In this new book, Marko Zlomislić argues that Slavoj Žižek's work does not contain any sort of radical emancipatory project, especially as it passes through the ideology of communism and Lacanian psychoanalysis. The evidence for the failure of communism is vast and includes the more than six hundred mass graves recently located in Žižek's homeland of Slovenia. Zlomislić demonstrates that the way out of the capitalist dilemma is not a repetition of communism but a return to the late medieval (...) notion of haecceity or "individual thisness" that was rejected by modernity. Haecceity, or the indescribable and indefinite here and now of the person, shows that the late medieval Franciscans were already "postmodernists." It is no wonder that the totalitarianism of the modernist Hegel is embraced by thinkers such as Žižek, Badiou, Hardt, Negri, and Laclau and was already rejected by Leibnitz, Kierkegaard, Nietzsche, Levinas, Deleuze, and Derrida. This important book shows that Žižek's work must be rejected because it does not uphold the dignity, worth, and uniqueness of the person. (shrink)

The “histone code” conjecture of gene regulation is our point of departure for analyzing the interplay between the (quasi)digital script in nucleic acids and proteins on the one hand and the body on the other, between the recorded and organic memory. We argue that the cell’s ability to encode its states into strings of “characters” dramatically enhances the capacity of encoding its experience (organic memory). Aristotle was the founder not only of logic but also of modal logic. In the Prior Analytics he developed a complex system of modal syllogistic which, while influential, has been disputed since antiquity--and is today widely regarded as incoherent. Combining analytic rigor with keen sensitivity to historical context, Marko Malink makes clear that the modal syllogistic forms a consistent, integrated system of logic, one that is closely related to other areas of Aristotle's philosophy. Aristotle's modal syllogistic differs significantly from (...) modern modal logic. Malink considers the key to understanding the Aristotelian version to be the notion of predication discussed in the Topics--specifically, its theory of predicables and the ten categories. The predicables introduce a distinction between essential and nonessential predication. In contrast, the categories distinguish between substantial and nonsubstantial predication. Malink builds on these insights in developing a semantics for Aristotle's modal propositions, one that verifies the ancient philosopher's claims of the validity and invalidity of modal inferences. While it acknowledges some limitations of this reconstruction, Aristotle's Modal Syllogistic brims with bold ideas, richly supported by close readings of the Greek texts. (shrink)

In their paper “Is psychopathy a mental disease?”, Thomas Nadelhoffer and Walter Sinnott-Armstrong argue that according to any plausible account of mental disorder, neural and psychological abnormalities correlated with psychopathy should be regarded as signs of a mental disorder. I oppose this conclusion by arguing that at least on a naturalistically grounded account, such as Wakefield’s ‘Harmful Dysfunction’ view, currently available empirical data and evolutionary considerations indicate that psychopathy is not a mental disorder.

What exactly is reasoning? While debate on this question is ongoing, most philosophers seem to agree on at least the following: reasoning is a mental process operating on contents, which consists in adopting or revising some of your attitudes in light of others. In this paper, I argue that this characterisation is mistaken: there is no single mental phenomenon that satisfies both of these conditions. Instead, I characterise two distinct mental phenomena, which I call ‘deducing’, on the one hand, and (...) ‘reasoning’ or ‘inference’ on the other, to play each of these roles. Recognising this division of labour is essential to developing a better understanding of our rational economy. (shrink)

The issue whether psychopathic offenders are practically rational has attracted philosophical attention. The problem is relevant in theoretical discussions on moral psychology and in those concerning the appropriate social response to the crimes of these individuals. We argue that classical and current experiments concerning the instrumental learning in psychopaths cannot directly support the conclusion that they have impaired instrumental rationality, construed as the ability for transferring the motivation by means-ends reasoning. In fact, we defend the different claim that these experiments (...) appear to show that psychopaths in certain circumstances are not aware of the relevant means for their ends. Moreover, we suggest how further empirical research could help to settle the issue. (shrink)

Cognitive agency - the idea that our judgments and beliefs are manifestations of agency on our part - is a deeply entrenched aspect of our self-conception as persons. And yet it has proven hard to give a satisfying account of what such agency might consist in. In this paper I argue that getting clear about Kant’s notion of spontaneity might help us make progress in that debate. In particular, I argue that the very same assumption - namely, that agency must (...) be understood on the model of production - has been holding us back in both areas. (shrink)

