The Catholic Church proscribes methods of birth control other than sexual abstinence. Although the U.S. Food and Drug Administration (FDA) recognizes abstinence as an acceptable method of birth control in research studies, some pharmaceutical companies mandate the use of artificial contraceptive techniques to avoid pregnancy as a condition for participation in their studies. These requirements are unacceptable at Catholic health care institutions, leading to conflicts among institutional review boards, clinical investigators, and sponsors. Subjects may feel coerced by such mandates to (...) adopt contraceptive techniques inconsistent with their personal situation and beliefs; women committed to celibacy or who engage exclusively in non-heterosexual activities are negatively impacted. We propose principles to insure informed consent to safeguard the rights of research subjects at Catholic institutions while mitigating this ethical conflict. At the same time, our proposal respects the interests of pharmaceutical research agencies and Catholic moral precepts, and fully abides by regulatory guidance. (shrink)

This paper is concerned with the problem of selfidentification in the domain of action. We claim that this problem can arise not just for the self as object, but also for the self as subject in the ascription of agency. We discuss and evaluate some proposals concerning the mechanisms involved in selfidentification and in agencyascription, and their possible impairments in pathological cases. We argue in favor of a simulation hypothesis that claims that actions, whether overt or covert, are centrally simulated (...) by the neural network, and that this simulation provides the basis for action recognition and attribution. Cet article a deux objectifs. Le premier est de montrer pourquoi l’argument instrumental en faveur de la démocratie est insuffisant pour justifier la délibération politique. Si notre but est l’optimisation du potentiel épistémique d’un régime politique, et que des approches agrégatives et inférentielles (sans délibération) atteignent cet objectif, alors nous ne pouvons plus justifier la délibération sur cette base. Ce problème peut être contourné en reprenant une distinction de Daniel Andler. Pour ce dernier, le groupe délibératif se distingue du groupe (...) agrégatif parce qu’il permet aux agents, par une occasion éducative informelle, de se responsabiliser. La délibération présente donc un potentiel épistémique supérieur, mais qui ne se limite pas à identifier la meilleure réponse dans un temps donné. Le second objectif de l’article est de montrer comme l’argument d’Andler fait le pont entre, d’une part, les théories de la justification publique et, d’autre part, les théories de la démocratie épistémique. This paper argues that Rawls’ principles of justice provide a normative foundation for stakeholder theory. The principles articulate (at an abstract level) citizens’ rights; these rights create interests across all aspects of society, including in the space of economic activity; and therefore, stakeholders – as citizens – have legitimate interests in the space of economic activity. This approach to stakeholder theory suggests a political interpretation of Boatright’s Moral Market approach, one that emphasizes the rights/place of citizens. And this approach to (...) stakeholder theory – in terms of citizens – raises a further question, what rights and obligations do economic agents have, beyond those attached to their roles as citizens? Rawls would reject additional rights and obligations of this sort for two reasons, one tied to freedom and one tied to pluralism. Rawls’ work therefore presses us to re-conceptualize the place of ethical claims in the economic context. (shrink)

How do humans discover causal relations when the effect is not immediately observable? Previous experiments have uniformly demonstrated detrimental effects of outcome delays on causal induction. These findings seem to conflict with everyday causal cognition, where humans can apparently identify long-term causal relations with relative ease. Three experiments investigated whether the influence of delay on adult human causal judgements is mediated by experimentally induced assumptions about the timeframe of the causal relation in question, as suggested by Einhorn and Hogarth (1986). (...) Causal judgements generally decreased when a delay separated cause and effect. This decrease was less pronounced when the thematic context of the causal relation induced participants to expect a delay. Experiment 3 ruled out an alternative explanation of the effect based on variations of cue and outcome saliencies, and showed that detrimental effects of delay are reduced even more when instructions explicitly mentioned the timeframe of the causal relation in question. Knowledge thus mediates the impact of delay on human causal judgement. Implications for contemporary theories of human causal induction are discussed. (shrink)

