Belgium has recently extended its euthanasia legislation to minors, making it the first legislation in the world that does not specify any age limit. I consider two strands in the opposition to this legislation. First, I identify five arguments in the public debate to the effect that euthanasia for minors is somehow worse than euthanasia for adults—viz. arguments from weightiness, capability of discernment, pressure, sensitivity and sufficient palliative care—and show that these arguments are wanting. Second, there is another position in (...) the public debate that wishes to keep the current age restriction on the books and have ethics boards exercise discretion in euthanasia decisions for minors. I interpret this position on the background of Velleman’s “Against the Right to Die” and show that, although costs remain substantial, it actually can provide some qualified support against extending euthanasia legislation to minors. Luc Vincenti starts from the question of applicability which, as regards human behaviour, specifies normativity within the wider field of regularity. Kant’s practical philosophy enables this applicability to be located, beyond the mere feeling of self, in the knowledge of one’s freedom. But what happens to this foundation of obligation outside of the moral realm, in the legal realm, where Kant is closer to Kelsenian positivism ? In fact, Kant’s political philosophy is two-sided : while he questions the contractualist foundation (...) within the properly legal realm, he returns to the idea of legitimacy in the purposive relation law has to morals, i.e., in the capacity of the law to produce peace by preserving peace. Kant’s notion of the public usage of reason then exhibits this purpose of law, through freedom of expression, and is also the public display of freedom’s knowledge of itself. (shrink)

The intention of this paper is to relate the various standpoints regarding anxiety and uncertainty. Within the humanities and social sciences, research is pursued in many different disciplines without much interaction between them. Everyone's thinking is based on concepts which are domain-specific, and the distinctions, methods and arguments used are the ones that are generally accepted within the discipline. The divergent conclusions constitute pieces of a puzzle that are seldom if ever put together. There are even doubts about whether such (...) a puzzle can be put together. It can hardly be denied, however, that inspiration is to be found in a consideration of the views and findings of colleagues from other disciplines who are working on the same problems. Now that we have as our guests two prominent academics, each with specific views about our subject, we should take this opportunity to discuss together some of the sociological, anthropological, economic, philosophical and theological approaches to anxiety and uncertainty.If a number of well-known authors are to be believed, lack of trust, uncertainty and insecurity affect the most affluent and modern societies. In French one speaks of précarité , in German of Unsicherheit and Risikogesellschaft , and in English of “fear”, “risk” and “insecurity” . All modern Western societies seem to be afflicted with the same dismal and frustrating human experience.Belgian society is no exception to this. In recent years we have regularly been subjected to the emotional reactions provoked by sensational events in the areas of politics , justice and public health . Less spectacular but no less real were the results of opinion polls which showed that confidence in public institutions in general, and politics in particular, is at an all-time low. (shrink)

Introduite par Godefroid, mais développée par Sutton, la notion de mode va jouer un rôle très important. According to a popular version of the current evolutionary attitude in cognitive science, the mind is a massive aggregate of autonomous innate computational devices, each addressing specific adaptive problems. Our aim in this paper is to show that although this version of the attitude, which we call GOFEP , does not suffer from fatal flaws that would make it incoherent or otherwise conceptually inadequate, it will nevertheless prove unacceptable to most cognitive scientists today. To show this, we raise a common (...) objection to the concept of innateness, not to mount an attack on GOFEP but to study how its proponents have attempted to meet that challenge. The aim of this move is to show that GOFEP cannot face the challenge without, as it were, losing its soul. There is, or so we will argue, something deep at the heart of GOFEP that prevents its proponents from meeting the challenge. (shrink)