The prediction error minimization framework denotes a family of views that aim at providing a unified theory of perception, cognition, and action. In this paper, I discuss some of the theoretical limitations of PEM. It appears that PEM cannot provide a satisfactory explanation of motivated reasoning, as instantiated in phenomena such as self-deception, because its cognitive ontology does not have a separate category for motivational states such as desires. However, it might be thought that this objection confuses levels of explanation. (...) Self-deception is a personal level phenomenon, while PEM offers subpersonal explanations of psychological abilities. Thus, the paper examines how subpersonal explanations couched in the PEM framework can be thought of as related to personal level explanations underlying self-deception. In this regard, three views on the relation between personal and subpersonal explanations are investigated: the autonomist, the functionalist, and the co-evolutionary perspective. I argue that, depending on which view of the relation between the personal and subpersonal is adopted, the PEM paradigm faces a dilemma: either its explanatory ambitions should be reduced to the subpersonal domain, or it cannot provide a satisfactory account of motivated reasoning as instantiated in self-deception. In this paper, we present a method for introducing law students to the writing of legal documents. The method uses a machine-readable representation of the legal knowledge to support document assembly and to help the students to understand how the assembly is performed. The knowledge base consists of enacted legislation, document templates, and assembly instructions. We propose a system called LEDAS (LEgal Document Assembly System) for the interactive assembly of legal documents. It guides users through the assembly process and provides (...) explanations of the interconnection between input data and claims stated in the document. The system acts as a platform for practicing drafting skills and has great potential as an education tool. It allows teachers to configure the system for the assembly of some particular type of legal document and then enables students to draft the documents by investigating which information is relevant for these documents and how the input data shape the final document. The generated legal document is complemented by a graphical representation of legal arguments expressed in the document. The system is based on existing legal standards to facilitate its introduction in the legal domain. Applicability of the system in the education of future lawyers is positively evaluated by the group of law students and their TA. (shrink)

This is a wide ranging and deeply learned examination of evolutionary developmental biology, and the foundations of life from the perspective of information theory. Hermeneutics was a method developed in the humanities to achieve understanding, in a given context, of texts, history, and artwork. In Readers of the Book of Life, the author shows that living beings are also hermeneutical interpreters of genetics texts saved in DNA; an interpretation based on the past experience of the cell (cell lineage, species), confronted (...) with and incorporating present environmental clues. This approach stresses the history, not only of the digital record saved in the DNA, but also of the flesh - the cellular organization which has a direct time-continuity with the very origins of life. This book is aimed at reconciling two opposite approaches to life. The first strictly sticking to a belief that all phenomena observed in the realm of the living can be explained from laws of physics. The opposite stressing the importance of features characteristic for a given level of description. To bring both views into a common understanding, the first part gives a comparison of the two problem solving strategies. The second part surveys the development of 20th century biology, bringing to light branches that never became part of the research mainstream. The third section of the book reviews a large body of recent evidence that can be interpreted in favor of the hermeneutic arguments. (shrink)

