Attempting to escape from the substantialist cartesian dualism, some take our conceptual schemes as dualist. Thus, Feigl makes the distinction between the mental and the physical from an epistemological viewpoint, accepting as distinctive of the mental a direct and immediate knowledge which has no place in the physical, but however he accepts the identity between mental states and neurological states. In a similar way, Davidson, stating that all events are physical, characterizes the mental as a specific manner of describing neurological (...) events, which is also accepted by Quine in his latest books. I take that theory as implying that there are mental properties, like those defined by Searle as macroproperties of the brain. But I see no reason to talk about the mind, unless with the purpose of abbreviating more complex expressions like ‘the set of mental properties’, or perhaps ‘the set of human psychological capacities’, as Kenny proposes. The object of the essay is to examine what is basically mental in humans as compared to animals. Differences in respect of the concept of will and in respect of the concept of intellect are examined following ideas expressed by Anthony Kenny in The Metaphysics of Mind, and some criticisms are suggested. Accepting the thesis put forward by Edelman as well as by Damasio that a neurological self is necessary for the development of consciousness, a scientific reading is given to (...) Kant�s idea of the self as well as to that of Wittgenstein in the Tractatus. For the same reasons, Wittgenstein�s later rejection of the concept of self is criticized. (shrink)

One challenge faced by aesthetics is the development of an account able to trace out the continuities and discontinuities between general experience and aesthetic experiences. Regarding this issue, in this paper, I present an enactive model of some raw cognitive dynamics that might drive the progressive emergence of aesthetic experiences from the stream of general experience. The framework is based on specific aspects of John Dewey’s pragmatist philosophy and embodied aesthetic theories, while also taking into account research in ecological psychology, (...) cognitive sciences, and dynamic systems theory. The model focuses on dynamically relevant nodes at the pre-reflective and the reflective side of experience that would work as nested rhythmic constraints at different cognitive timescales with the potential to shunt experiences toward the aesthetic in everyday situations. My proposal constitutes a way to explore aesthetic experiences from an enactive perspective that regards them as transformative events in which cognitive processes entrain and are entrained by changes taking place in the environment, the brain, and the body. This paper explores various notions of aesthetic affordance recently developed through embodied, situated and enactive approaches to aesthetic experience by Maria Brincker and Shaun Gallagher, and the similarities and differences between them and the idea of affective affordance put forward by Joel Krueger and Giovanna Colombetti. This discussion is a way to try to offer some answers to the question of what aesthetic affordances particularly afford compared to affective affordances. I will focus on the affordances that we perceive during various (...) aesthetic experiences in which we find ourselves more moved by the object, event or person(s) causing the experience than we had anticipated. I will argue that these experiences emerge as opportunities to carry out an active exploration of aspects of the narrative self that we feel is related to features of the experience; and that one particular brain network likely to be involved in these experiences – i.e. the default network – might help us to understand how these experiences meaningfully change our relationship with ourselves and with the social context of which we are a part. Integrated Information Theory (IIT) stands out as one of the most promising approaches to scientifically understand the emergence of consciousness. Even if it borrows from the phenomenology of consciousness to derive its axiomatic formulation, IIT does not initially adhere to any particular ontological position. However, its founder leans towards Panpsychism. More recently, Owen has studied the pros and cons of different ontologies as a metaphysical basis for IIT, defending a hylomorphic stance where en-grounding, en-forming relations gain the upper hand in (...) the causal narrative. This paper aims at (1) complementing Owen’s work by invoking additional arguments against physicalist IIT, both reductive and non-reductive; and (2) improving Owen’s characterization of non-physicalist causality through a “nested” version of hylomorphism that avoids the combination problem of Panpsychism. Many pragmatist and non-representational approaches to cognition, such as the enactivist, have focused on the relations between actions, affectivity, and habits from an intersubjective perspective. For those adopting such approaches, all these aspects are inextricably connected; however, many questions remain open regarding the dynamics by which they unfold and shape each other over time. This paper addresses a specific topic that has not received much attention: the impact on future behavior of not fulfilling possibilities for social interaction even though their (...) fulfillment is desirable within a given context. Inspired by Gibson’s theory of affordances and Dewey’s account of habits, these situations will be characterized as events where an agent does not act upon an inviting affordance for social interaction due to a conflict which he or she experiences between given concerns, needs, and social norms. This conflict leads to a sense of unfulfillment that may eventually bring about a crisis and revision of habits. Through specific examples, this work presents the potential impact of the connection between affordances, habits, and affectivity on everyday situations. It therefore represents an exploration of the common ground between pragmatism and enactivism and an attempt to contribute to a process-based approach to social interaction. (shrink)

