This article examines the precepts of natural law feminism, and in exploring the writings of two Canadian feminists, Maureen McTeer and Louise Vandelac, examines how natural law feminism is deployed in debates about how to theorize reproduction. I contend that the natural law perspective obscures many issues worthy of feminist inquiry, and, perhaps more critically, eschews a discourse that emphasizes reproductive freedom in favour of one which has at its centre a largely unproblematized view of reproduction that follows (...) a biologically driven script of conception, gestation, childbirth and mothering as inherently and necessarily connected. I argue that this stance is particularly evident in natural law feminist analyses of ecology and the regulation of new reproductive and genetic technologies. In both these areas, natural law feminism poses the central problem as one in which feminists must zealously protect the natural association between women and reproduction; in so doing, natural law feminists gloss over the nature of this association. I suggest a reframing of the focus of debates on reproduction from what is natural and what is socially constructed to how we demarcate the two. (shrink)

Louise Du Toit examines the phenomenon of rape with a feminist philosophical discourse concerning women’s or ‘feminine’ subjectivity and selfhood. She demonstrates how the hierarchical dichotomy of male active versus female passive sexuality – which obscures the true nature of rape – is embedded in the dominant western symbolic frame. Joint actions typically involve a sense of togetherness that has a distinctive phenomenological component. While it has been hypothesized that group size, hierarchical structure, division of labour, and expertise impact agents’ phenomenology during joint actions, the studies conducted so far have mostly involved dyads performing simple actions. We explore in this study the complex case of collectively improvised musical performances, focusing particularly on the way group size and interactional patterns modulate the phenomenology of joint action. We recorded two expert improvisation (...) ensembles of contrasting sizes (16 vs 4 musicians) and collected data about their musical behaviour, as well as reports about five aspects of their phenomenology (sense of agency, agentive identity, integration, dependence, reflexivity) and about their musical intentions. Our overall data enabled us to assess how those five phenomenological dimensions related to one another during jointly improvised performances. They also show how such phenomenology varied with the way improvisers dynamically related to one another throughout the performance. Finally, we observe that group size strongly altered the phenomenology of improvisers who otherwise shared many characteristics (high expertise, similar aesthetic preferences, etc.). Our study thus sheds light on the interactional and structural parameters that shape and modulate our felt experience when acting together, and thereby highlights the importance of pluralism for studying the phenomenology of joint action. ABSTRACT In this commentary I evaluate what McGowan’s project would conclude with respect to the treatment of professional Australian Football League player Adam Goodes, who was incessantly ‘booed’ by crowds for the final two years of his career. Analysing Goodes’ case in light of McGowan’s argument leads me to two observations. First, McGowan’s norm-enactment approach is incredibly useful because it explains how words like ‘boo’ (with unstable meaning) can constitute actionable discrimination. Second, however, I wonder if a narrow focus on (...) whether such speech is legally actionable might encourage an overestimation of the power of laws to shepherd new g-norms into social practices. The dire implications of navigating the overwhelming whiteness of the education system for Black women is foregrounded by the author’s autoethnography about her educational journey and experiences. Within it, the author illustrates the key role of her Black identity - despite being immersed in whiteness– to provide a strong sense of self, pride and resilience, which ultimately leads to her survival in the unequal spaces of the education system. By way of her own educational experiences, the author shares how she (...) becomes motivated to embark upon a PhD as a way to centre and affirm Black identities and in order to make palatable spaces within the hostility of whiteness. Drawing on her PhD research, which is framed by Black feminist epistemology, Critical Race Theory and Bourdieu’s theory of practice, her findings, based on the semi-structured interviewing of 25 other Black British women graduates, illustrates that the participants share similar educational experiences and responses. The paper concludes by asserting that the attainment of Black girls and young women often does not reflect their strong commitment to education- which evidences one consequence of journeying into the ‘heart of whiteness'. Therefore, the author argues for the necessity of more research and support for this diverse group. (shrink)

