The rapid adoption and implementation of artificial intelligence in medicine creates an ontologically distinct situation from prior care models. There are both potential advantages and disadvantages with such technology in advancing the interests of patients, with resultant ontological and epistemic concerns for physicians and patients relating to the instatiation of AI as a dependent, semi- or fully-autonomous agent in the encounter. The concept of libertarian paternalism potentially exercised by AI (and those who control it) has created challenges to conventional assessments (...) of patient and physician autonomy. The unclear legal relationship between AI and its users cannot be settled presently, an progress in AI and its implementation in patient care will necessitate an iterative discourse to preserve humanitarian concerns in future models of care. This paper proposes that physicians should neither uncritically accept nor unreasonably resist developments in AI but must actively engage and contribute to the discourse, since AI will affect their roles and the nature of their work. One’s moral imaginative capacity must be engaged in the questions of beneficence, autonomy, and justice of AI and whether its integration in healthcare has the potential to augment or interfere with the ends of medical practice. I. EXECUTIVE SUMMARY The MRCT Center Post-trial Responsibilities: Continued Access to an Investigational Medicine Framework outlines a case-based, principled, stakeholder approach to evaluate and guide ethical responsibilities to provide continued access to an investigational medicine at the conclusion of a patient’s participation in a clinical trial. The Post-trial Responsibilities (PTR) Framework includes this Guidance Document as well as the accompanying Toolkit. A 41-member international multi-stakeholder Workgroup convened by the Multi-Regional Clinical Trials Center of Brigham and Women’s Hospital and Harvard University (...) (MRCT Center) developed this Guidance and Toolkit. Project Motivation A number of international organizations have discussed the responsibilities stakeholders have to provide continued access to investigational medicines. The World Medical Association, for example, addressed post-trial access to medicines in Paragraph 34 of the Declaration of Helsinki (WMA, 2013): “In advance of a clinical trial, sponsors, researchers and host country governments should make provisions for post-trial access for all participants who still need an intervention identified as beneficial in the trial. This information must also be disclosed to participants during the informed consent process.” This paragraph and other international guidance documents converge on several consensus points: • Post-trial access (hereafter referred to as “continued access” in this Framework [for terminology clarification – see definitions]) is the responsibility of sponsors, researchers, and host country governments; • The plan for continued access should be determined before the trial begins, and before any individual gives their informed consent; • The protocol should delineate continued access plans; and • The plan should be transparent to potential participants and explained during the informed consent process. -/- However, there is no guidance on how to fulfill these responsibilities (i.e., linking specific responsibilities with specific stakeholders, conditions, and duration). To fill this gap, the MRCT Center convened a working group in September of 2014 to develop a framework to guide stakeholders with identified responsibilities. This resultant Framework sets forth applicable principles, approaches, recommendations and ethical rationales for PTR regarding continued access to investigational medicines for research participants. A key philosophical feature of Peter Jackson’s film interpretation of J.R.R. Tolkien’s The Lord of the Rings is its use of fantasy to inspire a “recovery” of the actual or, in other words, a reawakening to the beauty of nature and the many possible ways of living in healthier ecological relation to the world. Though none of these ways is perfectly achieved, this pluralistic view is demonstrated in the various lifeways of Hobbits, Elves, Men, and Ents. All of the positive (...) relationships embodied in the films—to trees, mountains, horses, and vegetable gardens—involve loving care and attention, receiving nourishment and livelihood without instrumentalization, or reducing nature to mere resource. The films also vividly display a variety of ugly and destructive ways of using the land to accrue power and wealth. These noxious ways, specifically because they actively destroy the lands that they use, always need more. They will thus eventually annihilate the beautiful ways of being if they are not actively resisted. Some of those who would rather be tending their own trees, gardens, or horses or even wandering in the wild forests must therefore turn their attention to struggle and resistance instead. This is a struggle full of grief, and at times even verging on despair, but it is marked by the refusal to give up hope. Indeed, what Jackson and Tolkien have to say about hope is as important in responding to the ecological crisis as anything they have to say about nature, inasmuch as they help to remind us that even in our own times, “there is still hope.”