El presente artículo analiza el desarrollo de las Elecciones Municipales Complementarias 2019 en doce distritos en los que se declaró la nulidad del proceso luego de las Elecciones Regionales y Municipales 2018 en el Perú. De acuerdo a la legislación electoral de este país, la declaración de nulidad de un proceso es competencia del Jurado Nacional de Elecciones y se produce debido a dos causales. En el primer caso, once distritos tuvieron que repetir su proceso electoral debido a que el (...) conteo de votos nulos y en blanco, sumado o separado, superaron los 2/3 del número de votos emitidos. Mientras que, en un solo distrito se declaró la nulidad del proceso debido a la inasistencia de más del 50% de votantes producto de la no instalación de las mesas de sufragio. Más allá del argumento jurídico sobre la nulidad de los procesos, es necesario considerar un factor como la violencia electoral que estuvo presente en todos estos distritos. El proceso electoral en estas circunscripciones fue interrumpido debido al descontento de los ciudadanos con el desarrollo del proceso y las amenazas de violencia electoral. Es así como, es posible incluir a esta variable como un factor explicativo para la interrupción de los procesos electorales. Así, la presente investigación desarrolla un análisis cualitativo, en base a la información recopilada por la Oficina Nacional de Procesos Electorales. Este estudio hace especial énfasis en las dinámicas propias de la gestión electoral en distritos con alta probabilidad de sufrir conflictos electorales y describe la forma en que se interrumpieron las elecciones subnacionales en estas circunscripciones. Como otros escenarios de la región, la democracia se erige tras décadas convulsas para un sistema político cooptado por elites caudillistas, encono político, intromisión militar y condiciones estructurales irresolutas. Este conjunto de factores, inscritos en un contexto de guerra fría, (...) y al albor de la revolución cubana, inspiró movimientos guerrilleros a inicios de los sesenta, como el Ejército de Liberación Nacional o el Movimiento de Izquierda Revolucionaria. Su escasa relevancia nada tendría que ver con la fuerza disruptiva que experimentaría el Partido Comunista del Perú - Sendero Luminoso. Un grupo armado de marcada impronta maoísta que, si bien hunde sus raíces en la ruptura sino-soviética de 1962, construye sus fundamentos ideológicos y sus bases revolucionarias durante la década de los setenta. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. The present study aims to apply a program based on Hellison’s Teaching Personal and Social Responsibility Model (TPSR), traditionally used in Physical Education, to other educational subjects and examine the assessment of the teachers who carried it out during the 2018-2019 school year. The program was applied over eight months of one academic year and during at least 60% of the weekly class hours. Initially, 586 students participated, 429 being experimental subjects with 30 teachers, of whom 16 participated in the (...) interviews carried out, all of them being Secondary Education teachers. We used qualitative methodology through content analysis carried out with ATLAS.ti 7.1.3. The instruments used to collect information were semi-structured recorded group interviews. The conclusion is that the Personal and Social Responsibility Model can be applied to all subjects in the curriculum and is adaptable to any content and type of student body. As a basis for future research, we suggest the application of the model by all teachers involved in the same school year and the participation of students’ families. (shrink)