We report a solution to an open problem regarding the axiomatization of the convex hull of a type of nonclassical evaluations. We then investigate the meaning of this result for the larger context of the relation between rational credence functions and nonclassical probability. We claim that the notions of bets and Dutch Books typically employed in formal epistemology are of doubtful use outside the realm of classical logic, eventually proposing two novel ways of understanding Dutch Books in nonclassical settings.

We describe the informed consent procedures in a research clinic in Santiago, Chile, and a qualitative study that evaluated these procedures. The recruitment process involves information, counseling and screening of volunteers, and three or four visits to the clinic. The study explored the decision‐making process of women participating in contraceptive trials through 36 interviews. Women understood the research as experimentation or progress. The decision to participate was facilitated by the information provided; time to consider it and to discuss it with (...) partners or relatives; and perceived benefits such as quality of care, non‐cost provision of methods and medical care. For some women, participation was an opportunity to express altruism. The main obstacles for participation were perceived side effects or risks. The final risk‐benefit balance was strongly influenced by women’s needs. Women perceived that the consent form benefited the clinic, proving that participants had made a free decision, and benefited the volunteers by warranting their right to free medical care. The most important problem detected was occasional misunderstanding of the information given on the form. We concluded that a full decision‐making process enhances women’s ability to exercise their right to choose, and assures research institutions that trials are conducted without coercion and that the participants are committed to the study. Este artigo considera o desenraizamento afetivo-religioso de Freud no seu contexto familiar e sociocultural e também visa mostrar algumas críticas que neofreudianos e cientistas fazem a Freud. Condicionado, conscientemente ou não, pelas representações (memórias) originárias, Freud não aprofundou as raízes afetivo-religiosas no chão pedregoso de sua infância. Suas primeiras experiências afetivo-religiosas (não tão positivas) foram como pedras escabrosas no chão de sua frágil existência. Com o drástico desaparecimento da babá Resi Wittek, as tenras raízes afetivo-religiosas do psiquismo de Freud praticamente (...) perdem a inicial vitalidade, tentando compensar essa perda com sua mãe, em nível de cuidados e afetos, que não podia corresponder. Ela poderia somente oferecer-lhe um suporte em nível narcisista (jovem e bonita). Ele somente recebeu esse apoio afetivo-religioso de seu pai (Jakob) mais tarde quando já marcado negativamente em seus relacionamentos com os primeiros objetos. Assim determinado, Freud se sente desamparado, em sua infância. Ao entrar na adolescência Freud se declara ateu influenciado pelo ambiente cultural eivado do cientificismo ateu e de um radical anticlericalismo. Sem raízes afetivo-religiosas profundas, em nível experiencial, Freud não poderia ser uma árvore robusta na dimensão religioso-espiritual, apesar de tanto se preocupar com ela. (shrink)