Using print ads and recognizing the role of visual images in argument (Groarke) and the presence of arguments in ads (Slade), this paper argues that the work of argumentation theorists from Aristotle to van Eemeren and Grootendorst can be used to support the thesis that ads are arguments. I cite as evidence definitions, demarcations, delineations, and descriptions of argument put forth by leading scholars in the field of argumentation. This includes Aristotle, Informal Logic, Toulmin (Claim, Data, Warrant, Backing, Qualifier, Rebuttal), (...) Johnson and Blair (argument as “reasons or evidence as grounds or support for an opinion”), Gilbert (Multi-Modal Argumentation), and van Eemeren and Grootendorst (argumentation as a social activity and pragma-dialectics). I show how, although just fitting a particular advertisement to someone’s definition does not mean that all ads are arguments, nevertheless, the fact that we can find in an ad all these elements from this variety of scholars over time, leaves us reasonably secure in stating that an ad is indeed an argument. Since my argument would be the same for practically any ad, I am using only one ad. I do, however, use the kind of ad that is least likely to seem to be an argument: an ad with few words, an ad which is mostly visual. If I can show how even an almost entirely visual ad can be analyzed as an argument using the terms of all these scholars of argumentation, I will maintain that most ads could be analyzed in the same way. This Article explores how managerial prerogative shapes disputes over employment classification and reveals a neglected but prominent feature in legal arguments about platform worker rights—the disputed relevance of a platform’s intellectual property rights. In classification disputes, instead of denying that it has a right to control how others perform services for it, the company often concedes its employer-like authority but offers an alternative rationale: managerial prerogative. The company argues, and judges often agree, that its labor control is not the exercise (...) of employer authority but instead reflects a prerogative of enterprise ownership, like a right to protect property and determine product lines. Thus, managerial prerogative both explains labor control and exempts that control from the statutory duties that would otherwise attach under the legal tests. Platform companies appear to have taken notice of such cases and designed their work relationships around property-based rationales. For instance, Uber uses a software “license” in which drivers agree to Uber’s authority as a condition for accessing the app. The license depicts the terms upon which drivers must affirmatively cooperate with Uber to produce transportation as simply the negative duties not to interfere with Uber’s intellectual property. The Article concludes that we must reject appeals to managerial prerogative in employment classification disputes. To assume that a property-based rationale for labor control is inconsistent with employment is to misunderstand the legal basis of employment and the purpose of statutory labor law. The appeals also rely on dubious economic assumptions and conflate property rights with agreements about the use of property. (shrink)

This article investigates differences in pragmatic abilities between children who have cochlear implants and their hearing peers. Recordings of 10-minute conversations between 10 children with cochlear implants and a hearing peer were transcribed. Conversation analysis provides insights into interactional troubles not evident in broader measures of number of turns, requests for clarification, topic initiation and so on used in earlier studies. How the children go about repair proves of particular interest; other-initiated repair that prompts the speaker to repeat the prior (...) utterance is, not surprisingly, more commonly produced by the children who have cochlear implants. The key contribution of this article, however, is to detail examples where children with cochlear implants choose not to initiate repair of an error made by their hearing friend. The discussion not only highlights the interactional cost of initiating repair, but also demonstrates that not doing repair can cause a breakdown in conversation. (shrink)

There is a strong tendency in both theory and practice to view education’s democratic role as that of equipping students with specific attributes presumed necessary for democratic life. Discussions thus center around identifying the required values, skills, and capabilities, as well as the types of educational endeavors that best foster them. What underpins such discussions is the assumption that the child is inherently lacking, which, I argue, leads to a conceptual dead end. In this article, I explore how the concept (...) of childism can expand the epistemological framework for understanding and theorizing education’s democratic role. Using theoretical concepts from Biesta and Rancière’s sporadic democracy, along with Fricker’s theory of epistemic injustice, I discuss a case from a Danish state school where a teacher harasses a student. I argue that the perception of the child as a deficit being causes children to suffer systemic epistemic (and other) injustices, as incidents of adults harassing children can go unnamed and unrecognized. The potential long-term harm is a loss of trust in one’s ability to know, interpret, and understand the world. I argue that this is also a loss in potential claims for equality based on the perception of injustice, a loss that damages the democratic quality of society. The article advocates a childist turn in research on education’s democratic role. Childism enables a hermeneutical breakthrough that can spark new discussions of scholarly, social, and political norms regarding the question of democracy and education. (shrink)