Background: Frailty is a common syndrome among older adults and patients with several comorbidities. Grip strength is a representative parameter of frailty because it is a valid indicator of current and long-term physical conditions in the general population and patients with severe mental illnesses. Physical and cognitive capacities of people with SMIs are usually impaired; however, their relationship with frailty or social functioning have not been studied to date. The current study aimed to determine if GS is a valid predictor (...) of changes in cognitive performance and social functioning in patients with type-2 diabetes mellitus and SMIs. Methods: Assessments of social functioning, cognitive performance, and GS were conducted in 30 outpatients with type 2 diabetes mellitus, 35 with major depressive disorder, 42 with bipolar disorder, 30 with schizophrenia, and 28 healthy controls, twice during 1-year, follow-up period. Descriptive analyses were conducted using a one-way analysis of variance for continuous variables and the chi-squared test for categorical variables. Differences between groups for the motor, cognitive, and social variables at T1 and T2 were assessed using a one-way analysis of covariance, with sex and age as co-variates. To test the predictive capacity of GS at baseline to explain the variance in cognitive performance and social functioning at T2, a linear regression analysis was performed. Results: Predictive relationships were found among GS when implicated with clinical, cognitive, and social variables. These relationships explained changes in cognitive performance after one year of follow-up; the variability percentage was 67.7%, in patients with type-2 diabetes mellitus and 89.1% in patients with schizophrenia. Baseline GS along with other variables, also predicted changes in social functioning in major depressive disorder, bipolar disorder, and schizophrenia, with variability percentages of 67.3, 36, and 59%, respectively. Conclusion: GS combined with other variables significantly predicted changes in cognitive performance and social functioning in people with SMIs or type-2 diabetes mellitus. Interventions aimed to improve the overall physical conditions of patients who have poor GS could be a therapeutic option that confers positive effects on cognitive performance and social functioning. The present study conducted a detailed bibliometric analysis focused on research related to Heuristic Method, Research Skills and Teaching Practice within the framework of Higher Education. For this purpose, the Scopus database was used, considering publications from 2013 to 2023. The initial analysis revealed a total of 4071 relevant records. Of these, research articles constituted the largest proportion with 60.1%. Given the relevance and volume of these articles, 2488 were selected for further analysis. However, after a filtering process, it was (...) decided to work with 2363 articles. A crucial observation of the study is the prominence of the Social Sciences in this field. With 1,693 articles, the Social Sciences accounted for a significant 39.9% of the total number of publications analyzed. This data suggests a notable inclination towards the Social Sciences when addressing the above-mentioned topics in the field of higher education. It also reflects the interdisciplinarity and diversity of approaches in contemporary educational research. It is essential to note that the methodology adopted in this study, based on bibliometric tools and the Scopus database, provides a robust and up-to-date overview of trends in educational research over the last decade. These findings are crucial for scholars, researchers and practitioners in education to understand the dynamics and recent evolutions in the field. (shrink)

Many prominent theories of moral responsibility rely on the notion of “tracing,” the idea that responsibility for an outcome can be located in (i.e., “traced back to”) some prior moment of control, perhaps significantly antecedent to the proximate sources of a considered action. In this article, I show how there is a problem for theories that rely on tracing. The problem is connected to the knowledge condition on moral responsibility. Many prima facie good candidate cases for tracing analyses appear to (...) violate the knowledge condition on moral responsibility. So, either we need to dispense with tracing approaches or we must refine our understanding of the knowledge condition or we are responsible less frequently than we suppose. (shrink)

Conceptual engineering is commonly characterized as the method for assessing and improving our representational devices. Little has been said, however, on how best to construe these representational devices—in other words, on what conceptual engineering should be all about. This paper tackles this problem with a basic strategy: First, by presenting a taxonomy of the different possible subject matters for conceptual engineering; then, by comparatively assessing them and selecting the most conducive one with a view to making conceptual engineering an actionable (...) method, that is, a method that can be applied effectively and consistently to specific case studies. The outcome is that conceptual engineering should be all about concepts on pain of pragmatic inconsistencies otherwise. (shrink)

Many prominent accounts of free will and moral responsibility make use of the idea that agents can be responsive to reasons. Call such theories Reasons accounts. In what follows, I consider the tenability of Reasons accounts in light of situationist social psychology and, to a lesser extent, the automaticity literature. In the first half of this chapter, I argue that Reasons accounts are genuinely threatened by contemporary psychology. In the second half of the paper I consider whether such threats can (...) be met, and at what cost. Ultimately, I argue that Reasons accounts can abandon some familiar assumptions, and that doing so permits us to build a more empirically plausible picture of our agency. (shrink)

Constitutive instrumentalism is the view that responsibility practices arise from and are justified by our being prosocial creatures who need responsibility practices to secure specific kinds of social goods. In particular, responsibility practices shape agency in ways that disposes adherence to norms that enable goods of shared cooperative life. The mechanics of everyday responsibility practices operate, in part, via costly signaling about the suitability of agents for coordination and cooperation under conditions of shared cooperative life. So, there are a range (...) of identifiable conditions where the ordinary operation of responsibility practices—and thus, the usual normative force of the practices—is disrupted. Justice Across Ages offers an attractive account of justice between the young and the old that brings together three notable principles of age-group justice: complete-lives equality, relational equality, and prudence. Yet, the book says little about the fact that many of us live longer than others, and the little it does say casts doubt on whether lifespan inequality threatens justice as construed by the three principles. This essay argues, instead, that theories of justice between the young and the old should (...) not dispense with a conception of justice between different longevity groups. It concludes that we must be sensitive to lifespan variations when designing policies to promote justice across age groups. (shrink)

