This paper explores Ronald Dworkin’s influential theory of constructive interpretation. It points out that this theory admits of two readings, which I call the “undemanding” and the “demanding” conceptions of constructive interpretation respectively. As I argue, Dworkin’s own presentation of the theory equivocates between these two conceptions, the former of which is utterly unproblematic, but the latter of which incorporates certain philosophical prejudices as to what it must mean for a practice to be purposive.

The age-old debate about the relation between science and society has, in the last two decades, materialized in novel forms at many universities. In this article, we follow the reconfiguration of relevance at one institute of higher education that aspires to become an impact-driven university. We employ a socio-technical instrumentation perspective to this institutional transformation so that we can follow how relevance is being enacted in terms of impact at different organizational levels. To grasp the links between organizational changes and (...) the conditions for academic practices, we analyze three policy instruments in-the-making and in-use: impact narratives as novel evaluation tool, the creation of impact profiles as part of human resource policy and new data infrastructures to monitor impact on the sustainable development goals. We investigate their problematizations and imaginaries through qualitative methods, namely document analysis and semi-structured interviews with researchers at various career levels and faculties at Erasmus University Rotterdam. Through the cases, we analyze how these new impact-oriented instruments open up or close down opportunities for academic practices. Our observations show that the reconfiguration of relevance as impact implies the advancement of a strategic approach to relevance and to academic work and institutions more generally. Ultimately, the site-specific case also includes bottom-up problematizations of impact that lead us to reflect on the limitations of a policy instrument approach and stress the importance of addressing the politics of the social relations of ‘relevant’ scientific work. This paper is one of four interrelated papers resulting from the National Summit on Legal Preparedness for Obesity Prevention and Control convened in June 2008 by the Centers for Disease Control and Prevention, the Robert Wood Johnson Foundation, and the American Society of Law, Medicine, Ethics. Each of the papers deals with one of the four core elements of legal preparedness: laws and legal authorities for public health practitioners; legal competencies public health practitioners and legal and policy decision makers need (...) for use of these laws and authorities; crossdisciplinary and cross-jurisdiction coordination of law-based public health actions; and information on public health law best practices. In 2012, a new and promising gene manipulation technique, CRISPR-Cas9, was announced that seems likely to be a foundational technique in health care and agriculture. However, patents have been granted. As with other technological developments, there are concerns of social justice regarding inequalities in access. Given the technologies’ “foundational” nature and societal impact, it is vital for such concerns to be translated into workable recommendations for policymakers and legislators. Colin Farrelly has proposed a moral justification for the use of patents (...) to speed up the arrival of technology by encouraging innovation and investment. While sympathetic to his argument, this article highlights a number of problems. By examining the role of patents in CRISPR and in two previous foundational technologies, we make some recommendations for realistic and workable guidelines for patenting and licensing. (shrink)

ObjectiveTo determine the effects of learning interventions aimed at optimizing the quality of physical education on psychomotor, cognitive, affective and social learning outcomes in children and adolescents.DesignA systematic review and meta-analysis.Data SourcesAfter searching PsycInfo, ERIC, and SportDiscus electronic databases, we identified 135 eligible studies published between January 1, 1995 to May 1, 2021.Eligibility Criteria for Selecting StudiesWe included randomized controlled trials, quasi-experimental studies, and controlled trials that assessed the effect of a PE-based intervention against one of the four identified learning (...) domains in youth at school.ResultsOne hundred and thirty five studies with over 42,500 participants and 193 calculated effect sizes were included in the study. The mean effect across all the learning and development outcomes was small to medium. When adjusted for publication bias using the Duval and Tweedie Trim and Fill Method, this mean effect size increased to d = 0.40. Effect sizes varied significantly based on learning and development outcomes. Interventions that consistently report above or below the mean d = 0.40 effect are identified based on learning outcome. The greatest effects across interventions were witnessed in psychomotor learning outcomes followed by affective, social, and cognitive learning outcomes. A minority of PE interventions captured by this systematic review and meta-analysis reported having a negative effect on student learning and development.ConclusionThe interventions with the greatest effects on student learning and development were dependant on the learning domains. Some PE interventions with a pedagogical focus such as games-based approaches, TARGET/Mastery Teaching, and Sport Education were found to be strong investments across multiple domains. The evidence is limited however by consistency in intervention dosage, study design, and data collection instruments. The study received no internal or external funding and was not prospectively registered. (shrink)

