The purpose of this commentary is to present and respond to the gap that currently exists in providing culturally inclusive residential long-term care options for Indigenous peoples in Ontario. After presenting statistics regarding the Indigenous population and long-term care options, we argue that we have an ethical responsibility to offer more culturally inclusive long-term care.

One well-known objection to supersubstantivalism is that it is inconsistent with the contingency of location. This paper presents a new objection to supersubstantivalism: it is inconsistent with the vagueness of location. Though contingency and vagueness are formally similar, there are important philosophical differences between the two. As a result, the objection from vague location will be structurally different than the objection from contingent location. The paper explores these differences and then defends the argument that supersubstantivalism is inconsistent with the plausible (...) thesis that it is vague where I am located. (shrink)

Slurs are derogatory terms targeting individuals and groups of individuals on the basis of race, nationality, religion, gender or sexual orientation. The aim of my paper is to propose an account of appropriated uses of slurs – i.e. uses by targeted groups of their own slurs for non-derogatory purposes, as in the appropriation of ‘nigger’ by the African-American community, or the appropriation of ‘queer’ by the homosexual community. In my proposal appropriated uses are conceived as echoic, in Relevance Theory terms: (...) in-groups echo derogatory uses in ways and contexts that make manifest the dissociation from the offensive contents. I will show that the echoic strategy has interesting advantages over alternative theories, and especially over Anderson and Lepore’s deflationary strategy. (shrink)

This paper considers whether transgender women should be permitted to compete in female categories in sports. Trans* women are often criticized for competing in female categories because they are seen as having an unfair advantage. Specifically, they are seen as having high levels of testosterone that unfairly enhance their performance in comparison to cisgender competitors. In this paper, I argue that trans* women should be permitted to compete in female categories. I suggest that if we want to maintain the skill (...) thesis as a guiding principle of sports and allow trans* women to compete in female categories, then we need to take relevant genetic advantages into consideration by introducing a handicap system. I claim that a handicap system should consider both cisgender and transgender women’s effective testosterone levels. (shrink)

Rule consequentialism (RC) holds that the rightness and wrongness of actions is determined by an ideal moral code, i.e., the set of rules whose internalization would have the best consequences. But just how many moral codes are there supposed to be? Absolute RC holds that there is a single morally ideal code for everyone, while Relative RC holds that there are different codes for different groups or individuals. I argue that Relative RC better meets the test of reflective equilibrium than (...) Absolute RC. In particular, I contend that Relative RC is superior because it accommodates our convictions about costless benefits. Some have charged that Relative RC threatens our convictions about the generality of moral codes and that it leads inevitably to what Brad Hooker calls “runaway relativism.” I argue that Relative RC has principled reasons for stopping this imagined slide down the slippery slope. In this paper, I argue for the following points. First, all of us have a presumptive moral obligation to be organ donors if we are in the relevant medical circumstances at the time of death. Second, family members should not have the right to interfere with the fulfillment of that obligation. Third, the ethical basis for that obligation is reciprocity. If we want a sufficient number of organs available for transplantation, then all must be willing donors. Fourth, that likelihood is (...) diminished if individuals are entirely free to refuse to be organ donors but still would demand to be organ recipients. Fifth, although individuals would be ethically obligated to be organ donors, we still need to permit them to refuse to be organ donors. Sixth, to encourage individuals to stay within the organ donation system, we should have as a just and ethically justified policy denying individuals an organ transplant in the relevant medical circumstances if they have chosen to exit the organ donation system. Individuals would not be permitted to be organ recipients if they were unwilling to be organ donors. This is what it means to be part of what Rawls in Political liberalism (15-22) would refer to as a “fair system of social cooperation.” We refer to this as the “reciprocity requirement.”. (shrink)

This chapter is an investigation of the morality of medical deportation, the practice of returning undocumented migrants, despite their ill health and/or injuries, to their countries of origin. In Sect. 16.1, I look more closely at the nature of medical deportation. In Sect. 16.2, I argue that understanding the morality of medical deportation requires nonideal theory. In Sect. 16.3, I outline contractualism as a nonideal theory. In Sect. 16.4, I apply contractualism to medical deportation and make the case that, first, (...) there are in principle some cases in which medical deportation is morally permissible but, second, the standards that must be met in cases of morally permissible medical deportation are very high. In Sect. 16.5, I consider stakeholders other than the patient and the medical care facility and examine the ways in which effects on them might render medical deportation morally impermissible. I conclude that real-world cases of morally permissible medical deportation are rare at best, and there is little prospect of this situation changing. (shrink)