Retirement is often viewed as a reward for a working life. While many have reason to want a work-free retirement, not everyone does. Should working retirees have to give up their retirement pension and, consequently, their status as retirees? The answer, I argue, boils down to whether we conceive of retirement as free time (need-free) or as leisure (work-free). In this article, I put forward a liberal case in favour of free time, despite whether our liberalism leans towards perfectionism or (...) neutralism, with social primary goods being a case in point. Applying this case for free time to retirement yields two significant policy implications. First, it demands “free synchronic combination” – that retirees may use their retirement pensions however they see fit, including to work. Second, it also yields “free diachronic combination” – that, within limits, individuals have discretionary control over how to combine retirement and work across time – thus challenging the idea that retirement should be available only in old age and not earlier in life. So far, the literature on free time focused only on narrow temporal units, such as hours and days, but there is much to gain by extending the concept into retirement. (shrink)

Through modern driver assistant systems, algorithmic decisions already have a significant impact on the behavior of vehicles in everyday traffic. This will become even more prominent in the near future considering the development of autonomous driving functionality. The need to consider ethical principles in the design of such systems is generally acknowledged. However, scope, principles and strategies for their implementations are not yet clear. Most of the current discussions concentrate on situations of unavoidable crashes in which the life of human (...) beings is existentially affected. In this paper, we argue that ethical considerations should be mandatory for any algorithmic decision of autonomous vehicles, instead of a limitation to hazard situations. Such an ethically aligned behavior is relevant because autonomous vehicles, like any other traffic participants, operate in a shared public space, where every behavioral decision impacts the operational possibilities of others. These possibilities concern the fulfillment of a road-user’s safety, utility and comfort needs. We propose that, to operate ethically in such space, an autonomous vehicle will have to take its behavior decisions according to a just distribution of operational possibilities among all traffic participants. Using an application on a partially-autonomous prototype vehicle, we describe how to apply and implement concepts of distributive justice to the driving environment and demonstrate the impact on its behavior in comparison to an advanced but egoistic decision maker. In mid-twentieth-century Mexican philosophy, there was a peculiar nationalist existentialist project focused on the cultural conditions of agency. This article revisits some of those ideas, including the idea that there is an important but underappreciated experience of one's relationship to norms and social meanings. This experience—something called accidentality—casts new light on various forms of social subordination and socially scaffolded agency, including cultural alienation, biculturality, and double consciousness.

Building Better Beings: A Theory of Moral Responsibility argues that the normative basis of moral responsibility is anchored in the effects of responsibility practices. Further, the capacities required for moral responsibility are socially scaffolded. This article considers criticisms of this account that have been recently raised by John Doris, Victoria McGeer, and Michael Robinson. Er zeigt, dass Berkeley das Naturgeschehen als einen göttlichen Diskurs sieht; das visuell Wahrgenommene ist dabei die Sprache. Berkeley beharrt darauf, diese These der göttlichen Sprache wörtlich auszulegen, da sie Grundlage eines seiner Ansicht nach einzigartigen Gottesbeweises ist. Um Berkeleys Argumentation zu verstehen, muss man sich auch mit den (historischen) Umständen beschäftigen, in welchen er diese These entwickelt und verteidigt. In this paper we explore in what sense we can claim that affordances, the objects of perception for ecological psychology, are related to normativity. First, we offer an account of normativity and provide some examples of how it is understood in the specialized literature. Affordances, we claim, lack correctness criteria and, hence, the possibility of error is not among their necessary conditions. For this reason we will oppose Chemero’s normative theory of affordances. Finally, we will show that there is a (...) way in which taking advantage of affordances could be considered as possessing a normative character, but only when they are evaluated within the framework of social normative standards in particular situations. This reinforces our claim that affordances, per se, lack normativity and can only be taken to be rule-governed in relation to established normative practices. (shrink)

