The article aims at addressing the question of representations of World War Two in Croatian and Serbian literature that were subversive in the sense that they queried the legend not simply by rejecting communism and affirming nationalism, but by emphasizing the uncertainty and sensibility of the human beings, a typical modern reaction to violence and, in general, modernist topoi. In this article I will focus on modernist novelistic representations of the 1960s in which the uncertainty and instability of collective warrants (...) are foregrounded. As a result a subversive meaning is produced which contradicts not only communism and revolution but more generally war as such, including the universal features of war such as confronting loneliness, love as an expression of an individual rather than a collective sense of existence, and the impossibility of a valid representation of past events. This paper explores the wandering during the Night of Culture, which I consider an essential practice for the people's experience of this event. Looking at this particular form of movement of those participating in this initiative between various event locations also allows us to see the implications of the Night of Culture for urban public spaces. The empirical base of the paper is the visual documentation of the events carried out during the Night of Culture during the 2023 edition. While (...) interpreting the material, I refer to the situationist theory of drift and then reconstruct the structure of the festival's wandering, its rhythm, the type of attention bestowed on the city by the participants, and the form of this ephemeral community. In conclusion, I propose that the atmosphere of places can be used to analyse the city-forming effects of the Night of Culture, to grasp better the specificity of the event and its risks and potentials. The obligation of the legalization of entrepreneurial activity from Article 14 of The Act of July 2, 2004 on the freedom of entrepreneurial activity caused deliberations regarding constitutive or declarative character of the legalization entry and as a result, created a problem with indication of the moment when the public law status of an entrepreneur is acquired. The answer to the question whether Central Register and Information of Entrepreneurial Activity or the register of entrepreneurs of the National Court Register have (...) also the creation function incites many controversies and is subject to discussions, in the process of which two main standpoints were formed. It is also important to note that the resolution of the discussed issue not only holds scientific value, but above all, it has significant importance in practice. Therefore, it is necessary and even essential. Furthermore, it is typical for this issue that concerns related thereto and arguments raised during the discussion have their basis in the legislation in force and in fact, encapsulate the favoured path of its interpretation. This paper develops a novel interpretation of Dasein, as we find it in Heidegger’s Being and Time. On this interpretation, Heidegger models this most famous of all his concepts after Aristotle’s account of the soul from De Anima as isomorphic with whatever it currently cognises. Indeed, Dasein proves central to the inquiry into Being he attempts in that book precisely because, like soul, it is capable of becoming like all beings.

Emotion Review, Volume 14, Issue 2, Page 132-160, April 2022. Autonomic nervous system activity is a fundamental component of emotional responding. It is not clear, however, whether positive emotional states are associated with differential ANS reactivity. To address this issue, we conducted a meta-analytic review of 120 articles, measuring ANS activity during 11 elicited positive emotions, namely amusement, attachment love, awe, contentment, craving, excitement, gratitude, joy, nurturant love, pride, and sexual desire. We identified a widely dispersed collection of studies. Univariate (...) results indicated that positive emotions produce no or weak and highly variable increases in ANS reactivity. However, the limitations of work to date – which we discuss – mean that our conclusions should be treated as empirically grounded hypotheses that future research should validate. (shrink)

The subject of this study are the argumentation strategies applied by the Polish and German apex courts competent in criminal matters, namely the Supreme Court and the Federal Court of Justice, respectively. The investigation encompasses a total of 200 rulings issued by the criminal panels of these bodies. Particular focus was put on examining which arguments both courts apply to solve interpretation problems, and secondly, how these courts systematize the interpretation process. Methodologically, the examination utilizes, inter alia, the principles of (...) qualitative research, without neglecting the legal dogmatic perspective. A crucial theoretical foundation underlying this study is the distinction between formalistic and substantive legal cultures. The examination reveals that neither the Polish nor the German legal culture is purely formalistic or value-oriented. Nevertheless, the Supreme Court of Poland shows greater affinity for formalistic arguments, whereas the substantive interpretation methods are more widespread in the judicature of the German Federal Court of Justice. In particular, the Polish Court prefers the linguistic interpretation, whereas the German Court favours the purposive approach. (shrink)

