Coherentism in epistemology has long suffered from lack of formal and quantitative explication of the notion of coherence. One might hope that probabilistic accounts of coherence such as those proposed by Lewis, Shogenji, Olsson, Fitelson, and Bovens and Hartmann will finally help solve this problem. This paper shows, however, that those accounts have a serious common problem: the problem of belief individuation. The coherence degree that each of the accounts assigns to an information set (or the verdict it gives as (...) to whether the set is coherent tout court) depends on how beliefs (or propositions) that represent the set are individuated. Indeed, logically equivalent belief sets that represent the same information set can be given drastically different degrees of coherence. This feature clashes with our natural and reasonable expectation that the coherence degree of a belief set does not change unless the believer adds essentially new information to the set or drops old information from it; or, to put it simply, that the believer cannot raise or lower the degree of coherence by purely logical reasoning. None of the accounts in question can adequately deal with coherence once logical inferences get into the picture. Toward the end of the paper, another notion of coherence that takes into account not only the contents but also the origins (or sources) of the relevant beliefs is considered. It is argued that this notion of coherence is of dubious significance, and that it does not help solve the problem of belief individuation. (shrink)

In this paper we aim to offer a balanced argument to motivate (re)thinking about the mental illness clause within the insanity defence. This is the clause that states that mental illness should have a relevant causal or explanatory role for the presence of the incapacities or limited capacities that are covered by this defence. We offer three main considerations showing the important legal and epistemological roles that the mental illness clause plays in the evaluation of legal responsibility. Although we acknowledge (...) that these advantages could be preserved without having this clause explicitly stated in the law, we resist proposals that deny the importance of mental illness in exculpation. We argue, thus, that any attempt at removing the mental illness clause from legal formulations of the insanity defence should offer alternative ways of keeping in place these advantages. (shrink)

The paper introduces and formally defines a functional concept of a measuring system, on this basis characterizing the measurement as an evaluation performed by means of a calibrated measuring system. The distinction between exact and uncertain measurement is formalized in terms of the properties of the traceability chain joining the measuring system to the primary standard. The consequence is drawn that uncertain measurements lose the property of relation-preservation, on which the very concept of measurement is founded according to the representational (...) viewpoint. Finally, from the analysis of the inter-relations between calibration and measurement the fundamental reasons of the claimed objectivity and intersubjectivity of measurement are highlighted, a valuable epistemological result to characterize measurement as a particular kind of evaluation. Psychopaths have emotional and rational impairments that can be expressed in persistent criminal behaviour. UK and US law has not traditionally excused disordered individuals for their crimes citing these impairments as a cause for their criminal behaviour. Until now, the discussion of whether psychopaths are morally responsible for their behaviour has usually taken place in the realm of philosophy. However, in recent years, this debate has been informed by scientific and psychiatric advancements, fundamentally so with the development of Robert Hare's (...) diagnostic tool, the Psychopathy Checklist. Responsibility and Psychopathy explores the moral responsibility of psychopaths. Transmission of justification across inference is a valuable and indeed ubiquitous epistemic phenomenon in everyday life and science. It is thanks to the phenomenon of epistemic transmission that inferential reasoning is a means for substantiating predictions of future events and, more generally, for expanding the sphere of our justified beliefs or reinforcing the justification of beliefs that we already entertain. However, transmission of justification is not without exceptions. As a few epistemologists have come to realise, more or less trivial forms (...) of circularity can prevent justification from transmitting from p to q even if one has justification for p and one is aware of the inferential link from p to q. In interesting cases this happens because one can acquire justification for p only if one has independent justification for q. In this case the justification for q cannot depend on the justification for p and the inferential link from p to q, as genuine transmission would require. The phenomenon of transmission failure seems to shed light on philosophical puzzles, such as Moore's proof of a material world and McKinsey's paradox, and it plays a central role in various philosophical debates. For this reason it is being granted continued and increasing attention. (shrink)