Attempts to explain behavior genetically face two major problems: the application of the concept of genetic coding and the theoretical possibility of decomposing behavior. This paper argues that using the notion of genetic coding is appropriate in explanations of protein synthesis but inadequate and even misleading in the context of explanations of behavior. Genes should be regarded as disparate components of mechanisms that account for behavior rather than as codes for behavioral phenotypes. Such mechanistic explanations, however, presuppose the possibility of (...) decomposing behavioral phenotypes, which is strongly disputed by researchers holding an interactionist view of behavior. It is argued that these researchers fail to distinguish etiological from constitutive decomposition, and that their objections apply to the former but not to the latter kind. Constitutive decomposition might identify genes as disparate components and open up the possibility of explaining behavior mechanistically by isolating causal paths from genes to behavior. Finally, research on the single gene disorder phenylketonuria is introduced to illustrate and test these views. It has been argued that a biomarker-informed classification system for antisocial individuals has the potential to overcome many obstacles in current conceptualizations of forensic and psychiatric constructs and promises better targeted treatments. However, some have expressed ethical worries about the social impact of the use of biological information for classification. Many have discussed the ethical and legal issues related to possibilities of using biomarkers for predicting antisocial behaviour. We argue that prediction should not raise the most pressing ethical worries. Instead, (...) issues connected with ‘biologisation’, such as stigmatization and negative effects on self-image, need more consideration. However, we conclude that also in this respect there are no principled ethical objections against the use of biomarkers to guide classification and treatment of adult antisocial individuals. This paper explores the phenomenon of revisionism in historiography, while focusing in particular on illegitimate revisionism and negationism. It is indisputably true that historiography must be subject to constant revisions. Like all scientific theories, it needs to be characterized by a sort of?conservative? openness towards new ideas; however, revisions and negations are often put forward without scientific grounding. They reject the well-established historiographical methods, while opening themselves to various kinds of ideologies, biases and manipulations. The paper further offers a synthesized (...) overview of the revisionist practice in dominant parts of the society and historiography in post-communist Serbia. The change in the ideological paradigm that occurred in the 1980s was accompanied by a politically motivated reinterpretation of the past, which primarily focused on World War II in Yugoslavia. In Serbia in the 1990s, Tito?s Partisans were no longer celebrated as national heroes and fighters against fascism; they were replaced by the royalist and nationalist Chetniks led by Draza Mihailovic, whose collaboration with the occupying forces was purposefully glossed over. The nationalist interpretation of history and the new revisionist politics in Serbia were supported by the state and the activities of its three branches: legislative, executive and judicial. In spite of the political changes that took place in Serbia in 2000, the dominant nationalist matrix in historical interpretations and revisionist politics remained unchanged. (shrink)

The concept of the ‘infodemic’ has become a popular explanation for the rejection of anti-COVID-19 crisis governance measures. In this paper, we argue that infodemic is an inherent property of society under free institutions misused to pursue an epistemically vicious political epistemology. Furthermore, we provide an alternative account of political epistemology of COVID-19 governance and popular resistance to it. Namely, we argue that 1) pandemics represent a complex problem, and some level of resistance to governance which restricts liberties while informed (...) by ongoing scientific and political learning processes is inevitable, and 2) the resistance is exacerbated by the history of technocratization of governance and the exclusionary socio-economic inequalities which condition political and epistemic deficiencies easily exploitable by the political entrepreneurs of right-wing populism, particularly under the conditions of social media which gamifies public discourse. Thus, we argue, the correct response to the cultures of rejection of anti-COVID-19 measures is to change the underlying political and economic conditions and not to limit speech or restrict franchise as the infodemic diagnosis suggests. Recently it has been argued that certain neuropsychological findings on the decision-making, instrumental learning, and moral understanding in psychopathic offenders offer reasons to consider them not criminally responsible, due to certain epistemic and volitional impairments. We reply to this family of arguments, that collectively we call the irresponsibility of the psychopath argument. This type of argument has a premise that describes or prescribes the deficiencies that grant or should grant partial or complete criminal exculpation. The other premise contends that neuropsychological (...) evidence shows that psychopaths have incapacitates that are sufficient to ascribe complete or partially exculpatory deficiencies. The focus of our criticism is this latter premise. We argue that it requires that psychopathy should correlate significantly with certain rational incapacities that manifest across contexts. We show that the available neuropsychological data do not support the claim that psychopaths have such general exculpatory incapacities. (shrink)

The harm usually associated with psychopathy requires therapeutically, legally, and ethically satisfactory solutions. Scholars from different fields have, thus, examined whether empirical evidence shows that individuals with psychopathic traits satisfy concepts, such as responsibility, mental disorder, or disability, that have specific legal or ethical implications. The present paper considers the less discussed issue of whether psychopathy is a disability. As it has been shown for the cases of the responsibility and mental disorder status of psychopathic individuals, we argue that it (...) is undecided whether psychopathy is a disability. Nonetheless, based on insights from disability studies and legislations, we propose that interventions to directly modify the propensities of individuals with psychopathic tendencies should be balanced with modifications of the social and physical environments to accommodate their peculiarities. We also suggest how this social approach in some practical contexts that involve non-offender populations might be effective in addressing some of the negative effects of psychopathy. (shrink)