. After characterizing the general outlines of Davidson's criticism of the idea of conceptual schemes, the specifics of his argument are examined and evaluated. It is argued that his argument against radically different conceptual schemes does mark out plausible limits to what might be thought of as differences against conceptual schemes, but it is doubtful that those he mentioned as proponents of the idea envisions such differences. It is argued that the stylized character of Davidson's arguments against the less radical (...) variants of the idea fail to foreclose the possibility of differences that many would find interesting. Debates over how to conceptualize the nursing role were prominent in the nursing literature during the latter part of the twentieth century. There were, broadly, two schools of thought. Writers likeHenderson andOrem used the idea of a self‐care deficit to understand the nurse as doing for the patient what he or she could not do alone. Later writers found this paternalistic and emphasized the importance of the patient's free will. This essay uses the ideas of positive and negative freedom to (...) explore the differing conceptions of autonomy which are implicit in this debate. The notion of positive freedom has often been criticized as paternalistic, and the criticisms of self‐care in the nursing literature echo criticisms from political philosophy. Recent work on relational autonomy and on the relationship between autonomy and identity are used to address these objections. This essay argues for a more nuanced conception of the obligation to support autonomy that includes both positive (freedomto) and negative (freedomfrom) dimensions. This conception of autonomy provides a moral foundation for conceptualizing nursing in something like Henderson's terms: as involving the duty to expand the patient's capacities. The essay concludes by generalizing the lesson. Respect for autonomy on the part of any health care provider requires both respect for the patient's choices and a commitment to expand the patient's ability to actualize their choices. (shrink)

This paper focuses on examining the dynamic nature of community supported agriculture (CSA) and the real-world experiences which mark its contours, often making it distinct from the early idealized CSA “model.” Specifically, our study examines the narratives of the farmers of Devon Acres CSA over its duration, in tandem with a survey of recent shareholders in order to understand and explain its evolution. The framework we develop here shows that this CSA is largely characterized by instrumental and functional beliefs (...) and practices, with some elements in the collaborative mode. A key contribution of this research is the development of a framework which helps to highlight the relative fluidity and patchwork quality of CSA participant positions over time. At Devon Acres, the real-world factors and issues influencing CSA evolution are seen to be products of both the local and larger contexts, evident in such areas as shifts in farmer learning and adaptation, differences between beliefs and practices in member volunteer efforts, and changes in farm and resource conditions. With respect to CSA more broadly, we argue that the reality of dominant food system context and site-specific influences on CSA development compels us to rework our attachment to early idealized “model” traits. Expansion in CSA numbers, evidence of adaptation and situated learning, and retention of the local and organic as core traits, speak to the pragmatic yet transformative potential of CSA contribution to food system change. The ability to extract patterns from sensory input across time and space is thought to underlie the development and acquisition of language and literacy skills, particularly the subdomains marked by the learning of probabilistic knowledge. Thus, impairments in procedural learning are hypothesized to underlie neurodevelopmental disorders, such as dyslexia and developmental language disorder. In the present meta‐analysis, comprising 2396 participants from 39 independent studies, the continuous relationship between language, literacy, and procedural learning on the Serial Reaction Time task (SRTT) was (...) assessed across children and adults with typical development (TD), dyslexia, and Developmental Language Disorder (DLD). Despite a significant, but very small, relationship between procedural learning and overall language and literacy measures, this pattern was not observed at the group‐level when examining TD, dyslexic, and DLD groups separately. Based on the procedural/declarative model, a positive relationship was expected between procedural learning and language and literacy measures for the typically developing group; however, no such relationship was observed. This was also the case for the disordered groups (ps >.05). Also counter to expectations, the magnitude of the relationship between procedural learning and grammar and phonology did not differ between TD and DLD (ps >.05), nor between the TD and dyslexic group on reading, spelling, and phonology (ps >.05). While lending little support to the procedural/declarative model, we consider that these results may be the consequence of poor psychometric properties of the SRTT as a measure of procedural learning. Cambridge: Cambridge University Press, 2007. x + 203 pp. Cloth, $90.In this well-focused study, Charles McNelis gives what is due both to the poetics of Statius’ epic and to what John Henderson has called its “political intelligence” (PCPS 37 [1991]: 52). Regarding the poem as a product of its (...) time both in terms of poetics and politics, McNelis shows that Statius uses the considerable arsenal of the Latin poets’ ability to be intertextual to create a work that addresses [End Page 436] the particular situation of post–civil wars Flavian Rome. McNelis finds that Statius proposes that the epic teleology of the Golden Age’s reestablishment under Augustus that Virgil presents (albeit with some ambiguity) “has been thwarted and/or challenged, thus suggesting the fragile nature of any claim—even claims that define a society—to have brought