Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...) in our study generally encounter hard ethics cases, even—surprisingly—those who do not work in hospitals. Most physicians have no CEC access, and those that do still do not employ CECs. However, physicians perceive this form of support as useful—even more so among actual users of CECs. We compared these findings with similar studies from other European countries and the North America. We point out peculiarities of our results as compared to those in other countries, with some possible explanations. We hope the results may encourage regulatory debate on the need to formally introduce CECs into the Polish healthcare system. (shrink)

Local hidden-variable model of singlet-state correlations discussed in Czachor (Acta Phys Polon A 139:70, 2021a) is shown to be a particular case of an infinite hierarchy of local hidden-variable models based on an infinite hierarchy of calculi. Violation of Bell-type inequalities can be interpreted as a ‘confusion of languages’ problem, a result of mixing different but neighboring levels of the hierarchy. Mixing of non-neighboring levels results in violations beyond the Tsirelson bounds.

In this paper we present a comparison of certain inconsistencyadaptive logics and Jaśkowski’s logic.

We generalize the notion of analytic/Borel equivalence relations, orbit equivalence relations, and Borel reductions between them to their continuous and quantitative counterparts: analytic/Borel pseudometrics, orbit pseudometrics, and Borel reductions between them. We motivate these concepts on examples and we set some basic general theory. We illustrate the new notion of reduction by showing that the Gromov–Hausdorff distance maintains the same complexity if it is defined on the class of all Polish metric spaces, spaces bounded from below, from above, and from (...) both below and above. Then we show that [Formula: see text] is not reducible to equivalences induced by orbit pseudometrics, generalizing the seminal result of Kechris and Louveau. We answer in negative a question of Ben Yaacov, Doucha, Nies, and Tsankov on whether balls in the Gromov–Hausdorff and Kadets distances are Borel. In appendix, we provide new methods using games showing that the distance-zero classes in certain pseudometrics are Borel, extending the results of Ben Yaacov, Doucha, Nies, and Tsankov. The classic approach to science is dominated by the belief that science is a form of cognitive activity that focuses on constructing theories to describe and explain the phenomena and processes found in the world. Due to the fulfilment of the criteria of intersubjective communicability and controllability, theories are considered to be objective products of research activity that do not bear social responsibility for their applications. In this paper, the issue of social responsibility of science is addressed both from the (...) classic perspective and from the non-classic viewpoint represented by laboratory sciences, i.e. those sciences that are predominantly concerned with creating phenomena rather than discovering them. It is argued that whereas in the former case the problem of social responsibility of science does not provoke serious controversy, in the latter case such controversies do exist and, furthermore, they are justified. Eric Olson and David Shoemaker argue that our numerical identity over time is irrelevant to such practical issues as moral responsibility or self-concern. Being the same individual at different moments in time may, in our case, can be seen as the preservation of the relevant biological processes (e.g., according to Olson), while psychological continuity, independent of these processes, may be crucial for such issues. I will defend the view that, contrary to the above authors, any conception of our diachronic identity (...) has ethical implications, at least with regard to the aforementioned issues. My argument has two basic assumptions. (1) The dispute over identity of persons is a dispute over the conditions of our persistence in time as the same individuals, whether we consider being a person as our essential property or not (e.g., Olson maintains the latter). The question is under what conditions I am the same as a particular earlier or later individual. (2) The pronoun “I,” on the other hand, is an essential component of practical reasoning, so also of ethical one. Thus, the debate on the persistence of persons concerns the identity conditions of the individuals to whom/which we refer when planning our future actions, formulating our intentions. My rational self-concern or my moral responsibility for past actions regards the individual to whom the pronoun refers. An additional result of my argument is to undermine the influential strategy of defending positions on our diachronic identity against the charge of controversial ethical implications. It cannot be argued in the case of every such controversy that a given ethical issue only apparently involves our identity, while in fact what is relevant to it is a different relation binding persons at different moments in time. The paper links higher education reforms and welfare states reforms in postcommunist Central European countries. It links current higher education debates (and reform pressures) and public sector debates (and reform pressures), stressing the importance of communist-era legacies in both areas. It refers to existing typologies of both higher education governance and welfare state regimes and concludes that the lack of the inclusion of Central Europe in any of them is a serious theoretical drawback in comparative social research. The region should (...) still, after more than two decades of transition and heavy international policy advising, be viewed as a “laboratory of social experimentation”. It is still too risky to suggest generalizations about how Central European higher education and welfare systems fit existing typologies. Consequently, the “transition” period is by no means over: it is over in terms of politics and economics but not in terms of social arrangements. Both higher education and welfare states should be viewed as “work in progress”: permanently under reform pressures, and with unclear future. (shrink)

Understanding the model is one of necessary preconditions of an analysis of China’s dynamic rise and development in recent decades. First, the article analyses the concept of historical development of multiple civilisations and modernities. It then examines the characteristics of China’s old civilisation and the associated model. It ends by showing how the historical Silk Road lives on in an updated modernised global version.

