In Daubert v. Merrell Dow Pharmaceuticals, Inc., Daubert charged Merrell Dow with creating a drug (Bendectin) that caused birth defects in two infants. In charging Merrell Dow, Daubert relies upon the testimony of a scientific expert who “reanalyzed” a number of studies to show that Bendectin was the cause of said defects. Merrell Dow objected, contending that the “reanalysis” method was not based upon reliable science, to which the judge agreed. Upon appeal, the United States Supreme Court was charged with (...) determining what scientific testimony is reliable enough to be admitted as evidence in court. This paper describes, not only the legal and definitional issues surrounding the Daubert cases but how the Daubert case could be used to prompt discussion about a variety of “what is X?” questions, e.g. “what is science?”, “what is an expert?”, “what is knowledge?”. We hypothesize that effective collaboration is facilitated when individuals and environmental components form a synergy where they work together and regulate one another to produce stable patterns of behavior, or regularity, as well as adaptively reorganize to form new behaviors, or irregularity. We tested this hypothesis in a study with 32 triads who collaboratively solved a challenging visual computer programming task for 20 min following an introductory warm‐up phase. Multidimensional recurrence quantification analysis was used to examine fine‐grained (i.e., every 10 (...) s) collective patterns of regularity across team members' speech rate, body movement, and team interaction with the shared user interface. We found that teams exhibited significant patterns of regularity as compared to shuffled baselines, but there were no systematic trends in regularity across time. We also found that periods of regularity were associated with a reduction in overall behavior. Notably, the production of irregular behavior predicted expert‐coded metrics of collaborative activity, such as teams' ability to construct shared knowledge and effectively negotiate and coordinate execution of solutions, net of overall behavioral production and behavioral self‐similarity. Our findings support the theory that groups can interact to form interpersonal synergies and indicate that information about system‐level dynamics is a viable way to understand and predict effective collaborative processes. When deciding what disorders to screen newborns for, we should be guided by evidence of real effectiveness, take opportunity cost into account, distribute costs and benefits fairly, and respect human rights. Current newborn screening policy does not meet these requirements.

The phenomenology of inner temporalizing developed by Edmund Husserl provides a helpful framework for understanding a type of experiencing that can be part of the Post-Traumatic Stress Disorder (PTSD). My paper extrapolates hints from Husserl's work in order to describe those memories — flashbacks — that come so strongly to consciousness as to overtake the experiencer. Husserl's work offers several clues: his view of inner temporalization by which conscious experiences flow in both a serial and a nonserial manner; a characterization (...) of process memory as distinct from representational memory; and the notion of telos, which takes human subjectivity as intrinsically changeable, for example, by means of a retroactive cancellation that would allow the PTSD experiencer to re-process the original meaning of the traumatic experience into a meaning that fits the current situation and thus allows a recovery. Canadian and American population-based research concerning sexual and/or gender minority populations provides evidence of persistent breast and gynecologic cancer-related health disparities and knowledge divides. The Cancer's Margins research investigates the complex intersections of sexual and/or gender marginality and incommensurabilities and improvisation in engagements with biographical and biomedical cancer knowledge. The study examines how sexuality and gender are intersectionally constitutive of complex biopolitical mappings of cancer health knowledge that shape knowledge access and its mobilization in health and treatment decision-making. Interviews were (...) conducted with a diverse group of sexual and/or gender minority breast or gynecologic cancer patients. The LGBQ//T2 cancer patient narratives we have analyzed document in fine grain detail how it is that sexual and/or gender minority cancer patients punctuate the otherwise lockstep assemblage of their cancer treatment decision-making with a persistent engagement in creative attempts to resist, thwart and otherwise manage the possibility of discrimination and likewise, the probability of institutional erasure in care settings. Our findings illustrate the demands that cancer places on LGBQ//T2 patients to choreograph access to, and mobilization of knowledge and care, across significantly distinct and sometimes incommensurable systems of knowledge. If emotions have a rational role in action, then one challenge for accounting for how we can act rationally when acting emotionally is to show how we can guide our actions by our emotional considerations, seen as reasons. In this paper, I put forward a novel proposal for how this can be so. Drawing on the interconnection between emotions, cares and caring, I argue that, as the emotional agent is a caring agent, she can be aware of the emotional consideration (...) as a pro tanto reason favouring an action choice and, even, as the reason for which she should act. Pressure is mounting to hold researchers and research institutions accountable for the protection of human subjects. When subjects or their family members believe they have been injured, they are increasingly willing to file lawsuits. Recent cases indicate that institutional review boards and their members may be pulled more and more into the legal fray.On September 17, 1999, 18-year-old Jesse Gelsinger died while participating in research conducted by the University of Pennsylvania's Institute for Gene Therapy. Gelsinger was involved in a Phase (...) I clinical trial testing a new approach to treatment of ornithine transcarbamylase deficiency, a rare metabolic disorder. Although infants affected by the severe form of OTC die shortly after birth, Gelsinger suffered from a relatively mild form. It appears undisputed that the cause of Gelsinger's death was not the disorder itself, but multiple organ system failure triggered by the virus used to carry new genetic material into his system. Narrative explanations in evolutionary biology have seemed fundamentally different from other scientific explanations, and similar to historical explanations. This investigation of the structure of narrative explanations in evolutionary biology reveals that narrative explanations do have a deductive-nomological base, but that their structure contains two significant additional elements as well. The additional elements are: the multidimensional recursive connection between the different sub-explanations in a narrative explanation; and a set of generic explanations which make possible the integration of multiple co-existing processes.

This paper is primarily an attempt to study the Homeric evidence on houses, particularly on the , in relation to the relevant remains. The reverse procedure, illuminating the archaeological evidence by references to Homer, is a hazardous one, as we shall see. It is often unclear just what is represented by the descriptions in the poems, and what period, if any, the things described belong to. I shall be concerned with these questions here. Are the houses in the poems Mycenaean: (...) genuine traditions from the period in which the stories are set? Or are they Geometric: contemporary? Or a memory of some time in between? Or a mixture? We know so little about the development of the epic tradition that any possible source of information is worth pursuing. (shrink)

I argue that in her first novel Near to the Wild Heart, Clarice Lispector puts forth a critique of Baruch Spinoza’s idea of freedom from Books IV and V of the Ethics. Although scholars have noted that Lispector was influenced by Spinoza, and that she quoted the Ethics in Near to the Wild Heart, none have yet explored her critical engagement with Spinozism. I argue that through the intimate relationship of two characters in Near to the Wild Heart, both of (...) whom strive to be free in Spinozist terms but fail, Lispector shows that freedom must depend on more than reason alone. For Lispector, I argue, freedom depends additionally on circumstances such as human relationships and societal structures. I give biographical background to establish Lispector’s stake in the question of what freedom means and how it can be achieved, then explore the ways her two respective characters, Otávio and Joana, strive yet fail to be free. The work of literary structuralists, particularly Roland Barthes, provides sharper insights into ethnomethodology than symbolic interactionism, labeling theory, or phenomenology. Further, it suggests that the metaphor of text may be fruitful for analysts of everyday life. Greater theoretical benefits derive from that metaphor, however, if one applies it using the ideas of literary theorists outside the structuralist tradition.
