King develops a syntax-based account of propositions based on the idea that propositional unity is grounded in the syntactic structure of the sentence. This account faces two objections: a Benacerraf objection and a grain-size objection. I argue that the syntax-based account survives both objections, as they have been put forward in the existing literature. I go on to show, however, that King equivocates between two distinct notions of ‘propositional structure ’ when explaining his account. Once the confusion is resolved, it (...) is clear that the syntax-based account suffers from both Benacerraf and grain-size problems after all. I conclude by showing that King's account can be revised to avoid these problems, but only if it abandons its motivating idea that it is syntax that unifies the proposition. (shrink)

Humans have the capacity for awareness of many aspects of their own mental lives—their own experiences, feelings, judgments, desires, and decisions. We can often know what it is that we see, hear, feel, judge, want, or decide. This article examines the evolutionary origins of this form of self-knowledge. Two alternatives are contrasted and compared with the available evidence. One is first-person based: self-knowledge is an adaptation designed initially for metacognitive monitoring and control. The other is third-person based: self-knowledge depends on (...) the prior evolution of a mindreading system which can then be directed toward the self. It is shown that the latter account is currently the best supported of the two. (shrink)

Despite being the subject of intense study for nearly a century, they remain maligned as too complicated, too abstruse, or too silly to be worth learning much about. Jewish law takes an approach to self-defense that differs dramatically from the conventional assumptions of Western secular legal systems. The central theme of Talmudic jurisprudence is that self-defense rests on a duty not to stand idly by while one's neighbor suffers. “Do not stand on the blood of one's neighbor,” as the point is cryptically put in Leviticus 19:16. This way of thinking about self-defense departs in two significant ways from common Western assumptions. First, it stresses that the roots of (...) self-defense are a duty rather than a right to act; second, it treats the case of third-party defense as logically prior to the first-party case of self -defense. To contribute to the continuing challenge of explaining how managers identify stakeholders and assess their salience, in this article, we chronicle the history, assess the impact, and evaluate the possibilities opened by Mitchell, Agle, and Wood (MAW-1997). We do so through two types of qualitative analysis, and also through utilizing a quantitative network analysis tool. The first qualitative analysis categorizes the major contributions of the most influential papers succeeding MAW-1997; the second identifies and compares the relevant issues with MAW-1997 at (...) the time of initial publication and today. We apply main path analysis, a quantitative tool, to map how this scholarly domain has evolved. These three analyses robustly depict the impact of MAW-1997 and the ensuing scholarly conversation, and they enable us to illustrate the current state and trajectory of stakeholder identification and salience scholarship. We close by discussing pressing topics related to the broader body of stakeholder theory literature. (shrink)

Often overlooked in studies of the corporation is the recognition that the modern corporate form and its power are rooted in the issue of race, and more specifically, in racial oppression. The racialized roots of the corporation become exposed when we acknowledge the significance of slavery and the Fourteenth Amendment to the evolution of the corporate form along with the discriminatory role corporations have traditionally played in shaping race relations in the U.S. This article draws upon several theoretical perspectives, primarily (...) critical race theory, management theory, legal studies, diversity management, and corporate social responsibility to introduce the corporate responsibility to race concept and establish it as a new basis for understanding why corporate persons have a responsibility for improving race relations. Predictive modeling in education draws on data from past courses to forecast the effectiveness of future courses. The present effort sought to identify such a model of instructional effectiveness in scientific ethics. Drawing on data from 235 courses in the responsible conduct of research, structural equation modeling techniques were used to test a predictive model of RCR course effectiveness. Fit statistics indicated the model fit the data well, with the instructional characteristics included in the model explaining approximately 85% of the (...) variance in RCR instructional effectiveness. Implications for using the model to develop and improve future RCR courses are discussed. (shrink)