In this paper I defend an intermediate position between the ‘bare mathematical results’ view and the ‘transmission’ view of mathematical explanations of physical phenomena (MEPPs). I argue that, in MEPPs, it is not enough to deduce the explanandum from the generalizations cited in the explanans. Rather, we must add information regarding why those generalizations obtain. However, I also argue that it is not necessary to provide explanatory proofs of the mathematical theorems that represent those generalizations. The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). The Enhanced Indispensability Argument appeals to the existence of Mathematical Explanations of Physical Phenomena to justify mathematical Platonism, following the principle of Inference to the Best Explanation. In this paper, I examine one example of a MEPP—the explanation of the 13-year and 17-year life cycle of magicicadas—and argue that this case cannot be used defend the EIA. I then generalize my analysis of the cicada case to other MEPPs, and show that these explanations rely on what I will call ‘optimal (...) representations’, which are representations that capture all that is relevant to explain a physical phenomenon at a specified level of description. In the end, because the role of mathematics in MEPPs is ultimately representational, they cannot be used to support mathematical Platonism. I finish the paper by addressing the claim, advanced by many EIA defendants, that quantification over mathematical objects results in explanations that have more theoretical virtues, especially that they are more general and modally stronger than alternative explanations. I will show that the EIA cannot be successfully defended by appealing to these notions. (shrink)

Focusing on the recent work of Michael Bratman as emblematic of several important developments in the philosophy of action, I raise four questions that engage with a set of interlocking concerns about systemic functionalism in the philosophy of action. These questions are: (i) Are individual and institutional intentions the same kind of thing? (ii) Can the risk of proliferation of systemic functional explanations be managed? (iii) Is there an appealing basis for the apparent methodological individualism in our theories of action (...) and agency? and (iv) Why not, instead, pursue a methodologically anti-individualist and ecological approach to action and agency? The latter alternative, I suggest, offers a promising way to retain many of the core insights of the Bratmanian project while avoiding the difficulties inherent to some of the methodological presumptions of some strands of contemporary philosophy of action. The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

In this paper I argue for a novel interpretation of Shepherd’s notion of selfhood. In distinction to Deborah Boyle’s interpretation, I contend that Shepherd differentiates between the mind and the self. The latter, for Shepherd, is an effect arising from causal interactions between mind and body – specifically those interactions that give rise to our present stream of consciousness, our memories, and that can unite these two. Thus, the body plays a constitutive role in the formation of the self. The (...) upshot of this interpretation is that it can dissolve the problem of individuating mind that Boyle identifies. Briefly, the problem consists in Shepherd seemingly individuating minds in terms of their associated bodies and bodies in terms of the minds they are united with. My interpretation, however, allows to see that Shepherd neither wants nor needs to individuate the mind in isolation of the body and to read the passages, in which the problem seems to arise, as being about what makes living beings individual – with mind and body both playing a crucial role in this context. The idea of moral responsibility is central to a wide range of our moral, social, and legal practices, and it underpins our basic notion of culpability. Yet the idea of moral responsibility is increasingly viewed with skepticism by researchers and scholars in psychology, neuroscience, philosophy, and the law. Building Better Beings: A Theory of Moral Responsibility responds to these challenges, offering a new account of the justification of our practices and judgments of moral responsibility. Three distinctive ideas shape the account. (...) The first is the agency cultivation model, which holds that a system of responsibility practices can derive its justification from the way it supports our agency. The second idea, circumstantialism, is a new way of thinking about agential capacities. This is the view that the capacities required for moral responsibility are functions of agents in circumstances, rather than basic features of agents considered in themselves. The third idea is revisionism, or the idea that a satisfactory theory of moral responsibility will conflict with some aspects of ordinary commitments about freedom and moral responsibility. (shrink)

In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

Explicitly fictional armchair reconstructions of the past are sometimes taken to be informative about philosophical issues. What appeal a counterfactual genealogy has depends on its speculative accuracy, that is, its accuracy in identifying relevant causal, functional, or explanatory particulars. However, even when speculatively accurate, counterfactual genealogies rarely secure more than proofs of possibility. For more ambitious deployments of genealogy – for example, efforts to show what properties the target concept in fact predicates – genealogies are hamstrung by the possibility of (...) predicative drift, or changes over time in what the concept predicates. Still, even when counterfactual genealogies fail to tell us about our current practices or concepts, they may identify appealing successors. Pettit's (2018 Pettit, Philip. 2018. The Birth of Ethics: Reconstructing the Role and Nature of Morality. New York, NY: Oxford University Press.[Crossref], [Google Scholar]) innovative defense of moral realism and his employment of a counterfactual genealogy provides an illuminating instance of the promise and challenges facing accounts employing counterfactual genealogies. The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. La estructura lingüística «el ser» que maneja la filosofía como un supuesto sustantivo, deriva de formas verbales arcaicas y polisémicas, lo cual determina la vacuidad semántica del supuesto sustantivo «el ser». Éste no es sustantivo, ni concepto, ni principio: es un flatus vocis. La ontología y la metafísica, a fin de subsanar los vacíos conceptuales de sus respectivos sistemas, se han visto obligadas a hipostasiar u ontologizar lo que es una simple estructura verbal asignificativa: «el ser».

