Should decision-making algorithms be held to higher standards of transparency than human beings? The way we answer this question directly impacts what we demand from explainable algorithms, how we govern them via regulatory proposals, and how explainable algorithms may help resolve the social problems associated with decision making supported by artificial intelligence. Some argue that algorithms and humans should be held to the same standards of transparency and that a double standard of transparency is hardly justified. We give two arguments (...) to the contrary and specify two kinds of situations for which higher standards of transparency are required from algorithmic decisions as compared to humans. Our arguments have direct implications on the demands from explainable algorithms in decision-making contexts such as automated transportation. (shrink)

Traditional discussions about the arrow of time in general involve the concept of entropy. In the cosmological context, the direction past-to-future is usually related to the direction of the gradient of the entropy function of the universe. But the definition of the entropy of the universe is a very controversial matter. Moreover, thermodynamics is a phenomenological theory. Geometrical properties of space-time provide a more fundamental and less controversial way of defining an arrow of time for the universe as a whole. (...) We will call the arrow defined only on the basis of the geometrical properties of space-time, independently of any entropic considerations, “the global arrow of time.” In this paper we will argue that: (i) if certain conditions are satisfied, it is possible to define a global arrow of time for the universe as a whole, and (ii) the standard models of contemporary cosmology satisfy these conditions. We put forth an account for when to believe causal and evidential conditionals. The basic idea is to embed a causal model in an agent’s belief state. For the evaluation of conditionals seems to be relative to beliefs about both particular facts and causal relations. Unlike other attempts using causal models, we show that ours can account rather well not only for various causal but also evidential conditionals.

We propose a semantics for a connexive conditional based on the Lewis-Stalnaker conditional. It is a connexive semantics that is both classical and intuitive.

The aim of this paper is to analyze time-asymmetric quantum mechanics with respect to the problems of irreversibility and of time's arrow. We begin with arguing that both problems are conceptually different. Then, we show that, contrary to a common opinion, the theory's ability to describe irreversible quantum processes is not a consequence of the semigroup evolution laws expressing the non-time-reversal invariance of the theory. Finally, we argue that time-asymmetric quantum mechanics, either in Prigogine's version or in Bohm's version, does (...) not solve the problem of the arrow of time because it does not supply a substantial and theoretically founded criterion for distinguishing between the two directions of time. According to ontological reductionism, molecular chemistry refers, at last, to the quantum ontology; therefore, the ontological commitments of chemistry turn out to be finally grounded on quantum mechanics. The main problem of this position is that nobody really knows what quantum ontology is. The purpose of this work is to argue that the confidence in the existence of the physical entities described by quantum mechanics does not take into account the interpretative problems of the theory: in the discussions about the (...) relationship between chemistry and physics, difficulties are seen only on the side of chemistry, whereas matters highly controversial on the side of physics are taken for granted. For instance, it is usually supposed that the infinite mass limit in the Born-Oppenheimer approximation leads by itself to the concept of molecular framework used in molecular chemistry. We will argue that this assumption is implicitly based on an interpretative postulate for quantum mechanics, which, in turn, runs into difficulties when applied to the explanation of the simplest model of the hydrogen atom. One of the open questions in Bayesian epistemology is how to rationally learn from indicative conditionals (Douven, 2016). Eva et al. (Mind 129(514):461–508, 2020) propose a strategy to resolve this question. They claim that their strategy provides a “uniquely rational response to any given learning scenario”. We show that their updating strategy is neither very general nor always rational. Even worse, we generalize their strategy and show that it still fails. Bad news for the Bayesians.

We propose a method of learning indicative conditional information. An agent learns conditional information by Jeffrey imaging on the minimally informative proposition expressed by a Stalnaker conditional. We show that the predictions of the proposed method align with the intuitions in Douven, 239–263 2012)’s benchmark examples. Jeffrey imaging on Stalnaker conditionals can also capture the learning of uncertain conditional information, which we illustrate by generating predictions for the Judy Benjamin Problem.

