The vision of legendary criminologist Cesare Lombroso to use scientific theories of individual causes of crime as a basis for screening and prevention programmes targeting individuals at risk for future criminal behaviour has resurfaced, following advances in genetics, neuroscience and psychiatric epidemiology. This article analyses this idea and maps its ethical implications from a public health ethical standpoint. Twenty-seven variants of the new Lombrosian vision of forensic screening and prevention are distinguished, and some scientific and technical limitations are (...) noted. Some lures, biases and structural factors, making the application of the Lombrosian idea likely in spite of weak evidence are pointed out and noted as a specific type of ethical aspect. Many classic and complex ethical challenges for health screening programmes are shown to apply to the identified variants and the choice between them, albeit with peculiar and often provoking variations. These variations are shown to actualize an underlying theoretical conundrum in need of further study, pertaining to the relationship between public health ethics and the ethics and values of criminal law policy. La théorie du « criminel-né » de Cesare Lombroso, produite dans le dernier tiers du x1xe siècle est prise ici comme exemple et support pour la discussion parce qu'elle apparaît comme un cas limite, presque caricatural, tant par sa formulation initiale que par son traitement dans la mémoire disciplinaire. Les approches normatives ou « présentistes » ne pouvant (...) rendre compte de la logique du discours de Lombroso que sur le mode de la dénégation, il a semblé préférable - sans qu'il soit nécessaire de devenir lombrosien - de suivre un autre fil directeur. On suggère de substituer à une posture épistémologique présentiste les concepts de « rationalité contextuelle » et de « présupposé cognitif». Ces concepts, combinés à une plus grande sensibilité aux différentes durées pourraient initier une approche qui serait à la fois plus spécifiquement historique et ouverte aux apports des autres sciences humaines. ArgumentEusapia Palladino (1854-1918) is remembered as one of the most famous mediums in the history of spiritualism. Renowned scientists attended her séances in Europe and in the United States. They often had to admit to being unable to understand the origin of the phenomena produced. Cesare Lombroso, for example, after meeting Eusapia, was converted first to mediumism, then spiritualism. This article will retrace the early stages of her career as a medium and shed light on the way she (...) managed to gain the attention of scientists. Criminal Woman [La Donna delinquente], Cesare Lombroso’s book on women criminals, published with Guglielmo Ferrero in 1893, marks the moment when the Italian criminologist first systematically integrated the animal world into his explanations of deviancy. At this time, he put forward a general theory of evolution based on femininity. This article queries the way this structure functions on the theoretical level, via a precise example: female brigands. It proposes that the textual and visual strategies of representing these women, (...) notably their virilization, was closely linked to the theory of “the primitive superiority of the female” and the lack of distinction between the sexes in certain “lower” animal species. Paradoxically, the atavism of criminal women thus brought them closer to masculine features, making them throwbacks on the evolutionary path that the “normal woman”– “a man in a state of arrested development” – had interrupted. If it is luck that has makes us the persons we are, and since our decisions and choices depend largely on the kind of persons we are, it seems that everything we do or fail (...) to do may only be attributed to luck. Abstract This article examines major methodological issues in Gramsci?s writings that are relevant for re?thinking contemporary political relationships, by considering his use of the ?particular?. It draws on Gramsci?s notes on Chesterton?s Father Brown stories, including his contrast between ?old? Catholic Europe and ?new? Protestant, positivist America, and discusses Gramsci?s critique of positivism and populism with reference to his writings on the palaeontologist Cuvier and the criminologist Cesare Lombroso. It links Gramsci?s use of details and fragments from diverse (...) sources, Father Brown?s methods, and the practice of psychoanalysis. Gramsci?s criticism of Conan Doyle is contrasted with Freud?s admiration for him. It examines the tensions involved in interrogating seemingly unimportant, ?everyday? material and in engaging with the innate conservatism of popular ?common sense? beliefs, whose ?good sense? is nonetheless the necessary point of departure for mass politics. At the same time it argues that in addressing major social and political issues, the ?general?, universal or hegemonic cannot be derived from the ?particular?. It connects these themes to contemporary questions about the status and objectives of different kinds of knowledge and the split between politics and people. It suggests that Gramsci?s aim to go beyond the dichotomy between rationalism and irrationalism has profound implications both for understanding his writings and for their use in contemporary political analysis. The first edition of The Mismeasure of Man appeared in 1981 and was quickly praised in the popular press as a