Twenty years after the end of apartheid rule, the claim that democratic South Africa is founded on the 'spirit of law' (nomos) of our shared humanity is questionable, to say the least. Some would argue that all talk of Ubuntu (or African humanism) should be dismissed as a passing fad of an exhausted nationalism. But a different response to the present is possible, one that proceeds from a temporary suspension (epoché) of the nationalist matrix and all the dead-end questions that (...) have resulted from it, in order to reposition Ubuntu in the more cosmopolitan terms of a critical humanism that must always remain irreducible to the politics of the day. If the universe and God are identical, as pantheism holds, how can we reconcile the supposed unity of God with the apparent dis-unity of the universe’s elements? I argue that a powers ontology, which generates a form of pantheism under plausible assumptions, is apt to solve the problem of unity. There is reason to think that the directedness of powers is equivalent to the directedness, or intentionality, of mental states. This implies that intentionality is a feature of the physical world (...) at large, not just the mind. As Pfeifer (2016) argues, this physical intentionality represents a mild form of panpsychism that is interpretable as a brand of pantheism. I argue that the theory of powers holism (Mumford 2004; Williams 2010) explains the unity of the universe’s elements and thus the unity of a pantheistic God, and that powers holism is strengthened by fully recognizing the role of physical intentionality. Die Philosophische Fakultat der Berliner Universitat stellte im Jahr 1828 eine Preisaufgabe, an deren Losung alle Studenten der Universitat teilnehmen konnten. Einem Vorschlag Hegels folgend ging es um eine Auseinandersetzung mit den "Prinzipien des Schonen" bei Kant. Nach anonymer Bewertung der eingegangenen Arbeiten wurde die von Bruno Bauer mit dem Preis geehrt. Wahrend die im Laufe der Jahre gestellten Aufgaben und erteilten Gutachten fast vollstandig erhalten sind, ist das Vorhandensein der von Bauer handschriftlich in lateinischer Sprache verfaten Arbeit (...) eine wissenschaftliche Raritat. Diese Schrift, deren Original sich im Archiv der Humboldt-Universitat zu Berlin befindet, wird hier erstmals publiziert. Eingeleitet durch eine philosophiegeschichtliche Betrachtung der Quelle (D. Moggach) und eine historische Einordnung der Preisschrift (W. Schultze) gestattet die synchrone Gegenuberstellung von lateinischem und deutschem Text dem Leser ein kritisches Studium der Quelle. Dieser Band soll den Auftakt fur weitere Publikationen wissenschaftlich und wissenschaftshistorisch interessanter Quellen des Archivs der Humboldt-Universitat bilden. (shrink)

Recently some bioethicists and neuroscientists have argued for an imperative of chemical cognitive enhancement. This imperative is usually based on consequentialist grounds. In this paper, the topic of cognitive self-enhancement is discussed from a Kantian point of view in order to shed new light on the controversial debate. With Kant, it is an imperfect duty to oneself to strive for perfecting one’s own natural and moral capacities beyond one’s natural condition, but there is no duty to enhance others. A Kantian (...) approach does not directly lead to a duty of chemical cognitive self-enhancement, but it also does not clearly rule out that this type of enhancement can be an appropriate means to the end of self-improvement. The paper shows the benefits of a Kantian view, which offers a consistent ideal of self-perfection and teaches us a lesson about the crucial relevance of the attitude that underlies one’s striving for cognitive self-improvement: the lesson of treating oneself as an end in itself and not as mere means to the end of better output. The paper contributes to the current discussion on the role of participatory methods in the context of technology assessment (TA) and science and technology (S&T) governance. It is argued that TA has to be understood as a form of democratic policy consulting in the sense of the Habermasian model of a “pragmatist” relation of science and politics. This notion implies that public participation is an indispensable element of TA in the context of policy advice. Against this background, participatory TA (pTA) (...) is defended against recent criticism of procedures of lay participation which states that pTA is lacking impact on S&T decision making, that pTA instead of opening S&T policies to new perspectives is used as a means to support mainstream S&T policy and that in pTA procedure the authentic lay perspective is systematically contorted by dominant expert knowledge. Even though the idea that privacy is some kind of control is often presented as the standard view on privacy, there are powerful objections against it. The aim of this paper is to defend the control account of privacy against some particularly pressing challenges by proposing a new way to understand the relevant kind of control. The main thesis is that privacy should be analyzed in terms of source control, a notion that is adopted from discussions about moral responsibility.

