Roughly three years after the creation of his mandate, United Nations Special Rapporteur Maina Kiai reflects on the global state of assembly and association rights. Although the mandate was created against the backdrop of shrinking space for civil society, a massive and growing global protest movement has grabbed most of the headlines since 2011. Kiai argues that the mandate has made a measurable impact – it has helped raise awareness of repressive NGO laws, provided technical assistance to governments to (...) strengthen assembly and association rights and developed soft law. But perhaps, the most important work of the mandate has been its contribution to a better understanding of just how important the rights to freedom of peaceful assembly and association are. Assembly and association rights are a powerful tool to promote dialog, pluralism, broadmindedness, tolerance and civic participation; they satisfy people's fundamental desire to take control of their own destinies. And if anything, the past few years have taught us that the worst turmoil comes when this desire is suppressed. When people are denied something so fundamental, rage inevitably follows. When people have no outlet for that rage, it can ultimately manifest itself as something much more chaotic than a street protest. (shrink)

It is notable how some papal social encyclicals have interchangeably used the terms ' common good ' and 'human rights.' This article analyzes the papal common good teaching and its contemporary shift to include human rights. I also explore the differential nuances between the common good and the human rights. Human rights as advocated by civil societies are understood as arising from a conception of the nature of the human person. The common good has been expressed in practical ways through (...) human rights, especially the right to work and receive a just wage. The papal social encyclicals are viewed here as relevant to our contemporary world where extreme capitalism and unrestrained consumerism have led to the accumulation of wealth and power in the hands of a few people. Moral theology explores the sources of the moral teaching in several religions. It is the branch of theology that analyzes the scriptural, rational, and ministerial bases of moral teaching on various issues in Christian living. Moral theology in the Catholic Church has been undergoing rapid development since the Second Vatican Council. This essay presents the encyclical Veritatis Splendor as providing an important perspective on fundamental issues in moral theology. In Veritatis Splendor , Pope John Paul II gave the response of (...) the church magisterium to the issues raised for decades in moral theology. This essay also evaluates the Catholic moral theologians’ responses to the encyclical. The theologians are categorized into two groups: the theologians who support the encyclical and the ones who view the encyclical in a critical way as misrepresenting their ideas. El objetivo de este artículo es analizar la práctica de la lectura durante la pandemia del COVID-19, profundizando en sus sentidos para la población de Córdoba, una gran urbe de Argentina. Bajo la premisa de que la lectura es una práctica cultural de trabajo subjetivo, establecemos su relación con la espiritualidad. Construimos el objeto de estudio a partir de un desarrollo conceptual propio y distintos tipos de referencias empíricas: revisamos las recomendaciones de la OMS durante la pandemia, analizamos los resultados (...) de una encuesta propia y profundizamos en el sentido de los datos sobre la lectura en pandemia a través de grupos focales organizados según variables etarias. En este artículo analizamos dos segmentos: jóvenes (18-23) y adultos (51-59). En las respuestas de la encuesta, la lectura ocupa el segundo lugar entre las actividades culturales habituales. La Biblia fue el libro más mencionado, con un registro del 10,5 %. En segundo lugar, se ubicaron los libros de autoayuda. Según surgió de los grupos focales, el recurso a las lecturas de orientación subjetiva fue estimulado por la crisis existencial que produjo la pandemia. Se refuerza así la tesis del aumento de las tasas de lectura en contextos de encierro, así como la tendencia a la apropiación terapéutica de textos sagrados en condiciones subjetivas cruciales. Do you have to be one to know one? Madhvàcàrya, the founder of the thirteenth century school of Vedànta, answered this question with a resounding 'yes!' Madhvàcàrya's insistence that one must be a Màdhva to study Màdhva Vedànta led him to employ various strategies to exclude outsiders and unauthorized readers from accessing the root texts of his tradition and from obtaining oral commentary from living virtuosos. Deepak Sarma explores the degree to which outsiders can understand and interpret the doctrine (...) of the Màdhva school of Vedànta. The school is based on insider epistemology which is so restrictive that few can learn its intricate doctrines. This book reveals the complexity of studying traditions based on insider epistemologies and encourages its audience to ponder both the value and the hazards of granting any outsider the authority and opportunity to derive important insights into a tradition as an insider. This project was undertaken to develop a telelearning knowledge base aimed at making specialized telelearning knowledge accessible to non-specialized practitioners in the field. The challenge stems from a rationale related to a user-centered approach for the software design process, which is focused on learning in the context of professional practice, the bridge to be built between expert and practitioner knowledge, as well as the knowledge valorization of the latter. In order to take into account users and their situated actions, a (...) usage study was integrated in the analysis phase. This study allows the creation of procedural and contextual telelearning models, and also lists of needs. These results serve as a basis for formulating guidelines for the development of ontologies, for the design of the telelearning knowledge base user interface and telelearning knowledge base environmental description. Although contract sugarcane farming is the most dominant and popular land use among farmers in Nzoia Sugarbelt, results from a 2007 study suggests that the intended goal of increasing farmers’ incomes seems to have failed. With a mean monthly income of Kenya Shillings 723 (US $ 10) from an average cane acreage of 0.38 hectares, it would be difficult for a household of eight family members to meet their basic needs and lead a decent life. Analysis of farmer statements showed (...) that up to 86% of the changes in net income were significantly determined by six cost variables as a group (i.e., acreage, tillage costs, seedcane costs, transport costs, yield, and farmer’s education level). Area under sugarcane had the greatest influence on net income whereby an increase in one hectare under cane would result in an increase of Kenya Shillings 110,427 in net income (per crop cycle of 21 months), holding other variables constant. This translates into Kenya shillings 5,258 per month (or 175 per day per household, or for a family of eight people—KES 22 or US $ 0.3) per member, which is far below the international standard of absolute poverty. Key net income depressors were tillage, seedcane, and transportation costs, all of which were determined by the company with no input from farmers. To bridge income gaps between the company and farmers in favor of sustainable community livelihoods, this paper argues strongly for the need to institutionalize Corporate Social Responsibility within the daily operations of the company particularly to address net-income depressors. Ten key building blocks for such a policy for Nzoia Sugar Company are suggested, based on farmers’ responses and ethical considerations. (shrink)

