First published in 1917 and 1918, with a second edition in 1946, this is the first English translation of Santi Romano's classic work, L'ordinamento giuridico. The main focus of The Legal Order is the notion of institution, which Romano considers to be both the core and distinguishing feature of law. After criticising accounts of the nature of law centred on notions of rule, coercion or authority, he offers a compelling conception, not merely of law as an institution, but of (...) the institution as 'the first, original and essential manifestation of law'. Romano advances a definition of a legal institution as any group who share rules within a bounded context: for example, a family, a firm, a factory, a prison, an association, a church, an illegal organisation, a state, the community of states, and so on. Therefore, this understanding of legal institutionalism at the same time provides a ground-breaking theory of legal pluralism whereby 'there are as many legal orders as institutions'. The acme of a jurisprudential current long overlooked in the Anglophone environment, The Legal Order not only proposes what Carl Schmitt described as a 'very significant theory', but, more importantly, it offers precious insights for a thorough rethinking of the relationship between law and society in today's world. Why are mistaken beliefs about COVID-19 so prevalent? Political identity, education and other demographic variables explain only part of the differences between people in their susceptibility to COVID-19 misinformation. This paper focuses on another explanation: epistemic vice. Epistemic vices are character traits that interfere with acquiring, maintaining, and transmitting knowledge. If the basic assumption of vice epistemology is right, then people with epistemic vices such as indifference to the truth or rigidity in their belief structures will tend to be more (...) susceptible to believing COVID-19 misinformation. We carried out an observational study (US adult sample, n = 998) in which we measured the level of epistemic vice of participants using a novel Epistemic Vice Scale that captures features of the current competing analyses of epistemic vice in the literature. We also asked participants questions eliciting the extent to which they subscribe to myths and misinformation about COVID-19. We find overwhelming evidence to the effect that epistemic vice is associated with susceptibility to COVID-19 misinformation. In fact, the association turns out to be stronger than with political identity, educational attainment, scores on the Cognitive Reflection Test, personality, dogmatism, and need for closure. We conclude that this offers evidence in favor of the empirical presuppositions of vice epistemology. (shrink)

Human social life is structured by social norms creating both obligations and entitlements. Recent research has found that young children enforce simple obligations against norm violators by protesting. It is not known, however, whether they understand entitlements in the sense that they will actively object to a second party attempting to interfere in something that a third party is entitled to do — what we call counter-protest. In two studies, we found that 3-year-old children understand when a person is entitled (...) to do something, and so they actively defend this person’s entitlement against unjustified interference from second parties. In some cases, they even enforce second-order entitlements, for example, in the case of ownership where an owner is entitled to entitle others to use the owner’s property. (shrink)

El presente artículo analiza el concepto de Diferencia en la filosofía de Gilles Deleuze. Se constata, en este sentido, que la dicotomía inmanencia-trascendencia juega un papel protagónico en la articulación de dicha propuesta. Si bien un plano de composición inmanente no entra en una dialéctica negativa de tipo hegeliano respecto a un plano de organización trascendente, la primacía del primero resulta evidente en la conceptualización de la diferencia. Así, analizaremos las tensiones generadas por dicho enfoque en lo concerniente al despliegue (...) de la diferencia como razón suficiente en un plano inmanente, lo cual nos llevará a problematizar este concepto desde un plano diferente; a saber, un plano inminente que emerge de forma silenciosa en el último trabajo de Gilles Deleuze. Prendendo le mosse dall’esame del ciclo pianistico Quatre études de rythme, di Olivier Messiaen , scritto fra il 1949 e il 1950, l’articolo delinea un sintetico confronto fra due differenti espressioni dell’arte musicale. Da un lato una composizione della metà del Novecento: repertorio profano, strumentale, frutto di concezioni individuali, testimonianza della fase post-tonale del pensiero musicale. Dall’altro la monodia gregoriana: repertorio sacro, vocale, anonimo, che esprime concetti formali pre-tonali. Occasione di tale raffronto è l’indagine sulla portata concettuale e tecnica di (...) termini chiave come “modo” e “neuma”, che Messiaen mutua dalla teoria musicale medioevale facendone oggetto di riflessione teorica e principio di concezioni tecniche. L’articolo tenta di sondare la complessa trama di rapporti mediante la quale due espressioni artistiche apparentemente agli antipodi entrano in contatto e si illuminano a vicenda. Expanding on the study of the piano cycle Quatre Études de Rythme by Olivier Messiaen , composed in 1949–1950, this article provides a brief comparison between two different expressions of art music. On the one hand we have a composition dating back to the mid-1900s: profane instrumental music, the result of individual conceptions, bearing witness to the post-tonal development in musical thought. On the other, Gregorian monody: sacred vocal music, anonymous, expressing formal pre-tonal concepts. This comparison is developed by looking at the conceptual and technical meaning of key terms, such as “mode” and “neume”, which Messiaen turned from Mediaeval musical theory into subjects for theoretical reflection and a principle of technical conceptions. The article sets out to discuss their complex inter-relationships whereby these two artistic, seemingly opposing, expressions converge and are thus reciprocally enhanced. (shrink)