Recently, there has been renewed interest in the search for low-mass magnetic monopoles. At the University of Oklahoma we are performing an experiment (Fermilab E882) using material from the old D0 and CDF detectors to set limits on the existence of Dirac monopoles of masses of the order of 500 GeV. To set such limits, estimates must be made of the production rate of such monopoles at the Tevatron collider, and of the binding strength of any such produced monopoles to (...) matter. Here we sketch the still primitive theory of such interactions, and indicate why we believe a credible limit may still be obtained. On the other hand, there have been proposals that the classic Euler–Heisenberg Lagrangian together with duality could be employed to set limits on magnetic monopoles having masses less than 1 TeV, based on virtual, rather than real processes. The D0 collaboration at Fermilab has used such a proposal to set mass limits based on the nonobservation of pairs of photons each with high transverse momentum. We critique the underlying theory, by showing that the cross section violates unitarity at the quoted limits and is unstable with respect to radiative corrections. We therefore believe that no significant limit can be obtained from the current experiments, based on virtual monopole processes. (shrink)

This paper focuses on Kant's account of physical geography and his theory of the Earth. In spelling out the epistemological foundations of Kant's physical geography, the paper examines 1) their connection to the mode of holding-to-be-true, mathematical construction and empirical certainty and 2) their implications for Kant's view of cosmopolitan right. Moreover, by showing the role played by the mathematical model of the Earth for the foundations of Kant's Doctrine of Right, the exact relationship between the latter and physical geography (...) is highlighted. Finally, this paper shows how, in Kant's view, the progress of physical geography can be assured if and only if the free circulation of human beings is established and regulated by law. Therefore, examining the mutual relationship between the theory of Earth and the foundations of right opens new perspectives on the relationship between epistemology and practical philosophy within Kant's system. According to the theory of meaning as justification, semantics is closely entangled with epistemology: knowing the meaning of an utterance amounts to knowing the justification one may offer for it. In this perspective, the theory of meaning is connected with the epistemic theory of justification, namely the theory that undergoes the more explicit attempts of naturalization. Is it possible to extend those attempts to the notion of meaning? There are many ways of naturalizing the notion of meaning, independently of its (...) links with the notion of justification. Our goal in this paper is to explore the possibility of naturalizing meaning using those very links. To this aim, we will evaluate in brief three main directions: a) the interaction between justification and discovery; b) Quine's naturalized epistemology; c) the naturalization of logic. (shrink)

Political authority is not eliminable, even if in a globalizing world order the particulars of its exercise might be undergoing a transformation. What matters to political philosophy is whether or not its existence and exercise can be justified. In this paper I begin by contrasting two paradigmatic approaches to justifications of political authority and political obligation: political naturalism and political voluntarism. Having set the stage for the debate, I connect Aquinas’s account of political authority with the former—though one will not (...) find a full-fledged version of that account in this paper. More importantly, I connect Aquinas’s naturalist defense of political obligation to a non-instrumental account of the common good, though the bulk of the paper deals with what I argue are failed attempts to offer non-naturalist accounts of the common good as alternative natural law defenses of political authority. We consider a proportional-prize contest to forecast future events, and show that, in equilibrium, this mechanism possesses perfect forecasting ability for any group size when the contestants share common knowledge about the probabilities by which future events realize. Data gathered in a laboratory experiment confirm the performance invariance to group size. By contrast, when realization probabilities are not common knowledge, there are some differences across group sizes. The mechanism operates marginally better with three or four compared to two players. Die kritische Auseinandersetzung mit zeitgenössischen Strömungen der Philosophie nahm in Nelsons Lehrtätigkeit und Veröffentlichungen breiten Raum ein. Neben konkurrierenden Ausprägungen des Neukantianismus grenzte er sich gegen Pragmatismus, Positivismus und die phänomenologische Schule ab, vor allem aber auch gegen Autoren wie Bergson und Spengler, die einem Paradigma von Philosophie verpflichtet waren, das Nelson in seinen Vorlesungen mit dem Ausdruck "intuitive Philosophie" bezeichnete. Nelsons Kritik beschränkt sich nicht darauf, dieser Art Philosophie Begründungsmängel vorzuwerfen. Vielmehr sieht er die "intuitive Philosophie" in dem klassischen (...) Denkfehler befangen, gehaltvolle Aussagen aus bloßen Begriffen herzuleiten und die Gültigkeit ihrer Thesen durch die fälschliche Berufung auf begriffliche Tatsachen zu erschleichen. Wie für Wittgenstein sind auch Nelsons leitende Ideale in der Philosophie Klarheit und kompromisslose Konsequenz. Wenn irgendwo, dann erweist sich Nelson mit diesem Text als analytischer Philosoph im besten Sinne - als ein Philosoph, für den die "Kunst, zu philosophieren" zuallererst in der Kunst des richtigen Argumentierens besteht und für den diese Kunst insbesondere durch die Analyse der Argumentationen und Fehlargumentationen anderer Philosophen erworben wird. In the study of human thought there could hardly be a more fundamental con cern than language and reasoning. In the tradition of Western philosophy, humans are distinguished by their ability to speak and to think rationally. And language is often considered a prerequisite for rational thought. If psycholoQists, then, are ever to discover what is truly human about their species, they will have to discover how language is produced and understood, and how it plays a role in reasoning and (...) other forms of rational thought. Within psychology there has been an imperative to study language and rea soning together. Since Wundt, psychologists have succeeded in building a the oretical foundation for both language and reasoning. What has become clear from these beginnings is that the two are inextricably bound to each other. Like the two players ina chess game, take away one of them and the game no longer exists. On the one hand, producing and understanding speech re quires an intricate process of reasoning. Speakers must rationally choose sentences that will affect their listeners in ways they intend, and listen ers must infer what speakers could conceivably have meant in selecting the sentences they did. Reasoning, inference, and rational thought lie at the very center of speaking and listening. On the other hand, logical reasoning begins with, and is influenced by, the language in which a problem is stated. (shrink)