In this paper, I develop a speech-act based account of presumptions. Using a score-keeping model of illocutionary games, I argue that presumptions construed as speech acts can be grouped into three illocutionary act types defined by reference to how they affect the state of a conversation. The paper is organized into two parts. In the first one, I present the score-keeping model of speech act dynamics; in particular, I distinguish between two types of mechanisms—the direct mechanism of illocution and the (...) indirect one of accommodation—that underlie the functioning of illocutionary acts. In the second part, I use the presented model to distinguish between the unilateral act of individual presumption, the point of which is to shift the burden of proof by making the hearer committed to justifying his refusal to endorse the proposition communicated by the speaker, whenever he refuses to endorse it, the bilateral act of joint presumption—‘bilateral’ in that it is performed jointly by at least two conversing agents—the function of which is to confer on the proposition endorsed by the speaker the normative status of jointly recognized though tentative acceptability, and the indirect or back-door act of collective presumption, the purpose of which is to sustain rules and practices to which the conversing agents defer the felicity of their conversational moves. The author presents a few consumer cases, which serves him to argue that customers frequently are victims of corporate arrogance and preponderance. In case of conflict between consumer expectations and corporate interests, corporations tend to put immediate profits above fairness, solidarity, the spirit of service or other non-material moral values. The power of corporations seems to be so immense today that we can talk about a form of corporate tyranny. Business companies resemble absolutist states of the past. In this context, (...) it is difficult to imagine how the "principle of gratuity and the logic of gift", a key proposal of the Encyclical Caritas in veritate, could be embraced by the business world. Gift, gratuity and communion require flexibility, prudence and freedom in decision making on the side of customer assistance and ground floor managers, which is an impossible prerequisite in a highly verticalised, centralised and standardised corporate world. The author warns that the arrogance and tyranny of corporations may become a source of human estrangement and oppression in the long run, as well as it may become a means of a "servile state". The author finishes claiming that the profit motive is not always the best incentive for corporate performance and that excellent business leadership is matter of balance between following rules and using common sense. He asks whether it is really possible to be efficient, profitable, prudent and humane in business at the same time? (shrink)

Psychological universals and nomothetic aspirations of social psychology The experimental social psychology basically rejects idiographism, though its nomothetism is only sometimes similar to the one that dominates in natural traditions. This is illustrated in the paper on instances of the selected theories. They often differ from their equivalents in the natural sciences because they describe the instruments of human psychological functioning which either are non-universal or appear with various frequency in different cultural and/or historical contexts, fulfill diverse functions there, and (...) even sometimes have a different meanings. This article demonstrates the fallacy of legal deduction as a method which is supposed to guarantee the certainty and predictability of the law. The Author asserts that legal deduction is in fact not of a logical nature. Their premises are of an uneven character or else one of them must be created in a non-mechanical way. This in turn makes legal deduction that is comprehended as a mode of inference that is infallible, provided its premises are true / valid nothing (...) more than misunderstanding and fallacy. In addition, in this paper, the outcomes of legal deduction are shown to be highly dependent on the direct and indirect context under the threat of their being utterly absurd. Since the lack of fixity and clarity, these contexts, however, may lead one to madness, i. e. at least unless she or he abandons the idea that only logical types of inferences govern legal deduction and are solely responsible for its outcomes. The paper develops a score-keeping model of illocutionary games and uses it to account for mechanisms responsible for creating institutional facts construed as rights and commitments of participants in a dialogue. After introducing the idea of Austinian games—understood as abstract entities representing different levels of the functioning of discourse—the paper defines the main categories of the proposed model: interactional negotiation, illocutionary score, appropriateness rules and kinematics rules. Finally, it discusses the phenomenon of accommodation as it occurs in illocutionary games and (...) argues that the proposed model presupposes an externalist account of illocutionary practice. In this paper, I analyze the semantics of the first person pronoun “I” from the perspective of the user/producer distinction. In the first part of the paper, I describe the Simple View and propose three interpretations of its thesis. In the second part, I analyze the notions of use and production of a linguistic token. In the next part, I show that all of the interpretations of SV are sensitive to counterexamples. In the end, I discuss possible answers of the (...) proponents of SV and argue against them. The first aim of this paper is to show that SV is wrong, and the second is to convince the reader that the user/producer distinction is of high importance in the philosophy of language. (shrink)

