In contrast to a positivist conception that considers the objective elements of its topographical location to be absolutely prevalent for the identification of a real estate, the Roman legal sources present a more articulated picture, in which the voluntas, affectio and constitutio of the dominus play a fundamental role in the subjective distinction between locus and fundus. In any case, a merely patrimo-nial perspective appears extraneous to Roman jurist’s thinking. This article intends to summarise the content of my book Insurgent Universality: An Alternative Legacy of Modernity and expand the meaning of the term ‘universality’. Universality is not defined in abstract legal terms or by juxtaposition vis-à-vis a common enemy. Instead, I clarify the meaning of a more concrete and open practice of universality through historical examples and theories that I excavate from social practices.

Choking under pressure describes the phenomenon of people performing well below their expected standard under circumstances where optimal performance is crucial. One of the prevailing explanations for choking is that pressure increases the conscious attention to the underlying processes of the performer's task execution, thereby disrupting what would normally be a relatively automatic process. However, research on choking has focused mainly on the influence of pressure on motor performance, typically overlooking how it might alter the way that vision is controlled (...) when performing these motor actions. In this article we ask whether the visual component of expert motor-skill execution is susceptible to choking much like the motor component is thought to be. To do so, we draw heavily on empirical findings from studies of sporting expertise, in particular focussing on the role of gaze in three types of visually-guided actions: interceptive actions, aiming tasks, and anticipatory skill. For each of these skills we evaluate the nature of the expert advantage, discuss the role of consciousness in their control, examine the potential impact of pressure on task performance, and consider interventions designed to reduce the likelihood of choking when performing these tasks. The article analyzes, at different levels, the relationship between war and borders. The question of the borders may provide an interesting point of view. At stake, in “new wars” is not the path of interstate frontiers but different borders developments. To analyze these dynamics the article emphasizes the useful relationship between two different bibliographies, on one hand the strategic literature about “new wars”, on the other hand the territorial and regional studies analyzing the new form of political, economic and juridical (...) spatiality. The aim is to catch the types of non homogeneous territorialities striated by flux spaciality, scaling and rescaling processes and different regimes of temporality and mobility, at stake in the “new wars”. The general question (G) How do we categorize artifacts? can be subject to three different readings: an ontological, an epistemic and a semantic one. According to the ontological reading, asking (G) is equivalent to asking in virtue of what properties, if any, a certain artifact is an instance of some artifact kind: (O) What is it for an artifact a to belong to kind K? According to the epistemic reading, when we ask (G) we are investigating what properties of the (...) object we exploit in order to decide whether a certain artifact belongs to a certain kind. (G) thus becomes: (E) How can we know that artifact a belongs to kind K? Finally, (G) can also be read as a question concerning the semantics of artifact kind terms. The semantic reading of (G) is: (S) What kind of reference do artifact kind terms have, if any? In this editorial we expand on the different answers to (O), (E) and (S) that are given in the selected literature on the topic. Background Respect for human rights and bioethical principles in prisons is a crucial aspect of society and is proportional to the well-being of the general population. To date, these ethical principles have been lacking in prisons and prisoners are victims of abuse with strong repercussions on their physical and mental health. Methods A systematic review was performed, through a MESH of the following words (bioethics) AND (prison), (ethics) AND (prison), (bioethics) AND (jail), (ethics) AND (jail), (bioethics) AND (penitentiary), (ethics) AND (...) (penitentiary), (prison) AND (human rights). Inclusion and exclusion criteria were defined and after PRISMA, 17 articles were included in the systematic review. Results Of the 17 articles, most were prevalence studies (n.5) or surveys (n.4), followed by cross-sectional studies (n.3), qualitative studies (n.1), retrospective (n.1) and an explanatory sequential mixed-methods study design (n.1). In most cases, the studies associated bioethics with prisoners’ access to treatment for various pathologies such as vaccinations, tuberculosis, hepatitis, HIV, it was also found that bioethics in prisons was related to the mental health of prisoners, disability, ageing, the condition of women, the risk of suicide or with the request for end-of-life by prisoners. The results showed shortcomings in the system of maintaining bioethical principles and respect for human rights. Conclusions Prisoners, in fact, find it difficult to access care, and have an increased risk of suicide and disability. Furthermore, they are often used as improper organ donors and have constrained autonomy that also compromises their willingness to have end-of-life treatments. In conclusion, prison staff (doctors, nurses, warders, managers) must undergo continuous refresher courses to ensure compliance with ethical principles and human rights in prisons. (shrink)