The Physical Intentionality Thesis claims that dispositions share the marks of psychological intentionality; therefore, intentionality is not exclusively a mental phenomenon. Beyond the standard five marks, Alexander Bird introduces two additional marks of intentionality that he argues dispositions do not satisfy: first, thoughts are extrinsic; second, the direction of causation is that objects cause thoughts, not vice versa. In response, this paper identifies two relevant conceptions of extrinsicness, arguing that dispositions show deep parallels to thoughts on both conceptions. Then, it (...) shows that Bird’s discussion of direction of causation overlooks complexities of dispositionality and intentionality that problematize apparent differences between thoughts and dispositions. Based on Moscovici’s classical study on the cultivation of psychoanalytic ideas in France in the 1950’s and our own research on modern biotechnology, we propose a paradigm for researching social representations. Following a consideration of the nature of representations and of the ‘iconoclastic suspicion’ that haunts them, we propose a model of the emergence of meaning relating three elements: subjects, objects, and projects. The basic unit of analysis is the elongated triangle of mediation : subject 1, object, project, and subject (...) 2, captured in the image of a ‘Toblerone’. Such social units cultivate, that is produce, circulate and receive representation which may be embodied in four modes–habitual behaviour, individual cognition, informal communication and formal communication–and in three mediums–words, visual images or non-linguistic sounds. We propose an operational definition of a ‘social representation’ as the comparison of four characteristics of communication systems: the content structures , the typified processes , and their functions , within the context of segmented social milieus. Seven implications for research on social representations are outlined: content and process; segmentation by social milieus rather than taxonomies; cultivation studies within social milieus; multi-method analysis; time structures and longitudinal data; the crossover of cultural projects and trajectories; the disinterested research attitude. This ideal type paradigm leads to an operational clarification to identify new research questions, and to guide the design and evaluation of studies on social representations. (shrink)

Climate change is one of the most important issues we are currently facing. There are many ways in which states can fight climate change. Some of them involve interfering with citizens’ personal lives. The question of whether such interference is justified is under-explored in philosophy. This paper focuses on a specific aspect of people’s personal lives, namely their informational privacy. It discusses the question of whether, given certain empirical assumptions, it is proportional of the state to risk its citizens’ privacy (...) or to risk infringing its citizens’ right to privacy to fight climate change. The main claim this paper argues for is that if fighting climate change and protecting our privacy conflict, we have good reason to fight climate change rather than protect our privacy. (shrink)

A standard account of privacy says that it is essentially a kind of control over personal information. Many privacy scholars have argued against this claim by relying on so-called threatened loss cases. In these cases, personal information about an agent is easily available to another person, but not accessed. Critics contend that control accounts have the implausible implication that the privacy of the relevant agent is diminished in threatened loss cases. Recently, threatened loss cases have become important because Edward Snowden’s (...) revelation of how the NSA and GCHQ collected Internet and mobile phone data presents us with a gigantic, real-life threatened loss case. In this paper, I will defend the control account of privacy against the argument that is based on threatened loss cases. I will do so by developing a new version of the control account that implies that the agents’ privacy is not diminished in threatened loss cases. (shrink)