The aim of this paper is to argue in favor of the view that some counterpossibles are false. This is done indirectly by showing that accepting the opposite view, i.e., one that ascribes truth to each and every counterpossible, results in the claim that every necessarily false theory has exactly the same consequences. Accordingly, it is shown that taking every counterpossible to be true not only undermines the value of debates over various alternative theories and their consequences, but also puts (...) into question the very possibility of such debates. In order to explicate this thesis, the close bond between counterpossibles and the so-called story prefix is explored. A number of possible responses to this criticism are also presented, and it is argued that none of them address the main problem. (shrink)

If we could build artificial persons (APs) with a moral status comparable to this of a typical human being, how should we design those APs in the right way? This question has been addressed mainly in terms of designing APs devoted to being servants (AP servants) and debated in reference to their autonomy and the harm they might experience. Recently, it has been argued that even if developing AP servants would neither deprive them of autonomy nor cause any net harm, (...) then developing such entities would still be unethical due to the manipulative attitude of their designers. I make two contributions to this discussion. First, I claim that the argument about manipulative attitude significantly shifts the perspective of the whole discussion on APs and that it refers to a much wider range of types of APs than has been acknowledged. Second, I investigate the possibilities of developing APs without a manipulative attitude. I proceed in the following manner: (1) I examine the argument about manipulativeness; (2) show the important novelty it brings to a discussion about APs; (3) analyze how the argument can be extrapolated to designing other kinds of Aps; and (4) discuss cases in which APs can be designed without manipulativeness. The paper aims to develop an interactional account of illocutionary practice, which results from integrating elements of Millikan's biological model of language within the framework of Austin's theory of speech acts. The proposed account rests on the assumption that the force of an act depends on what counts as its interactional effect or, in other words, on the response that it conventionally invites or attempts to elicit. The discussion is divided into two parts. The first one reconsiders Austin's and Millikan's (...) contributions to the study of linguistic practice. The second part presents the main tenets of the interactional account. In particular, it draws a distinction between primary and secondary conventional patterns of interaction and argues that they make up coherent systems representing different language games or activity types; it is also argued that the proposed account is not subject to the massive ambiguity problem. If existing or future robots appear to have some capacity, state or property, how can we determine whether they truly have it or whether we are deceived into believing so? John Danaher addresses this question by formulating his approach to what he refers to as superficial state deception (SSD) from the perspective of his theory termed ethical behaviourism (EB), which was initially designed to determine the moral status of robots. In summary, Danaher believes that focusing on behaviour is sufficient to (...) determine whether SSD occurs. My general claim is that Danaher’s approach to SSD based on EB is implausible since it results in the impossibility of conceptualizing SSD, e.g., it does not enable determining whether or not SSD occurs in a particular case. Moreover, I show how Danaher’s approach to SSD needs to be transformed to become plausible. To make my point, I (1) examine the main features of EB and distinguish its two versions by showing how Danaher revised the original EB in response to criticism; (2) discuss Danaher’s approach to the problem of deception from the perspective of EB; (3) criticize that approach by showing that it requires revisions analogous to those that have already been recommended in reference to EB, and (4) propose an alternative method for determining the presence of SSD that covers diverse, plausible approaches to SSD. In his paper “St. Anselm’s ontological argument succumbs to Russell’s paradox” Christopher Viger presents a critique of Anselm’s Argument from the second chapter of Proslogion. Viger claims there that he manages to show that the greater than relation that Anselm used in his proof leads to inconsistency. I argue firstly, that Viger does not show what he maintains to show, secondly, that the flaw is not in the nature of Anselm’s reasoning but in Viger’s (mis)understanding of Anselm as well as (...) in Viger’s (mis)application of some set-theoretical notions. I also describe some features of Anselmian greater than relation, which indeed plays a crucial role in his Ontological Argument. Last but not least, I present the Argument itself. (shrink)