Ethics deals with how we make decisions and the actions we perform. In decision-making, one weighs the pros and the cons of any course of action. Besides the realm of the private, there are ethical issues regularly dealt with in public discourses. Human identity in most instances is a cultural and religious construct. Our socio-historical background as human beings is constitutive of our identity and also informs our ethical decision making. In this essay, I argue for a possibility of positively (...) incorporating ideas from world religions and diverse cultures into public ethical discourses. Since world religions are about people, it is possible to appropriate humanity as understood in religions in the development of ethics. Hence, I present religions as practically relevant in the analysis of public ethical issues. Public ethical discourses are viewed as inclusive of history, religion, and culture. Further, the work of the philosopher Paul Ricoeur is presented as a way of reconciling subjectivity and objectivity in history and ethics. This essay is an analysis on ways in which the debate on ethical issues can incorporate all the voices in a society without excluding anyone while avoiding ideological extremism.  . (shrink)

ABSTRACT In this essay, I shall discuss Gadamer’s interpretation of Celan’s dialogical poetry in his essay “Wer bin Ich und wer bist Du?” (“Who am I and Who are You?”). One may argue that this is Gadamer’s articulation of the problem of the self-other relationship. To understand the question of self and other, it is first of all necessary to return to the poetic word from which the question arises. Speaking is, for Gadamer, the most profoundly self-forgetful action, because when (...) one speaks, one is so deeply “within the word” that one is not turned toward the word but, rather, to what one wants to say with the word. For hermeneutics, interpreting means putting oneself on the task of the poetic text. The proximity between poetizing and interpreting emerges, also in its specificity concerning the proximity between poetizing and thinking. Such a proximity, in turn, divides itself into two extremes: the word that sublates itself, and the word that stands for itself. It is hence the uncertain fullness of language, where, unsurprisingly, both poetizing and interpreting come into themselves, which constitutes the link between the one and the other. Therefore, the interpreted word, intertwined with the poetic word does not replace what it indicates, but merely points beyond itself, to what is other than itself. Both pursue a meaning that points toward an open realm. (shrink)

The paper is an attempt to revisit Rawls’ idea of a self, which elicits the concept of justice in the liberal tradition. Justice, as understood in the social and political context, is the basic feature of a well-ordered and rationally developed society and it is considered to be a virtue of the social institution. The liberal theory believes in the basic principle that right is prior to the good, and what is most fundamental to our personhood are not the ends (...) we choose but our capacity to choose them. Hence, in Rawls’ account of the self, absoluteness of the metaphysical priority has an edge over the absoluteness of the moral priority. The idea of an unencumbered self, in the social and historical sense, is at the core of the Kantian-Rawlsian theory of justice, which is under attack by the communitarians. Communitarians like Sandel, however, questions Rawls’ claim for the priority of right over good and maintains that liberals fail to recognize the self is ‘embedded,’ in and partly constituted by communal commitments and values which are objects of choice. In this paper, I examine communitarian critiques of Rawls’ liberal self. Further, I also refer to Rawls’ turn to the ‘political,’ which works as a ‘module’ that fits into and can be supported by a variety of reasonable comprehensive doctrines. (shrink)

