The survival of the personal copy of Commentary on the Mishnah by Maimonides, which he revised throughout his life, provides an unparalleled window into the ways he continually reconsidered legal and conceptual questions. This manuscript covers five of the six orders of the Mishnah and contains countless corrections and emendations, the vast majority in the author’s own hand. This article argues that Maimonides’s intense interest in solving problems related to the enumeration of the commandments, which he addresses at length in (...) Book of the Commandments and, to a lesser extent, Mishneh Torah, led him to make a number of emendations to his Commentary and to rethink other aspects of his work. That is, when writing Book of the Commandments and Mishneh Torah in the decade after completing his Commentary, Maimonides tackled, and sometimes even concocted, questions that he had no reason to consider in the latter work. This study traces two ways that Maimonides’s later works diverge from his earlier ones, in the meaning of Hebrew and Arabic technical terms and in increased attention to scripture in determing Jewish law, revealing a great medieval mind “in perpetual motion.”. Accounting for the Commandments in Medieval Judaism explores the discursive formation of the commandments as a generative matrix of Jewish thought and life in the posttalmudic period. Each study sheds light on how medieval Jews crafted the commandments out of theretofore underdetermined material. By systematizing, representing, or interrogating the amorphous category of commandment, medieval Jewish authors across both the Islamic and Christian spheres of influence sought to explain, justify, and characterize Israel's legal system, divine revelation, the cosmos, and even the (...) divine order. This volume correlates bodies of knowledge-such as jurisprudence, philosophy, ethics, pietism, and kabbalah-that are normally treated in isolation into a single conversation about a shared constitutional concern. This paper discusses the legal implications of setting up two new biobanks in Belgium. The first is hospital-based and will archive tissue from patients with haematologic cancer, whereas the second is linked to a general practice based morbidity registry and will involve storage of blood samples. To date, Belgium has no specific legislation that regulates storage of human tissue and related databases. Several issues concerning the protection of individuals with regard to the processing of personal medical data are discussed from (...) the existing privacy legislation. We will address the principle of consent (broad versus specific) and the type of data recorded (anonymous, encoded and identifiable) for both biobanks. (shrink)

In this article, the morality in the “wickedness” of design problems as wicked problems is explored. I will use for that purpose the characteristics of wicked problems as identified by Horst Rittel and Melvin Webber. These characteristics suggest interdisciplinary thinking for solving such problems. An awareness of the wicked nature of design problems can stimulate proper use of the concept of utopias for solving these problems. I will use the philosophy of Herman Dooyeweerd to provide a framework for understanding (...) the nature of design problems as wicked problems. (shrink)

The goal of this essay is to assess the Selected-Effects Etiological Theory of biological function, according to which a trait has a function F if and only if it has been selected for F. First, I argue that this approach should be understood as describing the paradigm case of functions, rather than as establishing necessary and sufficient conditions for function possession. I contend that, interpreted in this way, the selected-effects approach can explain two central properties of functions and can satisfactorily (...) address some recent counterexamples. This reading, however, shows that there is only a partial overlap between biological functions and selected effects, so the former cannot be reduced to the latter. Finally, I maintain that this result is still compatible with a naturalistic theory of function that appeals to some evolutionary process. (shrink)

Recent research on bacteria and other microorganisms has provided interesting insights into the nature of life, cooperation, evolution, individuality or species. In this paper, I focus on the capacity of bacteria to produce molecules that are usually classified as ’signals’ and I defend two claims. First, I argue that certain interactions between bacteria should actually qualify as genuine forms of communication. Second, I use this case study to revise our general theories of signaling. Ouija board sessions are illustrious examples of how subjective feelings of control – the Sense of Agency - can be manipulated in real life settings. We present findings from a field experiment at a paranormal conference, where Ouija enthusiasts were equipped with eye trackers while using the Ouija board. Our results show that participants have a significantly lower probability at visually predicting letters in a Ouija board session compared to a condition in which they are instructed to deliberately spell out (...) words with the Ouija board planchette. Our results also show that Ouija board believers report lower SoA compared to sceptic participants. These results support previous research which claim that low sense of agency is caused by a combination of retrospective inference and an inhibition of predictive processes. Our results show that users in Ouija board sessions become increasingly better at predicting letters as responses unfold over time, and that meaningful responses from the Ouija board can only be accounted for when considering interactions that goes on at the participant pair level. These results suggest that meaningful responses from the Ouija board may be an emergent property of interacting and predicting minds that increasingly impose structure on initially random events in Ouija sessions. Societal polarization has given rise to opposing groups that fight each other as enemies and that have very different ideas about what should be done and about what is the case. This article investigates what tools there are in the philosophy of Martin Buber to address this societal polarization. Buber’s notion of community, the relationship between means and ends, his opposition to the political principle, the notion of an (...) I-Thou dialogue and his conception of truth are presented as relevant for overcoming societal polarization. Why do physicians have financial conflicts of interest? They arise because society expects physicians to act in their patients’ interest, while simultaneously, financial incentives encourage physicians to practice medicine in ways that promote their own interests or those of third parties. Because physicians’ clinical choices, referrals, and prescriptions affect the fortune of third parties, these third parties may offer physicians financial incentives to make income-driven clinical choices. In the past, physicians and scholars typically conceived of conflicts of interest as an (...) ethical issue to be resolved according to individual judgment or professional and organizational norms. However, society can mitigate or eliminate conflicts of interest by changing financial and organizational arrangements in medicine. The federal government indirectly subsidizes the pharmaceutical industry by funding basic research, various tax credits and deductions, patent rules, grants of market exclusivity, and other means, in order to spur drug development, promote public health, and improve medical care. But today, the pharmaceutical industry often neglects these goals and sometimes even undermines them, due to what Lawrence Lessig refers to as institutional corruption — that is, widespread or systemic practices, usually legal, that undermine an institution’s objectives or integrity. A key (...) source of institutional corruption is improper dependence by the institution or its key actors on the actions of third parties that have fundamentally different interests. In the course of legal reasoning—whether for purposes of deciding an issue, justifying a decision, predicting how an issue will be decided, or arguing for how it should be decided—one often is required to reach conclusions based on a balance of reasons that is not straightforwardly reducible to the application of rules. Recent AI and Law work has modeled reason-balancing, both within and across cases, with set-theoretic and rule- or value-ordering approaches. This paper distinguishes an index ordering and a social ordering function as a simple way to formalize the indexing problem in the social choice framework. Two main conclusions are derived. First, the alleged dilemma between welfarism and perfectionism is shown to involve a third possibility, exemplified by the fairness approach to social choice. Second, the idea that an individual is better off than another whenever he has more (goods, functionings, etc.) in all dimensions, which is known to enter in conflict (...) with the Pareto principle, can be partly salvaged by adopting the fairness approach. Par ailleurs, sa théorie métaphysique de la substance individuelle incluant tous ses prédicats implique l’existence dans le sujet de « traces du futur », symétriques des traces du passé. L’objectif de l’article est d’étudier le rapport complexe entre anticipations de l’avenir et traces du futur, et, plus généralement, entre les déterminations psychologiques et métaphysiques des petites perceptions.
