Purpose. The paper considers the establishment of the paradigmatic determinants of the understanding of crime on the basis of fundamental changes in understanding of the essence of a man in ancient, medieval, Renaissance, modern and postmodern philosophy. Theoretical basis. The author determines that the understanding of the concept of crime is possible only in the combination of historical, philosophical, legal and sociological approaches. The interpretation of the essence of this concept dynamics and relevant legal practices is based on structuralist, post-structuralist (...) and hermeneutical methodological principles. Originality. The author has proved that the concept of "crime" is not a constant but a historically variable category whose dynamics of meanings is linked to a change in philosophical anthropological paradigms. Its understanding is primarily related to the interpretation of the essence of a man and the imperatives of his behavior. This allows a new understanding of the philosophical foundations of modern criminology. Conclusions. The article establishes that in the history of Western philosophy, there are five anthropological paradigms that differ in a thorough rethinking of the essence of a man. The first cosmocentric regards man as a microcosm, his soul and actions must be in harmony with the harmony of the Cosmos. The second Theocentric considers a man the image and likeness of God, though he is at the same time burdened with original sin. In the era of early Modernism, the third paradigm, which we called cognitive-centric, becomes dominant, since the essence of a man is reduced primarily to his mind. It gradually changes to the fourth – sociocentric, which focuses on the social essence of a man. However, despite its continued existence in our time, at the end of the XX century, there is a transition to the fifth paradigm – postmodernist, which deconstructs the essence of a man, reducing it to the role of an element of power systems. These paradigms, with a certain synchronicity, create the corresponding concepts of "crime": from violation of polis-space laws to identification with sin, from non-observance of mental and moral standards to social deviance. Contemporary understandings of crime are, for the most part, relativistic and constructivist, which is consistent with the postmodern anthropological paradigm. However, the diversity of interpretations of the concept of "crime" that exists in the current scientific literature needs further comprehension. (shrink)

This article examines the political anthropology developed by the Danish philosopher Jens Kraft in his study of Indigenous peoples and their institutions, customs, and opinions. Kraft aims to reconstruct human history by amalgamating insights on man, nature, and society from scholars like Wolff and Rousseau with empirical knowledge on Indigenous cultures worldwide. Through comparative analysis of diverse Indigenous groups, Kraft seeks to identify institutions, customs, and opinions that are identical and thus universal to human nature and history. This examination (...) not only allows Kraft to formulate general laws governing humanity’s progress but also to deduce fundamental natural principles – specifically, natural liberty and charity – against which ‘civilised’ society should be measured and improved. The article argues that, for Kraft, human history is the history of intellectual advancement, driven by humanity’s pursuit for rational solutions to challenges arising from external circumstances such as population growth and the emergence of property. In his work, Kraft, much like Rousseau, criticises contemporary ‘enlightened’ European society as morally debased, but maintains that humans are capable of rectifying their deficiencies and improving their imperfect civil societies through the use of progressively developed right reason. According to the working definition of the International Big History Association, ‘Big History seeks to understand the integrated history of the Cosmos, Earth, Life and Humanity, using the best available empirical evidence and scholarly methods’. In recent years Big History has been developing very fast indeed. Big History courses are taught in the schools and universities of several dozen countries. Hundreds of researchers are involved in studying and teaching Big History. Is Rousseau an advocate of natural law or not? The purpose of Rehm’s paper is to suggest a positive answer to this controversially discussed question. On the one hand, Rousseau presents a critical history of traditional natural law theory which in his view is based on flawed suppositions: not upon natural, but on artificial qualities of man, and even rationality and sociability are counted among the latter. On the other hand he presents the self-confident manifesto for a fresh start in (...) natural law theory, founded on what to Rousseau’s mind is the true idea of human nature. The paper intends to show that the only natural qualities which can be seen as anthropological constants are those that keep man flexible, namely perfectibility and freedom of will. It is argued that these are exactly the qualities which according to Rousseau serve as the standard of natural law for the system of politics and its laws: Only a state based upon the free consent of individuals can do justice to man’s perfectibility and freedom of will. Rehm stresses that because of perfectibility and freedom of will, this self-commitment has to be revisable, which is why the republic of the “Social Contract” should not have a constitution, or