The article is an exploration into the problem of the ethos of modern science viewed from the representationalist and interventionist perspectives. The representationalist account of science is associated with the position of theoreticism, while the interventionist account pertains to the concept of new experimentalism. The former of these approaches is dominated by the ethos of science which Robert K. Merton defined as comprising four sets of institutional imperatives referred to as ‘Mertonian norms’: universalism, communitarism, disinterestedness, and organized skepticism. In the (...) latter approach, the concept of ethos is far more intricate. It can be described as a hybrid mix of elements derived from Mertonian norms and some constituents from the area of science that John Ziman calls “industrial science”. This article compares the two types of ethos, highlighting the need to identify and investigate nuances in the ethos embraced by individual disciplines within the area of the interventionist approach to science. It is argued that the need can be attributed to the escalating process of substituting the ideal of value-free science for the ideal of value-laden science. The phenomenon is especially evident in the field of laboratory sciences, as exemplified by the research conducted on synthetic mRNA technology. The author also draws attention to the problem of the social responsibility of disciplines from the interventionist approach to science. (shrink)

Recognizing inherent and inalienable nature of dignity and universality of certain values, the Constitution of the Republic of Poland, introduces to the foundations of Polish legal system some elements of natural law which may be used for application of the Basic Law. Constitutional recognition of these elements only makes sense on the assumption of their cognizability. Therefore, as an important element of constitutional concept of natural law is taken the recognition of the argument of cognitivism according to which moral assessments (...) may have the nature of judgments and truth qualification (they may be true or false). In the course of application of the constitution, norms of natural-law character and natural-law justification. Since dignity and the essence of freedoms and rights based on dignity are the only inviolable values recognized by the constitution, the arguments of natural law lead to a far-going reinterpretation of constitutional norms. The norm of natural law protecting inviolable values will have precedence in the event of collision with norms protecting other values, also with constitutional norms. Even if such a norm is formulated on the basis of the provisions of the constitution, in fact natural law is given higher rank than elements based only on enacted law. Despite that, reliability of a legally established order does not seem to be radically endangered. -/- Konstytucja RP uznając przyrodzoność i niezbywalność godności oraz uniwersalność niektórych wartości, wprowadza do podstaw całego polskiego systemu prawnego elementy prawnonaturalne, które mogą być wykorzystane w stosowaniu konstytucji. Konstytucyjne uznanie takich elementów ma sens przy założeniu ich poznawalności, stąd istotnym elementem konstytucyjnej koncepcji prawa naturalnego jest uznanie tezy kognitywizmu głoszącej, że oceny moralne mogą mieć charakter sądów i kwalifikację prawdziwościową – mogą być prawdziwe lub fałszywe. W procesie stosowania konstytucji mogą być formułowane normy o charakterze prawnonaturalnym oraz uzasadnienia prawnonaturalne. Ponieważ jedynymi wartościami uznanymi w konstytucji za nienaruszalne jest godność oraz istota wolności i praw, których godność jest źródłem, argumentacja prawnonaturalna może prowadzić do daleko idącej reinterpretacji norm konstytucyjnych. Norma prawnonaturalna chroniąca warunki konieczne poszanowania godności lub istoty wolności i praw będzie miała pierwszeństwo w razie kolizji z normami chroniącymi inne wartości, także z normami konstytucyjnymi. Choć norma taka będzie formułowana na podstawie przepisów konstytucji, to jednak faktycznie prawo naturalne uzyskuje wyższą rangę od elementów opartych jedynie na stanowieniu. Mimo tego bezpieczeństwo prawne nie wydaje się być radykalnie zagrożone. O prawnonaturalnym charakterze normy i uzasadnienia decyduje oparcie w ocenach moralnych, które pretendują do bycia sądami, do bycia prawdziwymi lub fałszywymi. Z punktu widzenia stosowania konstytucji i wymogu intersubiektywnej komunikowalności i kontrolowalności dookreślania treści prawnonaturalnych, dla nadania ocenom charakteru sądów istotny jest kształt procedur i argumentacji prowadzących do tego dookreślenia. Powinny to być procedury i argumentacja typowe dla dyskursu mającego na celu sformułowanie prawdziwych sądów. Maksymalizowana powinna być dyskursywność takich procedur, a podstawą rozstrzygnięcia powinien być, jeśli to tylko możliwe, konsens. Nie mogą być uważane za rozstrzygające argumenty odwołujące się do woli indywidualnej lub zbiorowej, reakcji emocjonalnych, stopnia rozpowszechnienia danej oceny czy do tradycji kulturowej. (shrink)

