Is Judaism a religion, a culture, a nationality--or a mixture of all of these? In How Judaism Became a Religion, Leora Batnitzky boldly argues that this question more than any other has driven modern Jewish thought since the eighteenth century. This wide-ranging and lucid introduction tells the story of how Judaism came to be defined as a religion in the modern period--and why Jewish thinkers have fought as well as championed this idea. We are typically near-future biased, prioritising our present and near-future interests over our own distant-future interests. This bias can be directed at others as well, prioritising their present and near-future interests over their distant-future interests. I here argue that, given these biases, and given a plausible limit on the extent to which we can permissibly prioritise our present interests over the present interests of strangers, we are morally required to prioritise the present interests of strangers over our distant-future interests. I (...) also argue that a similar conclusion holds even if we are near biased only towards ourselves, and regardless of whether this bias is rational. And I show that my conclusions have interesting implications for the ethics of charitable giving, because they generate moral pressure to donate to charity those funds that would otherwise have gone into our long-term savings. Recently, several philosophers have argued that, when faced with moral uncertainty, we ought to choose the option with the maximal expected choiceworthiness (MEC). This view has been challenged on the grounds that it is implausibly demanding. In response, those who endorse MEC have argued that we should take into account the all-things-considered choiceworthiness of our options when determining the maximally choiceworthy option. In this paper, I argue that this gives rise to another problem: for the most part, acts that we (...) consider to be supererogatory are rendered impermissible, and acts that we consider to be suberogatory are rendered obligatory, under MEC. This problem arises because, when we factor in prudential reasons, we often have most reason, or most expected reason, to act in accordance with our interests. I suggest a way to reformulate MEC so that prudential reasons only make acts permissible or non-obligatory, without ever making acts obligatory or wrong under moral uncertainty. (shrink)

This book offers a critical account of the fundamental elements of Leibniz's philosophy, as they manifest themselves in his metaphysics and philosophy of language. Emphasis is placed upon his hitherto neglected doctrine of nominalism, which states that only concrete individuals exist and that there are no such things as abstract entities – no numbers, geometrical figures or other mathematical objects, nor any abstractions such as space, time, heat, light, justice, goodness, or beauty. Most people have the intuition that, when we can save the lives of either a few people in one group or many people in another group, and all other things are equal, we ought to save the group with the most people. However, several philosophers have argued against this intuition, most famously John Taurek, in his article ‘Should the Numbers Count?’ They argue that there is no moral obligation to save the greater number, and that we are permitted to save (...) either the many or the few. I argue in this article that, even if we are almost completely persuaded by these ‘numbers sceptics’, we ought not to just save the few. Whereas most books in this field focus on the creation and reproduction of music, Bruce Benson's concern is the phenomenology of music making as an activity. He offers the radical thesis that it is improvisation that is primary in the moment of music making. Succinct and lucid, the book brings together a wide range of musical examples from classical music, jazz, early music and other genres. It offers a (...) rich tapestry incorporating both analytic and continental philosophy, musicology and performance-practice issues. We present an axiomatization of a problem in commonsense reasoning, characterizing the proper procedure for cracking an egg and transferring its contents to a bowl. The axiomatization is mid-sized, larger than toy problems such as the Yale Shooting Problem or the Suitcase Problem, but much smaller than the comprehensive axiomatizations associated with CYC and HPKB. This size of axiomatization permits the development of non-trivial, reusable core theories of commonsense reasoning, acts as a testbed for existing theories of commonsense reasoning, and (...) encourages the discovery of new problems in commonsense reasoning.We present portions of core theories of containment, falling, and pouring, integrated into Shanahan's circumscriptive event calculus, and show how these can serve as the basis of an axiomatization that partly characterizes egg cracking. We discuss several commonsense reasoning problems encountered during this research, such as the Initial Specification Problem (a relative of the frame problem that occurs in theories