any law that the citizens cannot alter. The article discusses the concept of the humanitarian-anthropological turn formulated by the famous Russian philosopher Alexander Pavlovich Ogurtsov. He analyzes Dilthey's views, showing that he is not only the initiator of humanitarian discourse, but, in fact, is developing a new direction of philosophy alternative to the natural science approach. The author analyzes the situation that necessitated the development of this direction, as well as the concepts of "life", "history", "understanding", "expression" and "experience", which Dilthey puts at the basis of his (...) philosophical system. He shows that the essential feature of these concepts is a double modality. On the one hand, history (respectively, life, understanding, expression, experience) is “singular”, that is, it changes not according to some law, but due to random circumstances, on the other hand, life changes quite lawfully, under the influence of the mechanisms of culture, language, economics, relationships between people, technology. Dilthey's interest in a holistic analysis of life is explained. The author shows that within the framework of humanitarian and anthropological study, the integrity of life is determined by a number of factors: the problem that the researcher solves, the narratives and texts available to him, the methodology of humanitarian knowledge. In other humanitarian studies, these factors will change, and therefore the integrity of life will also change. It turns out that the integrity of life, over which Dilthey struggled, is not independent of the researcher, his personality and life, it is constituted in the very process of humanitarian knowledge, partly as a singular, partly natural phenomenon. In the latest edition of their popular overview text, Erickson and Murphy continue to provide a comprehensive, affordable, and accessible introduction to anthropological theory from antiquity to the present.

I reconstruct my own journey into the history of the human sciences, which I show to have been a process of discovering the metaphysical standing of the human. I begin with Alexandre Koyré’s encounter with Edmund Husserl in the 1930s, which I use to throw light on the legacy of Kant’s ‘anthropological’ understanding of the human, which dominated and limited 19th-century science. As I show, those who broke from Kant’s strictures and set the stage for the 20th-century revolutions in science (...) - from Hegel, to John McTaggart, to Max Weber - typically were pursuing crypto-theological questions about how a finite being can comprehend an infinite universe. This journey is about the ‘common measure’ of being human, which is what links Plato to Kuhn, but has been most consistently taken up by law. I suggest that in seeking this ‘measure of man’, we may discover that to be human is not necessarily to be Homo sapiens, which would suggest a radical reorientation of the history of the human sciences. This book is not a generalized essay on Hegel’s philosophy of history as the title seems to promise. It is rather an excellent exposition and interpretation of some of the main doctrines and assumptions of Hegel about the varieties of historical writing, mechanism and teleology, contingency and necessity. It also contains a discussion of the relation of Hegel to the covering law model of explanation. The first chapter is primarily an exposition and exegesis of Hegel’s discernment of the varieties of (...) historical writing in the long introduction to the Lectures. Although this section is generally successful, one of the burdens of Wilkins’ argument is that Hegel is not an a priori thinker, yet Hegel argues that the state is a necessary precondition to people having a history. Groups without a state lie "outside his plan." That such groups may be beyond his plan is appropriate, but that they can have no history needs to be critically evaluated in light of anthropological studies. A second difficulty with the exegesis centers around the almost complete neglect by Wilkins of the idea of providence in the Lectures and the notion of Christian religion. One can wonder whether a proper understanding of Hegel’s philosophy of history is complete without due consideration of both aspects. (shrink)

In anthropology, works of art are used as sources of information rather than as expressive realities in their own right. In anthropology the work of art is treated more as a window than as a symbol; it is treated as a transparency rather than as a membrane having its own properties and qualities. For instance, it is usually in social science that art "reflects" life with more or less distortion. Yet no art can record anything it is not (...) actually programmed to register. This programming usually concerns very small sectors of all actuality, and it is limited by the figural traditions and by the technical resources of the artisans....Given my assumptions—that art does not "reflect" life; nor does it necessarily imitate nature; nor can it be explained away by texts or informants—given these assumptions, we are required to limit our notions about how much "information" the arts can convey. The article discusses some aspects of the use of history by the authorities to legitimize the political order. Based on the concept of H. Arendt, the role of the truth of reason and the truth of fact as tools of cognitive resistance in the conflict between politics and truth is determined. The specificity of the formation of the policy of memory in the context of the anthropology of power is demonstrated.

