New mechanisms to ensure that counter ter ror ism ac t ivit ies do not contravene international law or ethical values and principles will require careful design. Apart from the ethical and legal grounds, there are good practical rea-sons to design more effective counterter-rorism measures. Preventable harms to population health contribute to mistrust and instability and undermine the stated objectives of the intelligence services.

Science frequently gives us multiple, compatible ways of solving the same problem or formulating the same theory. These compatible formulations change our understanding of the world, despite providing the same explanations. According to what I call "conceptualism," reformulations change our understanding by clarifying the epistemic structure of theories. I illustrate conceptualism by analyzing a typical example of symmetry-based reformulation in chemical physics. This case study poses a problem for "explanationism," the rival thesis that differences in understanding require ontic explanatory differences. (...) To defend conceptualism, I consider how prominent accounts of explanation might accommodate this case study. I argue that either they do not succeed, or they generate a skeptical challenge. (shrink)

Why does institutional police brutality continue so brazenly? Criminologists and other social scientists typically theorize about the causes of such violence, but less attention is given to normative questions regarding the demands of justice. Some philosophers have taken a teleological approach, arguing that social institutions such as the police exist to realize collective ends and goods based upon the idea of collective moral responsibility. Others have approached normative questions in policing from a more explicit social-contract perspective, suggesting that legitimacy is (...) derived by adhering to (limited) authority. This article examines methodologies within political philosophy for analyzing police injustice. The methodological inquiry leads to an account of how justice constrains the police through both special (or positional) moral requirements that officers assume voluntarily, as well as general moral requirements in virtue of a polity’s commitment to moral, political and legal values beyond law enforcement and crime reduction. The upshot is a conception of a police role that is constrained by justice from multiple foundational stances. (shrink)

Accelerated approval of aducanumab for mild Alzheimer's by the U.S. Food and Drug Administration on June 7, 2021, has generated substantial medical, scientific, and ethical controversy. That approval was contrary to the nearly unanimous judgment of the FDA's Advisory Committee that little reliable evidence existed of significant benefit, even though the drug did reduce β‐amyloid. Three major ethical problems were created by this approval: (1) Medicare resources would be unjustly squandered, given the drug's $56,000 annual price and the 3.1 million (...) older potential American patients needing the drug; (2) physicians will feel ethically compelled to provide the drug to desperate, insistent patients, given FDA approval and in spite of side effects of brain bleeds and brain swelling; (3) and false hopes are generated for patients. A needed corrective by the federal government would reduce reimbursement to the bare cost of producing the drug (plus only a modest profit) until a phase IV trial has been successfully completed. Reformulating a scientific theory often leads to a significantly different way of understanding the world. Nevertheless, accounts of both theoretical equivalence and scientific understanding have neglected this important aspect of scientific theorizing. This essay provides a positive account of how reformulation changes our understanding. My account simultaneously addresses a serious challenge facing existing accounts of scientific understanding. These accounts have failed to characterize understanding in a way that goes beyond the epistemology of scientific explanation. The literature suggests two main answers to the question of what it is for a material object to be located at a region of spacetime. Both have a number of virtues. However, both suffer from well-known problems. According to one answer, location is a primitive relation with no informative metaphysical analysis. But this makes a number of necessary truths seem mysterious and leaves them unexplained. According to the other answer, to be located at a region is just to be identical (...) to that region. But this is inconsistent with a number of independently plausible theses about material objects and their locations. In this paper, I explore a new theory of location and argue that it has the virtues of these familiar theories but not their vices. I then explore some further connections the new theory has with some contemporary issues in metaphysics. (shrink)