Effective and specifically targeted social and therapeutic responses for antisocial personality disorders and psychopathy are scarce. Some authors maintain that this scarcity should be overcome by revising current syndrome - based classifications of these conditions and devising better biocognitive classifications of antisocial individuals. The inspiration for the latter classifications has been embedded in the Research domain criteria approach (RDoC). RDoC - type approaches to psychiatric research aim at transforming diagnosis, provide valid measures of disorders, aid clinical practice, and improve health (...) outcomes by integrating the data on the genetic, neural, cognitive, and affective systems underlying psychiatric conditions. In the first part of the paper, we discuss the benefits of such approaches in comparison to the dominant syndrome-based ones and review recent attempts at building biocognitive classifications of antisocial individuals. Other researchers, how ever, have objected that biocognitive approaches in psychiatry are committed to an untenable form of explanatory. (shrink)

In this article I discuss and evaluate the selectivity problem as a problem put forward by Bermudez (1997, 2000) against anti-intentionalist accounts of self-deception. I argue that the selectivity problem can be raised even against intentionalist accounts, which reveals the too demanding constraint that the problem puts on the adequacy of a psychological explanation of action. Finally I try to accommodate the intuitions that support the cogency of the selectivity problem using the resources from the framework provided by an anti-intentionalist (...) account of self-deception. In the paper, I examine the conditions that are necessary for the correct characterization of the phenomenon of self-deception. Deflationists believe that the phenomenon of self-deception can be characterized as a kind of motivationally biased belief-forming process. They face the selectivity problem according to which the presence of a desire for something to be the case is not enough to produce a self-deceptive belief. Intentionalists argue that the solution to the selectivity problem consists in invoking the notion of intention. According (...) to them, self-deception involves intentional distortion of one's own belief-forming process. In this paper, I defend the claim that intentionalists also face the problem of selectivity. Accordingly, I argue that this objection cannot be used to determine which theory of self-deception is superior. Furthermore, I argue that limiting folk-psychological explanations to reason-based explanations might be responsible for the resilience of the selectivity problem. In that context, as an additional explanatory factor, I emphasize personality traits that, along with motives, play an important role in the psychological explanation of human behavior. In the rest of the paper, I explore how such an expanded view of the folk-psychological explanation can be used to better capture individual cases of self-deception. (shrink)

Regress arguments have convinced many that reasoning cannot require beliefs about what follows from what. In this paper I argue that this is a mistake. Regress arguments rest on dubious (although deeply entrenched) assumptions about the nature of reasoning — most prominently, the assumption that believing p by reasoning is simply a matter of having a belief in p with the right causal ancestry. I propose an alternative account, according to which beliefs about what follows from what play a constitutive (...) role in reasoning. (shrink)