This interview study investigates the short- and long-term implications of incidental findings detected through brain imaging on research participants’ lives and their surroundings. For this study, nine participants of the Rotterdam Scan Study with an incidental finding were approached and interviewed. When examining research participants’ narratives on the impact of the disclosure of incidental findings, the authors identified five sets of tensions with regard to motivations for and expectations of research participation, preferences regarding disclosure, short- and long-term impacts and impacts (...) on self and others. The paper shows: that the impact of incidental findings may be greater than participants at first let on; incidental findings can have significant effects on participants’ social environment; and participants may not feel prepared for disclosure even if incidental findings have been discussed during the informed consent process. The authors call for investigators to be aware of research participants’ experiences and these short- and long-term impacts when designing suitable courses of action for the detection and management of incidental findings in research settings. Psychological constructs such as personality dimensions or cognitive traits are typically unobserved and are therefore measured by observing so-called indicators of the latent construct. The Common Factor Model models the relations between the observed indicators and the latent variable. In this article we argue in favor of interpreting the CFM as a causal model rather than merely a statistical model, in which common factors are only descriptions of the indicators. When there is sufficient reason to hypothesize that the underlying causal (...) structure of the data is a common cause structure, a causal interpretation of the CFM has several benefits over a merely statistical interpretation of the model. We argue that a causal interpretation conforms with most research questions in which the goal is to explain the correlations between indicators rather than merely summarizing them; a causal interpretation of the factor model legitimizes the focus on shared, rather than unique variance of the indicators; and a causal interpretation of the factor model legitimizes the assumption of local independence. As thousands of healthy research participants are being included in small and large imaging studies, it is essential that dilemmas raised by the detection of incidental findings are adequately handled. Current ethical guidance indicates that pathways for dealing with incidental findings should be in place, but does not specify what such pathways should look like. Building on an interview study of researchers’ practices and perspectives, we identified key considerations for the set-up of pathways for the detection, management and communication of (...) incidental findings in imaging research. We conducted an interview study with a purposive sample of researchers at research facilities across the Netherlands. Based on a qualitative analysis of these interviews and on existing guidelines found in the literature, we developed a prototype ethical framework, which was critically assessed and fine-tuned during a two-day international expert meeting with bioethicists and representatives from large population-based imaging studies from the United Kingdom, Germany, Sweden and Belgium. Practices and policies for the handling of incidental findings vary strongly across the Netherlands, ranging from no review of research scans and limited feedback to research participants, to routine review of scans and the arrangement of clinical follow-up. Respondents felt that researchers do not have a duty to actively look for incidental findings, but they do have a duty to act on findings, when detected. The principle of reciprocity featured prominently in our interviews and expert meeting. We present an ethical framework that may guide researchers and research ethics committees in the design and/or evaluation of appropriate pathways for the handling of incidental findings in imaging studies. The framework consists of seven steps: anticipation of findings, information provision and informed consent, scan acquisition, review of scans, consultation on detected abnormalities, communication of the finding, and further clinical management and follow-up of the research participant. Each of these steps represents a key decision to be made by researchers, which should be justified not only with reference to costs and/or logistical considerations, but also with reference to researchers’ moral obligations and the principle of reciprocity. No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

The division of cognitive labor is fundamental to all cultures. Adults have a strong sense of how knowledge is clustered in the world around them and use that sense to access additional information, defer to relevant experts, and ground their own incomplete understandings. One prominent way of clustering knowledge is by disciplines similar to those that comprise the natural and social sciences. Seven studies explored an emerging sense of these discipline‐based ways of clustering of knowledge. Even 5‐year‐olds could cluster knowledge (...) in a manner roughly corresponding to the departments of natural and social sciences in a university, doing so without any explicit awareness of those academic disciplines. But this awareness is fragile early on and competes with other ways of clustering knowledge. Over the next few years, children come to see discipline‐based clusters as having a privileged status, one that may be linked to increasingly sophisticated assumptions about essences for natural kinds. Possible mechanisms for this developmental shift are examined. (shrink)

Background This manuscript explores the pervasive issue of moral distress among nurses and its impact on their well-being and professional satisfaction. Focusing on diverse factors contributing to moral distress, the review spans various experience levels and patient care settings. Method Utilizing integrative reviews and sourcing from PubMed, CINAHL, SCOPUS, PsycINFO, and ProQuest, the study synthesizes findings from studies worldwide. The conceptual framework by Whittemore & Knafl is employed to comprehensively analyze nurses’ experiences. Results Key factors were identified as contributing to (...) moral distress, including concerns about care quality, team dynamics, and insufficient support. Interventions range from light-touch approaches like mentorship programs to resource-intensive strategies such as staff wellness initiatives. The impact of the COVID-19 pandemic on nurses’ moral distress is also explored. Conclusion Moral distress in nurses leads to burnout and, in some cases, prompts professionals to leave the field. The study emphasizes the need for organizational-level initiatives, support networks, and interventions to address moral distress. Identified gaps in the literature underscore opportunities for future research to better prepare clinicians and advance understanding across experience levels and settings. (shrink)

