Partiu-se do complexo de castração em ambos os sexos para inferir que urge às pulsões perverso-polimorfas infantis, especialmente o impulso agressivo sádico-anal, extraviarem-se para o matrimônio. Tal processo conduziria, no caso das perversões, a uma hipotética unidade sadomasoquista. A reflexão crítico-literário de Marquês de Sade e de Sacher-Masoch, no entanto, mostra que ao passo que o sadismo recapitula o complexo de (...) Édipo, o masoquismo se vincula à oralidade da mãe Afrodite. O ensaio conclui que diferente de urgir o matrimônio com a concepção de um filho, a Psicanálise pode ensejar uma feminilidade empoderada da qual faz parte a complexidade do fetiche humano. (shrink)

In this article, I address a controversial aspect of Rawls’s treatment of the question of justice between generations: how the parties in the original position could be motivated to select Rawls’s preferred principle of intergenerational savings, which he dubs the just savings principle. I focus on the explanation found in his later work, where he proposes that the correct savings principle is the principle that any generation would have wanted preceding generations to have followed. By expanding upon this explanation, I (...) respond to the objection that this explanation disregards the perspective of the first generation. I demonstrate that this objection ceases to be a concern when a proper account of the parties’ reasoning is developed. What is notable about the explanation I defend is that it relies on the parties adopting maximax – not maximin – as a rule for rational decision making. Having established this intermediary conclusion, I depart with Rawls and consider what savings principle the parties would choose if given more options. Ultimately, I argue that the parties would select a principle that Rawls would have undoubtedly rejected if presented to him at face value. This is because the principle of savings I argue would be selected requires continual economic growth over generations to increase upwards indefinitely – a conclusion Rawls is explicitly trying to avoid in his theory of justice. A central feature of experimental development economics is the use of randomized controlled trials (RCTs) to evaluate the effectiveness of prospective socioeconomic interventions. The use of RCTs in development economics raises a host of ethical issues which are just beginning to be explored. In this article, I address one ethical issue in particular: the routine use of the status quo as a control when designing and conducting a development RCT. Drawing on the literature on the principle of standard care in (...) medical research ethics, as well as considerations of distributive justice in non-ideal circumstances, I argue that the practice of using the status quo as a control is ethically justifiable. However, I add an important qualification based on the natural duty of rescue to address the concern that my account is overly permissive. (shrink)

An overcomplete logic is a logic that ‘ceases to make the difference’: According to such a logic, all inferences hold independently of the nature of the statements involved. A negation-inconsistent logic is a logic having at least one model that satisfies both some statement and its negation. A negation-incomplete logic has at least one model according to which neither some statement nor its negation are satisfied. Paraconsistent logics are negation-inconsistent yet non-overcomplete; paracomplete logics are negation-incomplete yet non-overcomplete. A paranormal logic (...) is simply a logic that is both paraconsistent and paracomplete. -/- Despite being perfectly consistent and complete with respect to classical negation, nearly every normal modal logic, in its ordinary language and interpretation, admits to some latent paranormality: It is paracomplete with respect to a negation defined as an impossibility operator, and paraconsistent with respect to a negation defined as non-necessity. In fact, as it will be shown here, even in languages without a primitive classical negation, normal modal logics can often be alternatively characterized directly by way of their paranormal negations and related operators. So, instead of talking about ‘necessity’, ‘possibility’, and so on, modal logics could be seen just as devices tailored for the study of (modal) negation. What is the fundamental insight behind truth-functionality ? When is a logic interpretable by way of a truth-functional semantics? To address such questions in a satisfactory way, a formal definition of truth-functionality from the point of view of abstract logics is clearly called for. As a matter of fact, such a definition has been available at least since the 70s, though to this day it still remains not very widely well-known. A clear distinction can be drawn between logics characterizable through: (...) (1) genuinely finite-valued truth-tabular semantics; (2) no finite-valued but only an infinite-valued truthtabular semantics; (3) no truth-tabular semantics at all. Any of those logics, however, can in principle be characterized through non-truth-functional valuation semantics, at least as soon as their associated consequence relations respect the usual tarskian postulates. So, paradoxical as that might seem at first, it turns out that truth-functional logics may be adequately characterized by non-truth-functional semantics . Now, what feature of a given logic would guarantee it to dwell in class (1) or in class (2), irrespective of its circumstantial semantic characterization? (shrink)