Purpose The purpose of this paper is to lay out an approach to addressing the problem of privacy protection in the global digital environment based on the importance that information has to improve users’ informational self-determination. Following this reasoning, this paper focuses on the suitable way to provide user with the correct amount of information they may need to maintain a desirable grade of autonomy as far as their privacy protection is concerned and decide whether or not to put their (...) personal data on the internet. Design/methodology/approach The authors arrive at this point in their analysis by qualitative discourse analysis of the most relevant scientific papers and dossiers relating to privacy protection. Findings The goal of this paper is twofold. The first is to illustrate the importance of privacy by default and informed consent working together to protect information and communication technology users’ privacy. The second goal is to develop a suitable way to administrate the mentioned “informed consent” to users. Originality/value To fulfil this purpose, the authors present a new concept of informed consent: active “informed consent” or “Opt-in” model by layers. “Opt-in” regimens have already been used with cookies but never with 2.0 applications, as, for instance, social network sites. In seiner Auseinandersetzung mit Eberhard behauptet Kant, Kritizismus sei die eigentliche Apologie von Leibniz. Diese Äußerung darf nicht einfach als sarkastisch abgetan werden. Kant kann dies insofern ernsthaft denken und behaupten, da für ihn die Transzendentalphilosophie die wesentliche philosophische Bedeutung des leibnizschen Gedankens aufhebt, liegt doch schon in Leibniz ein kritizistischer Kern, welcher wiedergewonnen werden kann. Man sieht hier nur einen Aspekt dieser historischen Transformation von Leibniz im kantischen Gedanken, und zwar: die explizite Behauptung Kants, das Konzept der prästabilierten Harmonie (...) werde in der Theorie der reflektierenden Urteilskraft und im Begriff der Zweckmäßigkeit kritisch aufgehoben. Dazu muss man jedoch vorher den Grundzug des kritischen Unterschieds zwischen Kant und der leibniz-wolffschen Philosophie durch eine Diskussion über die Bedeutung des Begriffs des Transzendentalen erläutern. Introduction Currently, The nature and scope of Clinical Ethics Protocols in Madrid are not well understood.Objectives The main objective is to describe the features of ‘guideline/recommendation’ type CEPs that have been or are being developed by existing Clinical Ethics Committees in Madrid. Secondary objectives include characterisation of those CECs that have been the most prolific in reference to CEP creation and implementation and identification of any trends in future CEP development.Methods We collected CEPs produced and in process by CECs accredited (...) in the public hospitals in Madrid, Spain, from 1996 to 2008.Results CECs developed 30 CEPs, with 10 more in process. The most common topic is refusal of treatment . If CEPs addressing terminal illness, Do-Not-Resuscitate orders and advance directives are placed into a separate ‘ethical problems at the end of life’ category, this CEP subject emerges as the most common . There is a relationship between the age of the CEC and the development of CEPs . CECs now seem to be more likely to engage in CEP development.Conclusions The CECs in Madrid, Spain, have developed a significant number of CEPs and there is a trend towards continued development. The most frequent topics are ethical problems at the end of life and refusal of treatment by the patient. (shrink)

BackgroundMonitoring recovery–stress balance in sport is becoming more relevant to prevent training maladaptation and reach the optimal performance for each athlete. The use of questionnaires that identify the athlete’s recovery–stress state have much acceptance in sports due to reliability and useful, furthermore for its low cost. Identifying possible differences between sport modalities and sex is important to determine specific needs and possible intervention ways to keep a recovery–stress balance. The aim was to analyze the differences in the recovery–stress state and (...) mood states by sex and sport type during the competitive phase in young Mexican athletes. As a secondary objective, the psychometric properties of the Mexican version of the Recovery–Stress Questionnaire for Athletes were analyzed.MethodsA cross-sectional study was carried on with 461 athletes, 17.95 years old, from six sports disciplines. The RESTQ-Sport and Profile of Mood States were applied in a single moment. Differences by sex and sports modality were analyzed. RESTQ-Sport’s confirmatory factor analysis was performed after the stress and recovery theoretical structure of two stress and two recovery dimensions, and last, the concurrent validation with the POMS was carried on.ResultsSignificant differences by sex were found in the General Recovery and Sport Stress dimensions of the RESTQ-Sport as well as Vigor factor of the POMS, being higher for men; furthermore, both the Sport Recovery dimension of RESTQ-Sport and Cholera and the Fatigue and Depression factors from POMS also had differences by sport type, showing a less recovery and high stress for individual sport athletes. Goodness-of-fit indexes of the model for the RESTQ-Sport were acceptable. Pearson’s correlation between questionnaires was moderate.ConclusionThe recovery–stress state shows differences in the function of sex and sport modality. More special attention is suggested for women and individual sport athletes. The higher punctuation for men compared with women in sport stress dimension did not negatively affect the recovery–stress balance for male athletes. Finally, the Mexican context adaptation of the RESTQ-Sport provides a psychometric instrument suitable to assess the recovery–stress balance in Mexican athletes. (shrink)

