Le faux s'entend de multiples façons et ne désigne pas seulement le résultat d'une opération de falsification menée à des fins privées et, à ce titre, réprimée plus ou moins efficacement par le droit pénal. Il fait aussi partie des contraintes nécessaires au bon fonctionnement du système juridique: on ne peut se passer des fictions ou des présomptions ; il faut compter aussi avec les approximations nécessaires du langage juridique: jamais il n'est question de "décrire" une réalité, mais bien plutôt (...) de la schématiser ou d'énoncer un devoir-être la concernant. Ce qui a pour effet de placer le législateur et ses alliés objectifs dans une situation de tension permanente entre ce qui existe en fait ou risque d'advenir et les exigences énoncées par la règle juridique. Ce décalage nécessaire affecte tous les secteurs du droit, pas seulement les plus sensibles au changement social. On a donc essayé d'en prendre la mesure, dans certains d'entre eux - droit économique, droit des assurances, droit de l'environnement, protection des oeuvres de l'esprit, droit international et européen, droit des nouvelles technologies -, sans oublier que le droit n'est à tout prendre qu'un laboratoire des oppositions et conflits d'intérêts qui travaillent la société dans son ensemble et que, par conséquent, comme tout système de communication, il se doit pour continuer d'exister et de remplir cette fonction implicite, de maintenir une part d'ombre sur sa propre nature. Comme dans tous les colloques organisés par le Centre d'études et de recherches sur les contentieux, cette question juridique par excellence a été étudiée par des juristes, bien sûr, mais aussi par des collègues apparemment étrangers à la chose juridique mais directement concernés par les problèmes de la communication entre les hommes. Le colloque dont les actes sont ici reproduits s'inscrit dans la continuité d'un travail entrepris il y a quelques années dans le cadre du Centre d'études et de recherches sur les contentieux. Il a déjà donné lieu à une première publication consacrée aux problèmes de l'interprétation et de la traduction. (shrink)