Young children interpret some acts performed by adults as normatively governed, that is, as capable of being performed either rightly or wrongly. In previous experiments, children have made this interpretation when adults introduced them to novel acts with normative language (e.g. ‘this is the way it goes’), along with pedagogical cues signaling culturally important information, and with social-pragmatic marking that this action is a token of a familiar type. In the current experiment, we exposed children to novel actions with no (...) normative language, and we systematically varied pedagogical and social-pragmatic cues in an attempt to identify which of them, if either, would lead children to normative interpretations. We found that young 3-year-old children inferred normativity without any normative language and without any pedagogical cues. The only cue they used was adult socialpragmatic marking of the action as familiar, as if it were a token of a well-known type (as opposed to performing it, as if inventing it on the spot). These results suggest that – in the absence of explicit normative language – young children interpret adult actions as normatively governed based mainly on the intentionality (perhaps signaling conventionality) with which they are performed. Unlike with randomized controlled trials (RCTs) in clinical research, little has been said about the ethical principles that should regulate the use of RCTs in experimental development economics. One well-known principle in clinical research ethics is the principle of clinical equipoise. Some recent commentators suggest that an analogue of clinical equipoise should play a role in experimental development economics. In this article, I first highlight some difficulties with importing the concept to experimental development economics. I then argue that MacKay’s (2018, (...) 2020) notion of policy equipoise avoids these difficulties and has a role to play in experimental development economics. (shrink)

Genetic engineering has been a topic of discussion for over 50 years, but it is only recently that gene editing has become a reality. CRISPR biotechnologies have made gene editing much safer, precise and feasible. We have witnessed the first cases of human germline genetic modification resulting in live births, conducted by He Jiankui. In this paper, we will analyse He Jiankui’s case in relation to one of the most difficult problems in procreative ethics (or the ethics of future generations): (...) the non‐identity problem. We believe that this analysis will help us to understand the ethics involved in gene editing and hopefully allow for a better, more philosophically grounded legislation on CRISPR and other gene‐editing technologies. We say that things happen accidentally when they do indeed happen, but only by chance. In the opposite situation, an essential happening is inescapable, its inevitability being the sine qua non for its very occurrence. This paper will investigate modal logics on a language tailored to talk about essential and accidental statements. Completeness of some among the weakest and the strongest such systems is attained. The weak expressibility of the classical propositional language enriched with the non-normal modal operators of essence (...) and accident is highlighted and illustrated, both with respect to the definability of the more usual modal operators as well as with respect to the characterizability of classes of frames. Ugar and Malele 1 critique the use of ‘generic’ technologies like artificial intelligence (AI) and machine learning (ML) for mental health diagnoses, particularly in sub-Saharan African countries. They highlight how these AI medical tools often overlook traditional perspectives and local contexts. The article has the merit of working on ethical issues regarding the particularities and risks of using AI and ML for health diagnosis in the Global South, an urgent and neglected topic. According to the authors, the use of these (...) AI technologies leads to overgeneralisation in diagnosing mental disorders, which could be especially problematic in the mental health field because of value-laden judgements intrinsic to the definition of mental health disorders. The notion of schema has been given a major role by Recanati within his conception of primary pragmatic processes, conceived as a type of associative process. I intend to show that Recanati’s considerations on schemata may challenge the relevance theorist’s argument against associative explanations in pragmatics, and support an argument in favor of associative (versus inferential) explanations. More generally, associative relations can be shown to be schematic, that is, they have enough structure to license inferential effects without any appeal to (...) genuine inferential processes. Associative processes are thus able to explain a number of pragmatic and linguistic phenomena which have instead been thought to require specialized inferential processes. (shrink)