In a renowned essay, Odo Marquard’s set a cornerstone in defining anthropology from a history of concepts point of view. In the light of more recent researches, some of his conclusions are here reconsidered and criticised. The concept of anthropology, as developed by Herder, Kant, Wilhelm von Humboldt, romantic philosophers and physicians, and finally by Hegel and some of his followers, offers no evidence for Marquard’s alleged opposition between anthropology and philosophy of history. On the one side, (...) in Kant’s or Hegel’s work anthropology is not as peripheral as Marquard argued; on the other side, romantic anthropologists developed a deep interest towards historical perspectives. Rather, anthropology was quite often considered as a nonmetaphysical alternative to psychology. These results also suggest a revision as to the role of anthropology on a broader historical scale. Posing a powerful challenge to dominant trends in cultural analysis, this book covers the whole history of the concept of culture, providing the broadest study of this notion to date. Johnson and Michaelsen examine the principal methodological strategies or metaphors of anthropology in the past two decades (embodied in works by Edward Said, James Clifford, George Marcus, V. Y. Mudimbe, and others) and argues that they do not manage to escape anthropology's grounding in representational practices. To the extent (...) that it remains a practice of representation, anthropology, however complex, critical, or self-reflexive, cannot avoid objectifying its others. Extending beyond a critique of anthropology, the book reads the twinned notions of the human and culture across the long history of the human sciences broadly conceived, including anthropology, cultural studies, history, literature, and philosophy. Although there is no chance, they argue, for a "new" anthropology that would not repeat the old anthropology's problem of disciplining the other, they also recognize that there may be no way out of anthropology. Anthropological research in urban contexts reflects the fundamental mutations in social sciences. The boundaries between the traditional academic disciplines have become blurred. New clusters of interdisciplinary and transdisciplinary research emerge. These changes involve risks and chances. Philosophy of science insists on clear concepts and terminologies. Does it make sense to use the term ‘urban anthropology’? If new disciplines or sub-disciplines arise, they should have distinct shapes, and the nomenclature should reflect their scientific profile. The history of philosophical thought has often been compared to a comedy of errors, and is one of the most important dimensions of the intellectual history of mankind. When Giovanni Boccaccio undertook to compile the myths of Greco-Roman antiquity in the mid-fourteenth century, he was working within a long tradition of medieval commentaries on Ovid's mythological works and mythographical compendia, such as Alberic of London's De deis gentium. His Genealogie deorum gentilium libri, on which he worked until the final years of his life, also falls within the traditions of biblical exegesis and of philosophical commentary on texts, such as Boethius's De consolatione philosophiae and Virgil's Aeneid. The complex (...) and eclectic nature of Boccaccio's learning, however, along with the antimodern organizational structure of the treatise, has led to the underestimation of its importance in the history of medieval and Renaissance approaches to ancient myth. As Charles Osgood's partial translation of the work demonstrates, the focus of critics has been limited to the final two books of the treatise, in which Boccaccio defends both poetry and his work from detractors. The fourteenth and fifteenth books of the Genealogie have been by far the most long-lived sections of the work. Kant's lectures on anthropology capture him at the height of his intellectual power. They are immensely important for advancing our understanding of Kant's conception of anthropology, its development, and the notoriously difficult relationship between it and the critical philosophy. This 2003 collection of essays by some of the leading commentators on Kant offers a systematic account of the philosophical importance of this material that should nevertheless prove of interest to historians of ideas and political theorists. There are two (...) broad approaches adopted: a number of the essays consider the systematic relations of the anthropology to critical philosophy, especially speculative knowledge and ethics. Other essays focus on the anthropology as a major source for the clarification of both the content and development of Kant's work. In this article the advent of Lévi-Strauss's structural anthropology is described as a reaction against the predominantly phenomenological bias of French philosophy in the post-war years as well as against the old humanism of existentialism which seemed parochial both in its confinement to a specific tradition of western philosophy and in its lack of interest in scientific approach. Nevertheless, the paradigm of structural anthropology cannot be equated with the field of structuralism, which became a very contestable form of (...) intellectual fashion. The reception of Lévi-Strauss's theory in the English-speaking world carried on both the same enthusiasm and the same distortions and simplifications, to