Studies investigating the COVID-19 pandemic from a psychological point of view have mostly focused on psychological distress. This study adopts the framework of existential positive psychology, a second wave of positive psychology that emphasizes the importance of effective coping with the negative aspects of living in order to achieve greater wellbeing. Trait emotional intelligence (trait EI) can be crucial in this context as it refers to emotion-related personality dispositions concerning the understanding and regulation of one’s emotions and those of others. The present study investigated the relationship between trait EI and both wellbeing and psychological distress (i.e., depression, anxiety, and stress), while exploring the mediating role of meaning-centered coping (proactive transformative strategies based on meaning in life) and maladaptive coping (i.e., behavioral disengagement and self-blame) during the first few months of the COVID-19 pandemic. A sample of 326 Lebanese adults completed measures of trait EI, wellbeing, psychological distress, coping, and meaning-centered coping. Results showed a strong positive correlation between trait EI and meaning-centered coping. Trait EI also correlated positively with wellbeing and negatively with psychological distress. Structural equation modeling showed that meaning-centered coping partially mediated the relationship between trait EI and wellbeing. Maladaptive coping fully mediated the relationship between trait EI and psychological distress. Findings indicate that trait EI is positively related to dealing with a stressful situation such as the pandemic in positive ways at both the cognitive level, by reformulating the situation to see something valuable in it, and behavioral level, by being proactive about it. Trait EI was positively linked to seeing the situation as an opportunity for personal growth, finding personal meaning in this situation, maintaining an attitude of hope and courage, and acting more responsibly with one’s self and others during the current crisis. In turn, this coping formula was related to lower psychological distress and improved mental health. These results are consistent with the existential positive psychology framework and can inform implementation programs and policies aiming at raising awareness and promoting healthy and successful coping during the pandemic. Hillesum no habla propiamente de la experiencia mística, sin embargo, su proceso personal existencial en el duro contexto de guerra que le tocó vivir, la condujo a descubrirse profundamente habitada. Su experiencia de Dios le hizo posible comprender y gestionar el dolor en medio de (...) la guerra, así como la necesidad de ‘hacerse bálsamo sobre las heridas’ de sus hermanos judíos. Etty es una mística de ojos abiertos. Benjamín González Buelta ha profundizado en la comprensión de la mística, describiéndola y analizándola desde la experiencia de Dios en el contexto latinoamericano. Su reflexión permite hoy leer a Etty Hillesum desde la perspectiva del místico de ojos abiertos. (shrink)

Any complete account of morality should be able to account for its characteristic normativity; we show that enactivism is able to do so while doing justice to the situated and interactive nature of morality. Moral normativity primarily arises in interpersonal interaction and is characterized by agents’ possibility of irrevocably changing each other’s autonomies, that is, the possibility of harming or expanding each other’s autonomy. We defend that moral normativity, as opposed to social and other forms of normativity, regulates and, in (...) some cases, constitutes this very possibility. Agents are thus morally responsible for caring about their own and others’ autonomies in interaction. In our conception, moral normativity is embodied, situated, and deeply affective, and is constituted in social practices and maintained in interaction. We identify at least two necessary conditions for moral normativity to arise as a social practice. The first is our embodied constitution as living beings who are precarious and therefore vulnerable and in need of interaction with others and with the environment. The second is our sociolinguistic nature, which allows us to exponentially expand our possibilities for action and normatively distinguish among them. We finish by drawing a distinction between moral character and the moral content of interactions, which allows us to universally recognize the ethical dimensions of all human interaction while doing justice to the situated character of morals. The present study aims to apply a program based on Hellison’s Teaching Personal and Social Responsibility Model (TPSR), traditionally used in Physical Education, to other educational subjects and examine the assessment of the teachers who carried it out during the 2018-2019 school year. The program was applied over eight months of one academic year and during at least 60% of the weekly class hours. Initially, 586 students participated, 429 being experimental subjects with 30 teachers, of whom 16 participated in the (...) interviews carried out, all of them being Secondary Education teachers. We used qualitative methodology through content analysis carried out with ATLAS.ti 7.1.3. The instruments used to collect information were semi-structured recorded group interviews. The conclusion is that the Personal and Social Responsibility Model can be applied to all subjects in the curriculum and is adaptable to any content and type of student body. As a basis for future research, we suggest the application of the model by all teachers involved in the same school year and the participation of students’ families. (shrink)

Given the reality of legal orders collapsing or breaking, this paper argues that a good explanation is needed to understand this phenomenon. It adopts a Hartian account of positivism and considers law as part of a larger set of social facts and orders. The paper analyzes the relationship between evil moral commitments and the law. It concludes by showing that it might be more conducive to analyzing the loss of faith in a legal system as an explanation for its collapse (...) rather than thinking about problematic commitments to evil moral attitudes. We address the biological dynamics problem of the persistence of several species in conditions of non-existence of an equilibrium, including an example of stabilization by predation and the very controversial “competitive exclusion”. We give normal forms for various examples of such persistence and comments on the involved topology, which implies the presence of exceptional heteroclinic connections binding equilibria on the boundary.