Aunque el uso no problematizado en el lenguaje ordinario de los términos "consenso" y "consentimiento" sugiere que debe haber alguna comprensión compartida de su significado, no hay un acuerdo generalizado sobre el uso de estos conceptos entre los filósofos políticos. De hecho, el significado filosófico de estos conceptos sigue siendo elusivo y controvertido; tal vez precisamente a causa de su amplitud y centralidad. Teniendo en cuenta los numerosos intentos de explicar satisfactoriamente consenso y consentimiento -que con el tiempo se han (...) vuelto más sofisticados-, este artículo recoge algunos usos filosóficos fundamentales de estos dos multifacéticos conceptos y sugiere una estrategia para bosquejar un mapa que parece un rompecabezas cuyas piezas están moldeadas de tal forma que se necesita un enfoque multidisciplinario para poder identificar adecuadamente sus significados e implicaciones. Although the unproblematic use of the terms "consensus" and "consent" in ordinary language suggests that there must be some shared understanding of their meaning, there is no widespread assent on the use of these concepts among political philosophers. In fact, the philosophical meaning of these concepts remains elusive and controversial, perhaps exactly because of their extension and centrality. Taking note of the numerous attempts to provide a satisfactory account of "consensus" and "consent" - that have become increasingly sophisticated in time - this article recollects some fundamental philosophical uses of the two many-faceted concepts, and suggests a strategy for delineating a map that looks like a puzzle, whose pieces are shaped in such a way that we need a multidisciplinary approach in order to adequately identify their meanings and implications. We present an inferentialist account of the epistemic modal operator might. Our starting point is the bilateralist programme. A bilateralist explains the operator not in terms of the speech act of rejection ; we explain the operator might in terms of weak assertion, a speech act whose existence we argue for on the basis of linguistic evidence. We show that our account of might provides a solution to certain well-known puzzles about the semantics of modal vocabulary whilst retaining classical logic. (...) A finitary characterization for non-well-founded sets with finite transitive closure is established in terms of a greatest fixpoint formula of the modal μ-calculus. This generalizes the standard result in the literature where a finitary modal characterization is provided only for wellfounded sets with finite transitive closure. The proof relies on the concept of automaton, leading then to new interlinks between automata theory and non-well-founded sets.

"The last remnant of physical objectivity of space-time" is disclosed, beyond the Leibniz equivalence, in the case of a continuous family of spatially non-compact models of general relativity. The physical individuation of point-events is furnished by the intrinsic degrees of freedom of the gravitational field, (viz, the "Dirac observables") that represent - as it were - the "ontic" part of the metric field. The physical role of the "epistemic" part (viz. the "gauge" variables) is likewise clarified. At the end, a (...) peculiar four-dimensional "holistic and structuralist" view of space-time emerges which includes elements common to the tradition of both substantivalism and relationism. The observables of our models undergo real "temporal change" and thereby provide a counter-example to the thesis of the "frozen-time" picture of evolution. (shrink)

In this paper, we develop an impure somatic theory of emotion, according to which emotions are constituted by the integration of bodily perceptions with representations of external objects, events, or states of affairs. We put forward our theory by contrasting it with Prinz's pure somatic theory, according to which emotions are entirely constituted by bodily perceptions. After illustrating Prinz's theory and discussing the evidence in its favor, we show that it is beset by serious problems—i.e., it gets the neural correlates (...) of emotion wrong, it isn't able to distinguish emotions from bodily perceptions that aren't emotions, it cannot account for emotions being directed towards particular objects, and it mischaracterizes emotion phenomenology. We argue that our theory accounts for the empirical evidence considered by Prinz and solves the problems faced by his theory. In particular, we maintain that our theory gives a unified and principled account of the relation between emotions and bodily perceptions, the intentionality of emotions, and emotion phenomenology. According to constitutivism, the objective authority of practical reason is to be grounded in the constitutive features of agency. In this paper, I offer a brief survey of the basic structure of constitutive argument about objectivity and consider how constitutivism might dispel the worry that it can only ground a conditional kind of authority. I then consider David Enoch’s original shmagency challenge and the response in terms of the inescapability of agency. In particular, I revisit the appeal to inescapability in (...) light of Enoch’s restatement of the challenge in 'Shmagency Revisited'. I argue that the revised challenge still fails but that it helps clarify: first, the distinction between external and internal challenges to constitutivism, and, second, the existence of at least different kinds of inescapability of agency (metaphysical, psychological, and dialectical). I argue that only dialectical inescapability is helpful to show that constitutivism is a viable metanormative theory. I conclude by claiming that an internal challenge to constitutivism is still possible in principle but that the burden of proof has shifted once again to the critics of constitutivism. (shrink)