A dual-processing model of moral whistleblowing in organizations is proposed. In this theory paper, moral whistleblowing is described as a unique type of whistleblowing that is undertaken by individuals that see themselves as moral agents and are primarily motivated to blow the whistle by a sense of moral duty. At the individual level, the model expands on traditional, rational models of whistleblowing by exploring how moral intuition and deliberative reasoning processes might interact to influence the whistleblowing behavior of moral agents. For people to live together in pluralistic communities, they must find someway to cope with the practices of others that they abhor. For that reason, tolerance has always seemed an appealing medium of accommodation. But tolerance also has its critics. One wing charges that the tolerant are too easygoing. They are insensitive to evil in their midst. At the same time, another wing attacks the tolerant for being too weak in their sentimentsof respect. “The Christian does not wish to be (...) tolerated,” as T. S. Eliot said; and by this he meant to claim, presumably, that the Christian desires respect and acceptance, and not merely the forbearance suggested by “tolerance.” To make the case for tolerance, we must engage in a three-front campaign: first, against intolerance; second, against the moral failing of indifference; and third, against the desirability of respecting and accepting everyone. The central claim in making this case will be that unlike these three competing sentiments, tolerance is a complex attitude toward the behavior and beliefs of others. Its complexity consists in both moral disapproval and the avoidance of interference. If there is a case to be made for tolerance, it must derive from this peculiar complexity. After surveying its alternatives, I will argue that the complex sentimentof tolerance is more readily praised than its alternatives. (shrink)

In the United States today criminal justice can vary from state to state, as various states alter the Modern Penal Code to suit their own local preferences and concerns. In Eastern Europe, the post-Communist countries are quickly adopting new criminal codes to reflect their specific national concerns as they gain autonomy from what was once a centralized Soviet policy. As commonalities among countries and states disintegrate, how are we to view the basic concepts of criminal law as a whole? Eminent (...) legal scholar George Fletcher acknowledges that criminal law is becoming increasingly localized, with every country and state adopting their own conception of punishable behavior, determining their own definitions of offenses. Yet by taking a step back from the details and linguistic variations of the criminal codes, Fletcher is able to perceive an underlying unity among diverse systems of criminal justice. Challenging common assumptions, he discovers a unity that emerges not on the surface of statutory rules and case law but in the underlying debates that inform them. Basic Concepts of Criminal Law identifies a set of twelve distinctions that shape and guide the controversies that inevitably break out in every system of criminal justice. Devoting a chapter to each of these twelve concepts, Fletcher maps out what he considers to be the deep structure of all systems of criminal law. Understanding these distinctions will not only enable students to appreciate the universal fundamental ideas of criminal law, but will enable them to understand the significance of local details and variations. Merely approximate symmetry is mundane enough in physics that one rarely finds any explication of it. Among philosophers it has also received scant attention compared to exact symmetries. Herein I invite further consideration of this concept that is so essential to the practice of physics and interpretation of physical theory. After motivating why it deserves such scrutiny, I propose a minimal definition of approximate symmetry—that is, one that presupposes as little structure on a physical theory to which it is applied (...) as seems needed. Then I apply this definition to three topics: first, accounting for or explaining the symmetries of a theory emeritus in intertheoretic reduction; second, explicating and evaluating the Curie-Post principle; and third, a new account of accidental symmetry. Every time we think ahead, we are crafting a story. Every daily plan—and every political vision, social movement, scientific hypothesis, business proposal, and technological breakthrough—starts with “what if?” Linking causes to effects, considering hypotheticals and counterfactuals, asking how other people will react: these are the essence of narrative. So why do we keep overlooking story’s importance to intelligence in favor of logic? This book explains how and why our brains think in stories. Angus Fletcher, an expert in neuroscientific approaches (...) to narrative, identifies this capacity as “storythinking.” He demonstrates that storythinking is fundamental to what makes us human. Recent work on the hole argument in general relativity by Weatherall has drawn attention to the neglected concept of models’ representational capacities. I argue for several theses about the structure of these capacities, including that they should be understood not as many-to-one relations from models to the world, but in general as many-to-many relations constrained by the models’ isomorphisms. I then compare these ideas with a recent argument by Belot for the claim that some isometries “generate new possibilities” in general (...) relativity. Philosophical orthodoxy, by contrast, denies this. Properly understanding the role of representational capacities, I argue, reveals how Belot’s rejection of orthodoxy does not go far enough, and makes better sense of our practices in theorizing about spacetime. The concept of emergence is commonly invoked in modern physics but rarely defined. Building on recent influential work by Jeremy Butterfield, I provide precise definitions of emergence concepts as they pertain to properties represented in models, applying them to some basic examples from space-time and thermostatistical physics. The chief formal innovation I employ, similarity structure, consists in a structured set of similarity relations among those models under analysis—and their properties—and is a generalization of topological structure. Schmidt’s game and other similar intersection games have played an important role in recent years in applications to number theory, dynamics, and Diophantine approximation theory. These games are real games, that is, games in which the players make moves from a complete separable metric space. The determinacy of these games trivially follows from the axiom of determinacy for real games, $\mathsf {AD}_{\mathbb R}$, which is a much stronger axiom than that asserting all integer games are determined, $\mathsf {AD}$. One of (...) our main results is a general theorem which under the hypothesis $\mathsf {AD}$ implies the determinacy of intersection games which have a property allowing strategies to be simplified. In particular, we show that Schmidt’s $(\alpha,\beta,\rho )$ game on $\mathbb R$ is determined from $\mathsf {AD}$ alone, but on $\mathbb R^n$ for $n \geq 3$ we show that $\mathsf {AD}$ does not imply the determinacy of this game. We then give an application of simple strategies and prove that the winning player in Schmidt’s $(\alpha, \beta, \rho )$ game on $\mathbb {R}$ has a winning positional strategy, without appealing to the axiom of choice. We also prove several other results specifically related to the determinacy of Schmidt’s game. These results highlight the obstacles in obtaining the determinacy of Schmidt’s game from $\mathsf {AD}$. (shrink)