L'extrême barbarie de la seconde guerre mondiale, et l'espoir d'une vie différente pour l'humanité, ont amené M. Merleau-Ponty à réfléchir sur le marxisme - théorique d'une part, stalinien d'autre part. Notre projet consiste à suivre son cheminement intellectuel à cet égard depuis ses premiers écrits politiques de '45 jusqu'en I960, quelques mois à peine avant sa mort subite survenue il y a exactement trente ans, en mai 1961. Mais en quoi est-il pertinent, à l'heure où un vent d'Histoire plane sur (...) l'Est, de revenir sur des textes dont certains atteindront bientôt le demi-siècle ? C'est que l'auteur a vu clair avant presque tout le monde, de telle sorte qu'il réussit à identifier, inscrite dès l'origine dans son propre système, l'asphyxie inévitable du régime soviétique. Aussi, lire le Merleau-Ponty de ces années pas si lointaines, c'est lire à notre avis l'URSS de Gorbatchev et voir également s'épanouir la nouvelle Europe depuis Prague jusqu'à Sofia. C'est comprendre du même souffle - ce que n'eût point désavoué Marx - qu'on ne saurait bâillonner indéfiniment, enracinée dans le tissu de l'homme, la Volonté-de-liberté des peuples et des nations.The extreme barbarity of the Second World War, and the hope for a different life for Humanity, lead Merleau-Ponty to reflect on marxism, theoretical as well as Stalinian. Our aim is to follow his intellectual progress on this subject since his first political writing, from 1945 until I960, that is, just a few months before his sudden death in may 1961. However, where is the relevance to come back to these fifty years old texts when History blows on eastern countries? Simply because Merleau-Ponty has foreseen the present situation almost before any other analyst, in such a way that he identified successfully the unavoidable asphyxia of the soviet regimen, as inscribed at the very outset of this political system. To read the Merleau-Ponty of these years, it is, do we think, to read the USSR of Gorbatchev, and to see also the new Euro pa to expand, from Prague to Sofia. It is also to understand, by the same occasion - and Marx would not have disavowed it -, that one cannot silence indefinitely the Will of liberty of people and nations which is routed in the nature of man. This chapter explores Levinas's notion of substitution. This notion is astonishing, in fact, since it marks a redoubling of responsibility—in other words, “one degree of responsibility more, the responsibility for the responsibility of the other”—that involves me substituting myself for the other in what is most his own, his own responsibility: “the overemphasis of openness is responsibility for the other to the point of substitution.” This does not mean a simple hyperbole of responsibility, where I take upon myself, by sympathy (...) or solidarity, the charge that belongs properly to the other. It means first of all “a responsibility with regard to men we do not even know,” but also and especially “responsibility for the persecutor”. (shrink)

En octobre 1995 prenait place au Musée d’Art Contemporain de Bordeaux le grand colloque « Actualité cognitive de la Phénoménologie : Les défis de la naturalisation ». Abstract.This article focuses on a critical interpretation of the work of Unger. It is argued that Unger's view is less revolutionary than he depicts it and that American law often develops as Unger describes it, though this is absolutely no revolution. The authors further show what the possibilities and the limits of a transformative vocation at the bar can be.

Le passé de l’Occident reste marqué par une tache indélébile, celle de l’horreur de l’esclavage colonial. Il est certes aujourd’hui avéré que la traite atlantique ne fut que l’une des traites négrières, à côté de la traite arabe au travers du Sahara et le long des côtes de l’océan Indien, qui s’étale sur une plus longue durée, et des traites africaines internes au continent... Mais en elle s’exprime un scandale spécifique, celui de la contradiction entre une pratique et des idéaux (...) proclamés, qui furent d’abord ceux d’une religion à vocation universaliste prônant l’amour du prochain, puis ceux issus des Lumières, dont l’application fut loin d’être immédiate. En outre, concentrée sur une période de temps plus brève – en gros trois siècles et demi, du début du XVIe au milieu du XIXe siècle –, la traite atlantique a alimenté en force de travail servile non pas des sociétés à esclaves, comme le furent les sociétés arabo-musulmanes, mais des sociétés esclavagistes, dont le caractère totalitaire résultait d’un mode de production tout entier fondé sur l’utilisation d’une main-d’œuvre dégradable autant que l’exigeaient les contraintes des cultures de plantation, vouées à la satisfaction de marchés extérieurs , et donc sur une marchandisation et une réification de l’homme sans précédent. Ce qui en fait un phénomène éminemment moderne, en contrariété avec les usages antiques ou non occidentaux, caractérisé par une racialisation de l’oppression, avec la mise en place d’un préjugé de couleur qui servit de légitimation commode, sous le couvert de la nature, à une forme d’exploitation qui aurait pu paraître condamnable en fonction des valeurs religieuses et politiques officiellement affichées.