Are concepts stable entities, unchanged from context to context? Or rather are they context-dependent structures, created on the fly? We argue that this does not constitute a genuine dilemma. Our main thesis is that the more a pattern of features is general and shared, the more it qualifies as a concept. Contextualists have not shown that conceptual structures lack a stable, general core, acting as an attractor on idiosyncratic information. What they have done instead is to give a contribution to (...) the comprehension of how conceptual structure organized around such a stable core can produce contextually appropriate representations on demand. The conventional interpretation that Pierre Duhem condemned outright any type of thought experiment in Ernst Mach’s sense should be, at least in large part, rejected. Although Duhem placed particular emphasis on the perils of thought experiments that Mach had overlooked or at least underestimated, he retained the core idea of Mach’s theory, according to which thought experiments cannot break free from the ultimate authority of real-world experiments. This similarity between Duhem’s and Mach’s views about thought experiments is not the only (...) one. Just as there was in Duhem’s criticism of “expériences fictives” a tendency leading him to give voice to one of Mach’s basic empiricist claims, so also there was in Mach’s interpretation of thought experiments a tendency in the direction of Duhem’s conventionalism. If Mach’s and Duhem’s conceptions of thought experiments are compared, there results an importantly similar, although not identical, tension that should properly be taken into account in the more general comparison between Mach and Duhem. In considering what it means to lead organizations effectively and ethically, the literature comprising spirituality at work and spiritual leadership theory has become highly influential, especially in the USA. It has also attracted significant criticism. While in this paper, we endorse this critique, we argue that the strand of literature which purportedly takes a Christian standpoint within the wider SAW school of thought, largely misconstrues and misapplies the teaching of its founder, Jesus. As a result, in dismissing the claims and (...) application of SAW and SLT, there is a real risk that we lose the vital contribution of Christian thought, not least some of the timeless counter-cultural wisdom of Jesus which, we contend, offers a vital foundation to the practice of ethical leadership and business ethics in organizations. In proposing a way forward, two thorny issues which face all leaders are addressed: dealing with ego and closing the gap between what we say and what we do. The more we understand about the dynamics of human nature, the more we learn about the profundity of Jesus’ teachings. We then propose a number of ways in which Jesus-centred ethical leadership can be practised. Each is radical and each implies risk: both the personal risk of inner renewal arising from repentance as a doorway to personal integrity, as well as the risk of opposing unethical practices and promoting the excellence of core practices in the workplace. The standard view of classical cognitive science stated that cognition consists in the manipulation of language-like structures according to formal rules. Since cognition is ‘linguistic’ in itself, according to this view language is just a complex communication system and does not influence cognitive processes in any substantial way. This view has been criticized from several perspectives and a new framework (Embodied Cognition) has emerged that considers cognitive processes as non-symbolic and heavily dependent on the dynamical interactions between the cognitive system (...) and its environment. But notwithstanding the successes of the embodied cognitive science in explaining low-level cognitive behaviors, it is still not clear whether and how it can scale up for explaining high-level cognition. In this paper we argue that this can be done by considering the role of language as a cognitive tool: i.e. how language transforms basic cognitive functions in the high-level functions that are characteristic of human cognition. In order to do that, we review some computational models that substantiate this view with respect to categorization and memory. Since these models are based on a very rudimentary form of non-syntactic ‘language’ we argue that the use of language as a cognitive tool might have been an early discovery in hominid evolution, and might have played a substantial role in the evolution of language itself. In their attempt to connect the workings of the human mind with their neural realizers, cognitive neuroscientists often bracket out individual differences to build a