This essay explores the intersection of contingency and aesthetics in contemporary artistic practices, challenging the historical dichotomy between reason and fact, and between necessity and contingency. Through the lens of Italian feminist thought, particularly the work of Carla Lonzi, it examines how contingency can redefine aesthetic gestures and suggests the concept of “dynamic liminality” as the conceptual operator of such redefinition. The study identifies four main components of “dynamic liminality” – instability, repetition, impermanence, and unproductiveness – showing how contemporary artists (...) like Nao Bustamante, Marcel Broodthaers, Chiara Camoni, Lucia Cristiani, Peter Fischli & David Weiss, Laura Grisi, and Beatrice Meoni embody these concepts. Their works demonstrate the critical and transformative potential of contingency, proposing an aesthetics that embraces transient, unstable, and unproductive elements as essential to artistic expression and cultural critique. Contemporary defenders of autonomy and traditional defenders of authority generally assume that they have so little in common as to make it hopeless to attempt a dialogue on the defensibility of epistemic, moral, or religious authority. In this paper I argue that they are mistaken. Under the assumption that the ultimate authority over the self is the self, I defend authority in the realm of belief on the same grounds as Joseph Raz uses in his well-known defense of political authority (...) in the tradition of political liberalism. The acceptance of authority over certain beliefs extends to moral and religious beliefs and is not only consistent with autonomy, but is entailed by rational self-governance. (shrink)

Disaster response is a highly collaborative and critical process that requires the involvement of multiple emergency responders (ERs), ideally working together under a unified command, to enable a rapid and effective operational response. Following the 9/11 and 11/13 terrorist attacks and the devastation of hurricanes Katrina and Rita, it is apparent that inadequate communication and a lack of interoperability among the ERs engaged on-site can adversely affect disaster response efforts. Within this context, we present a scenario-based terrorism case study to (...) highlight the challenges of operational disaster command and response. In this article, which is based on the French emergency response doctrine, we outline a semantics-based common operational command system that is designed to guarantee an efficient information flow among ERs. Our focus is on offering to all ERs, a real-time operational picture of the situation in order to enable multilevel coordination among firefighters, police, healthcare units, public authorities, and other stakeholders. Our approach consolidates information to promote timely sharing of data among ERs. The proposed system is based on an ontology that has been developed to represent the different types of knowledge on the part of ERs, providing a shared vocabulary that covers a variety of interoperability concerns. In this Article, I examine a normative idea of territoriality which I call ethical territoriality. By ethical territoriality, I mean the conviction that rights and recognition should extend to all persons who are territorially present within the geographical space of a national state simply by virtue of that presence. I start by briefly reprising a claim I have developed elsewhere — that territorialism is preferable, on liberal democratic grounds, to status-based approaches to immigrants’ rights. Here, though, I set out to (...) interrogate the logic of ethical territoriality itself. I ask why the mere fact of a person’s territorial presence should serve as the basis for rights and recognition. Further, even conceding that it should, I ask how this commitment is to be operationalized. What is the scope of the territory in which presence figures so significantly in normative terms, and who, precisely, gets access to presence in that territory? My purpose in this Article is to get beyond the status vs. territorial presence-as-basis-for-membership dispute in the immigration debates and to begin a critical discussion of the ethical territorial commitment itself. Dual loyalty issues confront health and welfare professionals in immigration detention centres in Australia. There are four apparent ways they deal with the ethical tensions. One group provides services as required by their employing body with little questioning of moral dilemmas. A second group is more overtly aware of the conflicts and works in a mildly subversive manner to provide the best possible care available within a harsh environment. A third group retreats by relinquishing employment in the detention setting. A (...) fourth group is activist in intent and actions. Derived from research and ethnography conducted in Australia, the article explores the moral dilemmas confronting those who are duty-bound by professional codes of ethics while also bound by loyalty to their employers and silenced by confidentiality statements. It provides particular focus on psychiatry, nursing and social work. We conclude by speculating whether a politics of compassion and acts of solidarity can forge a pathway through the ethical terrain. In doing so we draw upon human rights considerations as well as on the works of Joan Tronto and Elisabeth Porter. (shrink)