Contemporary biomedical ethics and environmental ethics share a common ancestry in Aldo Leopold's and Van Rensselaer Potter's initial broad visions of a connected biosphere. Over the past five decades, the two fields have become strangers. Public health ethics, a new subfield of bioethics, emerged from the belly of contemporary biomedical ethics and has evolved over the past 25 years. It has moved from its traditional concern with the tension between individual autonomy and community health to a wider focus on social (...) justice and solidarity. Public health has a broad focus that includes individual, community, and environmental health. Public health ethics attends to these broad commitments reflected in the increasing concern with the connectedness of health of individuals to the health of populations, to the health of animals, to the health of the environment; it is well situated to reconnect all three “fields” of ethics to promote a healthier planet. It remains unclear whether such genetic variants are associated with disease aggressiveness. The NCI-SPORE Genetics Working Group retrospectively collected clinicopathologic information and genotype data for 36 SNPs which at the time had been validated to be associated with PC risk from 25,674 cases with PC. Cases were grouped according to race, Gleason score and aggressiveness. Statistical analyses were used to compare the frequency (...) of the SNPs between different disease cohorts. After adjusting for multiple testing, only PC-risk SNP rs2735839 was significantly and inversely associated with aggressive and high-grade disease in European men. Similar associations with aggressive and high-grade disease were documented in African-American subjects. The G allele of rs2735839 was associated with disease aggressiveness even at low PSA levels in both European and African-American men. Our results provide further support that a PC-risk SNP rs2735839 near the KLK3 gene on chromosome 19q13 may be associated with aggressive and high-grade PC. Future prospectively designed, case-case GWAS are needed to identify additional SNPs associated with PC aggressiveness. (shrink)

Bryan W. Van Norden's Taking Back Philosophy is a long-awaited and much-needed manifesto on multicultural curricula in the academic discipline of philosophy, which has up to now been stubbornly persistent in its monolithic approach to the teaching of its own self-defined genealogy, its origin, its methodology, and its very essence. As Van Norden points out, philosophy has a serious diversity problem. Only a handful of graduate programs have full-time faculty teaching non-Western philosophy.1 No other discipline in the humanities or social (...) sciences, other than those specifically designated as Anglo-European area studies, has been so lopsided in its curricula and student makeup as the resolutely and decisively... By analyzing a gedanken experiment designed to measure the distance l between two spatially separated points, we find that this distance cannot be measured with uncertainty less than (ll 2 P) 1/3 , considerably larger than the Planck scale lP (or the string scale in string theories), the conventional-wisdom uncertainty in distance measurements. This limitation to space-time measurements is interpreted as resulting from quantum fluctuations of space-time itself. Thus, at very short distance scales, space-time is “foamy.” This intrinsic foaminess of (...) space-time provides another source of noise in the interferometers. The LIGO/VIRGO and LISA generations of gravity-wave interferometers, through future refinements, are expected to reach displacement noise levels low enough to test our proposed degree of foaminess in the structure of space-time. This article interprets the logos Christology in the fourth gospel within Ewe-Ghanaian cosmic setting. The article employs a combination of the exegetical and mother tongue biblical hermeneutics as its methodologies. The article compares the concept of the logos in John 1:1–5, 14 with a similar concept in Ewe cosmology with the aim of finding their points of convergence and divergence. The article also identifies linguistic and theological gaps in the Ewe rendition of John 1:1–5, 14 and proposes a new translation (...) that addresses it. A translation of the logos in Ewe cosmic perspective renders the term nyagbe, the intelligible word which dwells with the female pair of Sogbe-Lisa and manifests itself from the absolute state of existence [ logo ] to the embodied state [ logosu ]. When nyagbe journeyed from the eternal state of existence to the embodied state of existence, it manifests itself at five different levels of existence until it reaches the final state where humans exist. Although believed to be the epitome of all creation, human beings are at the same time described as being at the shore of ignorance and therefore must continually climb the ladder of knowledge in order to free themselves from it. It is for this reason that humans constantly petition the cosmic forces for their salvation. The article therefore, identifies a soteriological gap created in the Ewe soteriology and concludes that the only soteriological response to the Ewe cosmic cry for deliverance from the state of ignorance is the logos incarnate in John 1:14. Contribution: The article contributes to the academic knowledge on the logos Christology in the prologue of the fourth gospel (John 1:1–5, 14), specifically in the use of mother tongue in biblical hermeneutics in Africa. The papers in this collection, which were presented at the Third Conference of University Centers for Rational Alternatives, deal with the challenges to academic freedom resulting from the demand that universities take public stands on controversial social and political issues. The papers are grouped under three headings: "Objectivity and Indoctrination," "Ethics of Teaching," and "Ethics of Research." The first group of papers discusses the current trends toward the politicalization of the university and the use of the educational process to indoctrinate (...) rather than to seek and present the truth. The central issue in this discussion is whether teachers should temper their views to avoid clashes with society’s most cherished beliefs. Most of the contributors maintain that teachers can function effectively only if they pursue truth without compromise. The second group of papers deals with such disparate topics as the value of academic freedom, the need to have a detailed legal code for the university and the importance of teaching ethics in law schools. The main dispute in this section concerns the value of codifying the university’s common law. Robert Rosenzweig maintains that attempts at codification will waste large amounts of faculty time because the end product is unlikely to be sufficiently clear to avoid many of the disputes that would have arisen without the code. William Van Alstyne argues that attempts to codify a university’s rules might bring out latent differences of opinion that need to be confronted and, if possible, resolved. The papers in the third section consider whether any limitation should be placed on scientific research that could adversely affect the lives of individuals or groups. Most of the papers support the view that moral considerations limit what scientists should do in their search for knowledge. The papers in this collection, which are mostly three to six pages long, are too brief to allow detailed or probing analyses. Nonetheless, the arguments they contain, which deal with important, current issues, make some interesting and valuable points.—M.G. (shrink)