[This is a pre-print; please cite the published version] This paper employs structural topic modeling (STM) to describe the academic philosophy landscape in Brazil. Based on a public national database, a corpus consisting of 12,515 abstracts of monographs defended in philosophy graduate programs between 1991 and 2021 was compiled. The final STM model identified 74 meaningful research topics, clustered into 7 thematic categories. This study discusses the prevalence of the most significant topics and categories, their trends across three decades, and (...) their (positive or negative) association with the supervisor's gender. Results show the first empirical evidence that Brazilian philosophical research exhibits a greater focus on philosophers than on specific themes or problems. Moreover, by visualizing the variations in topic prevalence over time, it was possible to track the rise or decline of the major interest categories and topics. Finally, results also show which topics are more influenced or less influenced by gender. (shrink)

Although ethical decision‐making theory has evolved over the years, within the field of management, research still revolves around James Rest’s (1986) four‐step framework, dominated by a positivist epistemology and a quantitative methodology. Given that currently there is a call for a theoretical, epistemological, and methodological renovation for the enlargement and enrichment of knowledge about how decisions are morally made in organizations, this paper has a double aim. First, by showing the models’ main flaws and limitations, it critically assesses the prominent (...) theoretical models of Rest, Trevino, and Jones. Then, for decision making in organizations, the paper aims to posit a fresh moral theory that addresses the phenomenon from a comprehensive epistemological perspective. To do so, it steps back from those prominent models in order to review John Dewey’s “theory of moral life.” At the core of the proposed comprehensive theoretical framework are Dewey’s concepts of a “moral standard” and “valuation.” Finally, the paper shows how the Dewey‐based framework can both overcome the flaws and limitations that are identified in those prominent models and can enrich empirical research, therefore contributing to developing as a whole the ethical decision‐making field. The modern world was in part born as a reaction against Aristotelianism. However, the image of Aristotle to which modern philosophers reacted was partial, to say the least. Paradoxical though it may seem, today, more than twenty-three centuries on, we may now be in the most advantageous position for understanding the Stagirite's philosophy and applying it to contemporary problems. The present book contributes to the forming of an idea of Post-modern reason inspired by a constellation of Aristotelian concepts, such as (...) prudence (phronesis), practical truth (aletheia praktike), science in act (episteme en energeiai), metaphor (metaphora), similarity (homoiosis) and the imitation-creation pair (mimesis-poiesis). They all form an interconnected network and together they make up an idea of reason that may prove suitable for the present. These concepts offer the most promising basis for undertaking a series of urgent reconciliations: of facts and values, of means and ends, of theoretical and practical reason, of intelligence and emotion. Aristotle's notions could help solve many dualisms of modern times. He offers a third way between identity and difference in ontology and politics, between algorithm and anarchism in methodology, between naïve realism and plain relativism in epistemology, between equivocity and univocity in language, between Enlightenment and Romanticism in culture... On the way, this shift facilitates the relationships between science, arts and ethics - the three parts of the sphere of culture which Modernity had separated - as well as the integration of the sphere of culture itself with the world of life. In many real-life applications of logic it is useful to interpret a particular sentence as true together with its negation. If we are talking about classical logic, this situation would force all other sentences to be equally interpreted as true. Paraconsistent logics are exactly those logics that escape this explosive effect of the presence of inconsistencies and allow for sensible reasoning still to take effect. To provide reasonably intuitive semantics for paraconsistent logics has traditionally proven to be a challenge. Possible-translations (...) semantics can meet that challenge by allowing for each interpretation to be composed of multiple scenarios. Using that idea, a logic with a complex semantic behavior can be understood as an appropriate combination of ingredient logics with simpler semantic behaviors into which the original logic is given a collection of translations preserving its soundness. Completeness is then achieved through the judicious choice of the admissible translating mappings. The present note provides interpretation by way of possible-translations semantics for a group of fundamental paraconsistent logics extending the positive fragment of classical propositional logic. The logics PI, Cmin, mbC, bC, mCi and Ci, among others, are all initially presented through their non-truth-functional bivaluation semantics and sequent versions and then split by way of possible-translations semantics based on 3-valued ingredients. The proliferation of legal documents in various formats and their dispersion across multiple courts present a significant challenge for users seeking precise matches to their information requirements. Despite notable advancements in legal information retrieval systems, research into legal recommender systems remains limited. A plausible factor contributing to this scarcity could be the absence of extensive publicly accessible datasets or benchmarks. While a few studies have emerged in this field, a comprehensive analysis of the distinct attributes of legal data that influence (...) the design of effective legal recommenders is notably absent in the current literature. This paper addresses this gap by initially amassing a comprehensive session-based dataset from Jusbrasil, one of Brazil’s largest online legal platforms. Subsequently, we scrutinize and discourse key facets of legal session-based recommendation data, including session duration, types of recommendable legal artifacts, coverage, and popularity. Furthermore, we introduce the first session-based recommendation benchmark tailored to the legal domain, shedding light on the performance and constraints of several renowned session-based recommendation approaches. This essay is concerned with concentrations of entities, which play an important—albeit often overlooked—role in scientific explanation. First, I discuss an example from molecular biology to show that concentrations can play an irreducible causal role. Second, I provide a preliminary philosophical analysis of this causal role, suggesting some implications for extant theories of causation. Communication campaigns often highlight environmental progress to encourage further pro-environmental behaviour. Consequently, the drop in carbon emissions caused by the COVID-19 restrictions has been framed as a positive environmental outcome of the pandemic. We conducted an experimental study with a US-representative sample (N = 500) to show that raising awareness of emissions reduction has the contrary effect: an increase in moral self-concept facilitated a negative spillover, namely, it reduced climate-friendly behavioural intentions. Normative influence was able to prevent this negative spillover (...) because activating environmental norms inhibited compensatory feelings. Besides, awareness of recent emissions reduction was less likely to increase the moral self-concept of participants with a strong environmental self-identity. Our findings demonstrate that environmental progress increases moral self-concept which, in turn, could cause a negative spillover (i.e., reduce climate-friendly low-carbon behaviour and increase climate-harmful high-carbon behaviour). Normative influences and environmental self-identity can inhibit this negative spillover. (shrink)