Comment concilier le relatif et l’universel? C’est à cette délicate tâche que s’était attelée il y a déjà quelques années Madame Delmas-Marty, spécialement dans le domaine des droits de l’homme. Le présent ouvrage envisage une difficulté supplémentaire en croisant les interrogations sur le pluralisme juridique avec la question de l’effectivité du droit économique. La prise en compte des pluralismes, notamment du pluralisme juridique, contribue-t-elle à une meilleure effectivité du droit économique? Ou bien, au contraire, le pluralisme juridique est-il un facteur (...) d’ineffectivité du droit économique? Dans cette recherche, les auteurs se sont attachés au pluralisme aussi bien dans la production du droit économique que dans le règlement des différends. C’est ainsi que le lecteur est appelé à cheminer dans la diversité des formes nouvelles qu’empruntent les régulations juridiques pour partir à la recherche des multiples intérêts que peut prendre en charge le droit économique, qu’ils soient individuels, collectifs ou même futurs. Le voyage se poursuit, là encore dans les mondes aussi bien des formes que de la substance. L'ouvrage, après avoir cherché à cerner la notion d’effectivité au regard de notions voisines comme l’efficacité ou l’efficience, s’interroge in fine sur l’éventualité des voies d’un dépassement de la notion de pluralisme juridique. Riječ “intelektualac” francuskog je porijekla, nastala krajem 19. vijeka. Stvorena tokom afere Dreyfus, uglavnom se odnosi na one mislioce koji su spremni da interveniraju u javnom forumu, čak i ako to znači da sebe izlažu riziku (Le Sueur 2001:2). Teoretičari kao što su Edward Said, Paul Ricoeur, Jean-Paul Sartre i Michael Waltzer dali su doprinos diskusiji o intelektualcima: intelektualca Said vidi kao kritički nastrojenog autsajdera, Ricoeur kao političkog edukatora, Sartre kao čovjeka od akcije, a Waltzer kao brižnog insajdera. Opisati intelektualca (...) na ovaj način, pak, ne spominje prostor unutar kojeg intelektualac djeluje, tj. građansko društvo. Upravo se u takvom prostoru ljudskog udruživanja i odnosnih mreža može promovirati kultura dijaloga, tolerancije, umjerenosti i uzajamno korisnog rješavanja sukoba, upravo onakva kultura kakva otjelotvorava stavove i vrijednosti demokratizacije. Mada intelektualac, onakav kakav je gore opisan, igra značajnu ulogu u održavanju dobro razvijenih demokratskih društava, u postkonfliktnim društvima, kakva su i kosovsko i bosanskohercegovačko, pojavljuje se potreba za intelektualcem koji je više od pukog kritičara društva, edukatora, čovjeka od akcije i saosjećajnog pojedinca. I tu na scenu stupa hiperintelektualac. Najupečatljivija karakteristika hiperintelektualca je možda upravo stepen u kojem se intelektualac bavi društvenom kritikom, političkim obrazovanjem, akcijom i “insajderizmom”, ne kao ideolog, već kao nestranačka fi gura. Društvena kritika i političko obrazovanje hiperintelektualca manifestiraju se na nestranački način, tako da se jasno čuje sve što je moguće i napadati i braniti, i sa jedne i sa druge strane. Important features of space and time are taken to be missing in quantum gravity, allegedly requiring an explanation of the emergence of spacetime from non-spatio-temporal theories. In this paper, we argue that the explanatory gap between general relativity and non-spatio-temporal quantum gravity theories might significantly be reduced with two moves. First, we point out that spacetime is already partially missing in the context of general relativity when understood from a dynamical perspective. Second, we argue that most approaches to quantum gravity (...) already start with an in-built distinction between structures to which the asymmetry between space and time can be traced back. The quantification of phase synchrony between neuronal signals is of crucial importance for the study of large-scale interactions in the brain. Two methods have been used to date in neuroscience, based on two distinct approaches which permit a direct estimation of the instantaneous phase of a signal [Phys. Rev. Lett. 81 (1998) 3291; Human Brain Mapping 8 (1999) 194]. The phase is either estimated by using the analytic concept of Hilbert transform or, alternatively, by convolution with a complex wavelet. In (...) both methods the stability of the instantaneous phase over a window of time requires quantification by means of various statistical dependence parameters (standard deviation, Shannon entropy or mutual information). The purpose of this paper is to conduct a direct comparison between these two methods on three signal sets: (1) neural models; (2) intracranial signals from epileptic patients; and (3) scalp EEG recordings. Levels of synchrony that can be considered as reliable are estimated by using the technique of surrogate data. Our results demonstrate that the differences between the methods are minor, and we conclude that they are fundamentally equivalent for the study of neuroelectrical signals. In all societies that have arrived at a certain degree of social differentiation, there are two types of culture that may be qualified respectively as “popular” and “lettered”. Popular culture is that of the people as opposed to the dominant political and intellectual classes. The latter two may be distinct (but allied), as in ancient India with the pair Brahman-kshatriva. or mixed as in Confucian China with the bureaucracy of scholars-civil servants. The duality between the two kinds of culture may (...) become less distinct with the democratization of power and education as well as with the omnipresent symbolic universe of the media. None the less, it survives, as has been proven by all sociological research on the nature of leisure time as employed by classes in industrial societies, in the “West” and in the “East”. (shrink)

Representations of the body depend on a social framework, a vision of the world and a definition of the person. The body is a symbolic construction and not a reality in its own right. A priori, its characterization seems to be self-evident, but ultimately nothing is less comprehensible. Far from being unanimously accepted by human societies, making the body stand out as a reality in some way distinct from man seems an uneasy effort, contradictory between one time and place and (...) another. Many societies do not retain it as part of their vision of the world. They do not detach man from his body in the dualist fashion so common to Western man. We might recall here the incident recounted by Maurice Leenhardt, who asked an elderly Kanak what the West had contributed to Melanesia. The answer surprised him. “What you brought us is the body”. With the intrusion of cultural and social values and forms from the Western world that tend to individualism, there came an awareness of the body as a barrier and a boundary distinguishing each person from every other person. In the societies to which we refer, the components of a person include the flesh without setting this off separately. The body itself is an abstraction. On the phenomenological level, only a person whose body gives him a face and establishes his presence in the world can exist. Man is indiscernible from the flesh that models him. (shrink)

Publicly funded services such as health care and education often offer their users little by way of choice of provider. Partly in consequence they often create substantial inequities, with the less well off utilizing those services less relative to their needs than the better off. Contrary to popular perception, policies that offer choice of provider within these services can increase equity — provided that those policies are properly designed.