In this paper, I present and defend a novel version of the Reactive Attitude account of moral blameworthiness. In Section 1, I introduce the Reactive Attitude account and outline Allan Gibbard's version of it. In Section 2, I present the Wrong Kind of Reasons Problem, which has been at the heart of much recent discussion about the nature of value, and explain why a reformulation of it causes serious problems for versions of the Reactive Attitude account such as Gibbard's. In (...) Section 3, I consider some ways in which Gibbard might attempt to avoid the Wrong Kind of Reason Problem. I argue that all of these ways fail to achieve their aim and further contend that the Wrong Kind of Reason Problem cannot be solved in a sufficiently convincing manner by the widely used method of making ad hoc distinctions among kinds of properties, kinds of attitudes, and kinds of reasons. In Section 4, I sketch my own version of the Reactive Attitude account of moral blameworthiness and show that it simply avoids the Wrong Kind of Reason Problem rather than attempting to solve the problem on a piecemeal basis. I begin this paper by discussing the difference between outweighing and canceling in conflicts of normativity. I then introduce a thought experiment that I call Crash Drive,and I use it to explain the nature of a certain kind of moral conflict as well as the appropriate emotional response – regret – on the part of the primary agent in this case. Having done this, I turn to a line of criticism opened by Bernard Williams and recently expanded by Jonathan Dancy (...) according to which archetypal examples of modern moral philosophies such as Kantianism cannot make sense of conflict and regret. Finally, I examine the general structure of such theories and explain how at least some of them can avoid this line of criticism. (shrink)

BackgroundAssessment of capacity to consent to treatment is an important legal and ethical issue in daily medical practice. In this study we carefully evaluated the capacity to consent to treatment in patients admitted to an acute medical ward using an assessment by members of the medical team, the specific Silberfeld's score, the MMSE and an assessment by a senior psychiatrist.MethodsOver a 3 month period, 195 consecutive patients of an internal medicine ward in a university hospital were included and their capacity (...) to consent was evaluated within 72 hours of admission.ResultsAmong the 195 patients, 38 were incapable of consenting to treatment (unconscious patients or severe cognitive impairment) and 14 were considered as incapable of consenting by the psychiatrist (prevalence of incapacity to consent of 26.7%). Agreement between the psychiatrist's evaluation and the Silberfeld questionnaire was poor (sensitivity 35.7%, specificity 91.6%). Experienced clinicians showed a higher agreement (sensitivity 57.1%, specificity 96.5%). A decision shared by residents, chief residents and nurses was the best predictor for agreement with the psychiatric assessment (sensitivity 78.6%, specificity 94.3%).ConclusionPrevalence of incapacity to consent to treatment in patients admitted to an acute internal medicine ward is high. While the standardized Silberfeld questionnaire and the MMSE are not appropriate for the evaluation of the capacity to consent in this setting, an assessment by the multidisciplinary medical team concurs with the evaluation by a senior psychiatrist. He authored many important works in the fields of philosophy, economics and social liberalism. First published in 1896, _The Theory of Knowledge_ considers the content and validity of knowledge, and the conditions on which our understanding of knowledge is based.