According to the extended cognition thesis, an agent’s cognitive system can sometimes include extracerebral components amongst its physical constituents. Here, we show that such a view of cognition has an unjustifiably anthropocentric focus, for it tends to depict cognitive extensions as a human-only affair. In contrast, we will argue that if human cognition extends, then the cognition of many non-human animals extends too, for many non-human animals rely on the same cognition-extending strategies humans rely on. To substantiate this claim, we (...) will proceed as follows. First (Sect. 1), we will introduce the extended cognition thesis, exposing its anthropocentric bias. Then, we will show that humans and many non-human animals rely on the same cognition-extending strategies. To do so, we will discuss a variety of case studies, including “intrabodily” cognitive extensions such as the spinal cord (Sect. 2), the widespread reliance on epistemic actions to solve cognitive tasks (Sect. 3) and cases of animal cognitive offloading (Sect. 4). In this article, I argue that there is philosophy of science since philosophy existed. Thus, the idea that the philosophy of science was born with neopositivism is historically wrong and detrimental to the development of the philosophy of science itself. Neopositivism tried to found the philosophy of science as an anti-philosophical discipline, as a field of study that came to replace simple philosophy. The attempt was maintained for thirty years, but failed. Now, this does not mean that we cannot make (...) good philosophy of science today, but that the philosophy of science has returned to the common house of philosophy, it is gradually recovering the connection that it should never have lost with the main philosophical traditions and disciplines. Scientific research in the formal sciences comes in multiple degrees of formality: fully formal work; rigorous proofs that practitioners know to be formalizable in principle; and informal work like rough proof sketches and considerations about the advantages and disadvantages of various formal systems. This informal work includes informal and semi-formal debates between formal scientists, e.g. about the acceptability of foundational principles and proposed axiomatizations. In this paper, we propose to use the methodology of structured argumentation theory to produce a formal (...) model of such informal and semi-formal debates in the formal sciences. For this purpose, we propose ASPIC-END, an adaptation of the structured argumentation framework ASPIC+ which can incorporate natural deduction style arguments and explanations. We illustrate the applicability of the framework to debates in the formal sciences by presenting a simple model of some arguments about proposed solutions to the Liar paradox, and by discussing a more extensive—but still preliminary—model of parts of the debate that mathematicians had about the Axiom of Choice in the early twentieth century. Este artículo trata de analizar la célebre frase orteguiana “e_l hombre no tiene naturaleza, sino que tiene… historia_” dentro del contexto de su obra, mostrando su génesis y su evolución, así como las interpretaciones que se le han venido dando a la misma. Junto a este análisis, se mostrará también la importancia de esta idea dentro de la filosofía de Ortega, así como la relevancia que estas ideas podrían tener para una posible reforma de la metafísica tradicional.

