Bayesian models of legal arguments generally aim to produce a single integrated model, combining each of the legal arguments under consideration. This combined approach implicitly assumes that variables and their relationships can be represented without any contradiction or misalignment, and in a way that makes sense with respect to the competing argument narratives. This paper describes a novel approach to compare and ‘average’ Bayesian models of legal arguments that have been built independently and with no attempt to make them consistent (...) in terms of variables, causal assumptions or parameterization. The approach involves assessing whether competing models of legal arguments are explained or predict facts uncovered before or during the trial process. Those models that are more heavily disconfirmed by the facts are given lower weight, as model plausibility measures, in the Bayesian model comparison and averaging framework adopted. In this way a plurality of arguments is allowed yet a single judgement based on all arguments is possible and rational. (shrink)

Evidence from functional neuroimaging of the human brain indicates that information about salient properties of an object¿such as what it looks like, how it moves, and how it is used¿is stored in sensory and motor systems active when that information was acquired. The Liar paradox arises when we consider a sentence that says of itself that it is not true. If such self-referential sentences exist? and examples like?This sentence is not true? certainly suggest this?, then our logic and standard notion of truth allow to infer a contradiction: The Liar sentence is true and not true. What has gone wrong? Must we revise our notion of truth and our logic? Or can we dispel the common conviction that there are such self-referential sentences? (...) The present study explores the second path.0After comparing the Liar reasoning in formal and informal logic and showing that there are no Gödelian Liar sentences, the study moves on from the semantics of self-reference to the metaphysics of expressions and proposes a novel solution to the Liar paradox: Meaningful expressions are distinct from their syntactic bases and exist only relative to contexts. Detailed semantico-metaphysical arguments show that in this dynamic setting, an object can be referred to only after it has started to exist. Hence the circular reference needed in the Liar paradox cannot occur, after all. As this solution is contextualist, it evades the expressibility problems of other proposals. (shrink)

Modern scientific cosmology pushes the boundaries of knowledge and the knowable. This is prompting questions on the nature of scientific knowledge. A central issue is what defines a 'good' model. When addressing global properties of the Universe or its initial state this becomes a particularly pressing issue. How to assess the probability of the Universe as a whole is empirically ambiguous, since we can examine only part of a single realisation of the system under investigation: at some point, data will (...) run out. We review the basics of applying Bayesian statistical explanation to the Universe as a whole. We argue that a conventional Bayesian approach to model inference generally fails in such circumstances, and cannot resolve, e.g., the so-called 'measure problem' in inflationary cosmology. Implicit and non-empirical valuations inevitably enter model assessment in these cases. This undermines the possibility to perform Bayesian model comparison. One must therefore either stay silent, or pursue a more general form of systematic and rational model assessment. We outline a generalised axiological Bayesian model inference framework, based on mathematical lattices. This extends inference based on empirical data (evidence) to additionally consider the properties of model structure (elegance) and model possibility space (beneficence). We propose this as a natural and theoretically well-motivated framework for introducing an explicit, rational approach to theoretical model prejudice and inference beyond data. (shrink)

We draw on the behavioral agency model to explore the ethical consequences of CEO equity incentives. We argue that CEOs are more concerned with funding pension plans when they have more to gain from their stock options yet will increasingly underfund employee pension funds as their current option wealth increases. Our findings reveal that both effects hold when the CEO has greater power (also occupying board chair) over firm decision making. Our study suggests that there is an ethical dimension to (...) equity incentives, given they are intended to align CEO interests with shareholders, yet potentially incentivize CEO behaviors with adverse consequences for employees. Insights from our findings provide boards and regulators with behavioral levers to protect employee well-being in the context of pension funding. (shrink)

This paper examines the question of whether human rights are related to ontology. It examines perspectives on this question from human rights theories in the Western and African traditions of philosophy and defends the thesis that a good account of human rights requires an explicit ontology of the human, and that taking this seriously engenders divergent conclusions about what rights are. It then proceeds to claim that the African Charter on Human and Peoples’ Rights adds substantive features to the International (...) Bill of Human Rights, and that the Charter expresses Kwame Gyekye’s ontology of the human being. (shrink)

Avantgarde in Halle: The Invention of Aesthetics and the Aestheticization of Christianity. The foundation of scholarly aesthetics by the Halle philosopher Alexander Gottlieb Baumgarten and Georg Friedrich Meier in the middle of the 18th century took place within a milieu that was shaped by both pietism and the Enlightenment. Martin Fritz demonstrates that aesthetics in Halle itself can be considered a synthesis of pietism and Enlightenment ideas. The sensualization of basic Christian concepts is of eminent relevance for these aesthetics, (...) in order to reinvent the pietistic striving for intensive religious experiences through such „aestheticization.“ The romantic idea of „Kunstreligion“, which continues to be significant in cultural life today, is also based on this programmatic notion of aestheticization. Building on this historical background, this article’s concluding systematic considerations argue for a theological revaluation of pertinent contemporary cultural phenomena. (shrink)

Heidegger piensa que el planteamiento aporético muestra que Aristóteles intuye ya que el Dasein mismo debe considerarse fundamentalmente tiempo. (...) Puesto que el tiempo es la determinación básica de la existencia humana, el Dasein sería imposible sin el tiempo. En otras palabras, no habría Dasein sin tiempo.: The subject of the present paper is Heidegger’s reception and radicalization of Aristotle’s aporia of time and soul in the texts of the period known as the phenomenological decade. The question about whether there would be time without the existence of soul leads to a difficult aporia which remains unanswered in the corpus aristotelicum. Nevertheless, Heidegger believes that this aporetical approach shows that Aristotle already sensed that Dasein itself is to be considered fundamentally as time. Since time is the basic determination of human existence, Dasein would be impossible without time. In other words, there would not be a Dasein without time. (shrink)

This study uses new arguments to reinvestigate the relation between aesthetics and politics in the contemporary debates on democratic theory and radical democracy. -/- First, Carl Schmitt and Claude Lefort help delineate the contours of an aesthetico-political understanding of democracy, which is developed further by studying Merleau-Ponty, Rancière, and Arendt. -/- The ideas of Merleau-Ponty serve to establish a general "ontological" framework that aims to contest the dominant currents in contemporary democratic theory. It is argued that Merleau-Ponty, Arendt, and Rancière (...) share a general understanding of the political as the contingently contested spaces and times of appearances.
