The author examines Heidegger's conception of the history of Philosophy as “the history of Being.” An authentic philosopher does not look at the history of philosophy as a more or less accurate description of philosophers' thoughts, chronologically ordered. The thoughts of the great philosophers are not “products” in a process of thinking; in fact, what is most original in each of the great philosopher's thinking is Being's “property.” Philosophers or, rather, “thinkers,” ask questions in order to open the way for (...) questioning. They do not think many thoughts, but just one which is constantly “repeated.” Repetition is here “recollection” and “re-sumption” of the ways in which Being has made itself patent. Heidegger's original plan for the “destruction of the history of ontology” has been carried on in his later works by means of a recollection of what had been forgotten. A softening of the crust of the history of philosophy in order to discover Being “within” characterizes Heidegger's “dialogue” with the great thinkers of the past. Thus, the history of philosophy is to be interpreted in the light of the experience of the oblivion of Being. Thinkers, as well as poets, are concerned with Being in their attempt to fathom the original essence of speech, but whereas the former are trying to find the unique word to speak about Being, the latter lay down Being in their poetic words. Yet, in the last resort, thinking is the same as “proto-poetizing”; thought precedes poetry in so far as through the “poetizing essence of thinking” the thinker becomes the custodian of the truth of Being. This essay stages a dialectical confrontation between Adorno–Horkheimer on one hand and Benjamin–Badiou on the other against the background of the former's reductive portrait of Ulysses in Dialectic of the Enlightenment, which depicts him as a proto-bourgeois archetype of profit-seeking and acquisitive ethos. In sharp contrast, Walter Benjamin's allegorical materialism foregrounds, by dialectical illumination, hieroglyphic traces of Homeric virtues. These, I argue, are sustained and further amplified by Alain Badiou's topological ethics and loop-politics.

Hart’s criticism of Devlin’s stance on the legal enforcement of morality has been highly influential in shaping a new liberal sensibility and in paving the way to many important legal reforms in the UK. After 50 years it is perhaps time to go back to Law, Liberty and Morality to see it in the perspective of the general evolution of Hart’s thought since the early 50s. This is a period of extraordinary creativity for the Oxford philosopher, in which he writes (...) many important contributions to legal, moral and political philosophy. Prominent among these is ‘Are There Any Natural Rights?’, an article that sets the agenda for Hart’s subsequent work on liberty, fairness and rights, and provides the philosophical background for the liberal understanding of the relations between law and morality defended in Law, Liberty and Morality. Resultado de esta comparación será evidenciar una absoluta incompatibilidad entre ambas, incompatibilidad que debe ser fijada a partir de sus propios conceptos básicos, a saber, intencionalidad y conciencialidad (Bewusstheit), los cuales, contra lo que podría pensarse, no son ni equivalentes ni paralelos, sino que responden a concepciones irreconciliables, principalmente en el modo en que cada uno de ellos se sitúa con respecto a la noción de (...) conciencia y a la tradición cartesiana moderna. According to Zurek, decoherence is a process resulting from the interaction between a quantum system and its environment; this process singles out a preferred set of states, usually called “pointer basis”, that determines which observables will receive definite values. This means that decoherence leads to a sort of selection which precludes all except a small subset of the states in the Hilbert space of the system from behaving in a classical manner: environment-induced-superselection—einselection —is a consequence of the process of decoherence. (...) The aim of this paper is to present a new approach to decoherence, different from the mainstream approach of Zurek and his collaborators. We will argue that this approach offers conceptual advantages over the traditional one when problems of foundations are considered; in particular, from the new perspective, decoherence in closed quantum systems becomes possible and the preferred basis acquires a well founded definition. Three distinctive dynamics may be identified in the post-war developmentsof territorial and minority rights polities in Italy. The first focuses on recession attempts in peripheral areas in the aftermath of the world war, and on their interplay with the regional reform. The second peaks in the late '60s-early '70s, and relates territorial minorities' demands for recognition to broader protest movements and 'internal colonialism 'perspectives. The third consists of the recent success of regional Leagues in the North, and largely reverses previous (...) approaches to territorial issues. Autonomy is still emphasized here, yet disconnected from, and often in explicit opposition to, social equality ideas. 'Minority rights' are largely replaced with a peculiar version of territorial populist politics. (shrink)