El transhumanismo es una moda intelectual que propone la transformación de los seres humanos mediante diversas tecnologías. Expondremos brevemente los rasgos más conspicuos del TH, así como las principales críticas que se le han hecho. Pero la intención de este artículo no es entrar en esta polémica; aportaremos tan solo las claves imprescindibles para poder seguir adelante. Y una de las claves más intrigantes del TH es que, por debajo de su pátina tecno-futurista, remite a ciertas ideas filosóficas tan viejas (...) como, en apariencia, incompatibles entre sí. El TH remite al naturalismo radical, tanto como al nihilismo existencialista. La tesis que aquí se defiende es que tanto el naturalismo radical como el nihilismo existencialista son producto de las diversas oleadas del dualismo: del dualismo platónico antiguo, del dualismo cartesiano moderno. Una vez que separamos, a la manera dualista, la libertad por un lado y la naturaleza por el otro, podemos contar hasta dos, como hacen los dualistas, o quedarnos solo en uno, como hacen los existencialistas, que se paran en la libertad, y los naturalistas, que solo cuentan con la naturaleza. En cualquier caso, la imagen del ser humano, que es libertad y naturaleza, sale dañada. Asoma entonces el animal aporético y enfermizo al cual hay que salvar… de sí mismo. ¿Cómo? Siguiendo el método de Procusto, pero ahora con los prefijos bio e info en lugar de sierra y martillo. Hasta que el pobre ser humano encaje en el lecho de la utopía que algunos visionarios han urdido. ¿Y no hay otra vía, otra forma de mejorar la vida humana que sea más respetuosa para con la humana envergadura? Quizá sí, mas para trazar esa tercera vía, entre el naturalismo radical que mutila y el nihilismo existencialista que descoyunta y estira, habría que negar de antemano el dualismo que a los dos engendra, y atenerse a la sensatez común, en línea con la tradición aristotélica, antes que a las ensoñaciones utópicas. En nuestra opinión, el concepto aristotélico de naturaleza humana nos habilita para juzgar las antropotecnias mejor que la normatividad extraída de las visiones futuristas propias del TH. (shrink)

La ética ambiental nació como justa contestación a los excesos del antropocentrismo. Sin embargo, un énfasis obsesivo en lo ético y en lo ambiental, con el consiguiente olvido de lo antropológico, puede estar dañando la vida humana, la libertad de las personas y la vida en general. Abogamos aquí por la construcción de una ecología humana que vaya más allá y más al fondo que las éticas ambientales al uso. Defendemos que el humanismo es perfectamente compatible con el reconocimiento del (...) valor inherente de todos los seres naturales. Lo hacemos basándonos principalmente en algunas ideas de Hans Jonas, aunque rechazamos su heurística catastrofista. De él retomamos la idea de que existe una responsabilidad moral hacia los demás seres vivos, empezando por los más próximos en el tiempo y en el espacio, y hacia el libre florecimiento de las personas actuales. Con ello, también, se rebaja el peso de lo ético sobre nuestra acción ecológica. Esta ha de atender principalmente a criterios experienciales, antropológicos, científicos y de sentido común. Por último, defendemos que la política, la educación y la comunicación ambiental deben orientarse directamente hacia la libertad y el desarrollo virtuoso de las personas actuales, y no hacia el control de las mismas por culpabilización. El tránsito desde la ética ambiental hacia la ecología humana —concluimos— puede ser beneficioso tanto para las personas como para la naturaleza. (shrink)