This book provides a comprehensive examination of the police role from within a broader philosophical context. Contending that the police are in the midst of an identity crisis that exacerbates unjustified law enforcement tactics, Luke William Hunt examines various major conceptions of the police—those seeing them as heroes, warriors, and guardians. The book looks at the police role considering the overarching societal goal of justice and seeks to present a synthetic theory that draws upon history, law, society, psychology, and (...) philosophy. The Wigner--Eckart theorem is central to the application of symmetry principles throughout atomic, molecular, and nuclear physics. Nevertheless, the theorem has a puzzling feature: it is dispensable for solving problems within these domains, since elementary methods suffice. To account for the significance of the theorem, I first contrast it with an elementary approach to calculating matrix elements. Next, I consider three broad strategies for interpreting the theorem: conventionalism, fundamentalism, and conceptualism. I argue that the conventionalist framework is unnecessarily pragmatic, while (...) the fundamentalist framework requires more ontological commitments than necessary. Conceptualism avoids both defects, accounting for the theorem's significance in terms of how it epistemically restructures the calculation of matrix elements. Specifically, the Wigner--Eckart theorem modularizes and unifies matrix element problems, thereby changing what we need to know to solve them. (shrink)

It is argued that God cannot be a fitting target of prepositional gratitude. The first premise is that if someone cannot be benefited, then they cannot be a fitting target of prepositional gratitude. The second premise is that God cannot be benefited. Concerning the first premise, it is argued that a necessary component of prepositional gratitude is the desire to benefit one’s benefactor. Then it is argued that such a desire is fitting only if one’s benefactor can in fact be (...) benefited. Concerning the second premise, it is noted that classical theism widely attributes blessedness to God. It is argued that if God is blessed then God necessarily has as much well-being as it is possible for God to have, and hence God cannot be benefited. Also noted are some ways in which God’s blessedness is compatible with less orthodox ideas about God’s passibility. The argument is then defended against eight objections. (shrink)

Building on recent formal work by Aleks Knoks, we explore how the idea that certain epistemic norms may be indeterminate could be implemented in a default logic.

In this article I challenge the standard view that clarity and coherence in moral philosophy and ethics are always good and obscurity necessarily bad. The appraisal of clarity, I argue, entails a risk of reducing and misrepresenting the complex and multifaceted nature of good, productive and true thinking and communication. Uncertainty and obscurity do not necessarily lead to vagueness, imprecision or meaning-obstruction. There are productive forms of uncertainty and there are unproductive forms. Indeed, to be precise, lucid and truthful sometimes (...) requires respecting and linguistically and conceptually reproducing the incoherence, obscurity and uncertainty of reality. (shrink)

Recently, scholars have argued that disclosure of personal information is an effective mechanism for building high-quality relationships. However, personal information can focus attention on differences in demographically diverse teams. In an experiment using 37 undergraduate teams, we examine how sharing personal information by ethnically similar and ethnically distinct newcomers to a team affects team perceptions, performance, and behavior. Our findings indicate that the disclosure of personal information by ethnically distinct newcomers improves team performance. However, the positive impact on team performance (...) comes at a cost to the newcomers, who are perceived as less competent by others and experience heightened social discomfort in team interactions. Ironically, what benefits the ethnically diverse team may undermine its ethnically distinct members. This study highlights how the management of diversity may sometimes require making trade-offs between individual interests and those of the team. (shrink)