Perceptions of human resource (HRM) management’s response to worker bullying were investigated through a netnographic analysis of written comments concerning an online ‘TEDx’ talk called “Bullying and Corporate Psychopaths at Work” to help determine whether HRM are seen as supportive of bullied workers. This research utilized a qualitative, ethnographic approach deemed to be highly valid in researching sensitive areas such as that of workplace bullying. Findings align with, deepen, and extend previous theory and knowledge in that a key finding that (...) emerges is that HRM is deemed by workers to be capable of, but unwilling to deal effectively with, bullying managers. HRM are seen as complacent in that they do little about psychopathic bullies, complicit in that they support managerial bullies and compounding in that they worsen outcomes from workers’ point of view. It appears that HRM has therefore lost the trust of this sample of bullied workers. The paper is a first to apply a netnographic analysis to the problem of workplace bullying and reveals HRM fails to deal with it to worker’s satisfaction. Implications include that the ubiquitous prevalence of workplace bullying around the world could continue unabated unless strict, clear codes of conduct are established and policed by HRM or non-HRM related forms of intervention are mobilized. This paper examines the two leading simulation approaches to mental selfascription, Alvin Goldman’s introspectionist account and Robert Gordon’s nonintrospectionist, “ascent routine” account, with a view to determining their adequacy as accounts of our ordinary self-ascriptions of mental states.I begin by reviewing the features of everyday mental state ascriptions and argue that an adequate account of mental state attribution must be able to account for the salient features of those mental attributions we make by using the sentences of a language we (...) know (section 1). By way of introducing the simulation accounts, I outline the tenets of the ‘Theory’-Theory of mental state ascription and sketch the simulationists’ objections to it (section 2). The specific proposals of Alvin Goldman (section 3) and Robert Gordon to ascent routine simulation approach (section 4) are then examined in detail. I argue that both Goldman’s and Gordon’s approaches to mental self-ascription have serious shortcomings. However, the difficulties facing their respective positions suggest *investigating a third approach to the self-ascription of mental states. (shrink)

Public and academic discourse about big data and digital technologies in agriculture present polarizing visions of the future of food, but it is still unclear whether and to what degree farmers are taking up the narratives of proponents or critics. Building on the sociotechnical imaginaries literature, we characterize and analyze farmer imaginaries about digital agricultural technologies. We present the findings from a survey of farmers in Canada (n = 1000). To study imaginaries, the survey uses both affective image analysis and (...) an original scale with a spectrum of possible scenarios for ten key aspects of agri-food futures (e.g., labour shortages, robotics and automation, food security, and sustainability). Canadian farmers’ imaginaries simultaneously include both negative and positive views. Respondents have extremely positive top-of-mind affective associations to digital agricultural technologies. However, overall, respondents are only very mildly optimistic when anticipating the future impacts of digital agricultural technologies at the farm-level and have more pessimistic views on how these tools will impact the agriculture sector more broadly. Our analysis reveals three core narratives in the farmer sociotechnical imaginary about digital agricultural technologies: (1) a feeling of ‘winner takes all’ and exacerbating power imbalances and disparity, (2) a belief that these tools are essential to grow more food on less land with fewer environmental impacts, and (3) faith that farmers and robots can work in harmony. This research contributes to the growing global body of scholarship on farmer experiences with data and digital technologies with a new way of studying sociotechnical imaginaries. (shrink)

Since the turn of the millennium, a new phenomenon has arisen on the global stage, as girls have increasingly begun to raise their voices. In an effort to achieve new philosophical understandings of contemporary childhoods in a post-truth era, the present article examines this Girl Rising movement from an existential perspective. In doing so, the article aims to problematise children’s right to be heard and listened to, as enshrined in Article 12 of the Convention on the Rights of the Child. (...) More specifically, the article explores children as rights-holders and their rights-subject position and how these positions are supported (or not) by adults in different ways. Throughout the analysis, Greta Thunberg is used as a case study to illustrate the phenomenon under study. This new movement highlights children’s right to be heard as a valuable right. The defence of this view relies on the claim that at the heart of adult’s acknowledgement lies the uniqueness of each child and the implications of this uniqueness. Taking into consideration the realisation of children’s rights, powerful stakeholders who seek to silence children’s voices are also identified, as are worldwide adult acknowledgements intended to empower girls to exist ‘in’ and ‘with’ the world in a ‘grown-up’ way. Allan Bell calls on hermeneutics to enliven the relation between discourse analysts and the materials they study, exploring the image of the analyst ‘standing before’ a corpus, prepared to be transformed by it. The ingredient of desire must be added to the account, as well as the embodied scenario of interpretation. These elements are mobilized to situate Bell’s rereading of Babel and of empire.