The paper refers to the argument from hiddenness as presented in John Schellenberg’s book The Hiddenness Argument and the philosophical views expressed there, making this argument understandable. It is argued that conditionals (1) and (2) are not adequately grounded. Schellenberg has not shown that we have the knowledge necessary to accept the premises as true. His justifications referring to relations between people raise doubts. The paper includes an argument that Schellenberg should substantiate its key claim that God has the resources (...) to accommodate the possible consequences of openness to a relationship with finite persons, making them compatible with the flourishing of all concerned and of any relationship that may come to exist between them. At the end of the text, I propose to treat the argument as a rejection of an anthropomorphic God. (shrink)

The fact of religious diversity is vital for the philosopher of religion but also, to some extent, for the believer of a given faith. It takes place in such a dimension in which the views of a given believer or the meaning of the practice of a given religion presupposes the truthfulness of specific claims concerning a given religion or the beliefs included in it. If now on the part of the philosopher of religion or the followers of another religion, (...) there is a direct or indirect challenge to such a key proposition, religious disagreement with epistemic dimension is involved. At the same time, it is not the case that any religious diversity is a case of epistemically significant religious dissent. The paper, by distinguishing different aspects of religions and functions performed by religion, tries to show in which situations religious diversification leads to religious disagreement. Both the follower of religion and the philosopher of religion can and should seek the truth in matters of crucial importance to religion. The difference is that the follower of a given religion is more interested in the salvific and practical functions of religion, along with the associated sense of value and meaningfulness of life and, to a lesser degree, the theoretical certainty that her religion is correct at crucial points. On the other hand, the achievement of ‘the soteriological’ purpose of religion based on false belief is impossible, just as the meaningfulness of life 'based on the sand and not on the rock’. It is because the false foundation is devoid of higher value. That is why there is a community of a philosopher of religion and a follower of a given religion to search for the truth of it. (shrink)

Two modern achievements, the modern figure of the intellectual and the modern institution of the university, have been undergoing a radical crisis of identity. The decline of the philosophical project of modernity is turning out to be a painful process for modern culture: once again it has to reformulate the aims of its social institutions (the university) and the tasks of its cultural heroes (the intellectual). The traditional modern figure of the intellectual seems untenable in our increasingly postmodern cultural surrounding. (...) The modern institution of the university may face a similar fate in our increasingly globalized surrounding: either it is going to accept the rules of bureaucratic consumer-oriented corporations, or it will have to try once again to find a new regulative idea. Thus, the history of the university and the history of the intellectual in the 20<SUP>th century being parallel, the present volume consists of essays in the philosophy of culture (devoted to the intellectual) and in the philosophy of education (devoted to the modern university) and attempts to link the two modern themes together. Philosophizing and the True Knowledge of Human Being -/- The article presents the principles and method of classical philosophy. This kind of philosophy, developed mainly in ancient and medieval times, is still viable and interesting today. What is more important, it can be used as grounds for academic philosophy. Doing so provides a philosopher with resources for autonomy in her philosophical inquiry as well as the usefulness and application of its results for various cultural, social, and political tasks. The last (...) part of the article explains the manner in which the principles of philosophy may be connected with different ways of classical philosopher’s concern the with knowledge of the human being understood as a special, unique being, with her transcendence behind her biological nature and human society. In the conclusion, several tasks for philosophical reflection are given. In all its parts, the article emphasizes the importance of the concept of philosophizing person for the understanding of philosophy. (shrink)