There are two standard conceptions of the functioning of and rationale for the diachronic will, i.e., for an agent's capacity to settle on her future conduct in advance. According to the pragmatic-instrumentalist view, the diachronic will benefits us by increasing the long-term satisfaction of our rational preferences. According to the cognitive view, it benefits us by satisfying our standing desire for self-knowledge and self-understanding. Contrary to these views, I argue for a constitutive view of the diachronic will: the rationale for (...) it is that it makes possible to engage in activities with a radically novel temporal structure, activities that are not merely continuous over time, but temporally integrated and unified. These activities are essential to our form of life and to our existence as temporally unified agents. The instrumental and cognitive benefits, if any, are merely secondary to the ontological ones. Boran Berčić, in the second volume of his recent book "Filozofija" , offers two responses to David Chalmers’s conceivability or modal argument against physicalism. This latter argument aims at showing that zombies, our physical duplicates who lack consciousness, are metaphysically possible, given that they are conceivable. Berčić’s first response is based on the principle of the uniformity of nature that states that causes of a certain type will always cause effects of the same type. His second response is based on (...) the assumption that the basic statements of physicalism in philosophy of mind are or should be contingently true. I argue that if Berčić’s first defence is aimed at the conceivability of zombies, it is unsatisfactory. Moreover, I argue that a quite similar argument, offered by John Perry in his book "Knowledge, Possibility and Consciousness" , is afflicted by a similar problem. Nevertheless, under a more plausible interpretation, Berčić’s argument might be taken to attack the metaphysical possibility of zombies. This version of the argument might be effective and has the merit to point out a so far overlooked link between the discussion of the Chalmers’s conceivability arguments against physicalism and the modal strength of causal links and natural laws. Then, I argue that Berčić’s second defence of physicalism, which cannot be combined consistently with his first one, in any case, should not be formulated in the terms of contingent physicalism. This research was carried out to explore some of the cognitive processes involved in scientific anomalies resolution. 40 subjects with a good neuropsychology expertise were asked to explain two (invented) anomalous neuropsychological cases. The subjects' efforts to give a meaningful structure to the data were recorded, and the resulting reasoning blocks were analysed to extract and compute the inferential (deductive, inductive and abductive) and analogical processes used. The processes were intercorrelated to experimentally verify the co-occurrence of different forms of logical (...) thinking. Statistical analysis point out the relevance of abductive inferences, the possible presence of an inferential-style switching process , the high number of external analogies used, the cognitive closeness manifested by expert reasoners. This essay tries to rethink Benjamin’s notion of “aura” through the consideration of two authors such as G. Didi-Huberman and D. Costello. The aim is not to distinguish between auratic and postauratic (or non-auratic) works of art, but to rethink the problem of aesthetic perception in the age of mechanical reproduction. More specifically, Costello and Didi-Huberman point out the relation between “aura” and “subjectivity”: on the one hand, the intersubjective (and ethical) nature of an “authentic” (i.e., auratic) experience; on the (...) other hand, the presence of the aura nowadays in the “interplay of gazes” between the (subject-)work and the (subject-)spectator. Works of art are indeed characterized by a “two-fold” or aesthetic “transcendence” – they are at once both inside and outside my world – which enables them to resist the reification into reproducible commodity. The philosophical contributes in the volume offer several considerations for the conclusion that psychopaths offenders should not be considered morally responsible for their crimes. We situate this conclusion within wider philosophical debates and indicate relevant directions of further research.

