The theory of mind (ToM) deficit associated with autism spectrum disorder has been a central topic in the debate about the modularity of the mind. In a series of papers, Philip Gerrans and Valerie Stone argue that positing a ToM module does not best explain the deficits exhibited by individuals with autism (Gerrans 2002; Stone & Gerrans 2006a, 2006b; Gerrans & Stone 2008). In this paper, I first criticize Gerrans and Stone’s (2008) account. It is impossible to hold patently contradictory beliefs in mind together at once. Why? Because we know that it is impossible for both to be true. This impossibility is a species of rational necessity, a phenomenon that uniquely characterizes the relation between one person's beliefs. Here, Eric Marcus argues that the unity of the rational mind--what makes it one mind--is what explains why, given what we already believe, we can't believe certain things and must believe certain others in this (...) special sense. What explains this is that beliefs, and the inferences by which we acquire them, are constituted by a particular kind of endorsement of those very states and acts. This, in turn, entails that belief and inference are essentially self-conscious: to hold a belief or to make an inference is at the same time to know that one does. An examination of the nature of belief and inference, in light of the phenomenon of rational necessity, reveals how the unity of the rational mind is a function of our knowledge of ourselves as bound to believe the true. Organ tourism occurs when individuals in countries with existing organ transplant procedures, such as the United States, are unable to procure an organ by using those transplant procedures in enough time to save their life. In this paper, I am concerned with the following question: When organ tourists return to the United States and need another transplant, do US transplant physicians have an obligation to place them on a transplant list? I argue that transplant physicians have a duty not to (...) relist organ tourists. Specifically, I contend that we should locate physicians’ duties in these cases within the new role of “transplant physician.” This role results from transplant physicians’ participation in a system that depends on organ donors’ voluntary act of donation. Abstract The current accountability system for private military and security contractors (PMSCs) is woefully inadequate, and mere enhancements in oversight cannot hope to remedy that failing. I contend that once we recognize the kind of accountability required of PMSCs, we will realize that radical changes in the foundational relationship between PMSCs and the state are required. More specifically, in order to be appropriately accountable, members of PMSCs must become a part of or, at the very least, directly responsible to the (...) legitimate authoritative military or police structures, and there must be a clear and precise delineation of responsibility among public officials for holding individual members of PMSCs criminally liable. Previous research into human traits has reached impressive consensus regarding at least some traits, but recent evidence suggests these to be genetically heterogeneous. This is problematic for theories of the neurobiology of human traits. Future research should more closely integrate genetic, behavioral, and psychometric research to arrive at biologically validated measurement instruments, which may be better used to understand the mediating role of these traits in the association between genetic variants and complex behaviors.

This article examines the idea of disjunctive rights—an idea first suggested by Joel Feinberg and more recently advocated by Richard Arneson. Using a hypothetical scenario to bring forward a conflict between two rights that cannot be simultaneously fulfilled, the suggestion that the conflict can be solved by describing the right-holders as holding disjunctive rights—rights that involve, in a significant way, a disjunction—is scrutinized. Several interpretations of the idea of disjunctive rights are examined from the perspectives of the interest theory and (...) will theory of rights. Ultimately, the idea of disjunctive rights fails to provide an acceptable solution to the problem at hand, as each interpretation has unacceptable implications. This conclusion challenges the compossibilist thesis, according to which moral rights do not, ultimately, conflict. Alternatively, if one wishes to keep the possibility of compossibility and disjunctive rights, the mainstream theories of rights must be revised or rejected. (shrink)

Alternative readings of quantification are considered. The absence of an unequivocal translation into ordinary speech is noted. Some examples are cited which, in the opinion of the author, are a result of equivocal readings of quantification, or unnecessarily restrictive readings which obscure its primary function.

In classical Chinese philosophy, the best kind of life is a life lived in line with the Dao (the “Way”). A core feature of this kind of life is attaining the ideal of wu-wei. In early Daoist writings, wu-wei denotes an ideal way of acting. However, since wu-wei is normally translated as “no-action” these ancient texts give us a picture of the best kind of life that may appear paradoxical to many philosophers. In this paper, I suggest a way to (...) make sense of this classical ideal. I argue that by applying a Merleau-Pontyian framework of action we can arrive at a non-paradoxical reading of wu-wei. On this reading, wu-wei is essentially manifested in a specific way we are aware of what we are doing. (shrink)