Abstract The aim of the paper is to reassess the role of British Aristotelianism within the history of early modern logic between the sixteenth and seventeenth centuries, as a crucial moment of cultural transition from the model of humanistic rhetoric and dialectic to that of facultative logic, that is, a logic which concerns the study of the cognitive powers of the mind. The paper shows that there is a special connection between Paduan Aristotelianism and British empiricism, through the mediation of (...) British Aristotelianism. British Aristotelians took the ideas of the Paduan Aristotelian tradition and carried them to an extreme, gradually removing them from the original Aristotelian context in which they were grounded and developing what would later become the fundamental ideas of British empiricism. In this paper I challenge the pernicious aspects of Milton Friedman's methodological outlook that continues to hold sway over mainstream neoclassical economists. I do this by showing how Friedman's own methodological dicta could have been used against him when he famously advanced the expectations critique of the Phillips curve at his presidential address to the American Economic Association. I use this case study to further suggest that psychological and neurophysiological data should not be deemed irrelevant to economic science.

We know from poem 95 that Cinna, Catullus’ poet friend and companion on his journey to the East, took nine years to write a similar poem, the epyllion entitled Zmyrna. Cinna’s work was famous for its obscurity, but also poem 35 mentions the time spent by another poet from Catullus’ circle of friends in writing a poem on the Magna Mater. Both references reveal the meticulousness (the labor limae) with which the neoteric poets composed their most important works.This explains the reason for the compositional virtuosity that can frequently be discovered in poem 64. An example of this is the repeated use of verbal reminiscences throughout the poem. 1 For the author this procedure serves various purposes: to provide a frame for the descriptive sections or direct speech; to link the different events by underlining the causal relations between them; to confer a symbolic nature on the text, and so forth. Before we turn to the introduction of the Parcae and their song, which is the main focus of this paper, it will be useful to illustrate Catullus’ technique of simultaneous ring composition and forward [End Page 75] cross-reference through verbal echoes from verses 112–15. This one case and its allusive network may serve as an example, among many, of this compositional virtuosity of Catullus. When he describes the hero Theseus emerging from the labyrinth after slaying the Minotaur, he does so in the following terms:inde pedem sospes multa cum laude reflexit errabunda regens tenui vestigia filo, ne labyrintheis e flexibus egredientem tecti frustraretur inobservabilis error.(64.112–15)These verses are an echo, after the elaborated Homeric simile used by the author to refer to the death of the monster, of those in which Catullus previously described the fears of Ariadne enamoured by Theseus’ fortune:cum saevum cupiens contra contendere monstrum aut mortem appeteret Theseus aut praemia laudis! non ingrata tamen frustra munuscula divis promittens tacito succepit vota labello.2 (64.101–4)In both cases the narration centres on the favours granted Theseus by Ariadne: in the first with the supplications she directs to the gods; in the second with the gift of the ball of thread which enables the hero to escape from the labyrinth.It is not difficult to discover a closer relation between the two passages. In the first, Theseus wishes to fight the monster: cum saevum cupiens contra contendere monstrum /... Theseus. The expectation thus raised with regard to possible narratives is answered in verse 110, which evokes the previous verse: sic domito saevum postravit corpore Theseus.The hero wishes for death or glory: 3 aut mortem appeteret Theseus [End Page 76] aut praemia laudis This verse is taken up later in the following passage: inde pedem sospes multa cum laude reflexit (64.112). If Theseus wished for death or the reward of glory, Ariadne’s help enabled him to avoid one and achieve the other. The reappearance of the term frustra (102) in the verb frustraretur (115) stresses the heroine’s intervention. 4In verses 112–15 we find, moreover, the stylistic recourse of etymologically related words that had been used by the poet in the previous simile (indomitus turbo, 107; exturbata, 108; domito, 110). Reflexit (112) and errabunda vestigia (113) are echoed again in labyrintheis flexibus (114) and inobservabilis error (115), such that the verses are ordered as follows: A (112), B (113), A′ (114), B′ (115).The repetitions stress the difficulty in returning and the importance of Ariadne’s help. En el presente artículo se expone una reflexión sobre la idea unamuniana de la amistad. Miguel de Unamuno, pensador existencial español, invita frecuentemente en sus escritos a replantearse la autenticidad de las relaciones que mantenemos con nuestros prójimos, con aquellos con quienes compartimos vida. Veremos que entiende la amistad como el enlace espiritual entre dos almas, como un amor compartido que se funda en la afección del espíritu, siendo justamente esa afección lo que nos permite el diálogo moral con nuestro (...) amigo. Es evidente que fácil es toparse con personas con las que se pueda establecer una amistad superficial, y muy difícil encontrar a una persona en la que se pueda confiar plenamente y a la que nos podamos entregar por completo para mantener una amistad auténtica e imperecedera. Con el propósito de aprender a identificar una verdadera amistad, se pretenden analizar las claves que nos ofrece el pensamiento de Unamuno, principalmente sobre la base de sus escritos espirituales. Apresentamos uma reconstrução da argumentação de Campos a favor da distinção entre abdução e inferência da melhor explicação, enfatizando a interpretação de Campos sobre inferência da melhor explicação na perspectiva de Peter Lipton. Em contraposição a Campos, que defende uma distinção parcial entre abdução e a inferência da melhor explicação, neste artigo sugerimos uma distinção (...) completa entre as formas de raciocínio. This paper discusses the existence of rules and criteria independent of our discursive practices by using Brandom’s philosophy and Wittgenstein’s philosophical development. For that, it examines the normativity of logic, especially facing the challenge of the diversity of non-classical logics and motivates that its constitution should be based on an analogy with games. This renders a pragmatist alternative to a realist sort of dogmatism. I then defend, using this pragmatist approach inspired in the notion of games and agreements, that it (...) is not the objectivity of discourse that makes possible the normativity of our practices, but on the contrary, it is the intrinsic normativity of our practices, its set of authorizations and prohibitions, that should ground the rationality of our discourse. This paper asks whether large language models (LLMs) can apply the law. It does not question whether LLMs should apply the law. Instead, it distinguishes between two interpretations of the ‘can’ question. One, can LLMs apply the law like ordinary individuals? Two, can LLMs apply the law in the same manner as judges? The study examines D’Almeida’s theory of law application, divided into inferential and pragmatic law application. It argues that his account of pragmatic law application can be improved as (...) it does not fully consider that law application (and rule-following) is a shared, public practice collectively realized by members of a linguistic community. The study concludes that LLMs cannot apply the law. They cannot apply the law in the inferential sense as they have mere syntactic (not semantic) interaction with the law. They cannot apply the law in the pragmatic sense as pragmatic law application does not depend on a single agent, whether that agent is a judge, an ordinary citizen, or a non-human entity. (shrink)