In this paper, I develop an epistemological argument for freedom from poverty, building on Gerald Gaus’ work on political and moral disagreement in New Diversity Theory (NDT). NDT argues that diversity and disagreement are fundamental to political and moral learning. In this paper, I address Gaus’ central arguments in NDT, and focus on what I argue to be the key epistemological distinction of his account—namely, the argument that the relevant diversity, which is conducive to political and moral learning and should (...) therefore be protected by an institutional order, should not be defended or defined by reference to its performance with regards to discovery of true beliefs, but by reference to the independent epistemic value of protection of disagreeing, redundant and distant investigators. I develop a restatement of this argument from the perspective of institutional epistemology, and show that (along with constitutional liberties, polycentric self-governance and markets) freedom from poverty must be considered an institutional “device” conducive to such a conception of diversity. While Gaus rejects redistributive policies at the level of an institutional order, it is precisely his account of the epistemic powers of diversity and disagreement which provides the strongest defense of minimal redistribution. Recently there has been a trend of moving towards biological and neurocognitive based classifications of mental disorders that is motivated by a dissatisfaction with the syndrome-based classifications of mental disorders. The Research Domain Criteria (indicated with the acronym RDoC) represents a bold and systematic attempt to foster this advancement. However, RDoC faces theoretical and conceptual issues that need to be addressed. Some of these difficulties emerge when we reflect on the plausible reading of the slogan “mental disorders are brain disorders”, (...) that according to proponents of RDoC constitutes one of its main presuppositions. Some authors think that endorsing this idea commits RDoC to a form of biological reductionism. We offer empirical and theoretical considerations for concluding that the slogan above should not be read as a reductionist thesis. We argue, instead, that the slogan has a pragmatic function whose aim is to direct research in psychopathology. We show how this function might be captured in the framework of a Carnapian explication as a methodological tool for conceptual engineering. Thus, we argue that a charitable interpretation of the aims of the proponents of RDoC should be understood as an attempt at providing an explication of the concept of mental disorder in terms of brain disorder whose main goal is to provide a more precise and fruitful notion that is expected to have a beneficial impact on classification, research, and treatment of psychiatric conditions. In their 2010 paper, Dizadji-Bahmani, Frigg, and Hartmann argue that the generalized version of the Nagel–Schaffner model that they have developed is the right one for intertheoretic reduction, i.e. the kind of reduction that involves theories with largely overlapping domains of application. Drawing on the GNS, DFH presented a Bayesian analysis of the confirmatory relation between the reducing theory and the reduced theory and argued that, post-reduction, evidence confirming the reducing theory also confirms the reduced theory and evidence confirming the (...) reduced theory also confirms the reducing theory, which meets the expectations one has about theories with largely overlapping domains. In this paper, I argue that the Bayesian analysis presented by DFH faces difficulties. In particular, I argue that the conditional probabilities that DFH introduce to model the bridge law entail consequences that run against the GNS. However, I also argue that, given slight modifications of the analysis that are in agreement with the GNS, one is able to account for these difficulties and, moreover, one is able to more rigorously analyse the confirmatory relation between the reducing and the reduced theory. Psychopathy, executive functions, and neuropsychological data: a response to Sifferd and Hirstein.

Psychopathy is typically characterized as a constellation of deviant personality traits and behavioral tendencies. The link between psychopathic personality traits and pervasive antisocial behavior raises a crucial question concerning the legal accountability of offenders with psychopathy. Some argue that the unique clinical profile and neurobiological peculiarities of individuals with psychopathy mitigate their responsibility, while others maintain that current scientific knowledge does not support the use of psychopathy as an exculpatory condition for criminal offending. Our overview mainly centeres on whether offenders (...) with psychopathy can be considered legally insane. In this regard, our overview suggests that there is still an ongoing debate whether psychopathy should be used as a legally relevant construct for determining criminal responsibility. Moreover, our discussion indicates that careful attention should be put on empirical and conceptual issues surrounding the role of (neuro)scientific data for determining whether individuals with psychopathy should be considered criminally blameworthy for their wrongdoings. This textbook offers the first unified treatment of wave propagation in electronic and electromagnetic systems and introduces readers to the essentials of the transfer matrix method, a powerful analytical tool that can be used to model and study an array of problems pertaining to wave propagation in electrons and photons. It is aimed at graduate and advanced undergraduate students in physics, materials science, electrical and computer engineering, and mathematics, and is ideal for researchers in photonic crystals, negative index materials, left-handed (...) materials, plasmonics, nonlinear effects, and optics. Peter Markos and Costas Soukoulis begin by establishing the analogy between wave propagation in electronic systems and electromagnetic media and then show how the transfer matrix can be easily applied to any type of wave propagation, such as electromagnetic, acoustic, and elastic waves. The transfer matrix approach of the tight-binding model allows readers to understand its implementation quickly and all the concepts of solid-state physics are clearly introduced. Markos and Soukoulis then build the discussion of such topics as random systems and localized and delocalized modes around the transfer matrix, bringing remarkable clarity to the subject. Total internal reflection, Brewster angles, evanescent waves, surface waves, and resonant tunneling in left-handed materials are introduced and treated in detail, as are important new developments like photonic crystals, negative index materials, and surface plasmons. Die Untersuchung gliedert sich in drei durch eine Einführung und eine Schlussbetrachtung eingerahmte Hauptkapitel. Im ersten Hauptkapitel geht es um Kants Raum- und Zeitkonzeption in seiner vorkritischen Phase unter Berücksichtigung seiner Reaktion auf die zeitgenössische Kritik an seiner Konzeption von 1770. Dabei wird Kants komplexer Denkweg hin zu seiner Wende zum Verständnis von Raum und Zeit als reinen Anschauungen thematisiert. Hieran schließt sich im zweiten Hauptkapitel die Behandlung der prominenteren, systematisch ausgereiften Raum- und Zeitkonzeption in der Kritik der reinen Vernunft (...) an, wobei zunächst die unterschiedlichen Argumente aus der transzendentalen Ästhetik sukzessive und unter Einschluss der Forschungsliteratur diskutiert werden und Raum und Zeit als formale Anschauungen in der transzendentalen Analytik sowie als Ideen der Vernunft in der transzendentalen Dialektik zur Sprache kommen. Psychopathy attracts considerable interdisciplinary interest. The idea of a group of people with abnormal morality and interpersonal relations raises important philosophical, legal, and clinical issues. However, before engaging these issues, we ought to examine whether this category is scientifically grounded. We frame the issue in terms of the question whether ‘psychopathy’ designates a natural kind according to the cluster approaches. We argue that currently there is no sufficient evidence for an affirmative answer to this question. Furthermore, we examine three ways (...) of dealing with the category of psychopathy. We could eliminate the category, revise it, or subscribe to a more encompassing account of kinds, which could capture psychopathy as it is currently conceptualized. We argue that while a revision of the category of psychopathy is to be expected with empirical and theoretical advancements, we also emphasize its role in clinical and forensic research that makes it an important pragmatic kind. In this study, we examine the influence of senior leadership on firms’ corporate social responsibility. We integrate upper echelons research that has investigated either the influence of the CEO or the top management team on CSR. We contend that functional experience complementarity between CEOs and TMTs in formulating and implementing CSR strategy may underlie differentiated strategies in CSR. We find that when CEOs who have predominant experience in output functions are complemented by TMTs with a lower proportion of members who (...) have experience in output functions, there is a pronounced effect on the community, product, and diversity dimensions of CSR. In turn, when output-oriented CEOs are complemented by output-oriented TMTs, we observe an effect on the employee relations dimension of CSR. Interestingly, we find no influence of CEO-TMT complementarity on the environment dimension of CSR. In general, our empirical results support the relevance of the interaction between CEOs and their TMTs in defining their firms’ CSR profile. (shrink)