In the last two decades, blame has become a core topic in ethics, philosophical moral psychology and, more recently, epistemology. This chapter aims at clarifying the complex state of the debate and at making a suggestion for how we should proceed from here. The core idea is that accounts of blame are often motivated by very different background goals. One standard goal is to provide a unifying account of our everyday blame practices. The chapter argues that there is reason to (...) think that this goal is not achievable. Another goal is to provide the tools for solving or clarifying important social or philosophical problems. Blame skeptics argue that we have strong reason to revise our blame practices because humans do not fulfill all the conditions for it being appropriate to blame them. This paper presents a new challenge for this view. Many have objected that blame plays valuable roles such that we have strong reason to hold on to our blame practices. Skeptics typically reply that non-blaming responses to objectionable conduct, like forms of disappointment, can serve the positive functions of blame. The new challenge (...) is that skeptics need to show that it can be appropriate (or less inappropriate) to respond with this kind of disappointment to people’s conduct if it is inappropriate to respond with blame. Skepticism about blameworthiness says that there is good reason to doubt that, in our world, humans are ever blameworthy for their deeds. A significant problem for the discussion of this view is that it is unclear how to understand the kind of blame that should be at issue. This paper makes a new proposal. The basic idea is that the kind of blame skeptics should be skeptical about is constituted by responses that can violate the targets’ claims and by the (...) responders’ thought that the targets have forfeited this claim because of their morally objectionable actions and because of how they were when they performed them. This view identifies an important part of our everyday lives and frames discussions about skepticism about blameworthiness in a new way. (shrink)

In this response we address additions to as well as criticisms and possible misinterpretations of our proposal for a second-person neuroscience. We map out the most crucial aspects of our approach by (1) acknowledging that second-person engaged interaction is not the only way to understand others, although we claim that it is ontogenetically prior; (2) claiming that spectatorial paradigms need to be complemented in order to enable a full understanding of social interactions; and (3) restating that our theoretical proposal not (...) only questions the mechanism by which a cognitive process comes into being, but asks whether it is at all meaningful to speak of a mechanism and a cognitive process when it is confined to intra-agent space. We address theoretical criticisms of our approach by pointing out that while a second-person social understanding may not be the only mechanism, alternative approaches cannot hold their ground without resorting to second-person concepts, if not in the expression, certainly in the development of social understanding. In this context, we also address issues of agency and intentionality, theoretical alternatives, and clinical implications of our approach. (shrink)

This book analyzes--in terms of branching--the pervasive reorganization of Latin syntactic and morphological structures: in the development from Latin to French, a shift can be observed from the archaic, left-branching structures (which Latin inherited from Proto-Indo-European) to modern right-branching equivalents. Brigitte Bauer presents a detailed analysis of this development based on the theoretical discussion and definition of "branching" and "head." Subsequently she relates the diachronic shift to psycholinguistic evidence, arguing that the difficuly of LB complex structures as reflected in (...) their painstaking and delayed acquisition accounts for the extensive typological shift from left to right branching that took place in Latin/French and the other Indo-European languages. ABSTRACT Recently, many authors have argued that claims about determinism and free will are situated on different levels of description and that determinism on one level does not rule out free will on another. This paper focuses on Christian List’s version of this basic idea. It will be argued for the negative thesis that List’s account does not rule out the most plausible version of incompatibilism about free will and determinism and, more constructively, that a level-based approach to free will (...) has better chances to meet skeptical challenges if it is guided by reasoning at the moral level – a level that has not been seriously considered so far by proponents of this approach. This paper discusses the idea that the concept of privacy should be understood in terms of control. Three different attempts to spell out this idea will be critically discussed. The conclusion will be that the Source Control View on privacy is the most promising version of the idea that privacy is to be understood in terms of control.

