Frammentazione del territorio e incidenza della volontà umana.Massimiliano Vinci - 2024 - Studi di Estetica 29.
In contrast to a positivist conception that considers the objective elements of its topographical location to be absolutely prevalent for the identification of a real estate, the Roman legal sources present a more articulated picture, in which the voluntas, affectio and constitutio of the dominus play a fundamental role in the subjective distinction between locus and fundus. In any case, a merely patrimo-nial perspective appears extraneous to Roman jurist’s thinking. On the contrary, emerges the full awareness of a special juridical (...)

Insurgent Universality: An Alternative Legacy of Modernity.Massimiliano Tomba - 2019 - Historical Materialism 30 (4):62-70.
This article intends to summarise the content of my book Insurgent Universality: An Alternative Legacy of Modernity and expand the meaning of the term ‘universality’. Universality is not defined in abstract legal terms or by juxtaposition vis-à-vis a common enemy. Instead, I clarify the meaning of a more concrete and open practice of universality through historical examples and theories that I excavate from social practices.

    Consciousness and choking in visually-guided actions.Massimiliano Cappuccio - 2015 - Phenomenology and the Cognitive Sciences 14 (2):333-348.
Choking under pressure describes the phenomenon of people performing well below their expected standard under circumstances where optimal performance is crucial. One of the prevailing explanations for choking is that pressure increases the conscious attention to the underlying processes of the performer's task execution, thereby disrupting what would normally be a relatively automatic process. However, research on choking has focused mainly on the influence of pressure on motor performance, typically overlooking how it might alter the way that vision is controlled (...)

The article analyzes, at different levels, the relationship between war and borders. The question of the borders may provide an interesting point of view. At stake, in “new wars” is not the path of interstate frontiers but different borders developments. To analyze these dynamics the article emphasizes the useful relationship between two different bibliographies, on one hand the strategic literature about “new wars”, on the other hand the territorial and regional studies analyzing the new form of political, economic and juridical (...)

The general question (G) How do we categorize artifacts? can be subject to three different readings: an ontological, an epistemic and a semantic one. According to the ontological reading, asking (G) is equivalent to asking in virtue of what properties, if any, a certain artifact is an instance of some artifact kind: (O) What is it for an artifact a to belong to kind K? According to the epistemic reading, when we ask (G) we are investigating what properties of the (...)

Background Respect for human rights and bioethical principles in prisons is a crucial aspect of society and is proportional to the well-being of the general population. To date, these ethical principles have been lacking in prisons and prisoners are victims of abuse with strong repercussions on their physical and mental health. Methods A systematic review was performed, through a MESH of the following words (bioethics) AND (prison), (ethics) AND (prison), (bioethics) AND (jail), (ethics) AND (jail), (bioethics) AND (penitentiary), (ethics) AND (...)

The work of Thomas Kuhn has been very influential in Anglo-American philosophy of science and it is claimed that it has initiated the historical turn. Although this might be the case for English speaking countries, in France an historical approach has always been the rule. This article aims to investigate the similarities and differences between Kuhn and French philosophy of science or ‘French epistemology’. The first part will argue that he is influenced by French epistemologists, but by lesser known authors (...)

The pragmatic logic of assertions shows a connection between ignorance and decidability. In it, we can express pragmatic factual ignorance and first-order ignorance as well as some of their variants. We also show how some pragmatic versions of second-order ignorance and of Rumsfeld-ignorance may be formulated. A specific variant of second-order ignorance is particularly relevant. This indicates a strong pragmatic version of ignorance of ignorance, irreducible to any previous form of ignorance, which defines limits to what can justifiably be asserted (...)

Some forms of analytic reconstructivism take natural language (and common sense at large) to be ontologically opaque: ordinary sentences must be suitably rewritten or paraphrased before questions of ontological commitment may be raised. Other forms of reconstructivism take the commitment of ordinary language at face value, but regard it as metaphysically misleading: common-sense objects exist, but they are not what we normally think they are. This paper is an attempt to clarify and critically assess some common limits of these two (...)

This paper proposes a new dialetheic logic, a Dialetheic Logic with Exclusive Assumptions and Conclusions ), including classical logic as a particular case. In \, exclusivity is expressed via the speech acts of assuming and concluding. In the paper we adopt the semantics of the logic of paradox extended with a generalized notion of model and we modify its proof theory by refining the notions of assumption and conclusion. The paper starts with an explanation of the adopted philosophical perspective, then (...)

A recurrent theme in the characterization of synthetic biology is the role of engineering. This theme is widespread in the accounts of scholars studying this field and the biologists working in it, in those of the biologists themselves, as well as in policy documents. The aim of this article is to open this black-box of engineering that is supposed to influence and change contemporary life sciences. Too often, both synthetic biologists and their critics assume a very narrow understanding of what (...)