in which fluents can trigger actions), and the Unobtainable State Problem (the problem of determining whether or not a theorem stating that one cannot get from one state to another is meaningful). Leo Strauss and Emmanuel Levinas, two twentieth-century Jewish philosophers and two extremely provocative thinkers whose reputations have grown considerably over the last twenty years, are rarely studied together. This is due to the disparate interests of many of their intellectual heirs. Strauss has influenced political theorists and policy makers on the right while Levinas has been championed in the humanities by different cadres associated with postmodernist thought. In Leo Strauss and Emmanuel Levinas: Philosophy and the Politics of Revelation, Leora (...) Batnitzky brings together these two seemingly incongruous contemporaries, demonstrating that they often had the same philosophical sources and their projects had many formal parallels. While such a comparison is valuable in itself for better understanding each figure, it also raises profound questions in the current debate on the definitions of 'religion', suggesting new ways that religion makes claims on both philosophy and politics. Modern contract law is characterized by a certain kind of unity and multiplicity. On the one hand, it establishes fundamental principles that apply to all contracts in general. But at the same time, it specifies further principles and rules for particular kinds of contracts or transaction-types that mark out their distinctive features, incidents and effects. Clearly, a viable theory of contract law should be able to provide a suitable account of both aspects. The central critical contention of The Choice Theory (...) of Contracts is that all prior approaches, in particular rights-based theories, have failed to do so. Indeed, Dagan and Heller argue that only a theory that explains the settled rules of contract law as teleologically oriented toward facilitating individuals’ pursuit of their different substantive goods, and thus as primarily power-conferring in this particularly robust sense, can provide the needed account. Such a theory, they believe, would be not only interpretatively accurate with respect to the actual law but also fully acceptable as a liberal view of contract. This Article challenges the core contentions of choice theory, suggesting why it may be unable to meet its own goal of explaining how contract law coherently specifies and integrates the general and specific dimensions of enforceable agreements. The Article looks into basic contract doctrines in order to specify a general conception of the contractual relation that can meet this desideratum and it sketches how, beginning with that conception, contract law unfolds a rich multiplicity of transaction-types. The resulting view is liberal but rights-based rather than teleological, and it proposes an alternative understanding of how the rules of contract law are power-conferring as well as duty-imposing. This article analyzes the question of how the size of bribes should impact criminal sanctions. In contrast to the commonly held view that punishment should increase with the size of the bribe, we argue to the contrary: that the punishment of the bribee should decrease with the size of the bribe. Our conclusion is based both on a philosophical argument and an economic argument. We argue that all else being equal, as an agent’s reservation price for selling public interests decreases, (...) the culpability of the agent willing to receive a bribe increases. In addition, from an economic perspective, the expected social harm of an official acting with a low reservation price for bribes is much greater than one acting with a high reservation price: both the susceptibility of being bribed as well as the potential for social harm is much greater when the reservation price is low. Although Franz Rosenzweig is arguably the most important Jewish philosopher of the twentieth century, his thought remains little understood. Here, Leora Batnitzky argues that Rosenzweig's redirection of German-Jewish ethical monotheism anticipates and challenges contemporary trends in religious studies, ethics, philosophy, anthropology, theology, and biblical studies.This text, which captures the hermeneutical movement of Rosenzweig's corpus, is the first to consider the full import of the cultural criticism articulated in his writings on the modern meanings of art, language, ethics, and national (...) identity. Bruce Ellis Benson puts forward the surprising idea that Nietzsche was never a godless nihilist, but was instead deeply religious. But how does Nietzsche affirm life and faith in the midst of decadence and decay? Benson looks carefully at Nietzsche's life history and views of three decadents, Socrates, Wagner, and Paul, to come to grips with his pietistic turn. Key to this understanding is Benson's interpretation of the powerful effect that Nietzsche thinks music has on the human (...) spirit. Abstract:Through dismantling the territorial integrity of the modern