Choć samo zjawisko wykluczenia społecznego nie jest nowe, to jego waga, zwłaszcza w perspektywie praw człowieka, została doceniona stosunkowo niedawno. „Wykluczenie społeczne” nie jest kategorią konstytucyjną. Celem opracowania jest ogólne usytuowanie problematyki wykluczenia w kontekście zagadnień konstytucyjnych. Zmierza się do dookreślenia, czym jest wykluczenie społeczne oraz do wskazania zasadniczych konstytucyjnych punktów odniesienia, pozwalających na podjęcie tego problemu. Właściwe wykluczeniu społecznemu jest złożoność przyczyn - sam brak środków finansowych nie musi prowadzić do wykluczenia, choć proces wykluczania może być zainicjowany jednym wydarzeniem. (...) Jednak wykluczenia nie można adekwatnie scharakteryzować jedynie poprzez jego przyczyny. Wielowymiarowość dotyczy także przejawów wykluczenia. O wykluczeniu społecznym w sensie właściwym mówi się wówczas, gdy ograniczenia dotyczą jednocześnie wielu sfer życia społecznego. Chodzi przy tym o sfery fundamentalne, istotne . Charakterystyczne dla wykluczenia jest dłuższe trwanie w czasie. Często ma wymiar przestrzenny – procesy wykluczania prowadzą do wyodrębnienia obszarów, enklaw zamieszkanych przez wykluczanych, co jeszcze bardziej utrwala stan wykluczenia. Procesy wykluczania prowadzą niekiedy do zjawiska zwanego dziedziczeniem biedy czy wykluczenia. Ochrona przed wykluczeniem, wolność od niego, została uznana za prawo człowieka; prawo niesprowadzalne do tradycyjnie formułowanych praw gospodarczych, socjalnych i kulturalnych; mimo że wykluczenie społeczne dotyczy przede wszystkim udziału w życiu gospodarczym, społecznym i kulturalnym. Wykluczenie jest powiązane z naruszeniem zasady równości, jednak nie daje się ująć jedynie w perspektywie tej zasady, przy czym w szeregu istotnych punktów różni się od dyskryminacji w korzystaniu z praw człowieka. Poszukując w Konstytucji RP, w której brak jest kategorii „wykluczenia społecznego” zasadniczych punktów odniesienia należy poszukiwać w zasadzie godności z art. 30 oraz – w stosunku do obywateli – w art. 1. The article deals with relations between the individual and human rights on the one hand, and the State on the other, in the context of the Constitution of the Republic of Poland. The author poses the question whether the idea of subordination of the State to the individual is really a central idea of that constitution. He puts forward many arguments against such suggestion. These arguments relate, above all, to the arrangement of the constitution: a chapter concerning human rights is (...) chapter II, while chapter I deals with foundation of the State; the goals of the State are specified in the preamble including the following initial phrase “the existence and future of Poland as our Homeland” and in Article 5 where human rights are as subject of protection by the State is mentioned after independence and integrity of [its] territory; a general concept of human rights protection adopted in the constitution is dominated by the structures typical of law in its objective sense; the way of regulation admissible limitations on human rights differs from international standards; possibility of claiming human rights is constitutionally guaranteed, mostly by constitutional complaint which is above all aimed at correction of legal system, rather than claiming of rights by the individual; Article 1 (“The Republic of Poland shall be the common good of all its citizens”) interpreted as referring to Article 1 paragraph 1 of the April Constitution of 1935, one of the main ideas of which was precedence of the State over the individual. He also analyses the arguments in favour of the recognition of the idea of subordination of the State. Nevertheless, they cannot be accepted as resolving the question of whether it is a central idea of the constitution. These arguments include in particular: the principle of subsidiarity contained in the preamble, even if it has not been appropriately emphasized there; recognition of inherent and inalienable dignity of the person, but it was not until Article 30 that this provision has been contained and it does not determine the relations between the human dignity and rights and the State. The author suggests that the only conclusive way to justify the subordination of the State in relation to the individual as a central idea of the constitution is by means of Article 1. Taking into account, above all, preparatory work, we should reject the interpretation of that article referring to the April (1935) Constitution. Essential interpretative context may be found in preparatory work and social teachings of the Catholic Church, referred to therein. In that case, the common good means the entirety of the conditions of social life which favour the human development. These conditions include above all the respect for human dignity. Such interpretation of Article 1 gives priority to proposals on what the State should be to serve the individual rather than to safeguard obligations of citizens in relation to the State. (shrink)