By definition, the implicit commitment of a formal theory $$\textrm{Th}$$ Th consists of sentences that are independent of the axioms of $$\textrm{Th}$$ Th, but their acceptance is implicit in the acceptance of $$\textrm{Th}$$ Th. In Cieśliński (2017, 2018), the phenomenon of implicit commitments was studied from the epistemological perspective through the lenses of the formal theory of believability. The current paper provides a comprehensive proof-theoretic analysis of this approach and compares it to other main theories of implicit commitments. We argue (...) that the formal results presented in the paper favour the believability theory over its main competitors. However, there is still a fly in the ointment. We argue that in its current formulation, the theory cannot deliver all the goods for which it was defined. In particular, being amenable to a generalised conservativeness argument, it does not support the view that the notion of truth is epistemically light. At the end of the paper, we discuss possible ways out of the problem. (shrink)

Recent research observed a sensitive window, at about 14 years of age, in the acculturation rates of Chinese immigrants to Canada. Tapping an online sample ofusimmigrants, we tested these relationships in a broader population and explored connections with new potentially causally related variables: formal education, language ability and contact with heritage-culture and mainstream United States individuals, both now and at immigration. While we found that acculturation decreased with age at immigration and increased with years in theus, we did not observe (...) a similar sensitive window. We also present an exploratory path analysis, exposing the relationships in our sample between acculturation and the variables above. The novel relationships documented here can improve theorising about this rich and complex empirical phenomenon. (shrink)

Artykuł oferuje nowe rozwiązanie problemu usytuowania umysłu (situated cognition), polegające na wykazaniu, jak i dlaczego ludzki umysł wydobywa z otoczenia nie informację, lecz wiedzę. Wiedza jest definiowana jako informacja posiadająca dla organizmu określoną wartość. Zaprezentowany został mechanizm, za pomocą którego owa wartość zostaje do bodźca informacyjnego wprowadzona. Usytuowanie – według tej interpretacji – polega na tym, że część poznania procesów człowieka wykonują za niego inni ludzie, mianowicie ci, którzy wytworzyli jego otoczenie poznawcze. Otoczenie poznawcze jest definiowane jako suma wartościowych bodźców (...) informacyjnych. Wiedza wydobyta z otoczenia definiuje różne style poznawcze człowieka, które – z uwagi na zewnętrzne źródło klasyfikacji – nazywane są ekotypami poznawczymi. Wyróżnione zostają cztery ekotypy poznawcze człowieka, na podstawie kształtu ich otoczenia poznawczego (rodzaje ofert ucieleśniających wartościową informację) oraz kompetencji poznawczych niezbędnych do wydobycia wiedzy z otoczenia. This paper’s aim is to provide a new interpretation of Martha C. Nussbaum’s and Richard Rorty’s views on the ethical role of literature. I pursue this aim in a threefold manner. First of all, I shortly discuss and provide a critique of previous comparisons by other authors. Afterwards, based on the presented critique of other comparisons, I present concise summaries of their respective views. Finally, I propose a double context for interpreting and assessing their views together. The main claim of (...) the paper is the following: despite several differences in their philosophical underpinnings, Nussbaum’s and Rorty’s views on literature can be interpreted together using the context of John Rawls and Jacques Rancière. This interpretation consists of showing how uncovering a shared Rawlsian characteristic of Nussbaum’s and Rorty’s views paves a way for explaining how literature actually does ethical work, using some concepts of Rancière. Such a contextual reading allows for both a more thorough understanding of their respective projects and assessing their shared shortcomings. (shrink)

The paper offers a critical analysis of the skeptic’s conviction that his doubts about the truth of thought on existence of the world outside the mind are not equivalent to real the doubts about existence of the world alone, but they are only a theoretical and speculative problem of knowledge. The main case of this criticism is based on the Kazimierz Ajdukiewicz’s philosophy, precisely, on his theory of truth.

The present article constitutes an attempt at a review of a few selected questions related to the complexity paradigm and its implications for research on cognition, especially within the so-called ecological approach framework. I propose several theses, among others concerning the two contrary tendencies within the dominant methodology (the propensity to search for simplicity and the growing emphasis on recognizing complexity), as well as the ontological consequences of the phenomenon under discussion (ontological emergence and processual emergentism).