When confronted with the question of why it is appropriate to morally blame a person for some bad action, it may seem plausible to reply that she is morally responsible for it. Some authors, inspired by Peter Strawson's "Freedom and Resentment," argue, however, that thinking this way is backwards. They believe that a person is morally responsible for some bad action because it would be appropriate to blame her for it. For a long time the dominant view on the nature of blame was that to blame someone is to have an emotion toward her, such as anger, resentment or indignation in the case of blaming someone else and guilt in the case of self-blame. Even though this view is still widely held, it has recently come under heavy attack. In today’s highly dynamic societies, moral norms and values are subject to change. Moral change is partly driven by technological developments. For instance, the introduction of robots in elderly care practices requires caregivers to share moral responsibility with a robot (see van Wynsberghe 2013 ). Since we do not know what elements of morality will change and how they will change (see van der Burg 2003 ), moral education should aim at fostering what has been called “moral resilience” (Swierstra 2013 (...) ). We seek to fill two gaps in the existing literature: (i) research on moral education has not paid enough attention to the development of moral resilience; (ii) the very limited literature on moral resilience does not conceptualise moral resilience in relation to new technological developments. We argue that philosophical accounts of moral education need to do justice to the importance of moral resilience, and that a specific form of moral resilience should be conceptualised as “technomoral resilience” to underline the added value of cultivating moral resilience in relation to technomoral change. We illustrate the role of technomoral resilience in practice by looking at the context of elderly care. To make the first step towards an account of how technomoral resilience can be fostered in moral education, we propose that moral education shall focus on a triangle of capacities: (1) moral imagination, (2) a capacity for critical reflection, and (3) a capacity for maintaining one’s moral agency in the face of disturbances. In the transcendental deduction, the central argument of the Critique of Pure Reason, Kant seeks to secure the objective validity of our basic categories of thought. He distinguishes objective and subjective sides of this argument. The latter side, the subjective deduction, is normally understood as an investigation of our cognitive faculties. It is identified with Kant’s account of a threefold synthesis involved in our cognition of objects of experience, and it is said to precede and ground Kant’s proof of the (...) validity of the categories in the objective deduction. I challenge this standard reading of the subjective deduction, arguing, first, that there is little textual evidence for it, and, second, that it encourages a problematic conception of how the deduction works. In its place, I present a new reading of the subjective deduction. Rather than being a broad investigation of our cognitive faculties, it should be seen as addressing a specific worry that arises in the course of the objective deduction. The latter establishes the need for a necessary connection between our capacities for thinking and being given objects, but Kant acknowledges that his readers might struggle to comprehend how these seemingly independent capacities are coordinated. Even worse, they might well believe that in asserting this necessary connection, Kant’s position amounts to an implausible subjective idealism. The subjective deduction ismeant to allay these concerns by showing that they rest on a misunderstanding of the relation between these faculties. This new reading of the subjective deduction offers a better fit with Kant’s text. It also has broader implications, for it reveals the more philosophically plausible account of our relation to the world as thinkers that Kant is defending – an account that is largely obscured by the standard reading of the subjective deduction. The problem of names of illnesses is both a problem of words and values that should address not only the classification of disorders, but also a fundamental question both for medical sciences and humanities: can psychiatric nosology and classifications fit with the ontological constitution of human beings? This paper aims to discuss the so-called “psychiatric object” and its language and it intends to provide a hermeneutical-phenomenological account to mental health. In doing so, the paper will firstly examine the “psychiatric object” (...) and its language; secondly, it will show the difference between taxonomy and ontology, both of interest for the psychiatric object; third, it will insist on the critique of the epistemological status of psychiatry conceived from a natural point of view following three main paths: a metaphysical one (Heidegger, Jaspers), a social one (Szasz, Foucault, Basaglia), and an ethical one (Laing). Finally, it will clarify why phenomenology and in particular hermeneutical-phenomenology can illuminate the understanding of the psychiatric object and its implications in a cultural context, in order to achieve a more humanistic psychiatry. The thought and work of the Jesuit Francisco Suárez (1548-1617) is widely acknowledged as the culmination point of the contribution of the theologians and jurists of the so-called School of Salamanca to the development of modern Western law. This collection of studies on the legal work of Suárez explores some of his major forays into the law. Both his theoretical system-building as well as his interventions in practical questions are covered. This work examines Kant’s remarkable decision to rewrite the core argument of the first Critique, the Transcendental Deduction of the Categories. I identify a two-part structure common to both versions: first establishing an essential role for the categories in unifying sensible intuitions; and then addressing a worry about how the connection between our faculties asserted in the first part is possible. I employ this structure to show how Kant rewrote the argument, focusing on Kant’s response to the concerns raised in (...) an early review by Johann Schultz. Schultz’s dissatisfaction with the original Deduction lies in its second part, and Kant’s subsequent revisions are focused on providing a better answer to this how-possible question. The new Deduction offers a more direct and convincing account of how our faculties work together to make experience possible. (shrink)

Teleosemantics is the view that semantic classification is a species of functional classification. While it is plausible, I think, that there are semantic functions in the natural world, I want to suggest that not all semantic states are functional. An assumption commonly endorsed by the teleosemantist is that there is a distinction between accidental or incidental contributory effects and functions. However, endorsing that distinction, I will suggest, implies the theoretical possibility of nonfunctional semantics.