definitive refutation of 100 years of scientific work on race, brain-size and intelligence. It sold 125,000 copies, was translated into 10 languages, and became required reading for undergraduate and even graduate classes in anthropology, psychology, and sociology. The second edition is not truly revised, but rather only expanded, as the author claims the book needed no updating as any new (...) research would only be plagued with the same philosophical errors revealed in the first edition. Thus it continues a political polemic, whose author engages in character assassination of long deceased scientists whose work he misrepresents despite published refutations, while studiously witholding from his readers fifteen years of new research that contradicts every major scientific argument he puts forth. Specific attention in this review are given to the following topics: the relationship between brain size and IQ, the importance of the scientific contributions of Sir Francis Galton, S. G. Morton, H. H. Goddard, and Sir Cyril Burt, the role of early IQ testers in determining U.S. immigration policy, The Bell Curve controversy and the reality of g, race /sex/social class differences in brain size and IQ, Cesare Lombroso and the genetic basis of criminal behavior, between-group heritabilities, inter-racial adoption studies, and IQ why evolutionary theory predicts group differences, and the extent to which Gould's political ideology has affected his scientific work. Le Musée d’Anatomie humaine fait partie d’un pôle muséal turinois en développement (...) qui comprend actuellement, en outre, le Musée des Fruits et le Musée d’Anthropologie criminelle « Cesare Lombroso ». Ces trois musées, qui accueillent presque 200 visiteurs par jour, offrent un bel aperçu du positivisme scientifique, qui fut particulièrement important à Turin.The University of Turin’s Museum of Human Anatomy, founded in 1739, was transferred in 1898 to the building it still occupies, which is notable for its monumental style of architecture. It was recently restored to the atmosphere of its day, but during the project, careful consideration was given to possibilities for transforming this scholarly establishment into a communicational museum. It is one of those included in Turin’s new museums project, alongside the Museum of Fruit and the Cesare Lombroso Museum of Criminal Anthropology. In 1903 Otto Weininger, A Viennese Jew who converted to Protestantism, published Geschiecht und Charakter, a book in which he set out to prove the moral inferiority and character deficiency of "the woman" and "the Jew." Almost immediately, he was acclaimed as a young genius for bringing these two elements together. Shortly thereafter, at the age of twenty-three, Weininger committed suicide in the room where Beethoven had died. Weininger's sensationalized death immortalized him as an intellectual who expressed the abject misogyny (...) and antisemitism.This collection of essays, many translated into English for the first time, examines Weininger's influence and reception in Western culture, particularly his impact on important writers such as Ludwig Wittgenstein, Sigmund Freud, Franz Kafka, and James Joyce. One essay considers the ways Weininger's ideas were used to further Nazi ideology, and several offer feminist approaches to interpreting the intersection of antisemitism and misogyny. The concluding essay explores Weininger's surprising role in Israel's ongoing sociopolitical self-definition through the bold production of Joshua Sobol's play, "The Soul of a Jew."This volume 's close examination of Weininger's ideas, and their subsequent appearance in other well-known texts, suggests how the legacies of prejudice affect Western culture today. Since the studies of Adolphe Quetelet, Franz von Liszt, and Cesare Lombroso, an empirical discourse has been established at the borders of statistics, criminology, and jurisprudence that sees in the dangerous individual a paradigmatic figure of the abnormal. Zola’s novel La bête humaine converges with this statistically induced criminology in at least three points: 1. in the reference to the complex of the dangerous individual; 2. in the assumption that all social processes have a reason in a fictitious (...) figure; and 3. in the detection of a danger area in which the social body is measured alongside a distribution scale of norm and defiance. These aspects point to the fact that a diffuse and dangerous force is working within the social body as well as within the body of the individual. All social relationships are pervaded by an energetics and a drive that functions automatically and out of reach of the will of the individual. (shrink)

The DAPRECO knowledge base is the main outcome of the interdisciplinary project bearing the same name. It is a repository of rules written in LegalRuleML, an XML formalism designed to be a standard for representing the semantic and logical content of legal documents. The rules represent the provisions of the General Data Protection Regulation, the new Regulation that is significantly affecting the digital market in the European Union and beyond. The DAPRECO knowledge base builds upon the Privacy Ontology, which provides (...) a model for the legal concepts involved in the GDPR, by adding a further layer of constraints in the form of if-then rules, referring either to standard first order logic implications or to deontic statements. If-then rules are formalized in reified Input/Output logic and then codified in LegalRuleML. Reified Input/Output logic is an application of standard Input/Output logic for legal reasoning, in which Input/Output logic is combined with the reification-based approach in Hobbs and Gordon. The DAPRECO knowledge base is then a case study for reified Input/Output logic, and it shows that the formalism indeed appears to be a good candidate to effectively formalize, via uniform and simple representations, complex linguistic/deontic phenomena that may be found in legal texts. To date, the DAPRECO knowledge base is the biggest knowledge base in LegalRuleML and Input/Output logic freely available online. (shrink)

