Rapid urbanization in Vietnam significantly impacts the environment and human well-being. Public parks are crucial for enhancing social and environmental sustainability in urban areas, yet their establishment and expansion require substantial funding. This study investigates the factors influencing Vietnamese urban residents’ willingness to donate to planting projects in public parks, utilizing the Bayesian Mindsponge Framework (BMF), which combines Mindsponge Theory’s informational entropy-based notion of value with Bayesian analysis. Analyzing data from 535 residents in major Vietnamese cities, we found that while (...) men visit public parks more frequently, they are less willing to donate to planting projects. Older residents visit parks more often and are more willing to donate, while higher-income individuals show greater willingness to donate. Most motivations—such as relaxation, physical activities, nature enjoyment, socializing, and family time—are positively linked to park visit frequency and indirectly to donation willingness. However, only relaxation and enjoyment of nature are directly associated with willingness to donate. Interestingly, higher education levels and visiting parks for children’s educational activities are associated with lower donation willingness. These findings hint at the possible existence of the free-riding problem, gender inequality, ineffective environmental education, and lack of awareness of public parks’ natural value, as well as opportunities to cultivate an eco-surplus culture through nature interactions in public parks. Since the outbreak of the Coronavirus disease 2019 (Covid-19), tremendous efforts have been made by scientists, health professionals, business people, politicians, and laypeople around the world. Covid-19 vaccines are one of the most crucial innovations that help fight against the virus. This paper attempts to revisit the Covid-19 vaccines production process by employing the serendipity-mindsponge-3D creativity management theory. Vaccine production can be considered an information process and classified into three main stages. The first stage involved the processes of absorbing information (...) (e.g., digital data and open science) and rejecting unhelpful information (e.g., misinformation and fake news) for effectively acquiring useful insights. Useful insights were later employed by experts, enterprises, governments, and international organizations through interdisciplinary coordinated efforts for developing vaccines within a short period. Finally, the appearance of multiple types of vaccines enabled more strategic options for vaccine distribution and administration. Findings from this vaccine creativity management process could be used as critical lessons for further improvements of vaccination programs. (shrink)

Crime victims are forgotten in criminal proceedings. Criminal justice systems tend to treat crime victims quite poorly, but, when they deal with child victims, their frequent failure to respect the child’s rights finds no excuse. Law enforcement and criminal justice interventions made in the name of protecting children against violent crime often fail to consider what is truly in the best interests of the child and end up further victimizing the child victims. Vietnam has instituted justice reforms that recognize the (...) need for special measures to protect the rights of child victims and witnesses of crime. This article reviews the progress achieved in implementing these reforms and points at several areas where implementation has been slow or further reforms are needed. Based on a comparative legal analysis, the article exemplifies how legal semiotics can contribute to an understanding of the complexity of policy transfer in the area of justice and human rights. This paper endeavors to understand the research landscape of finance research in Vietnam during the period 2008 to 2020 and predict the key defining future research directions. Using the comprehensive database of Vietnam’s international publications in social sciences and humanities, we extract a dataset of 314 papers on finance topics in Vietnam from 2008 to 2020. Then, we apply a systematic approach to analyze four important themes: Structural issues, Banking system, Firm issues, and Financial psychology and behavior. Overall, there have (...) been three noticeable trends within finance research in Vietnam: (1) assessment of financial policies or financial regulation, (2) deciphering the correlates of firms’ financial performances, and (3) opportunities and challenges in adopting innovations and ideas from foreign financial market systems. Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often contain long articles and only some parts are relevant (...) to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task. The relationship between greenwashing and visitors' green behavior remains an under-researched topic in the tourism and hospitality literature, despite evidence of the harmful effect of greenwashing on the reputation and competitive advantage of organizations. This study extends attribution theory into the green context to develop a research framework for investigating the interrelationship between greenwashing, green trust, and green word-of-mouth (WOM), especially the roles of green trust and connectedness to nature. We conducted a survey of 289 visitors staying in four- and (...) five-star hotels in Vietnam. The findings indicated that hotels should avoid greenwashing due to its negative impact on visitors' green trust and green WOM. Moreover, the study found that greenwashing had an indirect and negative influence on green WOM based on visitors' green trust. Importantly, the research revealed the value of connectedness in moderating green attitudes and behaviors among visitors. (shrink)

Esos síntomas sugieren que las controversias y los intereses que suscita tocan un aspecto jurídico neurálgico: las relaciones entre el Derecho y la moral. El neoconstitucionalismo constituye, en ese sentido, una corriente desafiante para el pensamiento jurídico contemporáneo, más aún en el contexto del inquietante y sorpresivo mundo de hoy. Una lucha tan despiadada tiene el significado de Reino y redención como apuesta única.

