This is the penultimate draft of a paper originally presented at the Hart-Fuller at 50 conference, held at the NYU Law School in February 2008. A revised version will appear in the NYU Law Review. The paper seeks to clarify and assess HLA Hart's famous claim that legal positivism somehow involves a 'separation of law and morals.' The paper contends that Hart's 'separability thesis should not be confused with the 'social thesis,' with the 'sources thesis,' or with a methodological thesis (...) about jurisprudence. Hart's thesis denies the existence of necessary (conceptual) connections between law and morality. But that thesis is false: there are many necessary connections between law and morality, some of them conceptually significant. Among these is an important negative connection: law is of its nature morally fallible and morally risky. Lon Fuller emphasised the 'internal morality of law,' the 'morality that makes law possible'. Hart stressed that there is also an immorality that law makes possible. Law's nature is seen not only in its internal virtues, in legality, but also in its internal vices, in legalism. (shrink)

The aim of this paper is to respond to recent discussion of, and objections to, the libertarian view of free will I have developed in many works over the past four decades. The issues discussed all have a bearing on the central question of how one might make sense of a traditional free will requiring indeterminism in the light of modern science. This task involves, among other things, avoiding all traditional libertarian appeals to unusual forms of agency or causation that (...) cannot be accounted for by ordinary modes of explanation familiar to the natural and human sciences. Doing this, I argue, requires piecing together a “complex tapestry” of ideas and arguments that involve rethinking many traditional assumptions about free will. The paper also argues that one cannot get to the heart of historical debates about free will without distinguishing different kinds of freedom, different senses of will, and different notions of control, among other distinctions. I especially focus here on different notions of freedom and control that are necessary to make sense of free will. (shrink)

Prominent accounts of collective intentional activity explain the nature of social groups by virtue of a specific criterion: goal-directedness. In doing so, these accounts offer little in the way of determining whether there are any differences among social groups. In this paper, I propose a refined framework of collective intentional activity that can distinguish among social groups better than alternative accounts, and which has revisionary but nevertheless plausible implications for the nature of the family: specifically, that certain friendship relationships may (...) count as genuinely familial, and that we ought to count them as such. I argue that social groups are distinguished by what we can expect from one another within different kinds of social groups; specifically, that there is an important difference between reciprocity that is equivalent in performance and reciprocity that is equivalent in intention; familial groups are specifically guided by this latter kind of reciprocity. This more inclusive definition of familial groups may have important implications for how such groups are supported within a given society – for instance, by recognizing certain caring relations as essential for well-being and supporting them accordingly. In an effort to clear away confusions regarding the role of cultural analysis in historical explanation, this paper proposes a new approach to the issue of cultural autonomy. The premise is that there are two forms of cultural autonomy, analytic and concrete. Analytic autonomy posits the independent structure of culture-its elements, processes, and reproduction. It is achieved through the theoretical and artificial separation of culture from other social structures, conditions, and action. Concrete autonomy establishes the interconnection of culture with the (...) rest of social life, and is achieved by fleshing out the historically specific formulation of particular cultural structures. In addition to theoretically specifying the two forms of cultural autonomy, I demonstrate analytic and concrete autonomy in practice by examining two works that incorporate culture into the analysis of the same historical event. The rewards of recognizing both analytic and concrete cultural autonomy are twofold. First, cultural reductionism can be countered by establishing that culture is structural. Second and more important, once the independent nature of a cultural form is established, its causal contribution to concrete historical situations can be assessed accurately and integrated into historical explanation. In a recent article, Director makes the case that many individuals with bipolar disorder have the capacity to consent to many decisions while acutely manic, even when those decisions are out of character and cause harm. Referring to recent qualitative evidence, I argue that Director overlooks a key mechanism of manic incapacity, an inflexible experience of the future that impairs one’s ability to value. Without attention to the illness-specific experience of decision-making, capacity assessments risk false negatives in people with mania.

Ask any Civil War historian about the cost of the Civil War and they will recite a host of well-known assessments, from military casualties and government expenditures to various measures of direct and indirect costs. But those numbers are not likely to include an appraisal of the humanitarian crisis and suffering caused by the wartime destruction of slavery. Peace-time emancipation in other regions and in other societies certainly presented dangers and difficulties for the formerly enslaved, but wartime emancipation chained the (...) new opportunities and possibilities for freedom to war’s violence, civil chaos, destruction and deprivation. The resulting health crisis, including illness, injury, and trauma, had immediate and lasting consequences for black civilians and soldiers. Although historians are more accustomed to thinking of enslaved people as the beneficiaries of this war, rather than its victims, we cannot assess the cost of this war until we answer two important questions: first, what price did enslaved people have to pay because their freedom was achieved through warfare rather than a peacetime process; and secondly, in this war in which so many Americans paid such a high cost, to what extent did racism inflate the cost paid by people of African descent? In answering these questions, we reconsider this specific war, but we must also tie the U.S. Civil War to a larger scholarship on how wars impact civilians, create refugee populations, and accelerate harsh treatment of people regarded as racial, religious, or ethnic outsiders. We are reminded that war is not an equal-opportunity killer. (shrink)