single, abstract model that purportedly represents (almost) every human being’s brain. In this paper I first examine the rationale behind this model, which I call ‘Platonic Brain Model’. Then I argue that it is to be surpassed in favor of multiple models allowing for patterned inter-individual differences. I introduce the debate on legitimate (and illegitimate) ways (...) of mapping neural structures and cognitive functions, endorsing a view according to which function-structure mapping is context-sensitive. Building on the discussion of the ongoing debate on the function(s) of the so-called Fusiform “Face” Area, I show the necessity of indexing function-structure mappings to some populations of subjects, clustered on the basis of factors such as their expertise in a given domain. Physical inactivity and coronavirus disease 2019 signify two pandemics with negative physical, mental, and economic consequences. Younger and older people have not reached the recommended physical activity level for years. Societal restrictions due to COVID-19 additionally reduce opportunities for physical activity, and they increase social isolation. Here, we outline how playing exergames with others at home could foster physical and mental health and promote communication and discussions on exergaming. Accordingly, we highlight the educational and social benefits of exergaming at home (...) and delineate the concept of Educational and Social Exergaming. We outline specific benefits and pitfalls of exergaming regarding its physical and nonphysical effects, including educational values of discussing exergaming experiences and related topics. Moreover, we discuss the relevance of practical guidelines for educational and social exergaming at home as well as prospects for future research. Overall, educational and social exergaming could alleviate several detrimental effects of both pandemics on the health and well-being of people of all ages. (shrink)

Il lavoro esamina criticamente i presupposti di cinque differenti approcci alla Scienza Cognitiva, (simbolico, connessionista, dinamico, della cognizione incarnata e della vita artificiale) e sostiene che tutti e cinque condividono tacitamente un’ipotesi metodologica molto generale. Tale ipotesi, che propongo di chiamare simulazionismo , postula che i fenomeni cognitivi di un qualunque sistema reale possono essere adeguatamente spiegati sulla base di opportuni modelli di simulazione del sistema stesso. Tuttavia, a causa della loro costituzione, i modelli di simulazione hanno forti limitazioni, sia (...) al livello descrittivo che esplicativo. Il limite descrittivo sta nel fatto che la corrispondenza fra i risultati di una simulazione e i dati relativi al fenomeno reale non è diretta e intrinseca ma, al più, indiretta e estrinseca. Il limite esplicativo consiste nel fatto che le spiegazioni supportate dal modello non sono mai compiute e realistiche ma, piuttosto, solo in linea di principio e romanzesche. Queste difficoltà potrebbero essere superate ricorrendo ai modelli Galileiani , costituiti da sistemi dinamici in cui ciascuna componente ha un’interpretazione precisa e definita, in quanto essa corrisponde ad una proprietà misurabile (grandezza) del fenomeno reale che il modello descrive. Humans have been using fire for hundreds of millennia, creating an ancestral expansion toward the nocturnal niche. The new adaptive challenges faced at night were recurrent enough to amplify existing psychological variation in our species. Night-time is dangerous and mysterious, so it selects for individuals with higher tendencies for paranoia, risk-taking, and sociability. During night-time, individuals are generally tired and show decreased self-control and increased impulsive behaviors. The lower visibility during night-time favors the partial concealment of identity and opens more (...) opportunities for disinhibition of self-interested behaviors. Indeed, individuals with an evening-oriented chronotype are more paranoid, risk-taking, extraverted, impulsive, promiscuous, and have higher antisocial personality traits. However, under some circumstances, such as respiratory pandemics, the psychobehavioral traits favored by the nocturnal niche might be counter-productive, increasing contagion rates of a disease that can evade the behavioral immune system because its disease cues are often nonexistent or mild. The eveningness epidemiological liability hypothesis presented here suggests that during the COVID-19 pandemic, the evening-oriented psychobehavioral profile can have collectively harmful consequences: there is a clash of core tendencies between the nocturnal chronotype and the recent viral transmission-mitigating safety guidelines and rules. The pandemic safety protocols disrupt much normal social activity, particularly at night when making new social contacts is desired. The SARS-CoV-2 virus is contagious even in presymptomatic and asymptomatic individuals, which enables it to mostly evade our evolved contagious disease avoidance mechanisms. A growing body of research has indirectly shown that individual traits interfering with social distancing and anti-contagion measures are related to those of the nocturnal chronotype. Indeed, some of the social contexts that have been identified as superspreading events occur at night, such as in restaurants, bars, and nightclubs. Furthermore, nocturnal environmental conditions favor the survival of the SARS-CoV-2 virus much longer than daytime conditions. We compare the eveningness