El artículo propone una historia tan detallada como sea posible de cada especie o grupo de especies cercanas; evoca las evoluciones de sus representaciones (...) sociales, de sus valorizaciones comerciales, de sus preparaciones culinarias, etc. Con su importante litoral sobre el Golfo de Vizcaya y sus ciudades ubicadas tierra adentro, el sudoeste de Francia constituye un área de estudio interesante para pensar la complejidad de los hábitos de consumo de mariscos durante el periodo anterior al desarrollo de los transportes rápidos y a la invención del frio artificial.: This text is a study on the consumption of marine and freshwater invertebrates in Southwest France from the early 16thcentury to the present day. Fıkıh literatüründe sünnet önemli bir yere sahiptir. Çünkü fıkhın temeli Hz. Peygamber tarafından atılmış ve fıkhın gayesini en iyi bilen ve uygulayan kendisi olmuştur. Bu sebeple şer’î amelî konularda hüküm istinbatı için müctehid imamlar, Kur’an’dan sonra sünnete başvurmuşlardır. Bununla birlikte müctehid imamlar, Hz. Peygamber’den gelen rivayetlerin bazılarını kabul ve onlarla amel etmede görüş ayrılıkları yaşamışlardır. Görüş ayrılıklarının temelinde ise sünnetin ekseriyetini teşkil eden haber-i vâhid vardır. Çünkü haber-i vâhid yapısal açıdan yalan, yanlışlık ve vehm ihtimali bulundurması yanında doğruluğu zan ile (...) sabit olması sebebiyle özellikle Hanefî usûlcülerine göre bilgi ifade etmez. Bu yönüyle haberi vâhid, mütevâtir haber kadar kuvvetli ve bağlayıcı olmayıp zannî bir bilgi ifade eder. Bu doğrultuda haber-i vâhid, “bilgi gerektirmez, zan gerektirir” şeklinde ifade edilmiştir. Bu ifade bağlamında şöyle bir soru ortaya çıkmaktadır: Haber-i vâhid, bilgi ifade etmediği halde, onunla amel edilmesi mümkün müdür? Bu sorudan hareketle zan ifade eden haber-i vâhidin hücceti ve onunla amel edilmesinin mümkün olup olmadığını, mezheplerin haber-i vâhide yaklaşımlarının nasıl olduğunu ve bu durumun cenaze bahsine ilişkin hükümlere nasıl yansıdığını ortaya koymak amacıyla bu çalışma ele alınmıştır. Dolayısıyla bu çalışmanın konusu, haber-i vâhidin hücceti için mezheplerin ileri sürdüğü farklı şartlar ve bu şartların hükümlere -cenaze namazı özelinde- etkisi ile sınırlıdır. Yöntem olarak öncelikle kavramsal çerçevede haber-i vâhidi tanımlamak, bilgi değerini ortaya koymak ve mezheplerin onunla hücceti noktasında benimsedikleri şartları tespit etmek amacıyla ilgili mezheplerin usûl eserleri incelenmiştir. Daha sonra mezheplerin benimsediği bu usûlî yöntem, cenaze bahsindeki yerini belirlemek üzere ilgili mezheplerin fürû kitapları taranmıştır. Bu metottan hareketle mezheplerin usûlde benimsediği ilkenin fürû meselelerine nasıl yansıdığı, haber-î vâhidin zannî bilgi ifade etmesine rağmen onunla amel etmenin gerekçesi ve cenazeye ilişkin bazı hükümlerde mezheplerin farklı hüküm benimsemelerinin nedeni ortaya konulacaktır. Este artículo pretende aportar a este vacío usando como documento de estudio el libro Éperons del autor, que pretende ser una ponencia sobre Nietzsche. A partir de una interpretación de los pasajes en los que Derrida se refiere al amor, encontramos casi siempre se trata de una cita de Nietzsche. Esto parece caracterizar un acto de ventriloquia (...) que subyace a la estrategia del autor. El problema surge cuando nos percatamos de que Derrida no da cuenta de la intromisión del amor en las citas que usa. Derrida prefiere evadir el problema del amor porque está en el núcleo de su propuesta de deconstrucción. (shrink)