the extent that in the course of anti-structural criticism, the main thrust of the epistemological approach of Lévi-Strauss seems to have been lost, to the collective detriment of social sciences and anthropology. The article explores the manifesto of the Moscow Anthropological School, emphasizing the primacy of hallucinations in anthropogenesis. The current predicament of modern humanity urges the anticipation of something genuine and substantial. However, the essence of philosophy does not always align with the prevailing “spirit of the times.” Its mission is to pursue autopoiesis, scrutinizing society for its inherent flaws that impede progress. From this viewpoint, F.I. Girenok’s hallucinatory theory is entirely pertinent and justified. The narrative of civilization is typically portrayed (...) as a chronicle of discoveries and triumphs of rationality over irrationality. The history of fears and misconceptions, which not only persist from the past but also resurface, is less well-documented. Therefore, the program of the Moscow Anthropological School is far from being peripheral; on the contrary, it holds significant relevance. It furthers the tradition of inversion anthropology, initially established by N.Ya. Danilevsky, the first Russian critic of Darwinism. This anthropological tradition was particularly advanced by the concept of B.F. Porshnev and the research of contemporary authors like Yu.M. Boroday and V.A. Podoroga. Each, in their unique way, contributed to the critique of evolutionism and reductionism. F.I. Girenok’s concept evokes schizoanalysis, albeit devoid of Marxist influence, unlike G. Deleuze. All these aspects warrant a comprehensive philosophical discourse on the manifesto. Meanwhile, reports and discussions concerning F.I. Girenok’s theory revealed that not all participants are readily prepared to tread the path suggested by the founder of this theory, confining themselves to theological explorations instead. This, as per the author of the article, inherently signifies that hallucinatory and messianic anthropologies are complementary to each other. (shrink)

This paper reviews the uneven history of the relationship between Anthropology and Cognitive Science over the past 30 years, from its promising beginnings, followed by a period of disaffection, on up to the current context, which may lay the groundwork for reconsidering what Anthropology and (the rest of) Cognitive Science have to offer each other. We think that this history has important lessons to teach and has implications for contemporary efforts to restore Anthropology to its proper place (...) within Cognitive Science. The recent upsurge of interest in the ways that thought may shape and be shaped by action, gesture, cultural experience, and language sets the stage for, but so far has not fully accomplished, the inclusion of Anthropology as an equal partner. The question has occupied a group of researchers from Brazil and Europe and has been explored at two workshops during which the contributors to this volume have discussed anthropological themes in Augustine's vast corpus. In this volume, the reader will find articles on a wide spectrum of Augustine's anthropological ideas. Some contributions focus on specific texts, while others focus on specific theological or philosophical aspects of Augustine's anthropology. This article presents a summary of the main views in Dambeck’s lectures on aesthetics on the basis of all known sources and compares the views thus obtained with views developed in German aesthetics in the late eighteenth and the early nineteenth century, with the aim of finding their chief source and reintegrating them both into German aesthetics and, more narrowly, into the aesthetics taught at Prague University. Johann Heinrich Dambeck constructed his lecture series on the plan of Zschokke’s textbook Ideen (...) zur psychologischen Aesthetik (1793) which has never been taken into account in any other research on his lectures. The close link between Dambeck’s lectures and this textbook compels us to revise the current understanding of the nature of their ideas. Dambeck has so far been most often unproblematically presented as an adherent and disseminator of Kant’s and Schiller’s ideas about aesthetics in the Bohemian Lands. The key textbook on which he bases his university lecture series is, however, intentionally un-Kantian. Zschokke’s Ideen is part of the psychological-anthropological stream of Late-Enlightenment German aesthetics. (shrink)

This paper traces the history of remoteness in contract law, namely the legal formants (in Rodolfo Sacco’s terms) constraining the availability of contract damages in various legal systems. Our journey takes us through different times, continents and cultures, from the eighteenth century to the twenty–first century, across the law of France, United States, England and Wales, India and Australia, among other jurisdictions. While it might seem that civilian and common law traditions have very different morphological legal forms, once a closer (...) historical, cultural, and anthropological gaze is turned upon the legal formants involved, it can be seen that remoteness discloses a shared concern which may be common to many human societies and cultures. In other words, as a matter of social experience, humans who enter into transactions generally realise that it is impossible to know the future, or