This article distinguishes three archetypal ways of articulating spatial cognition: (1) via metric representation of objective geometry, (2) via somatosensory constitution of the peripersonal environment, and (3) via pragmatic comprehension of the finalistic sense of action. The last one is documented by neuroscientific studies concerning mirror neurons. Bio-robotic experiments implementing mirror functions confirm the constitutive role of goal-oriented actions in spatial processes.

The Collectio Avellana, a collection of late antique documents which has been thoroughly investigated, above all by ancient historians and historians of Roman law, provides a wealth of historical, political-religious and legal information for the period between the middle of the 4th and the middle of the 6th century AD. This contribution, limited to the years of the pontificate of Pope Damasus, seeks to understand whether these texts can also represent a source of topographical information for the city of Rome.

    Figure dell’assenza tra Salomon Maimon, Emmanuel Lévinas e Walter Benjamin.

    The Ontology of Products.Massimiliano Vignolo - 2010 - Metaphysica 11 (1):1-16.
We speak of products in two senses: in one, we speak of types of products, in the other we speak of the particular objects that are instances of those types. I argue that types of products have the same ontological status as that of material stuffs, like water and gold, which have a non-particular level of existence. I also argue that the relationship between types of products and their instances is logically similar to the relation of constitution, which holds between, (...)

First of all, a brief summary about the concept of empathy is provided, with particular attention to empathy in Brechtian theatre. Then, a paragraph is dedicated to explain how empathy and emotional involvement are linked to neurobiological mechanisms and body state. The ‘Mind-Upload’ hypothesis, a radical version of the Brain-in-a-Vat thought experiment, asserts that a whole mind can safely be transferred from a brain to a digital device, after being exactly encoded into substrate independent informational patterns. Prima facie, MU seems the philosophical archenemy of the Embodied Mind theory, which understands embodiment as a necessary and constitutive condition for the existence of a mind and its functions. In truth, whether and why MU and EM are ultimately incompatible is unobvious. This paper, (...)

This paper motivates the idea that social robots should be credited as moral patients, building on an argumentative approach that combines virtue ethics and social recognition theory. Our proposal answers the call for a nuanced ethical evaluation of human-robot interaction that does justice to both the robustness of the social responses solicited in humans by robots and the fact that robots are designed to be used as instruments. On the one hand, we acknowledge that the instrumental nature of robots and (...)

    Minimal contents, lying, and conventions of language.Massimiliano Vignolo - 2022 - Synthese 200 (2):1-25.
One recurrent objection against minimalism is that minimal contents have no theoretical role. It has recently been argued that minimal contents serve to draw the distinction between lying and misleading. In Sect. 1 and Sect. 2 I summarise the main argument in support of that claim and contend that it is inconclusive. In Sect. 3 I discuss some cases of lying and some of misleading that raise difficulties for minimalism. In Sect. 4 I make a diagnosis of the failure of (...)

Bold and pioneering, this book makes a detailed historical and systematic case that Descartes's theory of knowledge is an elegant and powerful combination of a priori, naturalistic, and dialectical elements meriting serious consideration by both contemporary analytic philosophers and postmodern thinkers. In the course of making this case Thomas Vinci develops a broad reinterpretation of Cartesian thought that unlocks novel solutions to many of the most vexed questions in Cartesian scholarship.

The essay starts from the singularization and temporalization of political concepts, that originate a self-representation of modernity as hierarchically superior to pre-modernity. Such self-representation, in Massimiliano Tomba’s words, must be now pluralized not only in relationship with the many extra-European temporalities, but also with the multiple temporal layers of European history. The author’s proposal of working on «time differentials», i.e. on the trajectories that turn from the dominant course of modern history, founded on Western emancipation, individual rights and modern (...)

Massimiliano Simons provides the first systematic study of Serres' work in the context of late 20th-century French philosophy of science. By proposing new readings of Serres' philosophy, Simons creates a synthesis between his predecessors, Gaston Bachelard, Georges Canguilhem, and Louis Althusser as well as contemporary Francophone philosophers of science such as Bruno Latour and Isabelle Stengers. Simons situates Serres' unique contribution through his notion of the quasi-object, a concept, he argues, organizes great parts of Serres' work into a promising (...)

This essay analyses the second chapter of the Zhuangzi 莊子, the “Qiwulun 齊物論.” After a brief examination of its main ideas, it will be argued that the “Qiwulun” needs to be considered not as an equalization that makes everything indistinguishable but as a discourse on corresponding things. A more attentive analysis of this correspondence among the myriad things will lead to the consideration of their mutual transformation. The conclusion is that, contrary to the ontotheological nature of Western metaphysics that imposes (...)