Two concepts of truth as correspondence of ideas with facts are analyzed. One of them is the thought-external fact relation, and the other is the fact-proposition one. The two maps are then composed, and the resulting map is assumed to formalize the concept of truth as adequacy or correspondence of ideas to facts. Besides, some desiderata for a correspondence theory of partial truth are proposed. Finally, the truth criteria employed in science and technology are recalled.

This essay addresses the relationships between prescription and description in legal rules. The analysis will focus on the culture-laden connotations of factual categories implied in all legal sentences and/or provisions. This investigation is spurred by the need to assess the impact of cultural difference in people’s understanding of legal imperatives and, symmetrically, how that impact is to be considered in the application of law. Differences in ways of categorizing the world could position the cultural pre-understanding required by law, and the (...) pluralism recognized and protected by constitutional principles and human/fundamental rights discourse, at a crossroads. Hence, even when we find an illegitimacy or an ignorance about what legal rules do not explicitly state but instead implicitly presuppose, this does not exclude that behind that ignorance there may be something worthy of legal protection. A question emerges: is it legitimate and reasonable to consider the ignorantia facti resulting from differing ways of categorizing the factual world as automatically and uncritically subject to the principle ignoratia legis non excusat? The essay continues with an assessment of the possible consequences of ignorantia facti in the administration of justice in multicultural societies and migration contexts. For this purpose, the opportunity for an intercultural use of law—including within national law—will be considered as a means of avoiding the discriminatory application of ignorantia facti. This topic will be addressed by leveraging both semiotic and cultural-anthropological analytical tools, including the well-known greimasien “contrat de véridiction”. (shrink)

Reading through the Corpus Aristotelicum we come across a group of expressions meant to indicate predicative relations, which lead us to think that Aristotle connected predication to a part-whole relation. He frequently calls the ‘εἴδη’, “species”, ‘μέρη’, “parts”, of their genera. More generally, the universal is said to contain that of which it is true. In a parallel way, what is contained by something is also what is under something else. Again, it is quite common for him to consider the (...) species as partaking of their genera. Although the relation of partaking is normally used to qualify the way in which species are related to their genera, sometimes also the relation between particulars and species or even genera is expressed in terms of partaking. Classical philosophical Daoism as it is expressed in the Dao-De-Jing and the Zhuang-Zi is often interpreted as lacking a capacity for critique and resistance. Since these capacities are taken to be central components of Enlightenment reason and action, it would follow that Daoism is incompatible with Enlightenment. This interpretation is being refuted by way of developing a constructive dialogue between the enlightenment traditions of critical theory and recent philosophy of action from a Daoist perspective. Daoism's normative naturalism does neither rest (...) on a primitivist call for a return to the past, nor does it suggest future-directed activism. By way of reconstructing its descriptive, explanatory and emancipatory dimensions, it is shown that Daoism constitutes an alternative form of critical theory. In contrast to future-directed purposive action or blind rule-following, Daoism's key normative concept of "wu-wei" emphasizes effortless non-calculative responsiveness in the present. Drawing on recent insights in the philosophy of action, a reconstruction of wu-wei allows to conceive of a promising form of emancipatory agency. (shrink)

Up until recently social scientists took it for granted that their task was to account for the social world as objectively as possible: they were realists in practice if not always in their methodological sermons. This situation started to change in the 1960s, when a number of antirealist philosophies made inroads into social studies. -/- This paper examines critically the following kinds of antirealism: subjectivism, conventionalism, fictionism, social constructivism, relativism, and hermeneutics. An attempt is made to show that these philosophies (...) are false and are causing serious damage to social studies. -/- Next the subjective interpretation of probability is analyzed as a case of subjectivism. An approach to the subjective perception of justice is sketched as an example of the objective study of subjective experience. -/- Finally, the three main varieties of realism — naive, critical, and scientific — are outlined. It is argued that the scientific attitude involves scientific realism, which is put in practice even by scholars who, like Weber and Simmel, called themselves antirealists. (shrink)

Artificial Intelligence (AI), especially in its current incarnation of Machine Learning (ML), is an endeavor that is characterized by contingencies of two kinds. Intrinsic contingencies stem from the use of specific computational techniques that seem to decrease the control that human users exert on this technology. Relational contingencies emerge from the interaction of AI with other disciplines and contexts. I conduct an analysis of these contingencies on the backdrop of the visual arts with the aim to shed light on the (...) complex relations between technology and creativity. (shrink)