This article explores Adam Smith's (1723-90) cosmopolitanism by examining his conception of the ideal global regime and his attitudes to classical cosmopolitanism, British imperialism, American independence, war, mercantilism, benevolence, global integration, specialization, patriotism and his own alleged nationalism. It is argued that Smith shares with the Stoics the ideal of a world community but his cosmopolitanism is based, not on the sympathetic workings of universal benevolence, but on mutual enablement and the desire for and satisfaction of exponential material enrichment. Such (...) a state precludes conflict and territorial rivalry. Patriotism will not disappear but will be moderated by a pacific desire for prosperity via free trade. Eventually fierce nationalistic sentiments and intense alliances between security allies will be subdued by a development-induced aversion to conflict and the habits of amicable strangership underlying commercial cosmopolitanism. The article outlines the efficient mechanisms by which this is to be achieved and, in so doing, shows why, for Smith, economic cosmopolitanism is at once desirable, necessary and natural. (shrink)

It is taken as obvious that there is a conflict between objective temporal passage and relativistic physics. The traditional formulation of temporal passage is the movement of a universe-wide set of simultaneous events known as the NOW; the Special Theory of Relativity implies that there is no NOW and therefore no temporal passage. The vast majority of those who accept the B-theory blockworld—the metaphysics of time most friendly to relativistic physics—deny that time passes. I argue that this denial is a (...) mistake. Contrary to overwhelmingly popular opinion, temporal passage does not need a NOW. To show this, I defend a relational understanding of temporal becoming, that I call B-coming, in which an event y B-comes with respect to x iff R xy. Temporal passage is then the difference in what has B-come at one point in a thing’s history with respect to what has B-come at an earlier point in that thing’s history. Appealing to this kind of relation is a strategy that is well-known but has been widely dismissed. This dismissal is premature; I show that the essential elements of temporal passage do not necessarily require a NOW. There can be passage without presentness. (shrink)

Nurses and other medical practitioners often experience moral distress: they feel an anguished sense of responsibility for what they take to be their own moral failures, even when those failures were unavoidable. However, in such cases other people do not tend to think it is right to hold them responsible. This is an interesting mismatch of reactions. It might seem that the mismatch should be remedied by assuring the practitioner that they are not responsible, but I argue that this denies (...) something important that the phenomenon of moral distress tells us. In fact, both the practitioners’ tendencies to hold themselves responsible and other people’s reluctance to hold the practitioners responsible get something right. The practitioners may be right that they are responsible in the sense of having failed to meet a binding moral requirement, even when the requirement was impossible to meet. This makes moral distress a fitting response because it correctly represents their own action as a wrongdoing. However, others may meanwhile be right that the practitioners are not responsible in the sense of being culpable and blameworthy. To blame others, or oneself, for certain failures, including those that are unavoidable, would be unfair. My claim depends on distinguishing between the fittingness and the fairness of holding someone (including oneself) responsible for moral failure. Having drawn the distinction, I suggest that moral distress should be addressed in a way that both recognizes it as a fitting response and avoids the unfairness of blame. (shrink)

I begin my discussion by considering how to relate Descartes’s more general concern with the conduct of life to the metaphysics and epistemology in the foreground of his philosophical project. I then turn to the texts in which Descartes offers his developed ethical thought and present the case for Descartes as a virtue ethicist. My argument emerges from seeing that Descartes’s conception of virtue and the good owes much to Stoic ethics, a school of thought which saw a significant revival (...) in the seventeenth century. It does, however, deviate from classical Stoicism in critical ways. Towards the end of my discussion, I return to the question of the relation between Descartes’s ethics and his metaphysics and epistemology, and I suggest that the Discourse on the Method for Rightly Conducting Reason and the Meditations on First Philosophy are invested with the virtue ethical considerations of moral education and the regulation of the passions, respectively.