Although most commentators consider Kant's conception of empirical self-knowledge through inner sense to be either a failure or at least drastically under-developed, I argue that (just as Kant claims) his account of the capacity of the understanding to determine sensibility - the "productive imagination" - can ground an attractive account of self-knowledge. (...) The account of inner sense I propose, however, may seem to conflict with some of Kant's views on time. I close the paper by arguing that the apparent conflict is not a fault specific to my account of inner sense, but rather indicative of a deeper tension, internal to Kant's views on time. (shrink)

The aim of this work is to show, first of all, how landscape cannot but stand out on the horizon of a cognitive flux that affects every aspect of our being in the world (or, better said, of our being in the world) world). A special role will be reserved for aesthetic mediation, to be understood as a n act that regulates the epistemic negotiation between what is in the center and what is ”in the surroundings”. In this sense, the (...) work will start from bio cognitive assumptions on the species specific ways in which an organism circumscribes and enriches its world, and will then finally arrive at considerations that should, in our hopes, demonstrate how aisthesis is, in fact, the conceptual category that best lends itself to describing this process, in virtue of the particular gnoseological value it assigns to the se nsitive body and its extension extension. Abstract.Evolutionary psychology and behavioural genomics are both approaches to explain human behaviour from a genetic point of view. Nonetheless, thus far the development of these disciplines is anything but interdependent. This paper examines the question whether evolutionary psychology can contribute to behavioural genomics. Firstly, a possible inconsistency between the two approaches is reviewed, viz. that evolutionary psychology focuses on the universal human nature and disregards the genetic variation studied by behavioural genomics. Secondly, we will discuss the structure of biological explanations. (...) Some philosophers rightly acknowledge that explanations do not involve laws which are exceptionless and universal. Instead, generalisations that are invariant suffice for successful explanation as long as two other stipulations are recognised: the domain within which the generalisation has no exceptions as well as the distribution of the mechanism described by the generalisation should both be specified. It is argued that evolutionary psychology can contribute to behavioural genomic explanations by accounting for these two specifications. (shrink)