The many constraints of outer space experience challenge the human ability to coexist. Paradoxically, astronauts assert that on the international space station there are no conflicts or, at least, that they are able to manage their differences, behavioral as well as cognitive, in full respect of human rights and the imperatives of cooperative living. The question is: Why? Why in those difficult, a-terrestrial, and therefore almost unnatural conditions do human beings seem to be able to peacefully and collaboratively live together? (...) What is there beyond terrestrial boundary conditions that allows for such a result? And what can we learn from the astronauts’ experience about the effectiveness of human rights on Earth? My proposal is that the a-terrestrial dimension deeply alters the mind/body indexical framework and, in this way, disentangles the human inclination to semiosis from the cognitive and behavioral habits of categorization and territorialization inherent in the experience on Earth. If analyzed through the spectrum of an interdisciplinary approach involving anthropology, semiology, law, and human geography, I think that outer space enterprises can offer many insights into the cognitive and ethical/political hindrances to the effectiveness of human rights and their intercultural uses. Meanwhile the compulsive greed for a possessive territorialization of outer space and celestial bodies is growing by leaps and bounds. It haunts and imbues both astropolitics and space law. The astronauts’ semio-anthropological experience of human rights and cooperative coexistence seems to have been left in orbit. The future requires awareness and action by anthropologists, semioticians, cognitive scientists, geographers and lawyers, working all together in an interdisciplinary effort to move beyond approaching the experiential with a territorial mindset. The hope is that the “dark dream” of human exploitation/colonization of outer space will not turn from a political and legal speculation into a future reality. (shrink)

Our account of the problem of the classical limit of quantum mechanics involves two elements. The first one is self-induced decoherence, conceived as a process that depends on the own dynamics of a closed quantum system governed by a Hamiltonian with continuous spectrum; the study of decoherence is addressed by means of a formalism used to give meaning to the van Hove states with diagonal singularities. The second element is macroscopicity represented by the limit $\hbar \rightarrow 0$ : when the (...) macroscopic limit is applied to the Wigner transformation of the diagonal state resulting from decoherence, the description of the quantum system becomes equivalent to the description of an ensemble of classical trajectories on phase space weighted by their corresponding probabilities. A common and disabling consequence of stroke is the difficulty in processing contralesional space (i.e., hemispatial neglect). According to paper-and-pencil tests, neglect remits or stabilizes in severity within a few months after a brain injury. This arbitrary temporal limit, however, is at odds with neglect’s well-known dependency on task-sensitivity. The present study tested the hypothesis that the putative early resolution of neglect might be due to the insensitivity of testing methods rather than to the lack of spontaneous recovery at later (...) stages. A right hemisphere stroke patient was studied longitudinally for 3 years. According to paper-and-pencil tests the patient showed no symptom of hemispatial neglect 1 month post stroke. Awareness of spatially lateralized visual targets was then assessed by means of computer-based single- and dual-tasks requiring an additional top-down deployment of attention for the parallel processing of visual or auditory stimuli. Errorless performance at computer-based tasks was reached at month 12 and maintained until month 29 after stroke. A bottom-up manipulation was then implemented by reducing target diameter. Following this change, more than 50% of contralesional targets were omitted, mostly under dual-tasking. At months 40 and 41 the same task revealed a significant (but not complete) reduction in the number of contralesional omissions. Ipsilesional targets were, in contrast, still errorless detected. The coupling of a bottom-up (target change) and a top-down (dual-tasking) manipulation revealed the presence of a long-lasting spontaneous recovery from contralesional spatial awareness deficits. In contrast, neither manipulation was effective when implemented separately. After having excluded the potential confound of practice effects, it was concluded that not only the presence but also the time course of hemispatial neglect strongly depends on the degree of attentional engagement required by the task. We investigate the possibility to characterize (multi) functions that are Σ b i -definable with small i (i = 1, 2, 3) in fragments of bounded arithmetic T 2 in terms of natural search problems defined over polynomial-time structures. We obtain the following results: (1) A reformulation of known characterizations of (multi)functions that are Σ b 1 - and Σ b 2 -definable in the theories S 1 2 and T 1 2 . (2) New characterizations of (multi)functions that are (...) Σ b 2 - and Σ b 3 -definable in the theory T 2 2 . (3) A new non-conservation result: the theory T 2 2 (α) is not ∀Σ b 1 (α)-conservative over the theory S 2 2 (α). To prove that the theory T 2 2 (α) is not ∀Σ b 1 (α)-conservative over the theory S 2 2 (α), we present two examples of a Σ b 1 (α)-principle separating the two theories: (a) the weak pigeonhole principle WPHP (a 2 , f, g) formalizing that no function f is a bijection between a 2 and a with the inverse g, (b) the iteration principle Iter (a, R, f) formalizing that no function f defined on a strict partial order ( $\{0,\dots,a\}$ , R) can have increasing iterates. Physicists and philosophers today have formulated three opposing models that explain how laws work. Which is the best?