In what ways does religious fictionalism parallel positions often labelled 'fictionalist' in ethics and metaphysics? Does religious fictionalism represent an advance over its rivals? Can fictionalism provide an adequate understanding of the characteristic features of the religious life, such as worship, prayer, moral commitment? The speed of technology integration among businesses has accelerated during the COVID-19 pandemic due to the work-from-home arrangements and safe distancing regulations, prompting businesses to automate operations and digitalize work environments. These impacts have disrupted work environments and operational processes, and a fresh set of competencies is required to stay competent in this new normal. Consequently, there is a need to develop a state-of-the-art competency framework for logistics professionals during these trying times. This study has adopted the Preferred Reporting Items (...) for Systematic Reviews and Meta-Analyses to review, identify, and update the emerging competencies required by logistics professionals. The relevant academic documents were narrowed down to 81 and were used to identify the emerging competencies relevant to Industry 4.0 and COVID-19. The competencies were subsequently categorized into four key domains i.e., business, logistics, digital, and personal competencies, with a total of 17 sub-domains. This state-of-the-art framework contributes to academic research by updating the existing competency frameworks. Future research can also build upon this holistic list of emerging competencies by utilizing it to reduce the competency gaps faced by those who are less technology savvy i.e., older logistics professionals. Additionally, future research can correlate the competency framework to organizational learning theories to improve the overall performance of logistics companies. (shrink)

Nietzsche's readers are often tempted to look for his critique of morality in On the Genealogy of Morality. However, I will argue that the Genealogy does not contain Nietzsche's critique of morality, nor was it intended by Nietzsche to contain his critique. Rather, the Genealogy is Nietzsche's attempt to develop crucial parts of what he calls a natural history or typology of morals, which he considers to be a descriptive project meant to serve as preparation for a critique of values. More precisely, the Genealogy serves as preparation for a critique of moral values in three ways: it (1) traces the historical development of Judeo-Christian moral values in a way that (2) enables diagnosis of their psychological effects on various types of people, and of the physiological traits and states of which those values are symptoms. In turn, this vital factual information is needed by Nietzsche so that he can (3) compare Judeo-Christian values to other values. 1–3 are purely descriptive, and they make possible a further, evaluative project Nietzsche does not undertake in the Genealogy itself, namely, his critique of those values by determining their place in a new rank ordering of values (i.e., Umwertung or revaluation of values). Laruelle's first book Phenomenon and Difference: An Essay on Ravaisson's Ontology is unanimously overlooked as having little relevance to his later non-philosophy. On the contrary, this paper analyses Laruelle's dissertation and Ravaisson's writings to show how Ravaisson enables Laruelle to develop non-philosophy's three central ideas of decision, radical immanence, and cloning. Firstly, Laruelle inherits Ravaisson's critique of Platonism and anti-Platonism as dividing the unity of being between two terms, of which one alone is conflated with being to the detriment of (...) the other as non-being. Moreover, Laruelle follows Ravaisson's third way of envisioning being as a radical immanence, which philosophy presupposes to constitute its dualisms by dividing being into opposed terms. Finally, Laruelle's cloning adheres to Ravaisson's eclectic method of expressing being's true immanence through his cohering of all philosophies, as well as disciplines like art and religion, into a single narrative of one and the same being's self-unfolding. According to a plausible and influential account of perceptual knowledge, the truth-makers of beliefs that constitute perceptual knowledge must feature in the causal explanation of how we acquire those beliefs. However, this account runs into difficulties when it tries to accommodate time perception -- specifically perception of order and duration -- since the features we are apparently tracking in such perception are not causal. The central aim of the paper is to solve this epistemological puzzle. Two strategies are examined. The (...) first strategy locates the causal truth-makers within the psychological mechanism underlying time perception, thus treating facts about time order and duration as mind-dependent. This strategy, however, is problematic. The second strategy modifies the causal account of perceptual knowledge to include a non-causal component in the explanation of belief-acquisition, namely chronometric explanation. Applying this much more satisfactory approach to perceptual knowledge of time, we can preserve the mind-independence of order and duration, but not that of time's flow. (shrink)

Risk-taking behaviours often reflect ambivalent ways of calling for the help of one’s close friends and family – those who count. It is an ultimate means of finding meaning and a system of values; and it is a sign of the adolescent’s active resistance and his attempts to find his place in the world again. It contrasts with the far more insidious risk of depression and the radical collapse of meaning. In spite of the suffering it engenders, risk-taking nevertheless has (...) a positive side, fostering independence in adolescents and a search for reference points, it leads to a better self-image and is a means of developing one’s identity. It is nonetheless painful in terms of its possible repercussions: injuries, death or addiction. But let us not forget that the suffering is upstream, perpetuated by a complex relation between a society, a family structure and a life history. Paradoxically, for some young people who are suffering, the risk is rather that they will remain immured in their world-weariness, with a potentially radical outcome (i.e. suicide). The turbulence caused by risk-taking behaviours illustrates a determination to be rid of one’s suffering and to fight on so that life can, at last, be lived. (shrink)