Children’s digital playgrounds have evolved from commercialized digital spaces such as websites and games to include an array of convergent digital media consisting of social media platforms, mobile apps, and the internet of toys. In these digital spaces, children’s data is shared with companies for analytics, personalization, and advertising. This article describes children’s digital playgrounds as a data assemblage involving commercial surveillance of children, ages 3–12. The privacy sweep is used as a method to follow the personal information traces that (...) can be expected to be disclosed through typical use of two children’s digital playgrounds: the YouTube Kids app and Fisher-Price Smart Toy plush animal and companion app. To trace the data flows, privacy policies and other publicly available documents were analyzed using political economy and privacy informed indicators. This article concludes by reflecting upon the dataveillance and commercialization practices that trouble the privacy rights of the child and parent when data assemblages in children’s digital playgrounds are surveillant. This article argues that post—September 11 political debates and legislation around security necessitate a reconsideration of a right to privacy in Canada. It looks at the proposal for a Canadian Charter of Privacy Rights promoted by Senator Sheila Finestone in the late 1990s and the current challenges of emergent material technologies accelerated by digitization and political technologies of regulation and governance.

Over the past five decades, I have been developing a distinctive view of free will according to which it requires that agents be to some degree ultimately responsible for the formation of their own wills. To act ‘of one's own free will’ in this sense is to act ‘from a will’ that is to some extent ‘of one's own free making’. A free will of this ultimate kind has been under attack in the modern era as obscure and unintelligible. In (...) this paper, I discuss the arguments for such a view and compare it to other contemporary views of free will and action. I then address criticisms that such a non‐determinist free will cannot be made intelligible or reconciled with modern science, does not allow sufficient agent control, reduces to mere chance or luck or randomness, leads to various regresses, or fails to account for moral responsibility, among other criticisms. Perhaps the best way to understand the novelty of Berofsky’s approach is to discuss two prevailing views about autonomy he rejects. On one of these views, we have the following picture: Autonomous agents develop powers to critically reflect upon and evaluate their past and present motivations. Such reflection inevitably leads to conflicts between reflective evaluation and existing motivation. The workaholic judges that he should spend more time with his family; the smoker does not want to have the craving for cigarettes (...) she does have. When such conflicts arise, one exercises autonomy by choosing in favor of the evaluations or higher-order desires over one’s first-order desires. Ronit Stahl and Ezekiel Emanuel have recently issued a stark challenge to conscience protections in medical law and ethics. Their argument is flawed, however. They misrepresent the nature and relevance of conscientious protection in the military, misinterpret the scope of consent tendered by modern medical professionals, and offer no reason to think either that conscientious objection harms patient well-being or that such harm should solely determine the permissibility of conscientious objection. Moreover, and most fundamentally, Stahl and Emanuel do not recognize (...) that conscience protections promote moral integrity, a basic aspect of human well-being that justifies protective action. Drawing on qualitative interviews with parents of preschool children, the author addresses parental responses to children’s gender nonconformity. The author’s analyses indicate that parents welcome what they perceive as gender nonconformity among their young daughters, while their responses in relation to sons are more complex. Many parents across racial and class backgrounds accept or encourage some tendencies they consider atypical for boys. But this acceptance is balanced by efforts to approximate hegemonic ideals of masculinity. The author considers these patterns in (...) the context of gender as an interactional accomplishment, demonstrating that parents are often consciously aware of their own role in accomplishing gender with and for their sons. Heterosexual fathers are especially likely to be motivated in that accomplishment work by their own personal endorsement of hegemonic masculinity, while heterosexual mothers and gay parents are more likely to be motivated by accountability to others in relation to those ideals. Francis Bacon, the English philosopher, statesman and jurist, is best known for developing the empiricist method which forms the basis of modern science. Bacon's writings concentrated on philosophy and judicial reform. His most significant work is the Instauratio Magna comprising two parts - The Advancement of Learning and the Novum Organum. The first part is noteworthy as the first major philosophical work published in English. James Spedding and his co-editors arranged this fourteen-volume edition, published in London between 1857 and 1874, (...) not in chronological order but by subject matter, so that different volumes would appeal to different audiences. The material is divided into three parts: philosophy and general literature; legal works; and letters, speeches and tracts relating to politics. Volume 11, published in 1868, contains Bacon's political writings and letters from 1608 to 1613, including his treatise on the Irish plantations presented to King James I. (shrink)