To this end, I will address four issues: typographical errors, unfounded claims about my translations, content and problems of method and theory, and the future of scholarship in Mādhva (...) Vedānta.Typographical DoṣasFirst, I wish to thank Zydenbos for pointing out the typographical errors. I take full responsibility for them and I intend to correct them in future editions. These are unintentional mistakes and should not be taken as an accurate indicator of my academic ability. I invite readers to examine my other publications on Mādhva Vedānta and to decide for themselves. Jayatīrtha (1365-1388 C.E.), a renowned Mādhva commentator, explained the reasons for such errors in his Pramāṇapad-dhati. He held that defective eyes, whether from cataract, jaundice, or the like,1 [End Page 670] can give rise to defective knowledge, and further, that if an object is too far away, too near, too small, obstructed, or even mixed with similar things, then this will give rise to incorrect knowledge.2 I knew that such errors were likely to occur (especially given the size of the fonts in the page proofs!), which is why I wrote the following in my acknowledgments: "Errors that remain in this text are entirely my own responsibility. If any are found I beg your forgiveness and hope that they inspire you to further study Mādhva Vedānta!" (p. xi). Zydenbos should know better than to speculate about matters he has no knowledge of.Content and Methodological IssuesThe typographical errors and accusations of plagiarism are far less interesting than the points that were raised about the content of my book. Disputes in the West about interpretations of Mādhva Vedānta are recent; it has been largely ignored in favor of Buddhism and the crypto-Buddhist school, namely Advaita Vedānta. There have been very few books on Mādhva Vedānta written by outsiders, and those few are no longer in print, are poorly written, use dated language, or are in a language that is not available to most lay Mādhvas. Interpretations of Mādhva doctrines made by their authors have remained unquestioned by Western readers given the relative novelty and obscurity of Mādhva Vedānta, while Mādhva insiders have ignored most of them. It is wonderful, then, that Zydenbos doubts my interpretations. After all, his disputes are among the first ones published by an outsider concerning the interpretation of Mādhva doctrines.3Zydenbos' skepticism is reason for celebration for it indicates that Western scholarship on Mādhva Vedānta has come of age. There are now enough scholars of Mādhva Vedānta (or, rather, scholars who claim knowledge of Mādhva Vedānta) in the West that such a debate can occur. In recent years, there has been growing interest in bridging bodies of knowledge from introspective and contemplative traditions with modern neuroscience. By making the primary object of study an individual’s subjective experience, scientists are then confronted with the challenging problem of how to record a given mental state at a given point in time. For simple experiences, such as in facial recognition tasks, an external recording device such as a button box or computer keyboard is adequate. However, these devices pose (...) fundamental problems when attempting to record more subtle states of mind, or to do so in situations where the presence of an external input device would disturb the subject, such as in the case of studying the evolution of internal states of highly advanced meditators. Here, I suggest that variants of the mnemonic techniques used in memory competitions can be used to make measurements in experiments where an external device would be impractical to use, or would unnecessarily disturb the subject. Demographic and performance data from memory competitions suggest that these techniques can be learned by ordinary subjects participating in multi-session experiments, and that, for highly trained individuals, events can be recorded at roughly 400 millisecond intervals for timescales on the order of tens of seconds, and at roughly one-second intervals for sustained periods of one hour or longer. Finally, I discuss the relationship of the current proposal to descriptive experience sampling (DES) and the visualization techniques of the Tibetan meditative tradition. (shrink)

Situational and experiential factors provide a moral lens through which people judge the morality or otherwise of actions. The research in this volume goes a step further and illustrates that individual differences may interact with these situational and experiential factors to explain the acquisition of positive attitudes to immoral behaviour.

Not much work has been done on Hindu bioethics other than by a select few scholars and medical doctors. Professor Cromwell Crawford, author of Dilemmas of Life and Death: Hindu Ethics in a North American Context and Hindu Ethics for the Twenty-first Century, for example, is well known in the field of Hindu bioethics. Others scholars include Dr. Uma Mysorekar, who is a gynecologist as well as the president of the board of trustees of the Ganesha Temple of Flushing New (...) York. She has published several short pieces on Hindu bioethics, and has even been interviewed by PBS for their “Religion and Ethics” program. Dr. H. L. Trivedi, director of the Institute of Kidney Diseases and Research Center at the Civil Hospital Campus in Ahmedabad, India, is also prominent. His pithy paragraph in Transplant Proceedings on Hinduism and organ transplantation is cited with enormous frequency on the Internet and elsewhere. These thinkers, however, are unequivocally wrong in their position that Hinduism supports organ transplantation, and, more importantly, that it offers any coherent or systematic bioethics whatsoever.