an end to civil war” (177). Instead, Statius suggests that while it is possible for a particular civil conflict to come to an end, the results of it are ever with us and, further, that resolution comes in the form of clementia which is available to all on an individual basis from an entity that takes no blood sacrifice and is aniconic (163; Theb. 12.487–88, 493–94). A multifaceted challenge to the Virgilian/Augustan narrative of communal imperium sine fine guaranteed by Jove is manifest here.In order to make the case that Augustan/Virgilian teleology does not fit Flavian Rome, Statius’ particular strategy is a resort to Callimachus whose criticism of the epic genre had already made frequent appearances in Latin poetry. McNelis sees Statius restaging over the course of the epic the conflict that Callimachus (in Aetia 1 and elsewhere) presents between finely worked poetry and overdone epic. This conflict then reflects the presence of civil war in the literary-generic contouring of the poem. The presence of this conflict also ensures, in McNelis’ estimation, that the Thebaid is most emphatically not the “one continuous song” (Aetia 1.1.3: ) that Callimachus presents as the undesirable goal of epic composition and instead “replicate[s]” civil war “in the very fibres of the poem” (1).After the introduction, McNelis presents in the first chapter (“Gods, Humans and the Literary Tradition”) a discussion of Thebaid 1 with special attention paid to the story of Coroebus and the particularly malevolent Apollo therein. McNelis underscores in this story (significantly an aetion) the essentially hostile nature of the gods in the poem and the blending of them with chthonic forces, exemplified by Apollo’s killing of Python and his revenge, via a baby-eating monster, for the death of a baby born to a young woman he had raped. This story promises—and it is a promise that the epic delivers—that humans can hardly expect a settled existence with Jove as beneficent ruler.The second chapter (“Beginning”) foregrounds discussion of the necklace made by Vulcan, the Cyclopes, and the Telchines for Harmonia. McNelis sees in the necklace a product from the god of the forge’s workshop that comments on this epic in as serious a manner as the shields of Achilles and Aeneas comment on their respective epics. It is here that McNelis makes a key connection to the Aetia, for it is the Telchines whom Callimachus takes to task at 1.1.1. While at times he overstates the power of the necklace to cause things to happen (e.g., 51), McNelis is right to emphasize its significance. The necklace promises communal dissolution from the hands of the gods just as surely as the shield of Aeneas promises reintegration, likewise overseen by divine forces. Too, it is fitting that the poet of the Silvae would focus on a luxurious item such as this.In the third chapter (“Nemea”), McNelis sees the Callimachean aspects of the plot derail the warlike plan of Vulcan and the Telchines in the famous [End Page 437] digression at Nemea. The period 1873–1947 was productive in fostering ideas about observing, measuring, and quantifying repetitive human movements, prior to the rise of occupational health and ergonomics within industrial psychology. Starting with physiological experimentation in the lab, instruments of graphic inscription were then applied in the industrial workplace, initially as a benevolent measurement for monitoring worker health, but elsewhere as a more invasive measurement for the surveillance of worker efficiency. Herman Helmholtz’s invention of the myograph, and an adaptation called the ergograph, would (...) help form what Kronecker (1873) and later Mosso (1891) termed the ‘curve of fatigue’, and were used in extensive research on factory workers for Jules Amar’s Le Moteur humain in 1914. Meanwhile, in Britain in 1915 the physiologist Sherrington was observing workers in munitions factories, feeding into the formation of the Industrial Fatigue Research Board in 1919, which produced official reports. In the United States, similar but more high-profile research was conducted by Frederick Winslow Taylor and Lillian and Frank Gilbreth, who studied movement efficiency to maximize industrial productivity by innovating upon photographic and chronophotographic techniques. Further physiological research was taken up in Lawrence J. Henderson’s Harvard Fatigue Laboratory between 1927 and 1947 on subjects situated in environmental extremes. (shrink)

David Henderson and Terry Horgan offer a detailed account of the structure of conceptual analysis that is embedded within a more general account of a priori justification. Their account highlights an important feature of conceptual analysis that has been overlooked in the recent debate. Although it is generally recognized that conceptual analysis involves an inference from premises to the effect that some concept does (or does not) apply to a range of particular cases to a general conclusion about the (...) nature of the concept itself, the details of that inference have not been fully articulated. Henderson and Horgan offer an articulation of the inferential connection which, taken in conjunction with their account of a priori justification, yields a startling conclusion about the epistemic status of the results of conceptual analysis. My view is that their account of a priori justification misses the mark and, as a consequence, they arrive at a conclusion about the epistemic status of the results of conceptual analysis that many will find implausible. Moreover, I fear that because many will find their overall conclusion implausible, they will either overlook or dismiss the important feature of the inferential connection that Henderson and Horgan correctly highlight. Hence, I