There are two standard theoretical responses to putative errors in ordinary thinking about some given target property: eliminativism or revisionism. Roughly, eliminativism is the denial that the target property exists, and revisionism is the view that the property exists, but that people tend to have false beliefs about it. Recently, Shaun Nichols has proposed a third option: discretionism. Discretionism is the idea that some terms have multiple reference conventions, so that it may be true to say with eliminativists that the (...) property does not exist, and true to say with revisionists that the property does exist. This article explores the viability of discretionism, and argues that it faces serious difficulties. Even if the difficulties faced by discretionism can be overcome, it is unclear that discretionism secures anything beyond what is already available to standard revisionist views. The article concludes with some reflections about Nichols’ account of the bare retributive norm. (shrink)

La asignación de valores veritativos que le asigna la lógica bivalente al condicional, en la definición tabular estándar, se basa en categorías de índole gnoseológica, incompatibles con el carácter formal y abstracto de las estructuras lógicas. La lógica pretende calificar con categorías gnoseológicas, estructuras formales no-gnoseológicas. Esta asignación evade el rigor de logicidad que demanda toda estructura formal y por lo tanto, carece de necesidad racional.

: No existen los valores ni fuera de la mente humana, ni como creados por ella. Lo que se denomina “valores”, es el reaccionar emotivo de la conciencia valorante ante aquellos est´ımulos que impactan en su afectividad. La mente humana se vale de categor´ıas axiologicas creadas para expresar el ´ impacto que, segun sean las circunstancias, le producen aquellas situaciones o ´ entidades.

“The psychological causal laws ceteris paribus: with exceptions or heteronomicals?”A common and popular belief is the one that declares that, usually, the intentional behavior of an individual must be explained, and therefore, predicted, based on what is thought to he inner self of any person: his mental states and, over all, his beliefs and wishes. The aim of this author is to defend the causal laws of peculiar nature, that is, strict and not homonomical (or ceteres paribus) laws.

Commercial genetic testing offered over the internet, known as direct-to-consumer genetic testing (DTC GT), currently is under ethical attack. A common critique aims at the limited validation of the tests as well as the risk of psycho-social stress or adaption of incorrect behavior by users triggered by misleading health information. Here, we examine in detail the specific role of advertising communication of DTC GT companies from a medical ethical perspective. Our argumentative analysis departs from the starting point that DTC GT (...) operates at the intersection of two different contexts: medicine on the one hand and the market on the other. Both fields differ strongly with regard to their standards of communication practices and the underlying normative assumptions regarding autonomy and responsibility. Following a short review of the ethical contexts of medical and commercial communication, we provide case examples for persuasive messages of DTC GT websites and briefly analyze their design with a multi-modal approach to illustrate some of their problematic implications. We observe three main aspects in DTC GT advertising communication: (1) the use of material suggesting medical professional legitimacy as a trust-establishing tool, (2) the suggestion of empowerment as a benefit of using DTC GT services and (3) the narrative of responsibility as a persuasive appeal to a moral self-conception. While strengthening and respecting the autonomy of a patient is the focus in medical communication, specifically genetic counselling, persuasive communication is the normal mode in marketing of consumer goods, presuming an autonomous, rational, independent consumer. This creates tension in the context of DTC GT regarding the expectation and normative assessment of communication strategies. Our analysis can even the ground for a better understanding of ethical problems associated with intersections of medical and commercial communication and point to perspectives of analysis of DTC GT advertising. Una de las estrategias legislativas más extendidas en el ámbito penal es la de establecer límites mínimos y límites máximos para cada delito. De esta manera, al momento de determinar la pena para el caso en concreto, los jueces utilizan estos límites como guías de menor o mayor reproche por la conducta cometida. Entre los elementos en los que se apoyan los jueces para esta determinación se encuentran la culpabilidad del agente al momento de cometer el hecho y la lesividad (...) de su conducta delictiva. Sin embargo, existen ciertos casos en los cuales la pena mínima se muestra desproporcionada con el reproche que merece el agente. En particular, en este trabajo abordaré estas situaciones a fin de reconstruir algunas discusiones existentes en la filosofía jurídica y política. (shrink)