It is generally accepted that the notion of inclusion derived or evolved from the practices of mainstreaming or integrating students with disabilities into regular schools. Halting the practice of segregating children with disabilities was a progressive social movement. The value of this achievement is not in dispute. However, our charter as scholars and cultural vigilantes is to always look for how we can improve things; to avoid stasis and complacency we must continue to ask, how can we do it better? (...) Thus, we must ask ourselves uncomfortable questions and develop a critical perspective that Foucault characterised as an 'ethic of discomfort' by following the Nietzschean principle where one acts 'counter to our time and thereby on our time... for the benefit of a time to come'. The prevailing normative model of contemporary journalism, drawn primarily from a liberal enlightenment tradition emphasizing universal notions of rights, contributes to what many perceive as a crisis in contemporary journalism; at the least, Kantian models are too "thin" to provide an adequate ethical standard. We consider the extent to which an ethic of care, reconceived to address weaknesses identified in recent scholarly critiques, provides journalists with an alternative framework for moral decision making. We use the concept of unequal ethical pull (...) to rework caring and to promote caring for distant others because caring that remains at the personal level is inadequate as a moral value. We conclude by noting that public journalism and our retooled ethic of care share several important ideals. We suggest a program of mutually beneficial exploration, one that might help today's journalists cultivate the virtue of care as they work toward justice. (shrink)

This paper explores ethical questions arising from the work of health practitioners in immigration detention centres in Australia. It raises questions about the roles of professional disciplines and the ways in which they confront dual loyalty issues. The exploration is guided by interviews conducted with health professionals who have worked in asylum seeker detention and an examination of the outsider advocacy role undertaken by the social work profession. The paper discusses the stance taken by individuals and professional associations on participation (...) in controlled settings, including as participant, bystander and advocate, and asks when the provision of care becomes collusion with oppression. By now one might hope that the robust body of theoretical work recently published on immigration ethics would have taken general political philosophy a long way from the prevailing Rawlsian-style insularity premise, according to which society is “a closed system isolated from other societies” into which persons “enter only by birth and exit only by death.” But there are still a great many political theorists whose focus is unreflectively endogenous and who assume away questions of states’ constitutive scope and boundaries. (...) One of the signal merits of David Miller's new book,Strangers in Our Midst, is that it lucidly demonstrates why ignoring state boundary constitution is untenable for political theory. Miller shows that foundational debates in political philosophy are inescapably related, both as premise and entailment, to many normative immigration questions. (shrink)

Discourses of public education reform, like that exemplified within the Queensland Government's future vision document, Queensland State Education‐2010 , position schooling as a panacea to pervasive social instability and a means to achieve a new consensus. However, in unravelling the many conflicting statements that conjoin to form education policy and inform related literature , it becomes clear that education reform discourse is polyvalent . Alongside visionary statements that speak of public education as a vehicle for social justice are the visionary (...) or those reflecting neoliberal individualism and a conservative politics. In this paper, it is argued that the latter coagulate to form strategic discursive practices which work to secure dominant relations of power. Further, discussion of the characteristics needed by the ‘ideal’ future citizen of Queensland reflect efforts to ‘tame change through the making of the child’ . The casualties of this vision and the refusal to investigate the pathologies of ‘traditional’ schooling are the children who, for whatever reason, do not conform to the norm of the desired school child as an ‘ideal’ citizen‐in‐the‐making and who become relegated to alternative educational settings. Bi-intuitionistic logic is the union of intuitionistic and dual intuitionistic logic, and was introduced by Rauszer as a Hilbert calculus with algebraic and Kripke semantics. But her subsequent ‘cut-free’ sequent calculus has recently been shown to fail cut-elimination. We present a new cut-free sequent calculus for bi-intuitionistic logic, and prove it sound and complete with respect to its Kripke semantics. Ensuring completeness is complicated by the interaction between intuitionistic implication and dual intuitionistic exclusion, similarly to future and past modalities in (...) tense logic. Our calculus handles this interaction using derivations and refutations as first class citizens. We employ extended sequents which pass information from premises to conclusions using variables instantiated at the leaves of refutations, and rules which compose certain refutations and derivations to form derivations. Automated deduction using terminating backward search is also possible, although this is not our main purpose. (shrink)

Lectures on Kant’s Political Philosophy is the go-to text for readers interested in Hannah Arendt’s theory of judgment. Arendt’s discussion of Kantian aesthetic judgments of taste is typically associated with her own view. However, readers who find her interpretation idiosyncratic, if not wrongheaded, distinguish the author of the Critique of Judgment from Arendt’s Kant. Rather than debate who got Kant ‘right’, this essay explores what Arendt discovered about judging politically by reading Kant in her own Arendtian way. Judgment was present (...) early in her political thinking, for judgment deals with the particular and ‘the problem of the new’. As such, judgment concerns the realm of human affairs that the Western philosophical tradition has found unworthy of serious study due to its ever-changing and contingent nature. Beholden to the standards set by philosophy, political thought has been unable to make sense of its subject matter, which is action and ‘men in the plural’. Clarifying what it means to judge politically was crucial to Arendt’s lifelong effort to disentangle politics from philosophy and its focus on ‘Man in the singular’. (shrink)