Cet article poursuit la réflexion de Dilhac (2014) touchant la relation entre politique et vérité. Au terme d’une analyse de la tolérance chez Mill et Popper, Dilhac conclut qu’une conception épistémique de la tolérance manque sa dimension politique, et qu’il est préférable d’opter pour le concept rawlsien de consensus raisonnable. Discutant ces résultats, le premier objectif est ici de montrer qu’une notion de « raisonnabilité » peut facilement trouver ses racines dans la neutralité scientifique wébérienne, et donc être porteuse d’une (...) dimension épistémique minimale. Le second objectif est de clarifier l’impact de cet argument particulier sur le débat général entourant la démocratie épistémique. Il sera défendu que l’opposition traditionnelle entre les conceptions épistémique et politique de la délibération est à trouver dans un certain perfectionnisme épistémique, mais qu’il existe au moins une conception minimale du potentiel épistémique tout à fait compatible avec les valeurs fondamentales du libéralisme, comme l’inclusion, l’égalité ou la diversité. Alethic functionalism, as propounded by Michael Lynch, is the view that there are different ways to be true, but that these differences nevertheless contain enough unity to forestall outright pluralism. This view has many virtues. Yet, since one could conceivably apply Lynch’s “one and many” strategy to other debates, I try to show how his argumentative steps can be used to solve — not just the controversy pertaining to truth — but any controversy that surrounds a “What is X?” question.

This book is the first comprehensive examination of the psychological development of deaf children. Because the majority of young deaf children are reared in language-impoverished environments, their social and cognitive development may differ markedly from hearing children. The author here details those potential differences, giving special attention to how the psychological development of deaf children is affected by their interpersonal communication with parents, peers, and teachers. This careful and balanced consideration of existing evidence and research provides a new psychological perspective (...) on deaf children and deafness while debunking a number of popular notions about the hearing impaired. In light of recent findings concerning manual communication, parent-child interactions, and intellectual and academic assessments of hearing-impaired children, the author has forged an integrated understanding of social, language, and cognitive development as they are affected by childhood deafness. Empirical evaluations of deaf children's intellectual and academic abilities are stressed throughout. In this article we present a new experimental paradigm: comparative visual search. Each half of a display contains simple geometrical objects of three different colors and forms. The two display halves are identical except for one object mismatched in either color or form. The subject's task is to find this mismatch. We illustrate the potential of this paradigm for investigating the underlying complex processes of perception and cognition by means of an eye‐tracking study. Three possible search strategies are outlined, discussed, (...) and reexamined on the basis of experimental results. Each strategy is characterized by the way it partitions the field of objects into “chunks.” These strategies are: (i) Stimulus‐wise scanning with minimization of total scan path length (a “traveling salesman” strategy), (ii) scanning of the objects in fixed‐size areas (a “searchlight” strategy), and (iii) scanning of object sets based on variably sized clusters defined by object density and heterogeneity (a “clustering” strategy). To elucidate the processes underlying comparative visual search, we introduce besides object density a new entropy‐based measure for object heterogeneity. The effects of local density and entropy on several basic and derived eye‐movement variables clearly rule out the traveling salesman strategy, but are most compatible with the clustering strategy. Contemporary design practices, such as participatory design, human-centered design, and codesign, have inherent ethical qualities, which often remain implicit and unexamined. Three design projects in the high-tech industry were studied using three ethical traditions as lenses. Virtue ethics helped to understand cooperation, curiosity, creativity, and empowerment as virtues that people in PD need to cultivate, so that they can engage, for example, in mutual learning and collaborative prototyping. Ethics of alterity helped to understand human-centered design as a fragile encounter between (...) project team members and prospective users, and foregrounds the ethics in these encounters: our tendencies to “grasp the other” and to “program invention.” And pragmatist ethics helped to understand codesign as a process of joint inquiry and imagination, involving the organization of iterative processes of problem setting and solution finding, with moral qualities. When we open the “black boxes” of design practices, we find them filled with ethics. Moreover, it is proposed that design practitioners need to make explicit their practices’ inherent ethical qualities and that they can do that by embracing reflexivity. (shrink)