The pandemic of SARS-CoV-2 has led to unprecedented changes to society, causing unique problems that call for extraordinary solutions. We consider one such extraordinary proposal: ‘safer infection sites’ that would offer individuals the opportunity to be intentionally infected with SARS-CoV-2, isolate, and receive medical care until they are no longer infectious. Safer infection could have value for various groups of workers and students. Health professionals place themselves at risk of infection daily and extend this risk to their family members and (...) community. Similarly, other essential workers who face workplace exposure must continue their work, even if have high-risk household members and live in fear of infecting. When schools are kept closed because of the fear that they will be sites of significant transmission, children and their families are harmed in multiple ways and college students who are living on campus, whether or not they are attending classes in person, are contributing to high rates of transmission and experiencing high rates of exposure. We consider whether offering safer infection sites to these groups could be ethically defensible and identify the empirical unknowns that would need to resolve before reaching definitive conclusions. This article is not an endorsement of intentional infection with the coronavirus, but rather is meant to spark conversation on the ethics of out-of-the-box proposals. Perhaps most meaningfully, our paper explores the value of control and peace of mind for those among us most impacted by the pandemic: those essential workers risking the most to keep us safe. The paper offers a three-premise argument that a person with first-hand experience of possession and exorcism, such as an exorcist, can have a justified belief in the existence of demons. “Exorcism involves a process by which the exorcist comes to believe that testimony is offered by a demon.” Cited for are the Gospels, the Roman Ritual, some modern cases of exorcism, and exorcism practices in non-Christian contexts. “If defeaters are absent, the exorcist may treat as reliable the process by which (...) he comes to believe that testimony is offered by a demon.” For a case is offered that we have a reliable ability to identify when testimony is being offered and when it is being offered by particular types of agents, what is termed testifier-identification. “In many cases of exorcism, defeaters are absent.” An inductive case is given for by responding to possible defeaters, including several suggested recently by David Kyle Johnson. Therefore, in many cases of exorcism the exorcist may treat as reliable the processes by which he comes to believe that testimony is offered by a demon, and so can have a justified belief in the existence of demons. While pharmaceutical industry involvement in producing, interpreting, and regulating medical knowledge and practice is widely accepted and believed to promote medical innovation, industry-favouring biases may result in prioritizing corporate profit above public health. Using diabetes as our example, we review successive changes over forty years in screening, diagnosis, and treatment guidelines for type 2 diabetes and prediabetes, which have dramatically expanded the population prescribed diabetes drugs, generating a billion-dollar market. We argue that these guideline recommendations have emerged under pervasive industry (...) influence and persisted, despite weak evidence for their health benefits and indications of serious adverse effects associated with many of the drugs they recommend. We consider pharmaceutical industry conflicts of interest in some of the research and publications supporting these revisions, and in related standard-setting committees and oversight panels. We raise concern over the long-term impact of these multifaceted involvements. Rather than accept industry conflicts of interest as normal, needing only to be monitored and managed, we suggest challenging that normalcy, and ask: what are the real costs of tolerating such industry participation? We urge the development of a broader focus to fully understand and curtail the systemic nature of industry’s influence over medical knowledge and practice. (shrink)