to know what all outcomes of the transaction will be. Consequently, it is recognised that it would be unfair and unjust to hold a defendant liable for all outcomes, and as our journey will show, legal systems seek guidance from other legal systems in their efforts to deal with this problem. This book is a large-scale historical reconstruction of liberal legalism, from its inception in the mid-nineteenth century, the moment in which the jurists forged the alliance between political liberalism and legal expertise embodied in classical private law doctrine, to the contemporary anxiety about the possibility of both a liberal solution to the problem of political justification and of law as a respectable form of expert knowledge. Each stage in the history is a moment of synthesis between a substantive and a (...) methodological idea. The former is the liberal political theory of the period, purporting to provide a solution to the problem of political justification. The latter is a conception of legal method or science, supposedly vindicating the access of the expert to the political choices embodied in the law. Thus, each moment in the history of liberal legalism integrates a political theory with a jurisprudential conception. Although it reaches the unsettling conclusion that liberal legalism has largely failed by its own standards, the book urges us to avoid quietism, skepticism or cynicism, in the hope that a deeper understanding of the fragility of our values and institutions inspires a more thoughtful, broadminded and nurtured citizenship. The aim of this paper is to show the incompleteness of the exclusively logico-syntactical and logico-semantical approaches to one of the core issues of philosophy of science, namely, scientific laws and scientific explanation in C. G. Hempel’s works. I start with a brief exposition of the main characteristics of Hempel’s approach to deductive explanations based on universal scientific laws and then analyze the problems and paradoxes inherent in this approach. Next, I trace these characteristics back to Hempel’s and Carnap’s attempts (...) to ground the concepts of scientific law and explanation exclusively on logic , which led to a highly normative approach alienated from the practice of real science. In the latter part of the nineteenth century, diverse sciences grounded in natural history made a virtue of field research that somehow tested scientists' endurance; disciplinary change derived from the premise that witnesses were made reliable by character-molding trials. The turn to the field was a function of structural transformations in various quarters, including (but hardly limited to) global politics, communications systems, and scientific institutions, and it conduced to biogeographical explanations, taxonomic schemes that admitted of heterogeneity, and affective research styles. Sociocultural anthropology, which took specialized shape at the beginning of the twentieth century, shared many properties with other field sciences, but its method—participant observation—was distinctive. Critical to the method's definition were the efforts of the British experimental psychologist-anthropologist W. H. R. Rivers, who relied on notions then widespread in Europe and the United States. The discipline's future mythic hero, Bronislaw Malinowski, embraced Rivers's model. For both men, proper fieldwork meant using the researcher's body as an instrument and entailed understanding both the anthropologist's body and the research subject's body as energy systems; this symmetry facilitated a relativist perspective. Participant observation remains central to sociocultural anthropology, but the discipline's pedagogic habits contributed to loss of memory of its energetic conceptualization. -/- . (shrink)

The purpose of the article is to reveal the anthropologization of Dasein-psyche’s being by methods of neurophilosophy. The anthropologization of Dasein-psyche’s being by methods of neurophilosophy allows considering the noogenesis from the perspective of philosophical traditions, which is much richer in comparison with the history of scientific knowledge about the psychology of meanings. The being of Dasein-psyche in the meaning of "philosopher’s soul" was firstly mentioned by Plato in "Phaedo". The anthropologization of Dasein-psyche’s being reveals the ontological orientation and limits (...) of the being of Dasein-psyche within the being of Dasein-the-One, as well as the intellect, knowledge and techne, as the arete existentials. Theoretical basis of the study is built on Heidegger’s fundamental ontology and methods of neurophilosophy. Originality lies in exploring Dasein-psyche through the neurophilosophical approach. In the context, Dasein-psyche is revealed as a part of the whole or the image, created from Dasein-Y-Matter as a paradigm. It is formed by the factors and causes of complication, as well as by the experience of being of the previous states of matter. Conclusions. In conclusion, the anthropologization of Dasein-psyche’s being by methods of neurophilosophy allows considering the noogenesis from the perspective of philosophical traditions. The essence of a person is revealed as the arete existentials, which require further rethinking and clarification. (shrink)