Background: The concept of dignity is recognised as a fundamental right in many countries. It is embedded into law, human rights legislation and is often visible in organisations’ philosophy of care, particularly in aged care. Yet, many authors describe difficulties in defining dignity and how it can be preserved for people living in long term care. Objectives: In this article, Nordenfelt’s ‘four notions of dignity’ are considered, drawing on research literature addressing the different perspectives of those who receive, observe or (...) deliver care in the context of the long-term care environment. Methods: A review of the literature was undertaken using the terms ‘nursing homes’, ‘residential care’ or ‘long-term care’. The terms were combined and the term ‘human dignity’ was added. A total of 29 articles met the inclusion criteria from the United Kingdom (14), United States (2), Australia (1), Sweden (3), Hong Kong (2), Norway (3), Nordic (1), Taiwan (1), Netherlands (1). Ethical Considerations: Every effort has been made to ensure an unbiased search of the literature with the intention of an accurate interpretation of findings. Discussion: The four notions of dignity outlined by Nordenfelt provide a comprehensive description of the concept of dignity which can be linked to the experiences of people living in long-term care today and provide a useful means of contextualising the experiences of older people, their families and significant others and also of staff in long-term care facilities. Of particular interest are the similarities of perspectives of dignity between these groups. The preservation of dignity implies that dignity is a quality inherent in us all. This links directly to the exploration and conclusions drawn from the literature review. Conversely, promoting dignity implies that dignity is something that can be influenced by others and external factors. Hence, there are a number of implications for practice. Conclusion: We suggest that two of Nordenfelt’s notions, ‘dignity of identity’ and ‘dignity of Menschenwüde’, are a common thread for residents, family members and staff when conceptualising dignity within long-term care environments. The authors argue that women's dependence on men plays a key role in muting challenges to gender inequality, and they explore that argument through an analysis of gender-related attitudes in five countries. Women's dependence at both the societal and the individual levels is associated with less egalitarian gender attitudes; such dependence especially affects women's attitudes, drawing them toward men's less egalitarian views. Societal-level dependence also strengthens the impact of individual-level dependence on egalitarianism. Interdisciplinary research assumes that teams of highly specialized scientists develop new knowledge by bridging their respective horizons. Nurse educators preparing nursing doctoral students to conduct interdisciplinary research need insight into how members of interdisciplinary research teams experience knowledge horizons in these complex contexts. Based on the work of the philosopher Bernard Lonergan, this pilot study uses Transcendental Method for Research with Human Subjects to explore interdisciplinary researchers' experiences with and attitudes toward interdisciplinary research. Results reveal the overarching conceptual category of (...) “engaged interdisciplinary inquiry” which includes six themes: (i) valuing interdisciplinary engagement; (ii) direct engagement; (iii) interior engagement; (iv) disengagement; (v) facilitated engagement and (vi) engaged researcher development. Results also suggest engagement depends on vigorous “back and forth”, or dialogue, with self and others, and demonstrate the study method is fruitful for cognitive inquiry. This pilot supports expanded study to inform preparation for and conduct of interdisciplinary research involving nurses and raises important questions about how the trend toward interdisciplinary research affects nursing science. Blanchot’s Thomas the Obscure and Death Sentence are marked by the imperative to hear the call of night, of darkness, and death. In each work, the ear is enlisted to undermine the prominence accorded to the eye. If sight is essential to measure and confirm the space separating subjects from objects or subjects from other subjects, Blanchot introduces hearing as a way to collapse this protective distance. The border between inside and outside becomes porous, and the subject is no longer (...) protected by vision’s capacity to establish a neutral and demonstrable distance between itself and the object of sight. As vision becomes catastrophic, hearing assumes an ascendant role. Thomas and Anne each hear the call of death, as well as cries, laments and sudden sounds that burst through silence. The characters of Death Sentence also hear and respond to a variety of calls, including the call to yield to death and the open grave. The problem of how to access and deploy the explanatory power of culture in historical accounts has long remained vexing. A recent approach, combining and transcending the "culture as structure"/ "culture as practice" divide among social historians, puts explanatory focus on the recursivity of meaning, agency, and structure in historical transformation. This article argues that meaning construction is at the nexus of culture, social structure, and social action, and must be the explicit target of investigation into the cultural dimension of (...) historical explanation. Through an empirical analysis of political alliance during the Irish Land War, 1879–1882, I demonstrate that historians can uncover meaning construction by analyzing the symbolic structures and practices of narrative discourse.