The article provides an analysis of the European Court of Human Rights judgments in the case of Lautsi v. Italy (application no. 30814/06), also known as the Italian crucifix case. The applicant claimed that displaying crucifixes in the Italian State-school classrooms attended by her children was contrary to the principle of secularism, by which she wished to bring up her children, and therefore infringed her right to ensure their education and teaching in conformity with her religious and philosophical convictions, and (...) also breached her freedom of conviction and religion, as protected by Article 9 of the Convention. In its judgment of November 3, 2009, the seven-judge Chamber declared that there had been a violation of Article 2 (right to education) of Protocol No. 1 of the European Convention on Human Rights taken together with Article 9 (freedom of thought, conscience, and religion) of the Convention. The judgment was given unanimously and none of the judges appended a separate opinion. The Italian Government asked for the case to be referred to the Grand Chamber by virtue of Article 43 of the Convention. In the judgment of the Grand Chamber, delivered on March 18, 2011, the Court held, by fifteen votes to two (and with separate opinions of six judges), that there had been no violation of Protocol No. 1 and no violation of the Convention itself. The analysis in the article is focused on selected principal factors determining the Court's decision. It shows that the proposal for the Court to recognize secular convictions as those protected by Article 2 of Protocol No. 1 or Article 9 of the Convention has no sufficient basis in the Convention itself and in earlier Court's case-law and, even, may be considered as promotion of religious intolerance, threatening the freedom to publicly manifest a religion or belief, as guaranteed by Article 9 of the Convention. -/- Opracowanie zawiera analizę wyroków Europejskiego Trybunału, które zapadły w sprawie Soile Lautsi (app. 30814/06), zwaną „włoska sprawa krzyża” (Italian Crucifix Case). W sprawie tej skarżąca zarzucała, że okazywanie znaku krzyża w klasach włoskich szkół państwowych, do których uczęszczały jej dzieci, jest sprzeczne z zasadą sekularyzmu, zgodnie z którą chciała ona wychować swoje dzieci i dlatego stanowi naruszenie jej prawa do wychowania i nauczania zgodnego z jej religijnymi i filozoficznymi (moralnymi) przekonaniami, oraz stanowi naruszenie wolności religijnej, gwarantowanej art. 9 Konwencji. W wyroku siedmioosobowej izby ogłoszonym 3 listopada 2009 r. izba uznała naruszenie art. 2 (Prawo do nauki) Protokołu dodatkowego nr 1 do Konwencji o ochronie praw człowieka i podstawowych wolności w powiązaniu z art. 9 (Wolność myśli, sumienia i wyznania) Konwencji. Wyrok zapadł jednomyślnie i żaden z sędziów nie dołączył do wyroku swoich uwag. Rząd Włoch złożył wniosek w trybie przewidzianym art. 43 Konwencji o przekazanie sprawy do Wielkiej Izby. W wyroku Wielkiej Izby ogłoszonym 18 marca 2011 r. Trybunał uznał zdecydowaną większością głosów – 15 za wobec 2 przeciw (sześciu sędziów dołączyło swoje uwagi), że nie doszło do naruszenia ani Protokołu nr 1, ani samej Konwencji. Analizy koncentrują się na wybranych zagadnieniach, kluczowych dla argumentacji Trybunału. Analizy te pokazują, że postulowanie przez izbę uznania za prawo podmiotowe radykalnie pojętej negatywnej wolności religijnej, oraz postulowanie - tak przez izbę, jak i przez Wielką Izbę - ochrony przekonań sekularystycznych jako przekonań chronionych art. 2 Protokołu dodatkowego nr 1 lub art. 9 Konwencji, nie posiada należytego uzasadnienia ani w samej Konwencji, ani w dotychczasowym orzecznictwie Trybunału, a co więcej – może być uznane za propagowanie nietolerancji religijnej, godzącej przede wszystkim chronioną art. 9 Konwencji wolność publicznego uzewnętrzniania przekonań religijnych i filozoficznych. The article analyzes and criticizes the assumptions of Peter Van Inwagen’s argument for the alleged contradiction of the foreknowledge of God and human freedom. The argument is based on the sine qua non condition of human freedom defined as access to possible worlds containing such a continuation of the present in which the agent implements a different action than will be realized de facto in the future. The condition also contains that in every possible continuation of the present state of (...) affairs, the same propositions about the ‘present past’ (the past before the present moment) are true as are true in the present state of affairs. The paper argues that Van Inwagen’s reasoning is inconclusive, it contains the type of mistake of confusing conditional impossibility with unconditional and presents a methodologically wrong method of solving a philosophical problem. It is because in the very construction of the problem determining the available solution. The article points to the possibility that the human freedom of some action is not excluded by the fact that specific past facts logically entail that this event will occur. (shrink)