Practical reasoners are resource-bounded—in particular they require time to derive consequences of their knowledge. Building on the Timed Reasoning Logics (TRL) framework introduced in [1], we show how to represent the time required by an agent to reach a given conclusion. TRL allows us to model the kinds of rule application and conflict resolution strategies commonly found in rule-based agents, and we show how the choice of strategy can influence the information an agent can take into account when making decisions (...) at a particular point in time. We prove general completeness and decidability results for TRL, and analyse the impact of communication in an example system consisting of two agents which use different conflict resolution strategies. Science studies scholars often study up to high-tech elites who produce and design scientific knowledge and technology. Methodological tension begins when you pair a desire to study down to less economically developed countries, with the desire to study up to high-tech elites within them. This becomes further complicated when the ethnographer and his/her informants share professional interests and credentials. In these situations, the researcher has high status because of geopolitical privilege. However, the researcher is neither a high-tech elite nor a (...) local cultural elite. How might the ethnographer successfully access and navigate field sites imbued with these unseen power differentials? There are currently no visual mapping tools to enhance the process of reflexivity by feminist ethnographers, as they consider their globally embedded multiple, hierarchical, and situated positionality. This reflection methodology piece provides a tool to consider this phenomenon, as it exists across the Global North/south divide of power. Such a tool would be useful to northern ethnographers to better strategize ethics and access while avoiding complicity with structures of inequality and empowering their southern interlocutors. This is a reprint of a book first published by Little, Brown in 1978. George Fletcher is working on a new edition, which will be published by Oxford in three volumes, the first of which is scheduled to appear in January of 2001. Rethinking Criminal Law is still perhaps the most influential and often cited theoretical work on American criminal law. This reprint will keep this classic work available until the new edition can be published.

In a recent paper, Michal Masny put forward a novel, interesting, theory of the goodness of a life: the Dual Theory. As Masny’s discussion demonstrates, the Dual Theory, if true, would have very significant implications for various issues related to the goodness of lives and for normative ethics. SUMMARYThis essay combines the study of Humboldt's sources with a critique of the treatment of this subject in most studies of Humboldt and his linguistic thought. One crucial issue is the date of his early ‘Über Denken und Sprechen’, which is our first evidence of his mature thinking about language. This text is conventionally dated 1795, thus ruling out that Humboldt might be indebted to the anthropo-linguistic philosophy that he explored in Paris a few years later. But a host of (...) facts make the date untenable and the debt unquestionable, including incontrovertible evidence that ‘Über Denken und Sprechen’ relies on Condillac's argument for the anti-idealist principle that the distinction between subject and object is the absolute precondition for self-awareness and reflection, and thus, by the same token, for the concept of Weltansicht. ‘Über Denken und Sprechen’ also shows that Humboldt was inspired to choose Condillac's and Destutt de Tracy's argument over that of Fichte for what Berkeley disapprovingly called ‘outness’. This analysis exemplifies the critique that is advanced in this essay. (shrink)
