biobanks as a global phenomenon. Set against the two decades of experience of set-up, management and most recently granting access to biobanks to promote advances in human health, it is argued that the boundaries—and so the legitimacy—of the respective roles of ethics and law have become blurred and, potentially, blunted. The caricature of law as a tool of command and control—resulting in (...) compliance culture—is well recognised in regulation studies, but parallels with this can now also be seen within certain ethical regimes pertaining to biobanks and human health research more generally. At the same time, the ethical content of certain legal responses to biobanks can be lacking, as some legal systems seek to regulate biobanking in inflexible and unreflective ways that potentially undermine the entire enterprise. This can result in a net failure to capture adequately particular features of biobanking that make this field so potentially rich in terms of ultimate social value and human benefit. The argument is made that the interconnected, yet distinct, nature of the contributions of law and ethics must be better understood in this setting. The central message is unapologetically sceptical about the role of law in regulating biobanking, except when we see law as process. Rather, the position is advanced that more work is required to develop governance regimes that are ‘Ethics+’ : that is, rooted in the core values and principles at stake while able to adapt and accommodate the inevitable changing landscape of biobank research and practice. While ethics are always a necessary component of a robust and defensible regimes of health research, the notion of Ethics+ directs our attention to processes in which ethical discourse and engagement can be optimised to respond to particular features of biobanks and their operation. This essay is a comparison between two ancient theories of language—the 5th century BCE Indian etymologist Yāska and the 4th century BCE Chinese philosopher Xunzi 荀子. Specifically, it is a reading of the theory of “the rectification of names” in Xunzi through the lens of Yāska. Xunzi is known for his view that humanity’s innate tendencies need to be shaped through education and ritual. Similarly, ancient Indian authors like Yāska understand that a person is created, or made, through the performance (...) of Vedic sacrifice. Both thinkers’ constructivist theories of language and meaning proceed from these ritual assumptions. However, Yāska would query Xunzi’s inherent distrust of multiple meanings of words and their negative effects on a functional state. Guided instead by a theory of the transcendence of Vedic language, Yāska would argue that the more one can proliferate possible meanings the more powerful a word becomes. (shrink)

Although personal being plays an important role in G.W.F. Hegel's (1770–1831) philosophy he never provided a comprehensive definition of personality. Within the framework of his works it is thus possible to formulate different definitions of person and personality, and several conflicting definitions were presented among Hegelians during the 1830s and 1840s. In this paper I examine the role of personality in Hegel's system and discuss the relationship between personality and metaphysics. The question shall be analyzed in the context of various (...) works by Hegel and contrasted with two important precursors of Hegel, I. Kant (1724–1804) and J.G. Fichte (1762–1814). I shall also put the philosophy of Finnish Hegelian J.V. Snellman (1806–81) under scrutiny. This article represents an attempt to organize, critique, and extend research findings on gender differences in business ethics. The focus is on two dependent variables—ethical judgment and behavioral intent. Differences in findings between student and professional groups are noted and theoretical implications are discussed. The new research provided for this article contains two benchmark studies undertaken with identical stimuli and identical measures. These studies were followed by two additional studies, using the same measures but different stimuli, as a partial replication (...) and extension of the first two. Findings suggest that little difference exists between the genders on behavioral intent for professional groups and only minimal differences for the ethical judgment measures. Comparisons across languages have long been a means to investigate universal properties of the cognitive system. Although differences between languages may be salient, it is the underlying similarities that have advanced our understanding of language processing. Frost is not unique in emphasizing that the interaction among linguistic codes reinforces the inadequacy of constructing a model of word recognition where orthographic processes operate in isolation.

Figuring prominently in their decisions regarding which theories to pursue are scientists' appeals to the promise or lack of promise of those theories. Yet philosophy of science has had little to say about how one is to assess theory promise. This essay identifies several indices that might be consulted to determine whether or not a theory is promising and worthy of pursuit. Various historical examples of appeals to such indices are introduced.

Drawing on diverse historical cases, this paper describes and examines various aspects of a modality of scientific appraisal which has remained largely unexplored, theory pursuit. Specifically, it addresses the following issues: the epistemic and pragmatic commitments involved in theory pursuit, including how these differ from those characteristic of theory acceptance; how the research interests of scientists enter into their pursuit decisions; some of the strategies for the refinement and extension of a theory's empirical abilities which typify theory pursuit; and the (...) need to distinguish between individual and community rationality in contexts of pursuit. F.A. Trendelenburg's work "Logical Investigations" influenced greatly the decline of G.W.F. Hegel's philosophy in the early 1840s. In this work Trendelenburg challenged the very foundation of Hegel's system, his speculative logic. Somewhat twenty years later two leading late Hegelians, C.L. Michelet from Berlin and K. Rosenkranz from Königsberg, replied to Trendelenburg. Their common strategy was to show that Trendelenburg owes more to Hegel than he admits. At the same time, Trendelenburg has misunderstood Hegel's dialectics and in fact fallen into the (...) standpoint of empiricism. Michelet and Rosenkranz agreed on many problems of Trendelenburg's account, but their readings of Hegel differed in several respects. For example, they were apart on I. Kant's significance for Hegel. Partly because of this, I will argue, Rosenkranz has more affinity to Trendelenburg than Michelet. The debate between the three continued until Trendelenburg's passing in 1872. (shrink)