have two goals. First, I want to track down the source of their mischaracterization of the a priori and to show why it is a mischaracterization. Second, I want to highlight the important feature of the inferential connection involved in conceptual analysis that they identify, articulate its bearing on the debate over the existence of a priori knowledge and assess its implications. What makes for a good explanation of a person’s actions? Their reasons, or soa natural reply goes. But how do reasons function as part of explanations, that is, within an account of the causes of action? Here philosophers divide concerning the logical relation in which reasons stand to actions. For, tradition holds, reasons evaluatively characterized must be causally inert, inasmuch as the normative features cannot be found in any account of the empirical/descriptive. To countenance reasons as causes thus seems to (...) imply some degree of normative involvement in causal explanation. Mark Risjord opts for full normative involvement while David Henderson insistently denies a role to norms in explanation. Stueber occupies an intermediate position here. I question just whether there exists some "special" problem regarding norms, at least in the form which, I take it, all three of the authors I discuss assume there to be one. Mark David Henderson's book, The Soul of Atlas, defends the view that there is more common ground than is usually believed between Christianity and Objectivism. Despite some minor aesthetic difficulties, the book is well written, making it easily accessible as an introductory text to the Christian/Objectivist debate. After making some minor recommendations as to how the book could have been improved, the author concludes that The Soul of Atlas's place in the Objectivist literature is one of a "conversation (...) starter," not a "groundbreaking" work of Christian/Objectivist synthesis. The culture of self-improvement stems from philosophical classics, perfectionist religions, and a ruthless strain of capitalism—but today, new technologies shape what it means to improve the self. The old humanist culture has given way to artificial intelligence, social (...) media, and big data: powerful tools that do not only inform us but also measure, compare, and perhaps change us forever. Stories of firms that exceed local compliance requirements in their environmental performance appear routinely. However, we have limited theoretical explanations of what propels these firms to exceed compliance. Our theory suggests that global competitive and institutional pressures lead multinational firms to develop highlevel, environmental management systems (EMS) that make them more competitive. For economic and other reasons, select firms make the choice to rationalize their collective environmental performance to the highest common denominator rather than the lowest. Regulations around the world (...) differ widely and are a moving target in many settings. The need to comply with such myriad, shifting rules leads to firms creating EMS to help stay ahead of regulations worldwide. Using institutional and internationalization theories as our basis, we offer a propositional model concerning global competitive/institutional pressures and their effects on corporate environmental performance. _Rational Animals: The Teleological Roots of Intentionality_ offers an original account of the intentionality of human mental states, such as beliefs and desires. The account of intentionality in _Rational Animals_ is broadly biological in its basis, emphasizing the continuity between human intentionality and the levels of intentionality that should be attributed to animal actions and states. Establishing the goal-directed character of animal behavior, Mark Okrent argues that instrumentally rational action is a species of goal-directed behavior that is idiosyncratic to (...) individual agents and is distinguished by its novelty and flexibility. He also argues that some nonlinguistic animals are capable of instrumental rationality and that in the first instance, the contents of beliefs and desires are individuated by the explanatory role of those states in rationally accounting for such instrumentally rational behavior. The account of instrumental rationality offered in Rational Animals allows for understanding the practical rationality of linguistically competent human beings as a distinctive capacity of social animals capable of undertaking roles governed by socially sanctioned norms. Rational Animals will be of interest to cognitive scientists, philosophers of mind, philosophers of biology, philosophers of action, ethologists, and those interested in the debates concerning animal intelligence. Mark Murphy has argued that the relationship between a creator and their creatures is not a special relationship that generates new moral obligations for the creator. Murphy’s position is grounded, in part, on his claim that there are no good arguments to the contrary and that the creator-creature relationship is not a relationship between equals. I argue that there are good reasons to think that a creator and creature being equals is not required for such an obligation. I offer (...) an argument for such an obligation based on the moral significance of thrusting upon sentient or rational beings significant, unsought, and wholly new circumstances. More specifically, I argue that it is reasonable to conclude that a creator enters into a duty-generating special relationship with their creatures to promote their creatures’ well-being, when the creator is the voluntary source of the creatures’ wholly new and unconsented to circumstances from which to flourish or languish and it would cost the creator virtually nothing to