Sosyal bilimler alanında, ortak zaman diliminde yaşamanın getirisi olarak benzer özelliklere sahip bireylerin oluşturduğu gruplar “kuşak” kavramı ile tanımlanmaktadır. Günümüzde, kuşaklar ortak bir kabul olarak; Gelenekselciler, Bebek Patlaması, X, Y ve Z Kuşağı olarak literatürde yer almaktadır. Ortak zaman diliminde yaşayan insanların algıları, beklentileri, hayata bakış açıları, alışkanlıkları ve gündelik yaşam pratikleri kendilerinden önceki ve sonraki zamanlarda yaşayanlara göre farklılık göstermektedir. Gündelik yaşamın pratiklerinde yaşanılan değişimin en yoğun hissedildiği alan toplumlarda genel olarak aile kurumu üzerindedir. Günümüzde, Y Kuşağı temsilcilerinin çoğu (...) aileleriyle bir arada yaşayan ve kendinden farklı bir kuşağın temsilcisi olan anne babalarıyla zor iletişim kuran bireyler olarak toplumda yer almaktadır. Toplumu oluşturan en küçük birim olarak tanımlanan aile, eğitim, sağlık ve güvenlik gibi bazı işlevlerini başka kurumlara aktarmış olsa da ulusların ve kültürlerin gelişimi için temel birim olmaya devam etmektedir. Toplumun temel yapısını oluşturan aile kurumu, bireylerin ve toplumun gösterdiği değişime paralel bir şekilde değişmektedir. Ailenin yapısında görülen değişimlere rağmen aile, özünde toplumun en küçük birimi olarak kalmaya ve hem bireyler için hem de toplum için işlevini sürdürmeye devam etmektedir. Bu çalışmada, önceki araştırmalar ve Y kuşağının temel özellikleri dikkate alınarak bu kuşak temsilcileri için ailenin değişen anlam ve önemine ve toplumsal yaşamda nasıl bir belirleyiciliği olduğuna değinilmektedir. El presente artículo aborda la relación ambivalente de Nietzsche con los filósofos helenísticos, para saber por qué, a pesar de la extraordinaria influencia que estas escuelas ejercieron en su pensamiento, Nietzsche se les opone tan violentamente en su obra más tardía. Verificaremos que las principales críticas de Nietzsche a estas escuelas guardan mucha similitud con las que él dirigirá al cristianismo, y a la propia idea de terapia, como una crítica a la tradicional forma de concebirla, que estas escuelas parecen (...) inaugurar y fortalecer. Nietzsche identifica a los filósofos helenísticos como los promotores fundamentales del nihilismo, que él diagnostica como la mayor enfermedad de la cultura occidental, para la que se requiere un médico adecuado y un tratamiento efectivo. La terapia cristiana no fue la única y, principalmente, no fue la primera, pues tiene a los filósofos helenísticos como claros predecesores y precursores. Tampoco estos escaparon al escrutinio crítico de Nietzsche que, en la reconstitución de la historia clínica de la cultura occidental, los identifica como promotores fundamentales de la enfermedad que diagnostica, muy en particular por haber justamente creado las condiciones y el encuadramiento necesarios para la emergencia de la terapia cristiana, preparando el terreno y lanzando las semillas sin las cuales el cristianismo no habría podido surgir y, sobre todo, triunfar. Con un temor tal que en el amanecer del día 5 de abril de aquel año de 1588, una mujer de la pequeña aldea de Malmesbury, al suroeste de la Isla, alumbrará gemelos. Pues «al difundirse por nuestras plazas -contará uno de esos retoños, T. Hobbes- el rumor de que con la flota se acercaba el último día para nuestro pueblo, tanto miedo concibió mi madre que parió gemelos: a mí y al miedo al mismo tiempo». Es verdad. Pocas cosas le están tan hermanadas al hombre y le son tan reveladoras como sus propios miedos; al menos en su presente estado. Y pocas cosas como sus miedos ayudan a caracterizar mejor sus formas de organización social. De ahí que ame la paz y se goce con la compañía afable, como a renglón seguido también el propio Hobbes apunta. (shrink)

Es tan sorprendente, concorde con la naturaleza humana, útil y profunda la doctrina de Vitoria sobre la organización universal de los pueblos que aparece como repentinamente en el s. XVI, sin una aparente fuente de continuidad, que cualquier persona con un poco de mentalidad científica no puede dejar de preguntarse: ¿de dónde la ha sacado? ¿De dónde ha extraído esa comprensión tan profunda del mundo, y ese pensamiento tan hermoso? Cualquiera puede pensar que, pensamiento político o jurídico semejante había de (...) derivarse de algún manuscrito empolvado y escondido en algún lugar, como un tesoro, cuya influencia hubiera ejercido, de manera latente, y a este investigador le hubiera tocado descubrir. Pero veremos que no: que el verdadero tesoro escondido es la simple idea de amistad, entendida en su sentido más pleno. (shrink)

Selon Jean Ricardou, le concept "matérialiste" de production est censé rendre caduques les principales catégories de l'esthétique de la production: création, expression, inspiration, imitation. Par l'analyse d'une fiction témoin, cet article montre que la genèse de ce texte peut s'expliquer tans par la théorie de la production de Ricardou que par une approche plus classique. Refusant le dogmatisme et la dépréciation axiologique, il plaide pour une approche plurielle des phénomènes esthétiques.