Existe-t-il une chose de tel qu'une conception herméneutique du langage? C'est à cette question que cet ouvrage se propose de répondre, de façon positive, en opérant une mise en dialogue des herméneutiques de Hans-Georg Gadamer et Paul Ricoeur. Malgré les différences indéniables entre les oeuvres de ces deux philosophes, l'auteur montre qu'elles ont en commun de penser le langage comme étant un principe fondamental de notre expérience du monde et de tout événement de compréhension. Une articulation entre les deux oeuvres, (...) qui mise sur une dialectique entre les notions d'appartenance et de distanciation, est possible à partir de cet accord de fond sur notre appartenance essentielle au langage. De ce point de vue, tout effort pour mettre à distance le langage afin d'en faire un objet d'étude doit tenir compte du caractère premier et irréductible de cette appartenance, s'il veut éviter de n'offrir qu'une vision réductrice du langage. Comme le révèlent les analyses de ce livre, les recherches de Gadamer et Ricoeur se caractérisent par la prise en compte de ce fait dans leurs réflexions sur le dialogue, le texte et la traduction, ainsi que dans leurs travaux sur la puissance créatrice du langage qui se manifeste dans la métaphore, le dire poétique et le récit. Cependant, le plus important pour l'herméneutique est que cette appartenance fondamentale ne soit pas synonyme d'un enfermement dans le langage, mais que le langage offre au contraire une ouverture sur l'être et permette à ce qui est de se dire et de se penser. Regularity theories of causation are guided by the idea that causes are collectively sufficient for their effects. Following Mackie [1974], that idea is typically refined to distinguish collections that include redundant members from those that do not. Causes must be collectively sufficient for their effects without redundancy. While Mackie was surely right that the regularity theory must distinguish collections that are in some sense minimally sufficient for an effect from those that include unnecessary hangers-on, I believe that redundancy is the (...) wrong mark of that distinction. I propose a way to develop the regularity theory without it. Instead of distinguishing minimal from mere sufficiency in terms of redundancy, we should look to the influence that events have in the world. Causes, so construed, must have just enough collective influence to ensure that an effect occurs. Whereas classic work in judgment and decision making has focused on the deviation of intuition from rationality, more recent research has focused on the performance of intuition in real-world environments. Borrowing from both approaches, we investigate to which extent competing models of intuitive probabilistic decision making overlap with choices according to the axioms of probability theory and how accurate those models can be expected to perform in real-world environments. Specifically, we assessed to which extent heuristics, models implementing weighted additive information (...) integration (WADD), and the parallel constraint satisfaction (PCS) network model approximate the Bayesian solution and how often they lead to correct decisions in a probabilistic decision task. PCS and WADD outperform simple heuristics on both criteria with an approximation of 88.8% and a performance of 73.7%. Results are discussed in the light of selection of intuitive processes by reinforcement learning. (shrink)

Globalization is a ubiquitousyet highly elusive term. The debate on the cont and meaning of globalization is still waged largely in binary terms; for example, globalization is understood either as increasing standardization or as increasing difference. This article argues that the effects of globalization are best understood in terms of the following three sets of simultaneous contradictions: convergence and divergence, inclusion and exclusion, and centralization and decentralization. These contradictions can be fruitfully “unpacked” and examined through critical stakeholder analysis (CSA). This (...) technique focuses on broader structural commonalties and differences among key stakeholder groups, factors that are not incorporated in mainstream stakeholder theory. The associated normative agenda of CSA promotes a