The work of Thomas Kuhn has been very influential in Anglo-American philosophy of science and it is claimed that it has initiated the historical turn. Although this might be the case for English speaking countries, in France an historical approach has always been the rule. This article aims to investigate the similarities and differences between Kuhn and French philosophy of science or ‘French epistemology’. The first part will argue that he is influenced by French epistemologists, but by lesser known authors (...) than often thought. The second part focuses on the reactions of French epistemologists on Kuhn’s work, which were often very critical. It is argued that behind some superficial similarities there are deep disagreements between Kuhn and French epistemology. This is finally shown by a brief comparison with the reaction of more recent French philosophers of science, who distance themselves from French epistemology and are more positive about Kuhn. Based on these diverse appreciations of Kuhn, a typology of the different positions within the philosophy of science is suggested. (shrink)

The pragmatic logic of assertions shows a connection between ignorance and decidability. In it, we can express pragmatic factual ignorance and first-order ignorance as well as some of their variants. We also show how some pragmatic versions of second-order ignorance and of Rumsfeld-ignorance may be formulated. A specific variant of second-order ignorance is particularly relevant. This indicates a strong pragmatic version of ignorance of ignorance, irreducible to any previous form of ignorance, which defines limits to what can justifiably be asserted (...) about higher-order ignorance. Some forms of analytic reconstructivism take natural language (and common sense at large) to be ontologically opaque: ordinary sentences must be suitably rewritten or paraphrased before questions of ontological commitment may be raised. Other forms of reconstructivism take the commitment of ordinary language at face value, but regard it as metaphysically misleading: common-sense objects exist, but they are not what we normally think they are. In the paper we adopt the semantics of the logic of paradox extended with a generalized notion of model and we modify its proof theory by refining the notions of assumption and conclusion. It was then believed that a Kuhnian reformulation of the (...) contemporary debate on the problems of the psychiatric diagnosis was very useful because it allowed clarification in a comprehensive picture of the many rivulets of conceptual research in that field.In their comments Zachar (2009) and Banzato (2009) seem to agree with my analysis of psychiatric comorbidity (Aragona 2009a) when it stresses that abnormally high frequencies of co-occurrence are to be explained, in important respects, as a consequence of the way mental disorders are operationalized in the Diagnostic and Statistical Manual of Mental Disorders (DSM; also showing the importance of conceptual clarification to deal with this sort of only apparently pure factual problems). On the contrary, they are both unconvinced of the appropriateness and/or fruitfulness of the use of the Kuhnian technical terms and theory in this context.It could be said that the major aim of the paper was to let clinicians understand the effect of conceptual decisions on what would otherwise seem as a simple empirical finding (in this case, high levels of comorbidity), and that this result seems to be achieved in any case, thus minimizing the importance of a disagreement about the philosophical terms as a pure terminological dispute. Nevertheless, in my work the Kuhnian model had a significant role in the clarification of this matter and it also suggests to the reader a range of possible consequences that are not trivial (Zachar, for example, says to be skeptical about the possibility of a crisis and also about the possibility that a new paradigm could eliminate what I call the [End Page 29] comorbidity anomaly). As a consequence, some of the Kuhnian concepts that seemed to be at odds in this context have to be considered in detail to justify my analysis and its consequences. For reasons of space, I avoid a point-by-point reply to all the comments and I concentrate my discussion on three main points. First, I discuss the background of Kuhn's definition of terms such as anomaly and paradigm, as well as my own reasons for using them. In doing so the details of the psychiatric items under study that I wanted to highlight through the use of these philosophical concepts should emerge more clearly. Second, I discuss the problem of having distinguished between artifactual and real comorbidity. Third, I reconsider some of these problems, looking for their implications for future psychopathological research.Anomalies and ParadigmsBanzato (2009) stresses that comorbidity cannot be a truly Kuhnian anomaly because it is an anticipated side effect of the initial setup of the DSM, and not some unexpected discovery that violates the paradigm-induced expectation. This is a basically correct account of the most known version of Kuhnian anomalies; that is, the tale of some evident nature's failure to conform to clear paradigm expectations, which immediately forces researchers to recognize its importance as a possible source of crisis. However, as is the case for many other Kuhnian terms, he discussed anomalies in several scripts and there are other possible versions of its meaning. In particular, Kuhn (1977, XVII) highlighted that only in very rare cases are anomalies completely unexpected and come out of blue to announce an imminent crisis that leads to a large revolution. More frequently, scientific revolutions are much more smaller, like the discovery of oxygen, and in these cases the process is so gradual that historians find it difficult to say exactly when a discovery was made and who did it. A recurrent theme in the characterization of synthetic biology is the role of engineering. This theme is widespread in the accounts of scholars studying this field and the biologists working in it, in those of the biologists themselves, as well as in policy documents. The aim of this article is to open this black-box of engineering that is supposed to influence and change contemporary life sciences. Too often, both synthetic biologists and their critics assume a very narrow understanding of what (...) engineering is about, resulting in an unfruitful debate about whether synthetic biology possesses genuine engineering methodologies or not. By looking in more detail to the diversity of engineering conceptions in debates concerning synthetic biology, a richer perspective can be developed. In this article, I will examine five influential ways in which engineering is understood in these debates, namely engineering as applied science, as rational methodology, context-sensitive practice, cunning activity or design. The claim is first of all thus to argue that engineering must not be seen as something stable or characterized by a fixed essence. It rather has multiple meanings and interpretations. Secondly, the claim is that most of the debates on synthetic biology cannot be indifferent towards the question which conception of engineering is at play, since the specific questions and concerns that pop up depend to a great extent on the precise conception of engineering one has in account. This article distinguishes three archetypal ways of articulating spatial cognition: (1) via metric representation of objective geometry, (2) via somatosensory constitution of the peripersonal environment, and (3) via pragmatic comprehension of the finalistic sense of action. The last one is documented by neuroscientific studies concerning mirror neurons. Bio-robotic experiments implementing mirror functions confirm the constitutive role of goal-oriented actions in spatial processes.