The law of prior entry was one of E.B. Titchener’s seven fundamental laws of attention. According to Titchener : “the object of attention comes to consciousness more quickly than the objects which we are not attending to.” Although researchers have been studying prior entry for more than a century now, progress in understanding the effect has been hindered by the many methodological confounds present in early research. As a consequence, it is unclear whether the behavioral effects reported in the majority (...) of published studies in this area should be attributed to attention, decisional response biases, and/or, in the case of exogenous spatial cuing studies of the prior-entry effect, to sensory facilitation effects instead. In this article, the literature on the prior-entry effect is reviewed, the confounds present in previous research highlighted, current consensus summarized, and some of the key questions for future research outlined. In particular, recent research has now provided compelling psychophysical and electrophysiological evidence to support the claim that attending to a sensory modality, spatial location, or stimulus feature/attribute can all give rise to a relative speeding-up of the time of arrival of attended, as compared to relatively less attended stimuli. Prior-entry effects have now been demonstrated following both the endogenous and exogenous orienting of attention, though prior-entry effects tend to be smaller in magnitude when assessed by means of participants’ performance on SJ tasks than when assessed by means of their performance on TOJ tasks. In this paper we discuss the problem of the neural conditions of shared attitudes and intentions: which neural mechanisms underlie “we-mode” processes or serve as precursors to such processes? Neurophysiological and neuropsychological evidence suggests that in different areas of the brain neural representations are shared by several individuals. This situation, on the one hand, creates a potential problem for correct attribution. On the other hand, it may provide the conditions for shared attitudes and intentions.

As shown by neuroscientific evidence, neglect may occur without elementary sensorimotor impairments. The deficit is to be found at a higher, more abstract level of representation, which prevents the patient not only from seeing, but from conceiving the contralesional space. By analysing a series of neuropsychological results, in this paper we suggest a crucial role of time for the construction of a world: on this basis, we try to explain how it is possible that half the ontology gets lost. In the present paper we present a short review of some recent neuro- physiological and neuropsychological findings which suggest that self-generated actions and actions of others are mapped on the same neural substratum. Since this substratum is neutral with respect to the agent, correctly attributing an action to its proper author requires the co-activation of areas specific to the self and the other. A conceptual analysis of the empirical data will lead us to conclude that from a neurobiological point of (...) view the problem is not 'how is it possible to share the intentions of others', but rather 'how one can distinguish one's own action/intention from those of other people'. Arithm. p. 6,16–7,5 Hoche. In recent years both the text and the interpretation of this fragment, whose authenticity was questioned by W. Burkert, have been re-examined, and a good deal of progress has been made especially by paying more attention to the nature of Nicomachus' quotation and its context.

Despite society’s increasing sensitivity toward green production, companies often struggle to find effective communication strategies that induce consumers to buy green products or engage in other environmentally friendly behaviors. To add clarity to this situation, we investigated the effectiveness of negative versus positive message framing in promoting green products, whereby companies highlight the detrimental versus beneficial environmental consequences of choosing less versus more green options, respectively. Across four experiments, we show that negatively framed messages are more effective than positively framed (...) ones in prompting consumers to engage in pro-environmental behaviors. More importantly, we find that anticipated shame is the emotion responsible for this effect. Furthermore, both environmental concern and the type of product promoted serve as moderators; thus, the mediating role of anticipated shame is attenuated when environmental concern is low and the product is a luxury one. Finally, we discuss the theoretical and managerial implications of our work, along with its limitations and some directions for future research. (shrink)