common understanding of key issues within a focal organizational field, the negotiated settlement of zero-sum situations that optimize collective stakeholder interests within that field, and the containment and minimization of negative externalities within as well as between fields. The sociology of emotions is a fast-growing disciplinary field. Research on emotions has enabled major advances in medical science, political science, anthropology, psychosociology etc. Turner and Smets have shown that social relations feature a kernel of phenomena with an emotional substrate ranging from face-to-face encounters to the emergence of social movements. The social arena is shaped by emotions, which are powerful agents of change. In this paper, we focus on the links between emotions, happiness and well-being apprehended as a polymorphic (...) state culturally determined by an emotional substrate. Finally, through the lenses of emotions, we sketch out the features of the structural crisis of neoliberalism and the lessons for a renewed understanding of the underlying socio-economic phenomena. Serious concerns about pervasive, persistent, and unjustified social inequalities have prompted a small—but growing—number of academic commentators to raise some hard and troubling questions for those who would like to legalize physician-assisted suicide. In various ways, these commentators have asked: In light of existing social inequalities—inequalities that operate, for example, along sometimes intersecting lines of race, class, age, sex, and disability—how persuasive are autonomy-based arguments in favor of legalization of assisted suicide when those arguments depend on a conception of autonomy (...) that either presupposes social equality or does not expressly account for its absence? How compelling are arguments that we ought to legalize assisted suicide out of feelings of mercy for the sick and dying, when such affective expressions may actually be the socially acceptable manifestation of private ambivalence that includes merciless discrimination? In order for the valuable research published in the Anthropology of Consciousness (AoC) journal to have the impact it ought to have upon the anthropological mainstream, contributors must demonstrate that they appreciate the historical tradition of anthropology as an intellectual forebear. Although “ethnometaphysics” has been cited sporadically by anthropologists over the past half-century, it never really caught on as an interdisciplinary speciality like ethnobotany, ethnomusicology, and ethnomathematics. Pointing to the example of discord in the West between viewing psychoactive substances as (...) either “hallucinogens” or “entheogens,” I reassert ethnometaphysics in an aim to revamp the overlooked coining of this sub-field by anthropologist A. Irving Hallowell. Such a position rebrands SAC's alternative outlook in a way that could be seen by mainstream colleagues as less radical, thus giving the Society a more realistic opportunity to provoke progressive changes in the mainstream of our discipline. Dispositional accounts of various phenomena have claimed that dispositions can be intrinsically masked. In cases of intrinsic masking, something has a disposition while also having an intrinsic property that would prevent that disposition from manifesting in the face of its stimulus. This paper develops a theory of disposition ascriptions capable of recognizing such dispositions. The theory is modeled on the view that dispositions are powers. I propose that having a disposition is a matter of exerting a corresponding kind of influence. (...) Unlike powers theories, however, the account largely falls silent on questions of fundamental metaphysics. It does not build dispositions into fundamental ontology, posit necessary connections between properties, or otherwise appeal to sui generis modality. (shrink)

Ausgehend von Husserls Überlegungen zur passiven Synthesis und Merleau-Ponty’s Anmerkungen zur allgemeinen Synästhesie leiblicher Erfahrungen fragen die Autoren nach den Implikationen des Einsatzes von AR. Es werden drei Einwände vorgebracht, die diesen problematisch werden lassen: 1) das Problem der künstlichen Transformation von Umwelt, 2) das Problem der leiblichen Wahrnehmung durch Bevorzugung visueller Eindrücke und 3) die Unterdrückung emergenter Zugänge zu Welt zugunsten einer präformierten Aufmerksamkeitsstrukturierung. Vorbehalte für pädagogische Anwendungen (...) ergeben sich dann aus der limierten Responsivität, der Fixiertheit des Lerngegenstands und dem Vorrang der Medialisierung vor der Auseinandersetzung mit dem Gegenstand, wie unter Bezug auf die phänomenologische Theorie des Lernens und der Negativität deutlich wird. On a l’habitude de lire dans Antigone l’histoire d’un conflit entre d’un côté l’expression des liens affectifs