This article first of all attempts to assess the proposals of 2006–2007 to amend Poland’s Constitution, aimed mostly at strengthening constitutional protection of unborn human life. Parliamentary work on this proposal begins with the submission of the Deputy’s bill on amendment of the Constitution, published in the Sejm Paper No. 993 of September 5, 2006, and ends with a series of votes at the 39th sitting of the Sejm of the fifth term of office, held on April 13, 2007, on (...) which it was decided not to adopt any amendment. In the course of the legislative process, several modifi cation were offered not only to Article 38 concerning protection of life, but also to Article 30 dealing with dignity as a source of rights. Each of these proposals had drawbacks, including inter alia: the lack of a definite period of protection or entitlement to dignity, resulting in the decreased protection in relation to issues concerning euthanasia; the application of new categories granting a specific status to unborn human life; specifying the standards for protection by means of legislative acts ranking lower than a constitution, resulting in the transfer of life protection into the sphere of regulation of ordinary legislation. The most conducive for strengthening of the protection of unborn human life, even if not free of imperfections, was an amendment of Article 30 proposed by the Committee in the following wording: “The inherent and inalienable dignity, conferred on the person from the moment of conception, shall be a source of freedoms and rights of persons and citizens. It shall be inviolable; the respect and protection thereof shall be the obligation of public authorities.” From the rejection of the proposals it is diffi cult to draw conclusions that are vital for interpretation of the existing provisions. However, a conclusion that the intention of the authors of the constitution was not to strengthen the constitutional protection of life is not legitimate, mostly because of their doubts about formal correctness of the proposed amendments (when deciding to reject them), particularly the doubts about legal consequences of their adoption. -/- Streszczenie Zasadniczym celem opracowania jest próba całościowej oceny propozycji nowelizacji Konstytucji RP mającej miejsce w latach 2006-2007, zmierzającej przede wszystkim do wzmocnienia konstytucyjnej ochrony życia człowieka przed narodzeniem. Prace parlamentarne nad analizowaną nowelizacją otwiera poselski projekt ustawy o zmianie Konstytucji zawarty w druku sejmowym 993 z dnia 5 września 2006 (projekt wpłynął do Sejmu 7 września); zamyka seria głosowań na 39 posiedzeniu Sejmu V kadencji, dnia 13 kwietnia 2007 roku; głosowań, które przesądziły o niewprowadzeniu żadnych zmian. W trakcie procesu legislacyjnego proponowano szereg formuł, zmieniających nie tylko art. 38 dotyczący ochrony życia, ale także art. 30, który dotyczy godności jako źródła praw. W zasadzie wszystkie zgłoszone propozycje posiadały wady, wśród których najważniejsze to: brak domknięcia okresu ochrony lub przysługiwania godności, skutkujący obniżeniem ochrony w kwestiach związanych z eutanazją; stosowanie nowych kategorii, prowadzące do nadania specyficznego statusu człowiekowi przed narodzeniem; określanie standardu ochrony za pośrednictwem aktów o randze niższej od konstytucji, prowadzące do przesunięcia ochrony życia przed narodzeniem w sferę ustawodawstwa zwykłego. Z punktu widzenia celu, jakim było wzmocnienie konstytucyjnej ochrony życia człowieka przed narodzeniem i wzmocnienie jego pozycji prawnej, najlepsza, choć nie pozbawiona usterek, była zaproponowana przez Komisję zmiana brzmienia art. 30 prowadząca do formuły: „Źródłem wolności i praw człowieka i obywatela jest przyrodzona i niezbywalna godność człowieka, przynależna mu od chwili poczęcia. Jest ona nienaruszalna, a jej poszanowanie i ochrona jest obowiązkiem władz publicznych.”. Na podstawie odrzucenia propozycji zmian trudno wyciągać wnioski istotne dla interpretacji aktualnie obowiązujących przepisów; wniosek, że ustrojodawca nie chciał wzmocnienia konstytucyjnej ochrony życie nie jest prawomocny, przede wszystkim ze względu na – istotne w procesie podejmowania decyzji o odrzuceniu propozycji zmian – wątpliwości, co do formalnej poprawności formułowanych propozycji, w tym wątpliwości co do konsekwencji prawnych ich przyjęcia. The article discusses Nicholas Rescher’s metaphilosophical view of orientational pluralism. In his essay "Philosophical Disagreement: An Essay towards Orientational Pluralism in Metaphilosophy" Rescher explains a substantial difference between philosophy and science—namely, that philosophers—differently than scientists—continuously propose and undermine various solutions to the same old problems. In philosophy it is difficult to find any consensus or convergence of theories. According to Rescher, this pluralism of theoretical positions is caused by holding by philosophers different sets and hierarchies of cognitive values, i.e. methodological (...) orientations. These orientations are chosen in virtue of some practical postulates, they are of axiological, normative, but not strictly theoretical character. Different methodological orientations yield different evaluations of philosophical theses and arguments. This article shows that Rescher’s account does not determine clearly acceptable cognitive values. If there are no clear criteria of evaluation of methodological orientations, then the described view seems to be identical to relativism adopting the 'everything goes' rule. In addition, accepting orientational pluralism it is hard to avoid the conclusion that discussions between various philosophical schools are futile or can be reduced to non-rational persuasion. This article presents Alvin Plantinga’s views on epistemic justification. The first part situates Plantinga’s epistemological views in the context of his epistemology of religion and debates of general epistemology. The second part discusses Plantinga’s argument that the internalism of 20th century epistemology stems from deontologism and that the views on the epistemic justification of analytic philosophers reflect the relationship between classical deontologism and classical internalism. In philosophical literature terms: „natural theology” (or „rational theology”) and „philosophical theology” are used as exchangeable. The author argues that natural and philosophical theology are different philosophical disciplines. It is possible to point out a philosophic theology, different from natural theology, the former aims are not only supposed to show that God exists but to unifícate, interpret and explain (understand) religious faith and her tasks are not primary apologetic. The author considers that the aims of the latter discipline are bound (...) with the preference of cognitive values such as certainty, rationality and being able to use one ’s rationality to convince your opponent. In the end of this article author introduces a sketch of method of philosophical theology as different form natural theology, which could overcome one-sided views about role of philosophical argument in study of religious belief and faith and their propositional content and lead not only to a more adequate analysis of the researched reality but also to the development of other disciplines. Short paper about debate on cognitive meaning of religious use of language in early analytic philosophy of religion. Published in Companion to Philosophy of Religion, edited by Janusz Salamon, Cracow: WAM, 2016.