Though ‘evil’ is often used loosely as merely the generic opposite of ‘morally good’, used precisely it is the worst possible term of opprobrium available. In this essay it is taken as applying primarily to persons, secondarily to conduct; evil deeds must flow from the volition to do something evil. An evil action is one so horrendously bad that no ordinary decent human being can conceive of doing it, and an evil person is one who knowingly wills or orders such (...) actions. Malignant evil—doing evil because it is evil—is not just possible but real, and is one of several kinds of evil delineated. The relevance of this concept to ethnography has a very different past, present, and emergent associations. The Human Area Relations Files project as visionary science dependent on the making of an archive of ethnography contrasts with the uses of the past ethnographic record in the pursuit of contemporary fieldwork in a (...) so-called postmodern world. The goal of this paper is to describe the link between financial performance and the level of sustainability. In a novel approach, the paper classifies firms based on past financial success to address a potentially reciprocal relationship. For the groups of better and worse performing firms and for the entire sample, the above link is then tested, also accounting for non-linearity in the relationship. We show that environmental management system (EMS) implementation as a proxy for a firm's sustainability level is (...) only positively associated with the financial performance of financially well-performing firms. Conversely, it has a negative association with the performance of less good firms. We show that this implies that firms cannot change from good to bad performance, and vice versa, solely through the implementation of an EMS, and also that the result remains when introducing non-linearity in the link. Based on this result, we discuss implications for the direction of causality. (shrink)

Contextualist accounts of free will recently proposed by Hawthorne and Rieber imply that the same action can be both free and unfree (depending on the attributor's context). This paradoxical consequence can be avoided by thinking of contexts not as constituted by arbitrary moves in a conversation, but rather by (relatively stable) social practices (such as the practices of attributing responsibility or of giving scientific explanations). The following two conditions are suggested as each necessary and jointly sufficient for free will: (i) (...) the agent is able to form considered practical judgements and to act accordingly, and (ii) the agent (or some agent‐involving event) is the original cause of her actions. A contextualist reformulation of the second condition is developed according to which only contexts in which responsibility is attributed are relevant for the kind of original causation required for free will, which allows for a non‐relativist contextualism about free will. Originally published in 1984, this book broke new ground in assessing Freud as both an exemplary late-Victorian and as a pivotal figure in the creation of modern thought and culture. In his close reading of various of Freud’s theoretical and clinical texts, including two of the most famous case histories, Steven Marcus uncovers the steps in the development of Freud’s thought, the dynamics and contradictions and ‘the intellectual and emotional urgings, forces and conflicts that were at work… as the (...) first original insights and discoveries that constituted the inception of psychoanalysis as a theory, discipline of inquiry, and new kind of therapy, came suddenly, often unexpectedly and without being bidden, upon Freud’. Central to Professor Marcus’ inquiry is the relationship of Freud’s work to cultural change and to the very process of disclosure, formation and construction in the transition to modernity. In recent decades, a view of identity I call Sortalism has gained popularity. According to this view, if a is identical to b, then there is some sortal S such that a is the same S as b. Sortalism has typically been discussed with respect to the identity of objects. I argue that the motivations for Sortalism about object-identity apply equally well to event-identity. But Sortalism about event-identity poses a serious threat to the view that mental events are token identical (...) to physical events: A particular mental event m is identical with a particular physical event p only if there is a sortal S such that m and p are both Ss. If there is no such sortal, the doctrine of token-identity is not true. I argue here that we have no good reason for thinking that there is any such sortal. (shrink)

Is the human tendency toward musicality better thought of as the product of a specific, evolved instinct or an acquired skill? Developmental and evolutionary arguments are considered, along with issues of domain‐specificity. The article also considers the question of why humans might be consistently and intensely drawn to music if musicality is not in fact the product of a specifically evolved instinct.

This article uses differing interpretations of a thread of narrative taken from Orwell’s Nineteen Eighty-Four as a springboard to exploring the connection between philosophical truth and political liberalism. It argues that while no positive connection exists between realist truth and political liberalism, minimal negative connections do exist between Rorty’s humanistic account of truth and a basic commitment to democratic and liberal frameworks. It sees these minimal connections as limiting in their failure to provide a politics that moves beyond an exclusive (...) concern with liberty and democracy to more substantive political issues of equality and justice. However, it also sees them as reassuring in showing how acceptance of Rorty’s humanistic account of truth in no way necessitates adopting his own ethnocentric political stance. (shrink)