This essay, between serious and facetious, addresses an apparently secondary implication of the planetary tragedy produced by Covid-19. It coincides with the ‘problem of the veil,’ a bone of contention in Islam/West relationships. More specifically, it will address the question of why the pandemic has changed the proxemics of public spaces and the grammar of ‘living together.’ For some time—and it is not possible to foresee how much—in many countries people cannot go out, or enter any public places, without wearing (...) a sanitary mask. In short, almost all of us, by obligation or by urgent advice from the public authorities of the various countries, will not live the public sphere with our faces uncovered. The alteration of the social context affecting many Western countries will inevitably involve also the ‘local’ perception of the Islamic veil and—as a matter of equality—the consistency of the prohibition of wearing it. What will thus become of the ban on wearing it in public places established by some countries such as France and asseverated by the ECHR? If everyone can and will have to go around with their faces covered, why should only Islamic women be discriminated against? Will not the change in boundary conditions produced by Covid-19 also induce Western people to re-categorize the meaning of the veil? And will this re-categorization not directly affect the ‘fact’ of wearing the veil, that is, its empirical perception? And still, will this psycho-semantic change not show how empirical perceptions are cultural constructs rather than ‘objective facts,’ as such allegedly independent from the observer’s point of view? Consequentially, will the plurality of perceptions and cultural meanings related to the gesture of covering one’s own face not gain renewed relevance in determining the legitimacy of wearing the veil? The socio-semantic earthquake produced by Covid-19 compels us to rethink this and other issues orbiting around the translation of ‘facts’ into legal language; furthermore, it highlights the instrumentality of many ideological/partisan and ethnocentric assumptions passed off as objectivity regarding those alleged ‘facts.’ The essay will attempt to provide an answer to the above questions by proposing a semiotic-legal approach to intercultural conflicts and, indirectly, the pluralism in law. Recently the CJEU decision in the case of ‘Ewa Glawischnig-Piesczek v. Facebook Ireland Limited’ has raised the issue of the transcultural/trans-territorial signification of hate speech and hate crimes. Taking a cue from this decision and the related semiotic/legal implications, the paper proposes an analysis of the semio/pragmatic conditions for the production of performativity inherent in hate speech across different cultural universes of discourse. Given that web-based digital communication is global—at least, potentially—regardless of any spatial/political compartmentalization, it crosses different semio-cultural circuits. (...) This trans-spatiality implies transcultural crossings that can multiply and even transfigure the semantic implications of the original signifier and the related prognoses of ‘semantic effectiveness.’ Cultural boundaries therefore may function as a kind of ‘horizon of events’ for hate speech and, more inclusively, all linguistic acts and their legal signification/classification. The question then arises regarding whether and to what extent the performativity of hate speech is able to withstand the variation of cultural boundary conditions. Insofar as cultures are universes of experience, the issue to be investigated broadens, and ends up invoking the question of whether or not the production of performativity implicitly presupposes and tacitly epitomizes the semio-pragmatic implications/consequences (or, in Peircean terms, ‘bearings’) coextensive with cultural universes of experience. Were this the case, it would seem to call into question the very possibility of ‘making things only with words,’ or more explicitly, the alleged meaning of ‘linguistic acts.’. (shrink)