nation-state, Indigenous sovereignty threatens state imposed hegemonic systems. While these systems exist at the threshold spatially—borders and boundaries—they are the ideological epicenter for controlling human and non-human life, rendering them manageable by the state. These borders are also perpetually liminal spaces, and it is in this liminality that artists intervene through poetics, confronting state rhetorics and exercising sovereignty to address colonial wounds. In 2015 and 2017, two land-based ephemeral art projects were created (...) to challenge the terms by which territory is instrumentalized in order to justify the commodification of both land and humans. In 2015, the artist collective, Post-commodity, set up a land-based art installation, Repellent Fence, intersecting the US/Mexico border in an effort to “stitch” the Americas together again. The gesture of stitching is also employed in Maureen Gruben's Stitching My Landscape from 2017 in which Gruben stitched a segment of ocean ice with vibrant red broad cloth near her home in Tuktoyaktuk, Northwest Territories alongside the Ibyuk Pingo, a national landmark administered by Parks Canada. Both of these projects provide entry points into the various methods by which land is abstracted into an oppressive and singular form. They push back against the rigidity of prescribed borders, instead investigating more fluid entanglements with land.This paper provides a comparative analysis of these projects, examining the ways in which counterpoints are central to them as artistic interventions. Crossing diagonally to the borders that the nation-state has institutionalized produces a moment of reprise to a highly specific end: to heal. Pivotal to these anti-colonial critiques are rejection, dismissal and a refusal to translate. A symbolic reorientation of the ways humans interact with land arises, evoked through a performative gesture of stitching across fragmentations and divides. (shrink)

This essay examines the Kastner trial and the Eichmann trial as constitutive moments in the development of Israeli collective identity. This aspect of the trials is explored by comparing the intervention of two intellectuals, Nathan Alterman and Hannah Arendt, in the two trials respectively. Both social critics challenged the terms of the collective identity that was reinforced by the trials. During the Kastner trial, the Israeli poet Alterman set out to challenge the "two paths" conception of heroism and cowardice that (...) shaped the court's - and society's - understanding of the Holocaust. The first part of the essay examines Alterman's critical intervention and the public controversy that followed in its wake. In the second part, I examine Arendt's criticism of the Eichmann trial as an attempt to construct Israeli collective identity around opposition to the demonic Nazi In this context, I discuss the famous controversy between Arendt and Gershom Scholem over the terms of her criticism. The two episodes come together in the third part of the essay, where I discuss the surprising continuities and affinities between the controversies. The two controversies offer a fascinating tale about the role of the law in the construction of collective identities and the role of the social critic in the development of a liberal society. Western imperialism and colonialism have tremendously affected the epistemological conception of Africa and Africans. In the same vein, early missionaries did not countenance the cosmologies and lived experiences of the Africans in their interpretation and application of the Bible. On the contrary, they imposed Western epistemologies and theological images on Africa. Although much work has been carried out in these areas, little attention has been devoted to how contextuality, interculturality and decolonisation are exercised in power struggles: the power to define (...) what counts for Africa and Africans as they daily deploy the resources of the Bible. The author argues that contextuality, interculturality and decolonisation are schemes of power relations on the one hand and of owning the Bible on the other, rather than mere methods of biblical hermeneutics in Africa. As schemes of power, they reject imperialist agenda of unequal barter of cultural exchange claimed as civilising the African. Presenting contextuality as a finished product is a violation of the rights of Africans to productively apply the Bible as a text seeking understanding in a different clime from the West; it is also a denial of the reality of interculturality, and thus it ignites the need for decolonisation. By utilising conceptual analysis as a framework, it is argued that these schemes are beyond hermeneutical methods but have the power to resist the suffusing influence of Western theological suffocation in Africa. Contribution: This study argues that contextuality, interculturality and decolonisation are not mere hermeneutical methods for studying the Bible in context; they are instruments of struggle to liberate it from Western epistemological stranglehold.