How do human beings become human? This question lies behind the so-called human sciences. But these disciplines are scattered among many different departments and hold up a cracked mirror to humankind. This is why, in the view of Paul Ricoeur, we need to develop a philosophical anthropology, one that has a much older history but still offers many untapped resources. This appeal to a specifically philosophical approach to questions regarding what it was to be human did not stop Ricoeur (...) from entering into dialogue with other disciplines and approaches, such as psychoanalysis, history, sociology, anthropology, linguistics and the philosophy of language, in order to offer an up-to-date reflection on what he saw as the fundamental issues. For there is clearly not a simple, single answer to the question what is it to be human? Ricoeur therefore takes up the complexity of this question in terms of the tensions he sees between the voluntary and the involuntary, acting and suffering, autonomy and vulnerability, capacity and fragility, and identity and otherness. The texts brought together in this volume provide an overall view of the development of Ricoeurs philosophical thinking on the question of what it is to be human, from his early 1939 lecture on Attention to his remarks on receiving the Kluge Prize in 2004, a few months before his death. The inquiry into the moral status of artificial intelligence (AI) is leading to prolific theoretical discussions. A new entity that does not share the material substrate of human beings begins to show signs of a number of properties that are nuclear to the understanding of moral agency. It makes us wonder whether the properties we associate with moral status need to be revised or whether the new artificial entities deserve to enter within the circle of moral consideration. This raises the (...) foreboding that we are at the gates of an anthropological crisis: the properties bound to moral agency have been exclusively possessed in the past by human beings and have shaped the very definition of being human. In this article, I will argue that AI does not lead us to an anthropological crisis and that, if we adhere to the history and philosophy of technology, we will notice that the debate on the moral status of AI uncritically starts from an anthropology of properties and loses sight of the relational dimension of technology. First, I will articulate three criteria for analyzing different anthropological views in philosophy of technology. Second, I will propose six anthropological models: traditional, industrial, phenomenological, postphenomenological, symmetrical, and cyborg. Third, I will show how the emergence of AI breaks with the dynamics of increased relationality in the history and philosophy of technology. I will argue that this aspect is central to debates about the moral status of AI, since it sheds light on an aspect of moral consideration that has been obscured. Finally, I will reject entirely relational approaches to moral status and propose two hybrid possibilities for rethinking it. (shrink)

This article offers a critical rethinking of the view on ideas of psychoanalysis that have been established in Russian philosophical texts. The need to consider psychoanalytic concepts in the history of philosophy of the twentieth century, as well as in other educational courses, led to the creation of an unsubstantiated theoretical construct – «the philosophy of psychoanalysis». Against the backdrop of a number of problems of this type of conceptualization, we propose to concretize the area of interaction between philosophy and (...) psychoanalysis to a series of anthropological questions that have consequences for cultural, ethical and socio-philosophical issues, but in a revised form that does not have a direct connection with the theory and practice of contemporary psychoanalysis. Such a clarification, as shown in the article, allows us to more adequately and correctly (without the inaccuracies of a superficial and philosophically biased translation) present the originality of psychoanalytic ideas. This approach confronts us with the question of how exactly contemporary psychoanalytic thought can be used as a methodology in philosophical and anthropological research. (shrink)

This article embarks on a journey through time, unraveling the multifaceted connections between religion and the development of legal frameworks. (...) In numerous societies, religious doctrines formed the cornerstone of civil laws and regulations. The majority of civilizations witnessed priests assuming pivotal roles as lawmakers, effectively coupling civil laws and religious practices. By examining various historical civilizations, this study illustrates how religious norms and practices were intertwined with legal codes, revealing instances where religious teachings played a crucial role in promoting adherence to laws. The transition to modern times witnessed the emergence of alternative means for law enforcement, yet religion’s role persisted as an internal driving force for fostering law-abiding behavior. Drawing from examples such as the Code of Hammurabi, Islamic legal traditions, and the Roman Twelve Tables, this article showcases historical instances where religious values contributed to legal principles centered around equity, justice, and morality. Additionally, the study explores how religion’s influence shifted over time, from early religious leaders acting as legislators to the establishment of more secular legal systems. (shrink)