Beginning in his PhD program, and over a period of years in the 1960s, Richard Paul thoughtfully examined and deliberately critiqued existing theories of logic and reasoning. He took what was a very narrow conception of reasoning and broadened it to more accurately represent human thinking when people reason. He captured the idea of universal intellectual standards by exploring standards typically used by skilled reasoners, and assembled these standards into a constellation of ideas that is easily understandable. Following the tradition (...) of Socrates, Paul continually emphasized the importance of developing conceptual understandings based in foundational ideas and principles of analysis, and tested through life experience. His work laid the groundwork for what may be termed first principles in critical thinking and for a legitimate field of critical thinking studies. (shrink)

Political concerns about the importance of social identity are voiced equally across left, liberal, and right wing perspectives. Moreover, the suspicion of identity is not relegated to the discourse of intellectuals but is also manifest in the mainstream as a widespread public attitude, and not only among white communities.

From the most prominent thinkers in Latin American philosophy, literature, politics, and social science comes a challenge to conventional theories of globalization. The contributors to this volume imagine a discourse in which revolution requires no temporalized march of progress or takeovers of state power but instead aims at local control and the material conditions for human dignity.

"Territorial Presence As A Ground For Claims: Some Reflections" returns to political theory to assess the moral and legal position of those individuals who are inside the territory of liberal democratic states, but whose very presence has been unauthorised by the state. The author asks the question as to what their bodily presence means and does from a political perspective. The paper is part of a broader political phenomenology of territoriality in liberal national thought and puts emphasis on the idea (...) that it is migrants’ bodily presence within the state’s territory that lies at the analytical heart of the conversation about irregular immigrants. What is paradoxical about territorial presence of unauthorised migrants is that such presence is simultaneously the source of the offence states invoke as a justification for making them ‘illegal’; the basis for protections the migrants may claim against the state for basic fair treatment while present; and the ground for claims they make to remain present – i.e., to stay in the territory. Territorial presence is thus a fertile ground for the analysis of arbitrary law-making in migration. The author sets out to analyse some recent legal developments pertaining to the governance of irregular non-citizen immigrants in the United States. These developments bear on the project of theorising "immigrant justice" as resistance to the growing illiberalization of migration policy. In her view, the very existence of a class of people designated as irregular migrants within state polities presupposes that such polities maintain formal exclusionary border regimes and that in such regimes, some persons are predesignated as ineligible for entry. And even though those exclusion rules do not function to fully preclude entry and presence of such persons, states do not treat their arrival as an automatic basis for full membership either. Hence, irregular immigrants are territorially present in a state that purports to eschew that presence. The author then explores how the idea of “sanctuary” relates to the kinds of claims that both liberal humanitarians and immigrant justice advocates have been making over the last few years. These are claims which ground protection in what exponents cite as the overriding ethical significance of immigrants’ territorial presence – their already-hereness – as the basis for recognition and rights. In particular, the author makes the case that even though "sanctuary" provides a logic of safe harbour, it fails to end the predicament of constitutive based in border exclusionism. For her, the political, social, but also philosophical, struggle for the idea of border abolitionism requires a figurative sword that must go beyond sanctuary so that borders are not just mitigated, but radically deconstructed and even destroyed. The author takes this to be the vital imperative that confronts all legal and political theorists who must engage the normative challenge of rethinking arbitrary law-making in view of the new inequalities that a global political order grounded on sovereign borders produces. As this latest volume in the Peace & Policy series shows, sports can be an effective mechanism for peacebuilding, especially when incorporated into conflict-resolution programs. Such programs have been designed to bring children together in post-conflict situations with an ultimate goal of reducing future violence. In examining such programs, the volume's contributors ask key questions: "What are the programs achieving?" and "How are they measuring success?" Although such programs have by and large been successful, some issues need to be addressed (...) if these programs are to hone their effectiveness. Among the questions explored in the volume are: various aspects of culture and how they can help shape sports programs; the role of a coach in creating a culture of peace, and how this culture can fit into a peacebuilding process. Contributors also examine the role of sports in trauma relief programs in Rwanda; the role of universities in sports; and the role of sports in the demilitarization of child soldiers. The last three contributors tackle some of the legitimate concerns raised about using sports for peacebuilding, such as sports being competitive, violent, and focused on winning. Contributors look carefully at these and other issues that have arisen in sports as a tool of conflict resolution, discuss why they have become concerns, and consider some possible ways to deal with these concerns in the future.