New Mutualisms. Politics, Needs and Emancipation. According to the research hypothesis that forms the backdrop of this contribution, the most diverse forms of mutualism represent variants of political action born of, among, and for subjects in need. In contrast to the hypothesis of an uncritical valorization of these experiences, however, it is not necessarily the case that these collective actions of solidarity reciprocity also express the same need for renewal of institutional politics. The reconstruction of the different stages of the (...) modern history of mutualism will allow to question the alleged mutually exclusive relationship between politics and needs theorized by a long and authoritative philosophical tradition and, paradoxically, reaffirmed precisely by its fiercest critics such as Hannah Arendt. Following this operation of historical and conceptual contextualization it will become possible to identify the main differences between mutualism and other forms of civic engagement of the charitable or assistentialist kind, and then to draw an idealtypical classification of the different degrees of politicalness openly claimed or, in fact, expressed, by its contemporary manifestations. The core doctrine of supersubstantivalism is that material objects are identical to their spacetime locations. One powerful consideration for the view is the argument from harmony—supersubstantivalism, it is claimed, is in a position to offer an elegant explanation of a number of platitudes concerning objects and their locations. However, I will argue that identifying material objects with their locations does not provide a satisfying explanation of harmony. What the supersubstantivalist needs is not a theory about the identity of objects, but (...) another theory about the identity of some relations. Our understanding of folk and scientific psychology often informs the law’s conclusions regarding questions about the voluntariness of a defendant’s action. The field of psychology plays a direct role in the law’s conclusions about a defendant’s guilt, innocence, and term of incarceration. However, physical sciences such as neuroscience increasingly deny the intuitions behind psychology. This paper examines contemporary biases against the autonomy of psychology and responds with considerations that cast doubt upon the legitimacy of those biases. The upshot is that (...) if reasonable doubt is established regarding whether psychology’s role in the law should be displaced, then there is room for future work to be done with respect to the truth of psychology’s conclusions about criminal responsibility. This article considers the development of nurse-led services as a part of a pilot study and explores the therapeutic nature of the role of the nurse. In particular it suggests a need for reconsideration of the fundamental values of nurse-led care in the context of changing organizational culture. Within the UK there has been pressure from policy makers to extend the role of the specialist nurse and create new nursing roles, shifting the boundaries between professional health groups. The philosophy of (...) nurse-led initiatives has therefore been driven mainly from a service redesign and clinical need standpoint rather than necessarily focusing on enhancing patients’ experience and the changes in organizational culture required to achieve this. While several studies have focused on the safety, comparative cost and comparative patient outcomes in nurse-led care in relation to traditional or doctor-led care, little attention has been given to the changing organizational values underlying the nursing role. Exploring this context is essential if new nursing roles are to provide more than relief for bottlenecks in the system and also meet their potential for providing patient centred and innovative models of care. There are often public calls to codify moral sentiments after failures to help others, and recent tragedies have renewed interest in one’s legal duty to aid another. This Article examines the moral underpinnings and legitimacy of so-called “Bad Samaritan” laws—laws that criminalize failures to aid others in emergency situations. Part I examines the theoretical backdrop of duties imposed by Bad Samaritan laws, including their relationship with various moral duties to aid. This leads to the analysis in Part II, which examines (...) two related questions that are raised when moving from moral to legal duties: First, on what ground does the state have the authority to dictate that one’s needs should be met in the way specified by a particular legal duty? Rad započinje pregledom postojećih teorija o vrijednosti roditeljstva kako bi se vidjelo može li se vrijednost su-roditeljstva svesti na to. Utvrdivši da se ne može, ukratko elaboriram teoriju roditeljstva po kojoj su roditelji ti koji stvaraju osobe. Koristeći Aristotelova četiri uzroka kao korisnu prizmu, ocrtavam kako su roditelji uzrok svog djeteta i kako u stvaranju djeteta zajedno su-roditelji postaju roditelji i dijete jedno drugome. Na (...) primjer, s obzirom na to da roditelji stvaraju djecu kao modele koje treba kopirati, su-roditelji bi trebali uživati u najboljoj vrsti prijateljstva jedni s drugima, tretirajući procvat onog drugog kao ljudske osobe kao svoj cilj. Predlažem da su-roditeljstvo sadrži roditeljstvo virtualno, da je ljubav su-roditelja prema djetetu manifestacija njihove ljubavi jednih prema drugima te da teleološki ispunjeno stanje prijateljstva između roditelja i djeteta postoji u prijateljstvu su-roditelja. We consider a proportional-prize contest to forecast future events, and show that, in equilibrium, this mechanism possesses perfect forecasting ability for any group size when the contestants share common knowledge about the probabilities by which future events realize. Data gathered in a laboratory experiment confirm the performance invariance to group size. By contrast, when realization probabilities are not common knowledge, there are some differences across group sizes. The mechanism operates marginally better with three or four compared to two players. Einfühlung wird ideengeschichtlich an das Konzept der Selbstperfektionierung geknüpft und insofern im Modus der Defizienz verhandelt. Dabei fungieren antike und mittelalterliche Diskurse um Gotteserkenntnis als historisch-konzeptionelle Vorläufer neuzeitlichmoderner Erklärungsfolien zwischenmenschlicher Alterität, mithin als semantische Vorform der zeitgenössischen Einfühlungs-Idee. In diesem Kontext ist eine ethisch-epistemologische Asymmetrie zu konstatieren, die Gott einerseits als den All-Empathischen beschreibt und zugleich die Erkenntnisbemühungen des Menschen als unabgeschlossen und prozessual vorstellt. Einfühlung produziert sich als regulative Idee im doppelten Sinne: Während Gott als empathische Transzendenz erscheint, bedarf (...) es unendlicher Annäherungsbewegungen, damit der Mensch sich in einem Akt transzendenter Empathie in Gott einfühlen kann. Durch die Etablierung dieser Vorstellungsverbindung hat das Innenleben des Anderen eine transzendente Aufladung erfahren. Das Fremdpsychische wurde zum modernen Mysterium. (shrink)

Counterinsurgency doctrine emerged in the early 1960s as the Kennedy administration sought a politically progressive alternative to “pacification” campaigns waged by the French against the Vietnamese revolution. But its architects could not come up with a substitute for the conventional military reliance on massive firepower, which brought devastation to the Vietnamese people and failed to crush the “Viet Cong.” The Americans were again unsuccessful in transferring legitimacy to their allies in Saigon. After the war, the notion of counterinsurgency was kept (...) alive among military writers.