The United Nations deemed internet access to be of critical importance for human rights in 2016. In 2020, schools around the world closed during the COVID-19 pandemic. As schools were closed, inequities in internet access gained widespread public attention as many educational opportunities shifted online. Amidst this shift, this paper analyzes an Ontario provincial announcement to provide 21,000 iPads and free data for young people, during the pandemic. The closure of schools in Ontario, Canada, meant that young people and families (...) who faced technological challenges, such as a lack of devices, stable and affordable internet connections, or sufficient data allowances, could experience barriers to their right to an education. This paper revisits a community informatics model of internet access, the Access Rainbow, to analyze attempts to operationalize the right to an education through technology in Ontario. In parallel to rights, however, the field of CI faces the ongoing presence of profit-oriented corporations within universal access efforts. This paper argues that socio-technical infrastructural elements of access to the internet became visible through the breakdown of the pandemic. Furthermore, it considers the multi-stakeholder efforts required to implement useful and effective access, where school boards responded in varied ways locally. The paper contributes the concept of refraction to offer continued theorization of a distributive paradigm and a rights-informed approach in community informatics against the backdrop of the pandemic, which could also act as an opening for privatization and disaster capitalism. This study explored employee perceptions of participation in a corporate-sponsored volunteer initiative. Drawing on both questionnaire and focus group data, this study reaffirms the importance of altruistic concerns as a key driver for employee involvement in corporatesponsored volunteering. Characteristics of the volunteering activity also emerged as important determinants of employee's initial engagement and ongoing motivation for involvement in corporate-sponsored volunteering. In the same way that models of work design point to the value of enriched jobs, we see that there is (...) scope to consider how corporate-sponsored volunteer programmes can be enriched so that employees have satisfying experiences and are more likely to participate. Enhancing perceptions of task significance and meaningfulness and incorporating relational elements into the volunteer activity seem to be especially critical in this regard. (shrink)

This volume brings together sixteen essays by Louise Antony that reflect her distinctive approach to issues at the intersections of feminist theory, epistemology, philosophy of mind and philosophy of language. Antony proceeds from the Quinean precept that we treat knowledge as a natural phenomenon. This approach, Antony argues, offers feminists and other progressive theorists vital tools with which to expose and dismantle ideological conceptions of knowledge, human nature, and objectivity. She argues that naturalism's focus on the actual (as opposed (...) to hypothetical) circumstances under which human beings acquire knowledge illuminates and responds to feminist calls for a "situated" account of human knowledge. At the same time, Antony defends a number of views that have been the object of feminist criticism: psychological individualism, cognitive nativism, and the autonomy of semantics. These views, Antony argues, are in no way incompatible with feminist commitments, which is good, because they enjoy broad empirical support. Also in this volume, Antony addresses a number of practical issues of concern to feminists: Does pornography silence women? Are we ethically entitled to moral partiality? Is legitimate authority possible? Why are there so few women in philosophy? Finally, Antony presents and develops her own theory of gender. She argues that genders are socially constructed and multiply realized categories that bring into concordance sets of properties that have no natural or rational connection to each other. Genders must not be identified with the categories "female" and "male," but human sexual difference is the material, explanatory basis of gender systems: but for the existence of differences in reproductive role between females and males, gender regimes would not exist. Abstract Few theoretical insights have emerged from the extensive literature discussions of petitio principii argument. In particular, the pattern of petitio analysis has largely been one of movement between the two sides of a dichotomy, that of form and content. In this paper, I trace the basis of this dichotomy to a dualist conception of mind and world. I argue for the rejection of the form/content dichotomy on the ground that its dualist presuppositions generate a reductionist analysis of certain concepts (...) which are central to the analysis of petitio argument. I contend, for example, that no syntactic relation can assimilate within its analysis the essentially holistic nature of a notion like justification. In this regard, I expound a form of dialectical criticism which has been frequently employed in the philosophical arguments of Hilary Putnam. Here the focus of analysis is upon the way in which the proponent of a position proceeds to explain or argue for his/her own particular theses. My conclusion points to the use of such dialectic within future analyses of petitio principii. (shrink)