et de la piété, et de l’autre les prérogatives de l’État dont le but premier serait le maintien des institutions. D’un côté Antigone fidèle à son frère, de l’autre Créon attaché à sa Cité. D’un côté la morale de l’affectivité ou de la conviction (Gesinnungsethik), de l’autre la morale de la responsabilité (Verantwortungsethik), pour parler comme Max Weber. Cette lecture classique de la tragédie (...) demeure sans doute pertinente à bien des égards, mais traduit-elle l’essentiel? Et si l’intention du poète n’avait pas été d’en rester à cette confrontation mais de suggérer, par-delà l’affrontement ruineux, une troisième voie possible? Il n’y aurait plus alors deux termes seulement, le privé et le public que tout sépare, mais deux manières pour l’ordre public lui-même de se rapporter au privé, l’une conflictuelle et tyrannique, celle de Créon, l’autre conciliatrice et délibérative – démocratique en ce sens –, celle défendue par Hémon, par Tirésias, et finalement peut-être par Sophocle lui-même qui, par l’emploi d’un vocabulaire tiré de l’expérience politique athénienne, dénoue d’une main l’intrigue qu’il noue de l’autre. In a recent article in this journal, Remsen attacked moral objections to killing birds for museum collections, objections that are frequently raised by the general public and scientific community alike. The only grounds for moral objections against killing birds that Remsen considers and rejects are reverence for all life or personal, that is sentimental reasons. What Remsen ignores is avian sentience and the moral imperative of respecting it.

The expression “République des lettress” is still used today. It appears in most recent dictionaries of the French language, and it even occasionally occurs in ordinary conversation or in the press, a pompous and ironic circumlocution to designate the Parisian literary “milieu.” This archaistic and pejorative survival masks (somewhat similarly to the word “rhetoric”) the attention that researchers are now according to the older meaning of this surviving expression, and to the concept of an international exchange of ideas that it (...) represented for scholars of the Ancien Régime. As proof that this scientific interest is recent, Paul Hazard, in the famous Crise de la conscience européenne (1936), devotes not a single line to the “Republic of Letters,” while in the chapter dealing with Pierre Bayle he cites the “Nouvelles de la République des Lettres” (1684), the learned periodical published in Amsterdam by this erudite Calvinist, apparently without feeling a need to explain a title that seemed self-evident. For the history of ideas, this notion was not a subject for history. It resided outside the field of perception of a discipline that was completely devoted to a sort of chemistry of pure ideas, removed from the literary form that carried them, and a fortiori from institutional circuits, and forms of sociability and dialogue that “invent” and spread them, and even more so from the awareness that “scholars” might have had of the solidarity that united them and of the meaning they might be able to attribute to it. Two decades ago Benedict Anderson commented that "'the end of the era of nationalism,' so long prophesied, is not remotely in sight" [IC 3], and the intervening (...) years have made it increasingly clear that the developments and processes we summarize as "globalization" operate in mingled synchrony and tension with the political form of the nation-state. 1 That the nation-state should remain the premier vehicle of political and economic legitimation in an era dominated by American imperialism and international capital--forces that, of course, regularly and flagrantly violate the sovereignty of disadvantaged nations--is unsurprising if one accepts the continuing pertinency and power of a Western master-narrative of modernity, according to which the nation represents the emergence of a people into history and prefigures the global achievement of universal human concord. As the proper subject of history, the nation-state can prefigure history's end because, as David Lloyd writes, "the particularism of [nationalism's] contents, potentially in contradiction with the universalism of modernity, is subsumed in the formal congruence between its own narratives of identity, directed at one people, and the narrative of identity that universal history represents for humanity in general" ["Nationalisms" 178]. Lloyd goes on to note that the nation's intermediate status in this narrative--halfway between primitive tribalism and modernity's ever-deferred perpetual peace--accounts for nationalism's irreducibly double association with modernization and atavism. In consequence, the modernist paradigm continues to rule many skeptical or hostile accounts of nationalism, for so long as the nation-state is taken to supersede other political or social formations, the cosmopolitan critique fails to challenge "the fundamental philosophy of universal history that underwrites nationalism's inscription in modernity" ["Nationalisms" 177]. Indeed, both in the corporate media and in mainstream Western political discourse generally, nations and nationalisms are commonly treated as atavistic or progressive depending on the degree to which their behavior harmonizes with globalizing imperatives. That these imperatives emanate quite blatantly from Wall Street in no way seriously troubles the effectiveness of modernity as a narrative paradigm. 