In this chapter we argue that Robert Hare's psychopathy checklist revised (PCL-R) offers a construct of psychopathy that is valid enough for philosophical investigations of the moral and legal responsibility of psychopathic offenders.

I argue that intending and acting belong to the same genus: intending is a kind of doing continuous in structure with intentional acting. Future-directed intending is not a truly separate phenomenon from either the intending in action or the acting itself. Ultimately, all intentions are in action, or better still, in extended courses of action. I show how the intuitive distinction between intending and acting is based on modeling the two phenomena on the extreme and limiting cases of an otherwise (...) continuous spectrum of the ways in which agents exercise rational active intelligent guidance in the pursuit of goals. I argue that diachronic intentional agency is better understood in terms of continuity and unity of courses of active and intelligent guidance, and that the distinction between intending to do something and doing it is only a derivative and context-dependent segmentation of these continuous courses of rational active intelligent guidance. Given the common assumption that measurement plays an important role in the foundation of science, the paper analyzes the possibility that Measurement Science, and therefore measurement itself, can be properly founded. The realist and the representational positions are analyzed at this regards: the conclusion, that such positions unavoidably lead to paradoxical situations, opens the discussion for a new epistemology of measurement, whose characteristics and interpretation are sketched here but are still largely matter of investigation.

Timothy Smiley’s wonderful paper ‘Rejection’ (1996) is still perhaps not as well known or well understood as it should be. This note first gives a quick presentation of themes from that paper, though done in our own way, and then considers a putative line of objection – recently advanced by Julien Murzi and Ole Hjortland (2009) – to one of Smiley’s key claims. In set theory, a maximality principle is a principle that asserts some maximality property of the universe of sets or some part thereof. Set theorists have formulated a variety of maximality principles in order to settle statements left undecided by current standard set theory. In addition, philosophers of mathematics have explored maximality principles whilst attempting to prove categoricity theorems for set theory or providing criteria for selecting foundational theories. In 1886, Nietzsche felt the need to exercise a retrospective look at the works he had written up to that point. Hence, the writing of a series of prefaces (Vorreden). They can be considered and read as a thematically unified textual body. Rereading them as a unified work allows us to recognise their value as an “auto-pathobiography”. In it, the concepts of health and illness occupy a central position that Nietzschean research has long been questioning. Nevertheless, in reflecting on health (...) and illness, in the Vorreden, Nietzsche also prepares the fundamental epistemological move that will enable him to gradually and increasingly shift his speculative focus from the autoanalytical and biographical to the genealogical plane and authorise him to look at his main object of research, the moral phenomenon, as no other thinker had done before. Measurement in soft systems generally cannot exploit physical sensors as data acquisition devices. The emphasis in this case is instead on how to choose the appropriate indicators and to combine their values so to obtain an overall result, interpreted as the value of a property, i.e., the measurand, for the system under analysis. This paper aims at discussing the epistemological conditions of the claim that such a process is a measurement, and performance evaluation is the case introduced to support the (...) analysis, performed in systematic comparison with the paradigm of measurement of physical quantities. Some background questions arising here are: – Are the chosen indicators appropriate performance indicators? – Do such indicators convey complete and non-redundant information on performance? – Does the chosen combination rule generate results suitably interpretable as performance values? And enlarging the focus: – Does the obtained value specifically convey information on the system under analysis, instead of some different entity (typically including the subject who is evaluating)? Operatively: would different subjects evaluate the same system in the same way? i.e., is the obtained information objective? – Does the obtained value convey information that is interpretable in the same way by different subjects? Operatively: would different subjects who have agreed on a decision procedure make the same decision from the same performance information? i.e., is the obtained information intersubjective? Any well founded positive answers to these questions significantly support a structural interpretation of measurement encompassing both physical and soft measurement. (shrink)