The article aims to determine whether it is possible to build the reliably practiced classical philosophy, understood as a metaphysical research, directed towards the nature of objective reality. The purpose of this kind of philosophizing is knowledge and truth. Moreover, the practice of such philosophizing and its results should meet some of the characteristics of science. The paper establishes a set of conditions that have been imposed on the science of metaphysics by Kazimierz Twardowski. Among the conditions of such philosophizing (...) are anti-dogmatism, criticism, inter-subjectivity of philosophizing and its results, proper epistemic justification of philosophical beliefs, application of the analysis method, rigorous language and reasoning, the use of experience and scientific knowledge. The paper considers these conditions to be correct in most cases and argues that metaphysics can meet them. The existing cases of analytical metaphysics show that metaphysics is possible as a science. Next, the article argues that the late Twardowski failed to substantiate his claim that metaphysical positions which he classified as a world-view philosophy could not be scientifically justified, which could have been possibly done with differentiating ways of understanding what such a scientific justification should be. The article argues that he did not take into account a reductive conception of the metaphysical philosophy, which even though it allows the plurality of metaphysical explanations and does not force anyone to accept one position as the only possible and correct explanation, would have an objective value, if such metaphysics were elaborated indeed. PETER KNAUER'S CONCEPTION OF MORAL CHOICE ON THE ANTHROPOLOGICAL CREAITVENESS IN MODERN MORAL THEOLOGY Summary The author undertakes a critical analysis of the ethical views of Peter Knauer who is one of the most influential theological moralist today. The author tends to show the consequences of Knauer's theory which consequences are destructive for morality. The first part of the paper presents Knauer's standpoint in view of the conception of moral choice and shows three crucial points of his system. They are (...) the following: the definition of moral good (lightness) in its relation to physical good; the reinterpretation of the principle of double effect which reinterpretation reduces that principle to its "Ideological explanation"; and, finally, the conception of the so-called non-counterproductivity which decides whether an activity is right. That non-counterproductivity is comprehended as an all-embracing correspondence between the goals which the subject has chosen and means which the subject has taken in order to accomplish the goals. In the second critical part one finds some questions related to the immanent critique of the discussed theory and some consequences of Knauer's claims. If one applies his assumptions strictly, it turns out that in his model of morality there is no place for such an activity of man which, at the same time, would be both rational and free, i.e., sensu stricto moral. In view of Knauer's system the criteria of moral evaluation, which criteria he proposed, do not hold sense. Thus morality and ethics lose their essential normative character. Consequently, the system under scrutiny leads to an antipersonalistic vision of both an individual and society, and in terms of eternity it seems to dismiss the possibility of recognizing the existence of Absolute. Celem opracowania jest dookreślenie tego, czym jest prywatność. Interesuje mnie prywatność w aspekcie nor¬matywnym, jako coś, co uważamy za nasze dobro; coś, czego się domagamy, co jest naszym prawem, i to nie tylko w sensie moralnym, ale także chronionym prawem pozytywnym. Prywatność jest czymś relacyjnym, i to przynajmniej w dwojakim znaczeniu. Po pierwsze, konstytuowana jest poprzez relację oddzielenia od czegoś - państwa, zakładu pracy (pracodawcy), rozmaitych instytucji. Po drugie, to, co prywatne z punktu widzenia jednych relacji - np. relacji jednostki (...) do państwa, do sprawowanych urzędów - nie musi być prywatne z punktu widzenia pracy zawodowej. Prywatność nie jest oparta na prostej opozycji pomiędzy tym, co społeczne, grupowe, a tym, co osobiste, indywidualne; podmiotem prywatności może być podmiot zbiorowy i nie wobec każdej grupy społecznej można się sensownie domagać prywatności. Prywatność pozwala w pełni dysponować tym, co „moje”. Sfera prywatna daje szczególne możliwości realizacji moich własnych celów, uzyskuję przestrzeń indywidualizacji, realizacji siebie jako niepowtarzalnej jednostki, której też sam jestem autorem. W sferze prywatnej podmioty stają się też podmiotami tworzącymi przestrzeń normatywną, uznając reguły rozpoznawane jako wyraz tego, co naturalne, zastane, i tworząc lub współtworząc z innymi uczestnikami tej sfery własne reguły, realizując przez to istotny wymiar autonomii osoby. Prywatność daje wreszcie przestrzeń dla rozwoju relacji ściśle osobowych, opartych na wyłączności tego, co między osobami się rozgrywa. Mając na uwadze zbieżność dążenia do ograniczania prywatności z wprowadzaniem elementów totalitarnych, można także zauważyć, że ochrona prywatności nie tylko chroni jednostki, ale i potrzebna jest sferze publicznej jako jeden ze środków przeciwko wadom rozwiązań totalitarnych. I argue that Ireneusz Ziemiński doesn't justify his skepticism about knowledge of existence of God. First, he reduces a question to metaphysical one - do we have sound, valid proofs of God's existence and imposes too heavy conditions on arguments for God. Second, he doesn't show that disagreement between philosophers in that question justify his negative assessment of arguments. Third, Ziemiński omits epistemological question what is knowledge of God's existence, especially in its direct form as well as externalistic account's of (...) knowledge of God, for example Plantinga's and Alston's. On Conditions of Participation: The Deficits of Public Reason The paper analyzes the conditions of civic participation that are elucidated by criticism of the deficits of public reason. The interpretation proceeds in three steps. First, the idea of public reason and discourse is analyzed, followed by an explanation of democratic deficit and of the social deficit in the second and third steps, respectively. These deficits are analyzed as an essential limit to political and social conditions of the participation of citizens. (...) The analysis focuses thereby on the theory of public reason by one of the most influential political philosophers of the last decades, John Rawls. The paper identifies two main pitfalls in his theory: first, the deficit following from an inadequate integration of an individual into society, which, in this case, represents democratic deficit, second, the deficit linked with underrating the socio-distributive dimension of justice, which means a social deficit. The article deals with the theme of updating of Cuba’s economic model mainly from the perspective of economic and political philosophy and its interdisciplinary contexts. First, it examines the historical origins of Cuba’s socialist model and the subsequent changes after the fall of the Eastern Bloc. Second, it analyses the actualization of Cuba’s model in the first two decades of the 21st century, that is, mainly the introduction of market and private ownership to complement planning and public ownership. Third, it (...) explains the codification of these changes in the new constitution. Forth and finally, it focuses on an interpretation of international cooperation both in Latin America, especially within the framework of the two pink tides, and with other partners in global interactions, particularly China. This will make it possible to understand the updated Cuba’s model, which the author has coined strategic socialism with Cuban characteristics. (shrink)