The Bible recounts that in Eden, Adam gives names to all the animals. But those names are not only representations of the animals’ nature, rather they shape and constitute it. The naming by Adam contains in itself the divide between the human and non-human. Then, there is the Fall: Adam falls and forgets Being. Though he may still remember the names he gave to the animals in Eden, he is no longer sure about their meaning. Adam will have to try (...) to remember his own intentions. Through this effort he can also become aware of how he thinks, who he is, and what was the natural order he knew before the Fall. Medieval bestiaries tell us this story. Bestiaries are works of word play populated by animal figures. They depend on back-and-forth anthropomorphization, or circular metaphor. Animal figures are portrayed as both a mirror of human nature and a window on it. Bestiaries served as means for the moral education of human beings and, at the same time, a way to criticize the current state of humanity, including political and ethical habits. Within the moral irony of medieval bestiaries we can find the origin of the invented nature that modernity will try, subsequently, to insert into natural rights discourse through the teleological oxymoron of their naturalized and naturalizing counter-factuality. I will propose a historical-semiotic journey through the ironic representations of the human-beasts from the ancient world to contemporaneity. The proposal resulting from this cultural excursion is that the words included in the many national and international Rights declarations operate much like the names Adam gave to the animals and still more as they were re-read in medieval bestiaries, both textual and musical. So, can the words of Rights still serve as musical scores, open to an infinite play of re-signification? If we were able to overcome the modern culture/nature and human being/animal dualisms, we could cast, today as in the past, a zoological gaze on human rights by means of contemporary bestiaries and, in this way, perhaps find the gist of rights’ names and our ever regained and ever lost again humanity. Terms such as 'despotism' and 'tyranny' which proved efficacious in clarifying political debate until the beginning of the 19th century, have been eliminated from the vocabulary of political science because of a confusion that has muddled their sense. This vocabulary has thus become impoverished to the advantage of terms like 'autocracy', or yet others, especially 'dictatorship', equally vague and imprecise. This article demonstrates (through the adventures of the term 'despotism' during 23 centuries) that we have forgotten a distinction between these (...) two 'conceptual terms' which was clear in the past, and it attempts to understand at which moment in history the confusion occurred and why. There is no question of restoring the distinction in contemporary political vocabulary. This work would simply like to encourage people to reflect on the political terminology inherited from tradition, on the correct use of concepts and of their definitions, in order to reintegrate political vocabulary and render it more useful in decrypting contemporary reality, which remains often complex and even undecipherable. Epistemologists have debated at length whether scientific discovery is a rational and logical process. If it is, according to the Artificial Intelligence hypothesis, it should be possible to write computer programs able to discover laws or theories; and if such programs were written, this would definitely prove the existence of a logic of discovery. Attempts in this direction, however, have been unsuccessful: the programs written by Simon's group, indeed, infer famous laws of physics and chemistry; but having found no new (...) law, they cannot properly be considered discovery machines. The programs written in the Turing tradition, instead, produced new and useful empirical generalization, but no theoretical discovery, thus failing to prove the logical character of the most significant kind of discoveries. A new cognitivist and connectionist approach by Holland, Holyoak, Nisbett and Thagard, looks more promising. Reflection on their proposals helps to understand the complex character of discovery processes, the abandonment of belief in the logic of discovery by logical positivists, and the necessity of a realist interpretation of scientific research. This paper explores some aspects of the scientific study of creativity by focusing on intentional attempts to create instances of linguistic humour. We argue that this sort of creativity can be accounted for within an influential cognitive approach but that said framework is not a recipe for producing novel instances of humour and may even preclude them. We start by identifying three great puzzles that arise when trying to pin down the core traits of creativity, and some of the ways (...) taken by Cognitive Studies in this quest. We then consider what we call 'creative humour', which exhibits the core features of the aforesaid creativity. We then explore how a key cognitive approach to human communication can account for creative humour. We end by drawing lessons and highlighting limitations to cognitive approaches to creativity.