The Collectio Avellana, a collection of late antique documents which has been thoroughly investigated, above all by ancient historians and historians of Roman law, provides a wealth of historical, political-religious and legal information for the period between the middle of the 4th and the middle of the 6th century AD. This contribution, limited to the years of the pontificate of Pope Damasus, seeks to understand whether these texts can also represent a source of topographical information for the city of Rome.

We speak of products in two senses: in one, we speak of types of products, in the other we speak of the particular objects that are instances of those types. I argue that types of products have the same ontological status as that of material stuffs, like water and gold, which have a non-particular level of existence. I also argue that the relationship between types of products and their instances is logically similar to the relation of constitution, which holds between, (...) say, gold and a ring made of gold. In my approach, types of products are concrete entities, having spatiotemporal properties. This picture fits our commonplace conception of types of products better than alternative approaches according to which types of products are universal, abstract, or mereological entities. (shrink)

Summary The aim of this paper is to compare Brechtian theory concerning empathy in theatre and recent studies showing the biological basis of empathy. First of all, a brief summary about the concept of empathy is provided, with particular attention to empathy in Brechtian theatre. Then, a paragraph is dedicated to explain how empathy and emotional involvement are linked to neurobiological mechanisms and body state. In the end, an analysis of the Verfremdungseffekte in the Threepenny Opera is traced to understand (...) how recent studies contradict Brechtian theory as far as empathy is concerned. (shrink)

The ‘Mind-Upload’ hypothesis, a radical version of the Brain-in-a-Vat thought experiment, asserts that a whole mind can safely be transferred from a brain to a digital device, after being exactly encoded into substrate independent informational patterns. Prima facie, MU seems the philosophical archenemy of the Embodied Mind theory, which understands embodiment as a necessary and constitutive condition for the existence of a mind and its functions. In truth, whether and why MU and EM are ultimately incompatible is unobvious. This paper, (...) which aims to answer both questions, will not simply confirm that MU and EM actually are incompatible. It will also show the true reason of their incompatibility: while EM implies that a mind’s individual identity is contingent upon the details of its physical constituents, MU presupposes that minds can be relocated from one material vessel to another. A systematic comparison between these conflicting assumptions reveals that the real shortcoming of MU is not the one usually discussed by the philosophical literature: it has nothing to do with MU’s functionalist or computationalist prerequisites, and is only secondarily related to the artificial implementability of consciousness; the real problem is that MU presupposes that minds could still be individuated and numerically identified while being reduced to immaterial formal patterns. EM seems committed to refute this assumption, but does it have sufficient resources to succeed? (shrink)

This paper motivates the idea that social robots should be credited as moral patients, building on an argumentative approach that combines virtue ethics and social recognition theory. Our proposal answers the call for a nuanced ethical evaluation of human-robot interaction that does justice to both the robustness of the social responses solicited in humans by robots and the fact that robots are designed to be used as instruments. On the one hand, we acknowledge that the instrumental nature of robots and (...) their unsophisticated social capabilities prevent any attribution of rights to robots, which are devoid of intrinsic moral dignity and personal status. On the other hand, we argue that another form of moral consideration—not based on rights attribution—can and must be granted to robots. The reason is that relationships with robots offer to the human agents important opportunities to cultivate both vices and virtues, like social interaction with other human beings. Our argument appeals to social recognition to explain why social robots, unlike other technological artifacts, are capable of establishing with their human users quasi-social relationships as pseudo-persons. This recognition dynamic justifies seeing robots as worthy of moral consideration from a virtue ethical standpoint as it predicts the pre-reflective formation of persistent affective dispositions and behavioral habits that are capable of corrupting the human user’s character. We conclude by drawing attention to a potential paradox drawn forth by our analysis and by examining the main conceptual conundrums that our approach has to face. (shrink)