Libertarianism deals with what the law should be. In this article, we focus on what the appropriate law to punish criminals should be in a libertarian society; that is, one that respects the Non-Aggression Principle and property rights. We examine various theories of punishment and explain why some are incompatible with libertarianism. We contribute to the latest libertarian theory of punishment suggesting the necessity to take time preference into consideration. The concept of the "linear model of innovation" was introduced by authors belonging to the field of innovation studies in the middle of the 1980s. According to the model, there is a simple sequence of steps going from basic science to innovations - an innovation being defined as an invention that is profitable. In innovation studies, the LMI is held to be assumed in Science the endless frontier , the influential report prepared by Vannevar Bush in 1945. In this paper, (...) it is argued that: the LMI was introduced with critical purposes, as part of the questioning of the conception of science and the proposals for science policies put forward in Sef; at a first level of analysis, the LMI appears as a straw man, defended neither in Sef, nor anywhere else; the LMI is a weapon against the importance attributed to basic science in Sef, and its defense of the financing of basic research by the state; the LMI is a component of the process of commodification of science promoted by neoliberalism. The last section of the paper presents a qualified defense of basic science and basic research. (shrink)

La ciencia cognitiva ha evolucionado bastante y, en la actualidad, ha logrado generar grandes cambios en el pensamiento filosófico que, referido al ámbito científico, nos permite indagar respecto al proceso de generar ciencia y conocer mejor cómo ocurre la elección de teorías científicas; algo que por mucho tiempo fue entendido por los filósofos como un proceso puramente racional, en el que no había cabida para las emociones, pero ahora podemos decir que esto ha cambiado significativamente, dándole a los científicos su (...) lugar como seres humanos más que como entidades lógicas.
