Graeme Laurie stepped down from the Chair in Medical Jurisprudence at the University of Edinburgh in 2019. This edited collection pays tribute to his extraordinary contributions to the field. This thesis examines procedures for ascribing ambiguity to particular sentences and words of a language. My discussion focuses on theories advanced by Keith Donnellan, Saul Kripke and David Kaplan regarding the alleged referential/attributive ambiguity of definite descriptions, and on arguments offered by Paul Ziff, David Wiggins and Jerrold Katz concerning the ambiguity of the word 'good'. I distinguish two kinds of semantic ambiguity, which I call "strong" and "weak", and develop a theoretical model of the former. Using this model, I (...) devise and evaluate a number of theoretically related practical tests designed to detect the presence of ambiguity in concrete cases. I argue against direct appeals to our intuitions of meaning, to Occam's Razor, to grammatical analyses and to foreign languages in settling disputed ascriptions of ambiguity. I favor procedures which indirectly test our intuitions of meaning by isolating the linguistic effects of mixing and shifting senses. My tests rely on the assumption that the effects which accompany the use of truly ambiguous expressions are distinguishable from the mere pragmatic uncertainty which permeates general language use. Semantically ambiguous terms are viewed as awkward linguistic devices whose use, for example, will occasionally produce humor, as in the case of a pun, or deceptively bad reasoning. The account I develop rests heavily on the traditional theory of meaning , and to the extent that the standards I erect furnish better evidence for an ascription of semantic ambiguity, to that extent they ratify the classical analysis of meaning. This essay is a comparison between two ancient theories of language—the 5th century BCE Indian etymologist Yāska and the 4th century BCE Chinese philosopher Xunzi 荀子. Specifically, it is a reading of the theory of “the rectification of names” in Xunzi through the lens of Yāska. Xunzi is known for his view that humanity’s innate tendencies need to be shaped through education and ritual. Similarly, ancient Indian authors like Yāska understand that a person is created, or made, through the performance (...) of Vedic sacrifice. Both thinkers’ constructivist theories of language and meaning proceed from these ritual assumptions. However, Yāska would query Xunzi’s inherent distrust of multiple meanings of words and their negative effects on a functional state. Guided instead by a theory of the transcendence of Vedic language, Yāska would argue that the more one can proliferate possible meanings the more powerful a word becomes. (shrink)

Backround Education in ethics and professionalism should reflect the realities medical students encounter in the hospital and clinic. Method We performed content analyses on Case Observation and Assessments (COAs) written by third-year medical students about ethical and professional issues encountered during their internal medicine and paediatrics clinical clerkships. Results A cohort of 141 third-year medical students wrote 272 COAs. Content analyses identified 35 subcategories of ethical and professional issues within 7 major domains: decisions regarding treatment (31.4%), communication (21.4%), professional duties (...) (18.4%), justice (9.8%), student-specific issues (5.4%), quality of care (3.8%), and miscellaneous (9.8%). Conclusions Students encountered a wide variety of ethical and professional issues that can be used to guide pre-clinical and clinical education. Comparison of our findings with results from similar studies suggests that the wording of an assignment (specifying “ethical” issues, “professional” issues, or both) may influence the kinds of issues students identify in their experience-based clinical narratives. This article represents an attempt to organize, critique, and extend research findings on gender differences in business ethics. The focus is on two dependent variables—ethical judgment and behavioral intent. Differences in findings between student and professional groups are noted and theoretical implications are discussed. The new research provided for this article contains two benchmark studies undertaken with identical stimuli and identical measures. These studies were followed by two additional studies, using the same measures but different stimuli, as a partial replication (...) and extension of the first two. Findings suggest that little difference exists between the genders on behavioral intent for professional groups and only minimal differences for the ethical judgment measures. Student results, however, produced more substantial differences for behavioral intention. (shrink)

Academic incivility has contributed to (a) disruptions in learning, (b) poor mental health, (c) diminished academic achievement, and (d) increased financial costs. Understanding and characterizing human roles in academic incivility is foundational to developing plans and policies to mitigate the damaging effects of academic incivility. The purpose of this exploratory study is to characterize the roles of those involved in academic incivility in higher education. In this quantitative study of (N = 459) of higher education learners from 44 of 50 (...) states in the United States, a survey was deployed to investigate the role of self-esteem and advocacy beliefs in relationship to academic incivility roles (i.e., victim, perpetrator, bystander, and upstander). Statistical analysis included regression and correlations. Findings include that upstanders have higher self-esteem and perceptions of options to self-advocate than bystanders, victims, perpetrators, and victim/perpetrator. Likewise, respondents identified being involved in a plurality of incivility roles. Other findings included bystanders preferred faculty intervention in academic incivility incidences over self-advocacy. Those who endorsed being an incivility victim or victim/perpetrator were predictive of acknowledging having low self-esteem. (shrink)

Within the framework of his works it is thus possible to formulate different definitions of person and personality, and several conflicting definitions were presented among Hegelians during the 1830s and 1840s. In this paper I examine the role of personality in Hegel's system and discuss the relationship between personality and metaphysics. The question shall be analyzed in the context of various (...) works by Hegel and contrasted with two important precursors of Hegel, I. Kant (1724–1804) and J.G. Fichte (1762–1814). I shall also put the philosophy of Finnish Hegelian J.V. Snellman (1806–81) under scrutiny. We briefly speculate why the interest some managers and management writers take in philosophy has been so little reciprocated and why it needs to be. Then we suggest the scope of this new branch of philosophy and how it relates to and overlaps with other branches. Discussion of uses of biomedical data often proceeds on the assumption that the data are generated and shared solely or largely within the health sector. However, this assumption must be challenged because increasingly large amounts of health and well-being data are being gathered and deployed in cross-sectoral contexts such as social media and through the internet of things and wearable devices. Cross-sectoral sharing of data thus refers to the generation, use and linkage of biomedical data beyond the health sector. This (...) paper considers the challenges that arise from this phenomenon. If we are to benefit fully, it is important to consider which ethical values are at stake and to reflect on ways to resolve emerging ethical issues across ecosystems where values, laws and cultures might be quite distinct. In considering such issues, this paper applies the deliberative balancing approach of the Ethics Framework for Big Data in Health and Research to the domain of cross-sectoral big data. Figuring prominently in their decisions regarding which theories to pursue are scientists' appeals to the promise or lack of promise of those theories. Yet philosophy of science has had little to say about how one is to assess theory promise. This essay identifies several indices that might be consulted to determine whether or not a theory is promising and worthy of pursuit. Various historical examples of appeals to such indices are introduced.