This study examines the cultural roots of ethical conflicts in the global business environment. It begins with a brief look at worldviews on ethical behavior in general. Based on this, it is argued that an in-depth understanding of ethical conflicts has been hampered by an overreliance on Western models and viewpoints. Three common sources, or bases, of ethical conflicts are discussed as they relate to business practices, including conflicts over tastes and preferences, the relative importance of moral imperatives compared to (...) legal requirements, and people’s level of tolerance for different values among others. It is then argued that an understanding of ethical conflicts can be facilitated through different levels of understanding, including the meaning of universal values, the relationship between values and practices, and the existence of multiple levels of conflict within the same organizations or industries. These specific and interrelated ingredients in cross-cultural ethical conflicts form the basis for a broader discussion of the meaning of truth as it relates to such conflicts. The paper concludes with the need for more research that is cross-cultural and multidisciplinary in order to improve theory building and managerial practice. (shrink)

The comparative study of synchronic occurrences of a particular construction in interactional corpora from different languages can provide a complete understanding of the development of the construction as a response to some basic intimately associated set of interactional moves and cognitive demands. A comparative formal analysis of lists in Spanish and English conversations shows that in both languages the construction has developed a stylized intonation pattern based on the holding of tones by means of lengthening of nuclear syllables, a durable (...) syntactic organization based on parataxis and an almost identical inventory of lexicalized expressions to index the end of the list. A parallel analysis of lists in their interactional contexts shows that in both English and Spanish conversation the formal properties of lists emerge as adaptations to a recurrent set of communicative tasks. The first type of `framing' lists is used for its incremental structure in the negotiation of common background between interlocutors, whereas the second type of `demonstrative' lists is used for its rhetorical structure to provide evidence for a claim and is directed to obtaining agreement. By assuming a deterministic evolution of quantum systems and taking realism into account, we carefully build a hidden variable theory for Quantum Mechanics based on the notion of ontological states proposed by ’t Hooft. We view these ontological states as the ones embedded with realism and compare them to the quantum states that represent superpositions, viewing the latter as mere information of the system they describe. Such a deterministic model puts forward conditions for the applicability of Bell’s inequality: the usual (...) inequality cannot be applied to the usual experiments. We build a Bell-like inequality that can be applied to the EPR scenario and show that this inequality is always satisfied by QM. In this way we show that QM can indeed have a local interpretation, and thus meet with the causal structure imposed by the Theory of Special Relativity in a satisfying way. (shrink)