One recurrent objection against minimalism is that minimal contents have no theoretical role. It has recently been argued that minimal contents serve to draw the distinction between lying and misleading. In Sect. 1 and Sect. 2 I summarise the main argument in support of that claim and contend that it is inconclusive. In Sect. 3 I discuss some cases of lying and some of misleading that raise difficulties for minimalism. In Sect. 4 I make a diagnosis of the failure of (...) minimalism with those cases. In Sect. 5 I strengthen the case against minimal contents by addressing two received says-based definitions of lying. My analysis of the failure of minimalism suggests that the distinction between lying and misleading, at least in some important cases, calls for a kind of utterance content that is grounded on conventions of language. In the course of making this case Thomas Vinci develops a broad reinterpretation of Cartesian thought that unlocks novel solutions to many of the most vexed questions in Cartesian scholarship.

The essay starts from the singularization and temporalization of political concepts, that originate a self-representation of modernity as hierarchically superior to pre-modernity. Such self-representation, in Massimiliano Tomba’s words, must be now pluralized not only in relationship with the many extra-European temporalities, but also with the multiple temporal layers of European history. The author’s proposal of working on «time differentials», i.e. on the trajectories that turn from the dominant course of modern history, founded on Western emancipation, individual rights and modern (...) property relations, underlies that, in order to reconfigure the concept of modernity, it is necessary to reconfigure the concept of history itself. Massimiliano Simons provides the first systematic study of Serres' work in the context of late 20th-century French philosophy of science. By proposing new readings of Serres' philosophy, Simons creates a synthesis between his predecessors, Gaston Bachelard, Georges Canguilhem, and Louis Althusser as well as contemporary Francophone philosophers of science such as Bruno Latour and Isabelle Stengers. Simons situates Serres' unique contribution through his notion of the quasi-object, a concept, he argues, organizes great parts of Serres' work into a promising (...) philosophy of science as well as a challenge to the narrower field of French epistemology, to which it has often been limited. Simons highlights how the concept encompasses Serres' commitment to positive relations between science and culture and his rejection of pleas to purify the scientific self from imaginative and cultural elements. It helps to situate Serres between the distinct traditions of Bachelard and Latour as well as progressing the innovative aspects of Serres' philosophy for current debates in the philosophy, history, and sociology of science. Showing how Serres' philosophy can serve as a normative approach to science and technology, Michel Serres and French Philosophy of Science takes in themes of materiality, religiosity, modernity and ecology to advance a timely alternative to philosophy of science for contemporary life. This essay analyses the second chapter of the Zhuangzi 莊子, the “Qiwulun 齊物論.” After a brief examination of its main ideas, it will be argued that the “Qiwulun” needs to be considered not as an equalization that makes everything indistinguishable but as a discourse on corresponding things. A more attentive analysis of this correspondence among the myriad things will lead to the consideration of their mutual transformation. The conclusion is that, contrary to the ontotheological nature of Western metaphysics that imposes (...) a single logic for its hierarchical structure Being-beings, the correspondence of myriad things allows the differentiation and assimilation of values in a comprehensive and harmonious fashion. Thus, the essay offers an ethical reading of the “Qiwulun” and considers its significance in the contemporary world. (shrink)

This article examines how minimal genome research mobilizes philosophical concepts such as minimality and essentiality. Following a historical approach the article aims to uncover what function this terminology plays and which problems are raised by them. Specifically, four historical moments are examined, linked to the work of Harold J. Morowitz, Mitsuhiro Itaya, Eugene Koonin and Arcady Mushegian, and J. Craig Venter. What this survey shows is a historical shift away from historical questions about life or descriptive questions about specific organisms (...) towards questions that explore biological possibilities: what are possible forms of minimal genomes, regardless of whether they exist in nature? Moreover, it highlights a fundamental ambiguity at work in minimal genome research between a universality claim and a standardization claim: does a minimal genome refer to the minimal gene set for any organism whatsoever? Or does it refer rather to a gene set that will provide stable, robust and predictable behaviour, suited for biotechnological applications? Two diagnoses are proposed for this ambiguity: a philosophical diagnosis of how minimal genome research either misunderstands the ontology of biological entities or philosophically misarticulates scientific practice. Secondly, a historical diagnosis that suggests that this ambiguity is part of a broader shift towards technoscience. (shrink)

In this short paper we consider Linnebo's thin/thick dichotomy: first, we show that it does not overlap with the very common one between abstract/concrete objects; second, on the basis of some difficulties with the distinction, we propose, as a possible way out, to move from thin/thick objects to thin/thick concepts.