2Seeking to discredit universalizing narrative, much cultural criticism in recent years has exchanged cosmopolitanism and the abstract question of "nationalism" for an emphasis [End Page 58] on the contextual construction of national movements or identities. 3 This valuable body of work has sought to recover the particularity of cultural and socioeconomic circumstance, stressed the fundamental role of racism in colonialist contexts, and noted ways in which nationalist movements draw on or unleash forms of resistance that challenge representationalist politics. The pages that follow, however, remain focused on the nationalist fantasy proper to the discourse of modernity. Cultural critique can only profit from knowing as much as possible about the favored turns of the universal-historicist model, particularly since, as Lloyd and others have emphasized, this model is an aesthetic one that grants a world-historical role to "culture." The state, in a tradition that in its main lines runs from Schiller through Hegel and Matthew Arnold and is still very much alive today, represents the community to itself, thereby giving the community form and in a certain sense giving it an ethical imperative and a future: the state represents "our best self" [Arnold 99, passim], "the archetype of a human being" [Schiller 17], because it signifies the formal unification both of the citizen with the community and of the community with universal humanity. Because this unification is ideal rather than actual, it can be projected as the ethical terminus of history (that is, as the ideal of an accomplished modernity). In Becoming Nonviolent Peacemakers, Eli Sasaran McCarthy seeks to disrupt any complacency Americans and our representative leadership might have with these ethical approaches. Drawing on well-reasoned philosophical arguments and the witness of paradigmatic figures, McCarthy builds a case for public policies of nonviolent peacemaking created from and analyzed through the framework of virtue ethics. Such policies, he posits, would not only achieve a more comprehensive agenda of peacemaking but would also approach more closely the vision of Dr. Martin Luther King Jr.'s "Beloved Community."McCarthy's project is ambitious and multifaceted. He sets out to synthesize critiques of prevailing rule- and strategy-based assessments of nonviolent [End Page 204] peacemaking, making proposals for a virtue-based assessment from Christian, Hindu, and Muslim sources as well as with the best contributions of human rights theory in order to supplement a virtue approach. At the outset he states, "My thesis is that a virtue-based assessment of nonviolent peacemaking enhanced by aspects of human rights discourse largely resolves key limits of rule-based and strategy-based assessments of nonviolent peacemaking for public discourse and policy" (2). To prove this, he grapples with influential scholars on the subject, such as James Childress and Gene Sharp, to show how deontology and consequentialism too narrowly constrain the vision of what nonviolent peacemaking can achieve, both in effect and the formation of agents' character. Addressing the work of Bernard Häring, Stanley Hauerwas, and Lisa Sowle Cahill, he brings the fruit of Christian theological ethics to bear on the advantages of a virtue-based assessment of nonviolence. Though that is significant enough, McCarthy also presents the life and work of both Mahatma Gandhi and Abdul Ghaffar Khan to demonstrate the consonance of a virtue approach even across cultural and religious lines. He finally plots a way forward using the best of rights theory and virtue theory to show how nonviolent peacemaking fulfills the Catholic social tradition's vision of human dignity and the common good.McCarthy lends much to the argument that "we ought to consider nonviolent peacemaking a distinct virtue rather than merely subsuming it in the paradigmatic actions of other virtues" (75). One can hope McCarthy's continued research yields not only more case studies that invite creative problem-solving through the virtue of nonviolent peacemaking but also a book-length study that challenges US domestic policy as successfully as his investigation of US foreign policy here.