Text se zaměřuje na ideu otroctví v dějinách evropského a severoamerického myšlení. Věnuje se souboru šestnácti esejí Zotročení svobodou (2010), v němž Petr Bláha mapuje pojetí otroctví u vybraných filosofů v těchto dějinách a koncentruje se zejména na myšlenky autorů evropského kánonu. Postupuje chronologicky, začíná tradičně od antiky a pokračuje až do 20. století. K autorům, kteří měli na Bláhovo stanovisko největší formativní vliv, patří novověcí filosofové, s nimiž sdílí jak témata, tak do velké míry i přístup k nim. S (...) tím souvisí i zájem o ideu svobody, která do určité míry stála v opozici k ideji otroctví. Odtud ve svém paradoxním důsledku pochází myšlenka „zotročení svobodou“. (shrink)

A Higgsless model for strong, electroweak and gravitational interactions is proposed. This model is based on the local symmetry group SU(3)×SU(2)L×U(1)×C,where C is the local conformal symmetry group. The natural minimal conformally invariant form of total Lagrangian is postulated. It contains all standard model fields and gravitational interaction. Using the unitary gauge and the conformal scale fixing conditions, we can eliminate all four real components of the Higgs doublet in this model. However, the masses of vector mesons, leptons, and quarks (...) are automatically generated and are given by the same formulas as in the conventional standard model. In this manner one gets the mass generation without the mechanism of spontaneous symmetry breaking and without the remaining real dynamical Higgs field. The gravitational sector is analyzed, and it is shown that the model admits in the classical limit the Einsteinian form of gravitational interactions. (shrink)

W artykule autor chciałby, na przykładzie XX‑wiecznego czeskiego filozofa Jana Patočki, przedstawić problem wolności człowieka skonfrontowanej z dwojakiego rodzaju doświadczeniami: wojny oraz przemocy politycznej reprezentowanej przez państwo totalitarne. Te dwa doświadczenia można z pewnością traktować jako historyczne doświadczenia zła. Chodzi więc o konfrontację między ludzką wolnością a złem. W tym kontekście czeski myśliciel starał się odpowiedzieć na pytanie: jakiego rodzaju odpowiedzi moralnej w takiej sytuacji może czy nawet powinien udzielić człowiek? Jak człowiek może lub powinien się zachowywać, doświadczając zła? Freedom (...) and evil in politics. Reflections on war and totalitarianism in the thought of Jan Patočka Taking the 20th century Czech philosopher Jan Patočka as an example, in this paper, the author would like to illustrate the problem of human freedom when dealing with two kinds of experiences: war and political violence, as exemplified by the totalitarian state. Indeed, it is possible to treat these two types of experiences as historical experiences of evil. What is at stake, then, is the juxtaposition of human freedom and evil. Given this context, the Czech thinker sought to answer the question: in such a situation, with which moral response can or should one reply? When experiencing evil, how can or should a person behave?