Entre ellos, revisa el concepto formal de moral, ligado a los sentimientos, antes de centrarse en el punto crucial: la fundamentación de la ética moderna. Aquí se distingue, por un lado, la justificación comparativa de un contractualismo igualitario frente a otras alternativas (...) teóricas y, por otro, los motivos que pueden llevar (more heideggeriano, en realidad) a un individuo autónomo a entenderse en términos morales. The blooming desert or ‘El desierto florido’ in Spanish, is a millenarian climate pattern caused by El Niño that warms the surface waters in the eastern tropical Pacific Ocean and creates the conditions for rain in the Altiplano and the Atacama Desert, north of Chile. After some millimeters of abundant rain, a rich biotic community emerges, and in a matter of hours or days, the driest surface on Earth becomes an impressive colorful habitat for more than two hundred different species (...) of eye-catching flowers that host the desert biotic life. Unfortunately, this breathtaking display of colors coexists with less appealing but equally astonishing landscapes. The Atacama Desert harbors the largest accumulation of discarded clothing worldwide and the largest pools of lithium mining which require vast amounts of water for their production. Every year, approximately 56,000 tons of used clothing, predominantly consisting of fast fashion polyester products, water-intensive cotton fabrics, and equally polluting material scraps, are deposited, forming toxic mountains of waste. This article presents an interpretation of these distinct landscapes as interconnected realities of the dump that illustrate the impact of biocultural semiocides, whereby the loss of relationships and meanings with Earth materials is shaped by glocal forces. By making this argument, the article contends that the Atacama region replicates the conditions of the Earth as a global dumping and solastalgia, namely ‘the pain caused by the loss of solace and the sense of desolation connected to one´s home and territory.’. In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. Este artículo explora las formas en que la migración afecta al sentimiento de pertenencia del migrante al grupo nacional-cultural a partir de un ensayo autobiográfico del escritor heleno-sueco Theodor Kallifatides. El estudio se basa en los análisis del sentimiento de pertenencia al grupo procedentes de la fenomenología contemporánea. Pese a su gran interés, dichos estudios se fijan o bien en episodios afectivos demasiado circunscritos en el tiempo, o bien en orientaciones afectivas de fondo con contornos demasiado vagos para capturar la (...) especificidad del fenómeno que nos interesa. Apoyándose en el texto de Kallifatides, el artículo esboza algunos elementos específicos del sentimiento de pertenencia que se reconfiguran en la migración, apuntando a los papeles que juegan el reconocimiento y la identidad narrativa, y subrayando los matices, gradaciones y la maleabilidad de dicho sentimiento. Resumen: Con el fin de encontrar una configuración pertinente para la teología práctica en el actual contexto teológico, este articulo propone comprenderla y practicarla como teología de la acción. Se identifica primero la presencia de una dimensión práctica en las teologías premodernas, lo cual señala una nota fundamental del saber teológico y sirve de antecedente a nuestra subdisciplina. Hecho esto, se analizan los enfoques históricos más relevantes en la teología práctica como subdisciplina: uno centrado en los oficios del pastor con (...) un modelo aplicativo, otro enfocado en las prácticas eclesiales con un procedimiento deductivo y un tercero abierto a la actividad humana con una dinámica correlacional. Para profundizar este tercer enfoque, se presenta una propuesta metodológica en su comprensión de base y su actualización procedimental. En lo primero, se acoge la metáfora de la conversación continúa; en lo segundo, se desarrollan las dinámicas de la percepción, análisis y planificación. Comprender la teología práctica como teología de la acción implica asumir con radicalidad la convicción de que la correlación entre la acción de Dios y la acción humana, que dinamiza la experiencia de revelación-fe, debe fecundar también los caminos de la reflexión teológica. Abstract: With a view to configuring practical theology in the present theological context, this article suggests understanding it and practice it as a theology of action. The analysis, therefore, starts with identifying the presence of a practical dimension in pre-modern theologies, which points out a fundamental aspect of theological knowledge and serves as a forerunner of our modern sub-discipline. After that, the most relevant historical approaches in practical theology as a subdiscipline are described: the first one, centres on the pastor's duties using an applicative model, the second, focuses on ecclesial practices adopting a deductive procedure and the third one, looks at human activity through a correlational dynamic. To develop this third approach, the mutually critical correlation is developed in its basic understanding and its procedural implementation. For the first, the metaphor of the ongoing conversation is embraced; for the second, the dynamics of perception, analysis and planning are developed. Doing practical theology as theology of action implies radically holding firm the conviction that the correlation between God's action and human action, which energizes the experience of revelation-faith, must also inform and nurture the paths of theological reflection. Este estudio analiza el artículo 146 del Código Orgánico Integral Penal (COIP) de Ecuador, esta trata sobre el homicidio culposo por práctica profesional equivocada. La mala praxis médica es un problema grave en el sistema de salud de Ecuador, y la interpretación inadecuada de este artículo ha generado confusión en los procesos legales relacionados. El objeto de la investigación es analizar la normativa del artículo 146 del COIP y las lagunas de interpretación jurídica para determinar la culpabilidad o inocencia de (...) los profesionales de la salud. Para ello, se emplearán métodos comparativos e históricos, que incluyen revisión bibliográfica, análisis de contenido del artículo 146. Los resultados esperados son demostrar las dudas razonables en la prueba del delito de mala praxis, resaltar la importancia de la bioética en los procedimientos legales. Este estudio busca contribuir a una mejor comprensión del marco legal y brindar ideas para la resolución de casos de mala praxis y homicidio culposo en Ecuador. (shrink)