In this paper, three theories of progress and the aim of science are discussed: the theory of progress as increasing explanatory power, advocated by Popper in The logic of scientific discovery ; the theory of progress as approximation to the truth, introduced by Popper in Conjectures and refutations ; the theory of progress as a steady increase of competing alternatives, which Feyerabend put forward in the essay “Reply to criticism. Comments on Smart, Sellars and Putnam” and defended as late as (...) the last edition of Against method. It is argued that, contrary to what Feyerabend scholars have predominantly assumed, Feyerabend's changing attitude towards falsificationism—which he often advocated at the beginning of his career, and vociferously attacked in the 1970s and 1980s—must be explained by taking into account not only Feyerabend's very peculiar view of the aim of science, but also Popper's changing account of progress. In this paper we focus on transmission and failure of transmission of warrant. We identify three individually necessary and jointly sufficient conditions for transmission of warrant, and we show that their satisfaction grounds a number of interesting epistemic phenomena that have not been sufficiently appreciated in the literature. We then scrutinise Wright’s analysis of transmission failure and improve on extant readings of it. Nonetheless, we present a Bayesian counterexample that shows that Wright’s analysis is partially incoherent with our analysis of (...) warrant transmission and prima facie defective. We conclude exploring three alternative lines of reply: developing a more satisfactory account of transmission failure, which we outline; dismissing the Bayesian counterexample by rejecting some of its assumptions; reinterpreting Wright’s analysis to make it immune to the counterexample. Crispin Wright has given an explanation of how a first time warrant can fall short of transmitting across a known entailment. Formal epistemologists have struggled to turn Wright’s informal explanation into cogent Bayesian reasoning. In this paper, I analyse two Bayesian models of Wright’s account respectively proposed by Samir Okasha and Jake Chandler. I argue that both formalizations are unsatisfactory for different reasons, and I lay down a third Bayesian model that appears to me to capture the valid kernel of (...) Wright’s explanation. After this, I consider a recent development in Wright’s account of transmission failure. Wright suggests that his condition sufficient for transmission failure of first time warrant also suffices for transmission failure of supplementary warrant. I propose an interpretation of Wright’s suggestion that shield it from objections. I then lay down a fourth Bayesian framework that provides a simplified model of the unified explanation of transmission failure envisaged by Wright. (shrink)

In this paper we focus on two claims, put forward by Feyerabend in his later writings , which constitute the metaphysical core of his view of scientific inquiry. The first, that we call the pliability thesis, is the claim that the world can be described by indefinitely many conceptual systems, none of them enjoying a privileged status. The second, that we call the resistance thesis, is the claim that the pliability of the world is limited, i.e., not all the different (...) conceptual systems that can be used to describe the world will be equally successful: the world offers resistance to some attempts to describe it. We show that, in spite of the later Feyerabend’s notorious antirealist leanings, the pliability thesis is fully compatible with a robustly realist view of science, and we suggest that, surprisingly, Feyerabend’s insights concerning the limited pliability of the world turn out to be those of a potential ally of sophisticated versions of scientific realism. In this paper we argue that Michael Huemer’s phenomenal conservatism—the internalist view according to which our beliefs are prima facie justified if based on how things seems or appears to us to be—doesn’t fall afoul of Michael Bergmann’s dilemma for epistemological internalism. We start by showing that the thought experiment that Bergmann adduces to conclude that is vulnerable to his dilemma misses its target. After that, we distinguish between two ways in which a mental state can contribute to the justification (...) of a belief: the direct way and the indirect way. We identify a straightforward reason for claiming that the justification contributed indirectly is subject to Bergmann’s dilemma. Then we show that the same reason doesn’t extend to the claim that the justification contributed directly is subject to Bergmann’s dilemma. As is the view that seemings or appearances contribute justification directly, we infer that Bergmann’s contention that his dilemma applies to is unmotivated. In the final part, we suggest that our line of response to Bergmann can be used to shield other types of internalist justification from Bergmann’s objection. We also propose that seeming-grounded justification can be combined with justification of one of these types to form the basis of a promising version of internalist foundationalism. (shrink)