In this essay both the facts/values and facticity/normativity divides are considered from the perspective of global semiotics and with specific regard to the relationships between legal meaning and spatial scope of law’s experience. Through an examination of the inner and genetic projective significance of categorization, I will analyze the semantic dynamics of the descriptive parts comprising legal sentences in order to show the intermingling of factual and axiological/teleological categorizations in the unfolding of legal experience. Subsequently, I will emphasize the translational (...) and enactive cognitive disposition underlying the construction of the second premise of the so-called judiciary syllogism and thereby the untenability of the idea that ‘law makes its facts.’ Hence, I will try to bring to the fore the cultural pre-assumptions encapsulated in the positivistic and therefore also formalistic or analytical approaches to legal experience and the loss of their inner consistency when legal experience confronts the phases and major changes of global semiotics. Finally, I will strive to relativize the opposition between the positivist and non-positivistic theories of law in view of an understanding of legal experience focused not only, or at least not primarily, on what ‘law is’ but also on ‘how’ it unwinds through, and _in spite of_, environmental and semantic transformations. The framework for this contribution is the transformation of the textual community, namely, modern society, into a digital community, in other words, a network society. This paper analyzes two theses. The first holds that the text, due to its genetic and historic nature, is always IMMUTABLE, STABLE, and never mobile. For this reason, the text represents the foundational element of a specific society, modern society. The second thesis is based on the assertion that within information and hypertext technologies two diverse (...) views confront and contrast each other. I locate these tendencies in the following key words: “dream” (Nelson) and “intellect” (Engelbart). Hypertext technology and culture represent the most transformative location and agency, they are the actors of the paradigm shift in which we are implicated. The hypertext revolution is based on the criticism of and attack against the material supports of writing and reading, as well as typographic technologies. Hypertext fights and wins this battle. However, hypertext technology is not able to reach the deep structure of alphabetic culture that is made not only of material support but also mental and bodily experience, consolidated and evolving, and of social relationships that are implied in the materiality of the support. La cornice di riferimento di questo contributo è la trasformazione della società testuale, cioè della società moderna, in società digitale, ovvero nella società dei network. Nell’intervento vengono analizzate due tesi: la prima afferma che il testo, per sua natura genetica e storica, è sempre IMMUTABILE, STABILE e non è mai mobile e per questo è fondativo di una società specifica, quella che noi chiamiamo la società moderna. La seconda tesi si basa sull’assunto che all’interno della cultura informatica e tecnologica che genera gli ipertesti si confrontano e si scontrano due idee diverse. Identifico queste due tendenze nelle parole chiave: dream (Nelson) e intellect (Engelbart). La tecnologia e la cultura ipertestuale sono il luogo e l’agente più fortemente trasformativi, gli attori del cambio di paradigma che ci coinvolge. La rivoluzione ipertestuale ha le sue basi nell’attacco e nella critica dei supporti materiali della scrittura e della lettura e sulle tecnologie tipografiche. L’ipertesto combatte e vince questa battaglia. La tecnologia ipertestuale non riesce però a raggiungere la struttura profonda della cultura alfabetica che è composta non solo da supporti ma da esperienze sia della mente sia del corpo, da relazioni sociali consolidate e mutanti che sono sottese e operanti con la materialità del supporto. What kind of relationship has modernity established between knowledge and power? What forms does such a relationship take in contemporary society? Theattempt here is to enter into the merits of its new formulations, focusing attention on the degradation to which power and knowledge have been subjected. The essay also indicates a solution that does not consist in a return to the past or escape into the future, but in the possibility of viewing the present as an opportunity for cultural emancipation.

Inimvajadus seletatavana on empiirilis-teoreetiline mõiste, mille kaudu on sõnastatavad mitmed humanoloogilised normtasemeseadused . Vajadus seletajana on teatavate otsuste õigustaja. Artiklis visandatakse vajaduse teoreetiline mudel, mis kirjeldaks kindlat hulka praktiliselt paratamatuid inimelu fenomene, mida nimetatakse vajadusteks, seletaks vajaduste ilmnemist ja õigustaks vajaduste rahuldamisele ehk kahju vältimisele suunatud tegevust. Mudeli tarvilikud tingimused on vajaduse subjekt - inimisik või inimgrupp; vajaduse objekt ehk otstarve, mis rahuldab vajaduse ja kõrvaldab vajaduspinge; potentsiaalne kahju , mis vältimatult sünnib vajadushüve puudusest; vajaduse vältimatuse tingimused - kindlad sõltuvusseosed (...) inimkeha ja inimvaimu ning materiaalse ja kultuurilise elukeskkonna vahel; vajaduse pingetegur - sõltuvusseostest tulenev sund tegutseda vajaduse rahuldamise sihil. Inimvajadused on liigitatavad kahte kategooriasse ja mitmesse tüüpi. Vahetud vajadused on organismi füsioloogilised ja psüühilised vajadused ning organismi ja isiksuse keskkonna- ja elutingimusvajadused. Vahendlikud ehk funktsionaalsed olukorrakohased vajadused on tarbed vahendite järele, vältimaks või vähendamaks tõsist sattumuslikku kahju (nt kirurgia, ravimid); tarbed vahendite järele, rahuldamaks vahetuid vajadusi (nt toiduainete tööstus); tarbed vahetuid vajadusi rahuldava koostöö ja ressursiallikate järele; lõpuks tarbed innovaatiliste vahendite järele, millega tagada normtasemele vastavat eluviisi (nt elatusraha, osasaamist kultuuripärandist). Sellisena väljendab vajadus teatavat elutähtsat tingimust, mille kestev puudus tekitab vältimatult inimisikule tõsist kahju ja mille potentsiaalne või lühiajaline puudus avaldab inimesele praktiliselt paratamatut motiveerivat survet. Mis tahes vajaduse rahuldamise tõeliseks aluseks on isiksuse tõsise kahjustumise vältimine. Human need is an empirical-theoretical concept allowing formulation of humanological normic-level laws . The author proposes a theoretical model, which is able to describe a certain set of practically necessary phenomena of human life, to explain the appearance of these phenomena, and to justify decisions aiming at need-satisfaction, i.e. avoidance of serious harm . The necessary conditions of the model are a subject of the need (personal or collective), an object of the need (an appropriate operational function (purpose)), the potential harm of an unsatisfied need, nomological and humanological conditions of unavoidability of need , and the tension-factors of the need. There are two categories and several types of human needs. The immediate needs are the physiological and psychological functionality of an organism and the immediate life-conditions of an organism and personality. The intermediate , i.e. functional and circumstantial, needs are for the innovative means of direct harm avoidance and remedy, for the innovative means of the basic need-satisfaction, for the cooperation and for the sources (resources) of the basic need-satisfaction, and for the innovative providers of normal ( normic-level ) life-conditions. Therefore, the need is a vitally important condition, ongoing shortage of which inevitably and seriously harms a person, but a potential or a short-term shortage of which motivates him or her to practically necessary action. The genuine ground of need-satisfaction is the avoidance of causing serious harm to the human personality. (shrink)