epidemiological liability hypothesis with other factors related to non-compliance with pandemic safety protocols, namely sex, age, and life history. Although there is not yet a direct link between the nocturnal chronotype and non-compliance with pandemic safety protocols, security measures and future empirical research should take this crucial evolutionary mismatch and adaptive metaproblem into account, and focus on how to avoid nocturnal individuals becoming superspreaders, offering secure alternatives for nocturnal social activities. La réflexion cosmologique de Bernardin de Saint-Pierre est un outil précieux pour mieux comprendre sa philosophie – généralement négligée par la critique – et, surtout, le providentialisme anthropocentrique qui est au centre de son épistémologie. Les croyances astronomiques de Saint-Pierre sont exprimées dans deux grands ouvrages théoriques : les Études de la nature de 1784 et, particulièrement, les Harmonies de la nature, écrites dans les vingt dernières années de sa vie et publiées à titre posthume en 1814. Le neuvième et (...) dernier livre de cet ouvrage est consacré spécifiquement à la cosmologie, comme l’indique son titre : Harmonies du Ciel, ou les mondes. Bernardin y rejette fermement les explications du cosmos qui, comme celle de Laplace, déclarent l’inutilité du recours à Dieu dans la description de la mécanique céleste, pour analyser la seule loi qu’il reconnaisse comme universelle et intemporelle : la providence divine. À partir de prémisses méthodologiques spécifiques (rejet de la synthèse, primauté du sentiment, méthode intuitive, etc.), Saint-Pierre construit une cosmologie téléologique qui combine un « ciel médité », inspiré de Huygens et Herschel, et un « ciel rêvé », caractérisé par des idées mystiques et par un élément évident de normativité morale. According to some philosophers and social scientists, mainstream economic theories currently play an unprecedented role in shaping human societies. This phenomenon can be linked to the dissemination of methodological individualism, where common goods are interpreted as reducible to aggregates of individuals' well-being. Nonetheless, some emergent difficulties of economics in coping with global institutional issues have encouraged some authors to revise that paradigm. In the last three decades, there has been a parallel growing philosophical interest in investigating social sciences' epistemological and (...) ontological foundations. Unfortunately, these two research trends have often not communicated systematically enough to understand the specific ontology of collective aims. It is still unclear whether some irreducible social goods exist and how the answer to this question can set up a consistent understanding of cooperative actions. This dissertation addresses this issue, drawing on philosophical investigations about collective intentionality. It claims that a coherent ontological taxonomy of irreducible and reducible social goods is theoretically viable and can reframe prevailing approaches to collective action dilemmas influenced by the traditional economic categorisation of goods. The research begins by analysing how the influential theory of public goods has paved the way for some social and moral impasses. Furthermore, some theoretical proposals suggesting the existence of relational goods and common-pool resources are scrutinised. Hence, a refutation of the ontological reduction of all social goods to individual ones is developed, arguing that a specific form of cooperation, grounded in we-intentions and we-reasoning, shows the plausibility of the existence of some kinds of irreducible collective goods. Expanding on that view, a refinement of this categorisation of social goods is put forward by underlying the function of some relational entities, such as trust and shared sensemaking processes, in making cooperation robust in uncertain environments. Finally, by applying the taxonomy to collective action gridlocks regarding climate change, digital information, and public education, the consistency of this hypothesis is tested, showing that a pluralistic ontological account of social goods might improve the moral understanding of current social dilemmas. Fission of cellular membranes is ubiquitous and essential for life. Complex protein machineries, such as the dynamin and ESCRT spirals, have evolved to mediate membrane fission during diverse cellular processes, for example, vesicle budding. A new study suggests that non-specialized membrane-bound proteins can induce membrane fission through mass action due to protein crowding. Because up to 2/3 of the mass of cellular membranes is contributed by proteins, membrane protein crowding is an important physiological parameter. Considering the complexity of membrane shape (...) transitions during a fission reaction, spatial and temporal variability in protein distribution, and the abundance of intrinsically disordered regions in proteins on an invaginating membrane, protein crowding can have diverse consequences for fission in the cell. The question is, how and to what extent this mechanism combines with the action of dedicated fission machineries. Membrane fission, which is required for formation of vesicles or cytokinesis, can be carried out by specialized proteins like dynamin and the ESCRT complex. Recent work suggests that fission of cellular membranes, which are densely packed with proteins, can also be induced by protein crowding due to high entropic tension. (shrink)