Biometric technologies are becoming more pervasive in the workplace, augmenting managerial processes such as hiring, monitoring and terminating employees. Until recently, these devices consisted mainly of GPS tools that track location, software that scrutinizes browser activity and keyboard strokes, and heat/motion sensors that monitor workstation presence. Today, however, a new generation of biometric devices has emerged that can sense, read, monitor and evaluate the affective state of a worker. More popularly known by its commercial moniker, Emotional AI, the technology stems (...) from advancements in affective computing. But whereas previous generations of biometric monitoring targeted the exterior physical body of the worker, concurrent with the writings of Foucault and Hardt, we argue that emotion-recognition tools signal a far more invasive disciplinary gaze that exposes and makes vulnerable the inner regions of the worker-self. Our paper explores attitudes towards empathic surveillance by analyzing a survey of 1015 responses of future job-seekers from 48 countries with Bayesian statistics. Our findings reveal affect tools, left unregulated in the workplace, may lead to heightened stress and anxiety among disadvantaged ethnicities, gender and income class. We also discuss a stark cross-cultural discrepancy whereby East Asians, compared to Western subjects, are more likely to profess a trusting attitude toward EAI-enabled automated management. While this emerging technology is driven by neoliberal incentives to optimize the worksite and increase productivity, ultimately, empathic surveillance may create more problems in terms of algorithmic bias, opaque decisionism, and the erosion of employment relations. Thus, this paper nuances and extends emerging literature on emotion-sensing technologies in the workplace, particularly through its highly original cross-cultural study. (shrink)

Retomando el tan explorado debate entre elitismo y populismo penal, este libro adopta una perspectiva republicana para argumentar a favor de un mayor grado de participación popular en la determinación de las penas. En el plano de la teoría no-ideal, se argumenta que fenómenos como las dinámicas de indignación y los linchamientos, contrariamente a lo que se sugiere, cuentan a favor de la democratización de los sistemas penales. En este sentido, el libro disputa el enfoque de quienes sostienen que las (...) preferencias punitivas arbitrarias de los ciudadanos deberían favorecer mecanismos que aíslen la política criminal de la influencia popular. Por el contrario, se argumenta que tanto el elitismo como el populismo penal operan como fuentes de diferentes tipos de dominación y, por lo tanto, deben evitarse en un estado republicano. Adicionalmente, el libro se propone responder a la necesidad de revisar los presupuestos teóricos del pensamiento crítico sobre los sistemas penales señalada por Carlos Santiago en su debate con Eugenio Raúl Zaffaroni. En consecuencia, la pregunta sobre cuál debe ser el grado de participación popular en los sistemas penales es abordada en el marco de la teoría política republicana. De este modo les lectores cuentan con la ventaja de poder cuestionar los presupuestos normativos de fondo, la propia teoría republicana y la centralidad del valor de la libertad como no-dominación, o el modo en que son empleados para defender una propuesta de democratización. En este artículo hemos intentado poner de relieve la íntima solidaridad que existe entre la ontología y la estética de Gilles Deleuze. La conexión entre ambas disciplinas es tan estrecha que resulta materialmente imposible aproximarse a la teoría del arte de Deleuze sin tener una clara comprensión de las nociones nucleares que integran su pensamiento. Los conceptos de Deleuze no son estáticos, sino móviles, lo que les permite variar de fisonomía a medida que se desplaza el horizonte de la investigación. (...) Este es el motivo de que, en el proyecto del filósofo francés, la obra de arte reciba un tratamiento conceptual que es tributario de tesis elaboradas en el ámbito de la más rigurosa especulación ontológica. Deleuze concibe el arte como un antídoto contra las pasiones tristes de las que hablaba Spinoza, un revulsivo contra una Sociedad que asfixia la creatividad con sus clichés, un «paisaje» nuevo que solo podemos habitar a condición de despojarnos de nuestra pretendida identidad. Els estudis sobre la filosofia de Wittgenstein darrerament han posat de manifest la potència del seu pensament sobre qüestions morals, estètiques i, fins i tot, polítiques, a més dels problemes lògics, lingüístics o epistemològics que va plantejar. Les qüestions estètiques van ocupar bona part del seu treball en filosofia i, com mostren els treballs recollits en aquest volum, la vinculació entre el pensament filosòfic de Wittgenstein, les qüestions estètiques i la seua pròpia biografia és tan estreta que cal considerar-la com (...) un dels pòrtics d’entrada que ens permeten endinsar-nos en l’univers de la filosofia wittgensteiniana.