promote the creatures’ welfare. In "Behavioral Law and Economics: The Assault on Consent, Will, and Dignity," Mark D. White uses the moral philosophy of Immanuel Kant to examine the intersection of economics, psychology, and law known as "behavioral law and economics." Scholars in this relatively new field claim that, because of various cognitive biases and failures, people often make choices that are not in their own interests. The policy implications of this are that public and private organizations, such as the state and employers, (...) can and should design the presentation of options and default choices in order to "steer" people to the decision they would make, were they able to make choices in the absence of their cognitive biases and failures. Such policies are promoted under the name "libertarian paternalism," because choice is not blocked or co-opted, but simply "nudged." White argues that such manipulation of choice is impossible to conduct in people's true interests, and any other goal pursed by policymakers substitutes their own ends, however benevolent they may be, for people's true ends. Normatively, such manipulation should not be conducted because it fails to respect the dignity and autonomy of persons, what some hold to be the central idea in Kant's ethical system, and which serves to protect the individual from coercion, however subtle, from other persons or the state. Over the past four decades, Charles Taylor's work as an intellectual historian, epistemologist, and normative political theorist has made him a leading figure in contemporary social philosophy. In Charles Taylor: Thinking and Living Deep Diversity, Mark Redhead examines the problem of political fragmentation, the problem of how to accommodate narrowly defined groups while promoting allegiance to a larger polity, through an analysis of Taylor's thought and politics.

Aristotle states the nominal definitions of the terms "truth" and "falsehood" as part of his arguments in defense of the logical axioms. These nominal definitions express conceptions of truth and falsehood his philosophical opponents would have recognized and accepted in the context of (...) dialectical argument. On the basis of these nominal definitions, Aristotle develops his definitions of the essences of truth and falsehood--his "real" definitions of truth and falsehood. Aristotle's methodical exposition of his essential definitions of truth and falsehood in the Metaphysics serves as a well-developed example of how his philosophical inquiry starts with nominal definitions and ends with real definitions. Wheeler also argues for the novel claim that Aristotle defines the most fundamental kind of truth in terms of accurate measurement. Aristotle's metrical conception of truth serves as the theoretical basis for specifying the truth conditions of various assertions, for identifying the sorts of beings implicated in these truth conditions, and for explaining the nature of approximate truth and falsehood. Far from offering us a minimal account of truth, Wheeler shows how Aristotle offers us a sophisticated and metrical theory of truth. (shrink)

Pisone Patre. The guest editors of this volume were Cynthia Damon and Sarolta Takacs. While it has not been the practice of the Journal to publish special issues, it seems appropriate (...) that we do so from time to time when a particularly interesting set of articles on a major theme presents itself. Such special issues are able to cover an author, work, or subject with more range and depth than one individual paper can, and they often contain layers of complexity and interdisciplinary insights that a single author would find it difficult to contribute.This special issue had its origins in the conference "Performing Aristophanes," held at Case Western Reserve University on February 24, 2001. Designed by the University's Theater Arts Department to complement the production of Mary-Kay Gamel's version of Aristophanes' Thesmophoriazousai, The Julie Thesmo Show, the conference was generously supported by the Baker-Nord Center and by the Susan and Ronald Heller Conferences for the Arts Fund. Two of the articles in this volume, those by Angeliki Tzanetou and Gonda Van Steen, were presented in an earlier version at the conference; others offering presentations were Niall W. Slater, Peter Meineck, John Starks, Jr., and Richard Perloff. Jeffrey Henderson provided incisive comments (which formed the basis for his epilogue in this volume). The other articles included here (Gamel, Scharffenberger, Stehle) were added at a later date.As Henderson points out in his epilogue, the Thesmophoriazousai is the Aristophanic play that has been least explored by scholars. But it has lately received more notice in new translations and a new critical [End Page 5] edition, and the time seems right for a new production of this play with accompanying reflections on its performance history, issues of gender and the body, the limits of a written text, the relationship between tragedy and comedy and between ritual and theatrical representation, and an unpublished, controversial, and relatively unknown translation of this play. Indeed, classicists are now paying more attention to both performance studies/performance criticism and translation as bona fide subdisciplines of classics. It should be noted that this year, for only the second time, the American Philological Association gave the Goodwin Award of Merit to a translation (of several plays of Aristophanes, done for the Loeb Classical Library by Jeffrey Henderson). 1 AJP has in the past year published as Brief Mentions several reviews of contemporary performances of ancient texts.Thus, this special issue marks a new horizon for the American Journal of Philology.