In this paper I argue that olfactory experience, like visual experience, is exteroceptive: it seems to one that odours, when one smells them, are external to the body, as it seems to one that objects are external to the body when one sees them. Where the sense of smell has been discussed by philosophers, it has often been supposed to be non-exteroceptive. The strangeness of this philosophical orthodoxy makes it natural to ask what would lead to its widespread acceptance. I (...) argue that philosophers have been misled by a visuocentric model of what exteroceptivity involves. Since olfaction lacks the spatial features that make vision exteroceptive the conclusion that olfaction is nonexteroceptive can appear quite compelling, particularly in the absence of an alternative model of exteroceptivity appropriate to olfaction. I offer a model according to which odours seem to be external to the body because they seem to be brought into the nose from without by sniffing and breathing through the nostrils. I argue that some natural-seeming objections to this model rely on substantive assumptions about how the senses are distinguished from one another, and how perceptual experience is put together out of its modality-specific parts, that require defence. Abstract: In this paper I offer an account of a particular variety of perception of absence, namely, visual perception of empty space. In so doing, I aim to make explicit the role that seeing empty space has, implicitly, in Mike Martin's account of the visual field. I suggest we should make sense of the claim that vision has a field—in Martin's sense—in terms of our being aware of its limitations or boundaries. I argue that the limits of the visual field (...) are our own sensory limitations, and that we are aware of them as such. Seeing empty space, I argue, involves a structural feature of experience that constitutes our awareness of our visual sensory limitations, and thus, in virtue of which vision has a field. (shrink)

This paper explores the application of ethical thinking from the perspective of someone with the dual role of social worker and PhD researcher. The focus of the research was family secrets and their influence upon child-to-parent violence and abuse (CPVA). The participants were children and their parents, who, at the time of the research, were experiencing family violence and abuse.This paper was developed from a conversation between Lee-Ann and Louise. Lee-Ann was Louise’s PhD supervisor and was therefore involved (...) in supporting Louise in gaining ethics approval, as well as holding continued reflexive conversations about the ethical questions and dilemmas that arose throughout this study.This paper has shown the importance of hearing the voices of children within research about CPVA. Children can offer a rich layer of information that is seldom heard. It also shows that there may be a different lens through which ethics can be considered during research, not only the purely objective or academic, but also from a practitioner-researcher in a social care setting position. This essay investigates the marginalisation in eighteenth-century literary theoretical discussions of a category of emotion, ‘the affections’, which plays a significant role elsewhere in eighteenth-century thought, especially in moral philosophy and theology. It proposes that affections are incompatible with a series of principles that underpin dominant concepts of the literary in early and mid-eighteenth-century literary criticism by authors including Kames, Burke, Alison, Duff, Brown, Du Bos, Trapp and Beattie, many of whom were associated with the Scottish Enlightenment. By analysing eighteenth-century (...) theories of the perceived obscurity of literary emotions in comparison with the emotions of the other fine arts , and by highlighting the perceived distinction of literary emotions from what theorists of the period term ‘reality’, it shows how the supremacy of the belief that literary merit is tied to the individuality, particularity, and plausibility of represented emotion gives rise to a prioritisation of passions over affections in literary critical discussions about the emotions. This article begins with a brief outline of current African and Western contexts, and the moral predicaments in which leaders in South Africa find themselves. The research problem addressed is how the spiritual maturity and moral excellence of Christian leaders can be advanced. The methodology employed draws on African and Western cultural and Christian traditions of moral formation. Whilst some common means of moral formation are discussed, particular attention is given to the role of spiritual disciplines. The article aims to (...) address the following question: ‘how do leaders become the kind of people who will make good and right decisions, live moral lives, contribute to the life and work of the church, care for others and the environment, and pursue social justice?’ Three clusters of moral deficiencies are discussed, including pride, vainglory and greed, together with the spiritual disciplines that can counteract them. The central argument is that spiritually mature and morally excellent leaders can address more effectively the moral challenges facing the church and South African society.Contribution: This transdisciplinary article contributes to the HTS’s theological research by combining the academic disciplines of Christian Spirituality and Theological Ethics with particular reference to leadership formation. It further contributes to academic contextual discourse by evaluating African and Western traditions of moral formation and advancing practical means of addressing leadership deficiencies. (shrink)
